NYS FUNDING LLC STATEMENT

Statement from NYS Funding LLC, a prospective applicant for a Gaming Facility License in the Capital Region of
New York:

We are announcing today that we will no longer be pursuing a gaming facility license for the E23 development
site in Albany and instead will shift our efforts to the DeLaets Landing site in Rensselaer.

A thorough review of the E23 site uncovered significant land development constraints that limit our ability to deliver
a destination gaming resort at that property.

We believe that the DeLaets Landing site offers the best opportunity to develop a world-class facility that will bring
jobs and tax revenues to the Albany area.

We are confident this project will significantly benefit the State of New York, the Albany area, and other
surrounding communities in the Capital Region.
We look forward to working with local officials as we finalize our response to the RFA.

Why are you abandoning the E-23 site?

A thorough review of the site uncovered significant land development constraints that limit our ability to
deliver a destination gaming resort at the property.

What specifically were the land development issues?

It was a combination of topography and wetlands.

Are the rumors true that the Mayor maybe pushed too hard, asked for too much and thats the real reason
you are leaving.

No. We worked very closely with Mayor Sheehan, her staff, and the Citys outside counsel, and they were
tireless advocates for the City of Albany, but unfortunately land development constraints impacted our
ability to deliver a world-class destination gaming resort at the Noonan Lane property.

Why did you choose Rensselaer?

We believe that the DeLaets Landing site meets our needs to develop a world-class destination gaming
resort in the Capital Region and also further demonstrates our intention to bring jobs and revenues to the
Albany area.

Do you think this indecision and last minute maneuvering will diminish your chances of securing a bid?

No. We are confident that our proposal once finalized will deliver the type of destination gaming resort
contemplated by the legislation.

Why do you think the Board will pick you?

We have a best-in-class team and the financing in hand. This is an A team ready to deliver jobs and
revenues to the Capital Region.

David Flaum said last week that there was more than enough acreage on the site. Was that not correct?

We have been on the ground for a little over a month and since then have worked tirelessly with our third-
party professionals to assess the viability of the site. Based on that analysis, it is our opinion that the land
development constraints prevent us from delivering a world-class destination gaming resort at the site.

TALKING POINTS AND GUIDANCE FOR COMMUNITY QUESTIONS.

Three issues. Local officials focused on three key areas: jobs, revenues, and impact on downtown Albany
entertainment and convention venues.

Land. After an exhaustive review of the Noonan Lane site, we uncovered significant land development
constraints that dramatically reduced the potential footprint of the proposed facility. [These restrictions in
turn would have reduced to unacceptable levels the potential number of jobs and tax revenues that a project
at the site could have achieved.][These constraints limit our ability to develop a world-class destination

Rensselaer. We believe that the Rensselaer site allows for us to develop a world-class destination gaming
resort that will serve as an economic driver for the Albany area. Also, we are committed to working to limit
the impact of our project on downtown Albany entertainment and convention venues.
