1. Use and Purpose. The leased premises shall be used exclusively for Food Mart & Office and shall not be used for any other purpose without a prior written letter of intent to PPA Sta. Ana Port Management.
2. Monthly Rental. The PERMITTEE shall pay a monthly rental including 12% VAT in the amount of PESOS: 933.18 only payable in advance within the first five (5) days of the month at the Cashiers Office of the PPA Sta. Ana Port without the necessity of billing likewise in case of increase of the rental rate, the PPA Sta. Ana Port Management will notify the permittee and will automatically implement the increase.
3. Interest and Penalty. Rental not paid on time shall be considered in default without need of notice and shall be charged interest and penalty as prescribed under PPA Administrative Order No. 01-2002 and other issuances.
4. Cash Deposit. Upon signing of this PERMIT, an amount equivalent to one (1) month advance rental plus two (2) months deposit shall be paid by the PERMITTEE. This amounts shall be applied as payment for back rents, if any, and other expenses and charges billed against the company for water, telephone, cost of damages on the premises and other utility service still remaining unpaid upon the termination of this Permit.
5. Non-Transferable of Leasehold Rights. The PERMITTEE shall not directly or indirectly sublease, assign, transfer, convey, mortgage or in any way encumber its rights to lease over the leased premises or any portion thereof under any circumstances whatsoever, any transactions entered into in violation of this clause shall be deemed null and void.
6. Water, Electricity, Telephone, Other Utility Expenses. Charges for water, electricity, telephone and other utility services including repairs in the service utility system shall be for the account of the PERMITTEE.
7. Insurance Premiums / Real Estate Tax Premium. The PERMITTEE shall pay the prorated accrued insurance and real estate premiums due its leased premises in accordance with Section 13.2 and 13.3 of PPA AO No. 22-95.
8. Permanent / Temporary Structures / Other Alterations. The PERMITTEE shall not introduce any permanent / temporary structures or improvements or make any alterations in the lease premises without prior written consent and approval of the PPA Sta. Ana Port. All improvements or alterations of whatsoever in nature made thereon as agreed by both parties, shall upon completion thereof, become the exclusive property of the PPA Sta. Ana Port without reimbursement of the cost or value thereof. Likewise, it shall not place any inscription, hang or display any signboard outside the leased premises of any portion of the building without the prior consent of the PPA Sta. Ana Port.
9. Inspection of Premises. The PPA Sta. Ana Port or its duly authorized representative/s shall have the right to inspect the leased premises at any reasonable hour of the day or nighttime when there is operation.
10. Safety/ Precautionary Measures. The PERMITTEE shall not bring into or store in the leased premises, any inflammable, explosive and dangerous goods or materials or any article which may expose the leased premises to fire or increase the fire hazard of the building and other nearby premises, or any other article which the PPA Sta. Ana Port may prohibit. Any damage caused, directly or indirectly by infringement of this prohibition will be borne by and charged to the Lessee.
11. Cleanliness. It shall be the responsibility of the PERMITTEE to maintain the cleanliness and sanitation over the occupied area disposing garbage properly outside the Port during the lifetime of the Permit.
12. Compliance with PPAs and Other Government Agencies Rules and Regulations. The PERMITTEE shall comply with all rules, ordinances promulgated by the PPA Sta. Ana Port and those of other Government Agencies regarding the use, occupation and sanitation of the lease premises and non-compliance therewith shall be at its exclusive risks and expenses.
13. Return of Premises Upon Termination of Permit to Occupy. Upon the expiration of the term of this Permit to Occupy or upon cancellation thereof as herein provided, the PERMITTEE shall promptly surrender the premises to the PPA- Sta. Ana Port in as good tenable conditions as when taken within 15 day grace period, without any need of demand/formal notice. Upon termination or cancellation, the PERMITTEE shall not bring any action intended to stifle, prevent, obstruct, hinder or hamper the exercise of PPAs rights and privileges as owner of the property.
14. Sufficiency of Notice to Vacate. The PPA Sta. Ana Port reserves the rights to revoke this Permit on a 30 day notice for violation of any of the afore-stated terms and conditions.
15. No Automatic Renewal of Permit. Failure to submit written notice/request to renew said Permit to lease two (2) months prior to expiry date shall be interpreted as a waiver or abandonment of any interest by PERMITTEE to continue his lease occupancy.
16. Absolution from Liabilities. The PPA Sta. Ana Port shall be absolved from any liabilities of whatever nature for damage and injuries incurred by PERMITTEE during effectivity of this Permit.
17. Description of Occupied Area. The measurement of the office area as described hereon has a total area of 40 sq. m.
