A !ension is a !eriodi#al allo-an#e of ,oney *ranted +y the Bo.ern,ent in #onsideration or re#o*nition of ,eritorious !ast ser.i#es, or of loss or in1ury sustained in the !u+li# ser.i#e. A !ension is intended to assist a retired #i.il ser.ant in !ro.idin* for his daily -ants so lon* he is ali.e in #onsideration of his !ast ser.i#es, thou*h re#ently the a+o.e +enefit has +een e0tended inter alia in Pa&istan to the -ido-s and the de!endent #hildren of the de#eased #i.il ser.ants. /he raison d7etre for !ension see,s to +e ina+ility to !ro.ide for oneself due to old-a*e. /he ri*ht and e0tent to #lai, !ension de!ends u!on the ter,s of the rele.ant statute under -hi#h it has +een *ranted. A !erson -ho enters Bo.ern,ent ser.i#e has also so,ethin* to loo& for-ard after his retire,ent, to -hat are #alled retire,ent +enefits, *rant of !ension +ein* the ,ost .alua+le of su#h +enefits. Pension li&e salary of a #i.il ser.ant is no lon*er a +ounty +ut is a ri*ht a#3uired after !uttin* in satisfa#tory ser.i#e for the !res#ri+ed ,ini,u, !eriod. A fortiori, it #annot +e redu#ed or refused ar+itrarily e0#e!t to the e0tent and in the ,anner !ro.ided in the rele.ant rules. A##ordin* to hi, as the !ension is to +e #o,!uted on the +asis of !ay, any in#rease in !ay s#ales enhan#es !ension of those !ensioners, -hose !ension is to +e #al#ulated on the +asis of the re.ised !ay s#ales. At this sta*e it -ould not +e out of !la#e to ,ention that -hen the !ension s#he,e -as su+stantially re.ised and au*,ented, -hi#h has +een referred to +y ,y learned +rother in #lauses $i% and $iii% of su+-!ara. $a% of !ara. 19 of his 1ud*,ent, the enhan#ed +enefits -ere ,ade a.aila+le to !ast !ensioners +y .irtue of !ara. 11 of Einan#e ?i.ision <.4. dated 18-8-1966 and !ara. 8 of Einan#e ?i.ision <.4. dated '-1-19'' res!e#ti.ely. /his a##ords -ith the de#ision of the ndian 2u!re,e Court in the #ase of ?.2.
