9.10.2013/11.10.2013 Petitioner while applying online for preliminary
examination had filled up all columns and specified her gender status as
Female and Domicile of Uttarakhand in the online application form. The
column in the online application form mentioning sub category for
reservation was ambiguous as only the reservation for female domicile of
Uttarakhand was in abbreviated form i.e. UF. However the rest of the
options in the sub category column were mentioned fully and were self-
explanatory of the reserved sub category to which it related. The meaning
of abbreviation UF and to which reserved sub category it related was not
explained neither in the online application form nor in the advertisement,
which was confusing as it can be for Union Forces etc.


Further the ambiguity of the software designed for online
application is evident from the fact that the print copy of the online
application form obtained after two days of depositing the Challan
is not the same as was submitted to UKPSC. The online application
form which was sent to UKPSC had various columns like Gender
of applicant and whether Domicile of Uttarakhand or not etc. but
after submitting the filled online application form, the print copy is
not the same and it does not have various column like gender status
of applicant or domicile status etc. which was filled up by the
petitioner. Here the petitioner orally inquired from UKPSC about
the discrepancy in the print copy to which it was orally assured that
it was first time that the application for the examination were being
submitted by online application it might be some technical fault it
will be cured later. Thereafter the petitioner was allotted Roll
Number 200479 to appear in the preliminary examination.

That it appears, the grievance of the petitioner was not considered on the basis of
the writ petition no. 79/2010 Radha Mittal v. UKPSC decided by this honable court
and special leave petition no. 19532/2010 decided by honable Supreme Court
mentioned in the advertisement of the UKPSC. However the matter in issue in that
writ petition was that the candidate had not blackened UF/ 0 in the sub
category column in the OMR application form whereas in the present petition filed
by the petitioner the matter in issue is that the term used form describing female
domicile of Uttarakhand in the online application form was in abbreviated form i.e.
only UF and the meaning to the same and to which reserved sub category it
related was not specified neither in the advertisement nor in the online application
form.
