Sealed Tenders are invited for supply of following Milk items as per the tentative quantities
mentioned below:
1. Butter Oil

500 MT

2. Pasteurized White Butter

500 MT

3. Skimmed Milk Powder

1000 MT

4. Fresh Mixed Milk

70000 kgs.per day.

for our Milk Plants located in Punjab. The interested parties may submit their offers
alongwith requisite Earnest Money Deposit (EMD) on or before 25.03.2014 by 1.00 PM.
Offers will be opened on the same day at 3.00 PM. The detailed NIT can be obtained from
office of the undersigned between 10.00 AM to 4.00 PM or the same can be down loaded
from our Website www.verka.coop The undersigned reserves the right to accept any or
reject any or all tenders without assigning any reason whatsoever.

TERMS & CONDITIONS FOR THE SUPPLY OF FRESH RAW CHILLED/PASTEURISED
MIXED MILK
Sealed tenders are invited from Private Milk Plants/Milk Producer Company/NGOs from
outside Punjab for supply of Fresh Raw chilled/Pasteurized Mixed Milk by 25-03-2014 upto 1.00
pm, which will be opened on the same day at 3.00 PM in Milkfed Head Office, Chandigarh( in
case tender opening date is declared Holiday, the tenders shal be received & opened on next
working day at same time) .
Terms and Conditions :1. Milkfed-Punjab needs approx. 70,000 kgs/day Fresh Raw chilled/Pasteurized Mixed
Milk as per requirement for its Milk Plants located in the State of Punjab. Interested
Parties may offer quantity as per availability with them but the minimum quantity
offered should not be less than 20,000 kgs/day. Milkfed Punjab is free to purchase
milk from more than one bidder to meet out its requirement.
2. ONLY THOSE PARTIES ARE ELIGIBLE FOR PARTICIPATION IN THE TENDER
FOR SUPPLY OF MIXED MILK WHO ARE NOT COLLECTING MILK IN THE
PUNJAB STATE.
3. The parties which are having any litigation / court case / arbitration with Milkfed / Milk
Unions in any court of law are not eligible to participate in the tender.
4. The quantity of milk can increase or decrease from time to time, as per actual
requirement of milk plants.
5. Specifications : For Fresh Raw Chilled / Pasteurized Mixed Milk is as per Annexure
A .
6. Quality Inspection will be done by our Plant(s) representatives at our respective
receiving Milk plants. Results of inspection at our receiving Milk Plant shall be final
and binding on the supplier(s).
7. Mixed Milk rejected during inspection shall be taken back by the supplier at his own
risk, cost & responsibility.
8. Earnest Money Deposit (EMD) : Bidder(s) will have to provide EMD of Rs 50,000/(Rupees fifty thousand only) for every 10,000 kgs of Mixed Milk per day along with its
offer in the shape of Demand Draft drawn in favour of The Punjab State Co-operative
Milk Producers Federation Limited, payable at Chandigarh. For successful bidder(s),
the EMD will be adjusted into Security Deposit (SD) which will be retained till complete
execution of the order. The EMD/SD will be forfeited for non-acceptance/nonexecution of order. No interest will be paid on the EMD/SD. Offers without requisite
EMD will be straight way rejected.
9.1 Successful bidder has to deposit security of Rs. 3.00 lac (Rupees three lac only) per
10,000 kgs of Mixed Milk per day. This security amount will be deducted from milk bills
in equal five installments of Rs 50,000/- (Rupees fifty thousand only) which will be
retained till complete execution of the order. The SD will be forfeited for non-execution
of order. No interest will be paid on the EMD/SD.

9.2

Documents to accompany tender : A photocopy each of current and valid FSSAI


License, VAT/CST Certificate and PAN number.

10.a

Price basis & delivery place : Price quoted should be on F.O.D. basis at our Milk
Plants in Punjab inclusive of Freight , Insurance, Taxes & Duties (as applicable
at the time of delivery), but exclusive of entry tax/advance tax. However Entry
Tax/Advance Tax will be reimbursed as per actual on submission of original
receipts. The Entry Tax/Advance Tax receipt should be submitted alongwith
milk dispatch note /delivery challan for each individual milk tanker. Offers
deviating from our NIT requirement shall be straightway rejected.

10.b

Price quoted should be for milk having composition of mixed milk 6.50% FAT
and 9.00% SNF & payment will be made on prorata basis upto 3.50% FAT &
8.50% SNF. The Milk Containing FAT contents upto 3.50% & SNF contents
upto 8.00% can be accepted on prorata basis by imposing double deduction
on SNF. Milk containing Fat and SNF contents below 3.50% & 8.00%
respectively will be straightway rejected. Bidder should quote rates of mixed
milk accordingly.

Escalation / de-escalation in milk purchase rates shall be as per NMG rates


given to the Federations

The Agreement shall remain in operation w.e.f. Ist April,2014 to 31 st


October,2014, which can further be extended upto 30 th November,2014 on
mutually agreed basis.

The bidder shall supply pure, unadulterated fresh raw chilled/pasteurized mixed
milk conforming to the specifications for its acceptance as specified in the
enclosed annexure A.
In case supply of milk is not made for 3 consecutive days without any valid or
acceptable reason, the General Manager of the receiving Milk Plant may take
any action and can also
terminate the contract and forfeit the Security Deposit and pending milk
payments will not be released. The decision of the G.M. of the Milk plant in this
regard shall be final and binding with the consent of Milkfed Punjab.
The receiving Plants shall make arrangement to take physical delivery of milk
from tankers of the bidder at the dock of the Central Dairy and shall arrange
unloading, weighment and quality test of the milk at its cost.
The quantity accepted shall be decided by the weighment at the receiving Milk
Plant and shall be considered final for billing purpose.

16.0 ACCEPTANCE & QUALITY INSPECTION OF MILK:16.1

Acceptance of milk shall be subject to quality tests in the Quality Control Laboratory of
the receiving Milk Plant. The sampling will be done at the earliest after arrival of milk
tanker at Milk Plant. Only, such milk will be accepted which on tests will satisfy the
requirements mentioned in the annexure Aand also the relevant provisions of FSS
Act, 2006. In case any milk offered does not
conform to the requirements as
stated above, the same shall be rejected and the supplier shall arrange to lift the same
at his risk, cost & responsibility, and the Bidder shall have no claim on such milk on the
receiving Milk Plant.

16.2

Milk will be accepted on basis of organoleptic, chemical and bacteriological tests as per
standard dairy practices.

16.3

Receiving Milk Plant may increase/decrease the quantity of mixed


their requirement well in advance on 10 days basis.

Normal temperature of milk supplied by the party should not be more than 5C.

16.5

The receiving Milk Plant shall arrange to analyze and test the milk at their Quality
Control
Laboratory for its acceptance. The analytical results at the Quality Control
Laboratory of the
receiving Milk Plant shall be final. The method of test will be as
in vogue. If variations in testing by the receiving plant for Fat and SNF is more
than 0.1% and 0.2% respectively in comparison
to the testing of the supplier then
the sample of milk will be preserved by receiving Milk Plant for 24 hours and the
representative of the supplier will be free to come and get the same retested in his
presence. In case of dispute, a third agency as mutually agreed shall test the sample &
shall be binding on both the parties. If in any consignment the quality of milk does not
conform to the norms specified the entire consignment, will be rejected by the receiving
Milk Plant.

17.0 PENALTY:- In case of failure to supply the contracted quantity of milk, G.M. of the
receiving Milk Plant shall impose penalty at the rates of Rs.1/-per Kg of milk/day on
short supply on 10 days average basis.
18.1

Whenever under this contract, any amount shall become recoverable from or payable by
the supplier, G.M., of the receiving Milk Plant may recover the same from any of the
outstanding bills of the supplier which are due for payment. In case recoveries in the
manner as above do not become possible, G.M. of receiving Milk Plant may at his sole
discretion recover the same from the Security Deposit in full or in part and in the event
of the Security Deposit being not sufficient, the balance may be deducted from any
amount lying with the receiving Milk Plant or which at any time thereafter may become
due to the supplier under this or any other contract with Milkfed / Milk plant from the
payments. And if still this is not sufficient, the bidder shall pay the remaining balance to
the Milkfed / Milk plant on demand. In case of failure of supplier/bidder to do so,
recovery process shall be initiated by the receiving Milk Plant as per law.

18.2

The G.M., of the receiving Milk Plant shall also be entitled to recover any other losses
suffered as a result of any default or failure on the part of the bidder in fulfilling the terms
of the Agreement for supply of milk. Such recoveries will be affected from the Security
Deposit and the price payable to the bidder for milk supplied and if that is not available
or in case of deficit if any, from payments due for other supplies or services rendered by
the supplier.

19.

PAYMENT:- The bidder shall submit bill after every Ten days in triplicate indicating the
quantity and quality as certified by the receiving Milk Plant and the value of the supplies
made during the preceding Ten days. The receiving Milk Plant shall subject to the
provisions contained in the agreement arrange, to make the payment within Four
working days after the date of receipt of bills.

-5SUBLETTING OF CONTRACT:-The bidder shall not assign or sublet the contract


any part therein.
The successful bidder will have to become Nominal Member of Milkfed/Milk Union
as per Bye Laws with latest amendments after deposit of Membership Fee of
Rs.1000/- only once for all ( Non-refundable) along with prescribed format.

FORCE MAJEURE CLAUSE: The supplier shall not be liable for forfeiture of its
performance security, liquidated damages or termination for default, if and to the
extent that, its delay in performance or other failure to perform its obligations under the
contract is the result of an event of Force Majeure. For the purpose of this clause, Force
Majeure means an event beyond the control of the supplier and not involving the
suppliers fault or negligence and not foreseeable. Such events may include, but are
not restricted to, acts of the purchaser either in it sovereign or
contractual capacity,
wars or revolutions, fires, floods, epidemics, quarantine restrictions and
freight
embargoes. If a Force Majeure situation arises, the supplier shall promptly notify the
Purchaser in writing of such conditions and cause thereof. Unless otherwise directed
by the Purchaser, in writing the Supplier shall continue to perform its obligations under
the contract as far as is reasonably practical and shall seek all reasonable practical and
shall seek all reasonable alternative means for performance not prevented by the Force
Majeure event.

23.

Validly of offer shall remain for 30 days from the date of bid opening. Mikfed may solicit
the Bidders consent to an extension of the period of validity. The request and the
responses thereto shall be made in writing (email/fax etc.). A Bidder may refuse the
request without forfeiting its bid security/EMD. A Bidder granting the request will not be
required nor permitted to modify its bid.

Arbitration Clause : In case of any dispute or controversy arising out of this contract the
same shall be referred to the arbitration of the Registrar, Co-operative Societies, Punjab
or his nominee. The decision of RCS, Punjab or his nominee shall be firm and binding on
both the parties. The provision of the Punjab Co-operative Societies Act, 1961 & as
amended upto date shall apply to Arbitration proceedings which shall be held at
Chandigarh only .

Either of the party may terminate the contract by giving one month notice in advance.

Managing Director, Milkfed-Punjab, reserves the right to accept any or reject any or all
tenders without assigning any reason whatsoever.

Bids not fulfilling NIT terms & conditions are liable to be rejected.
The tenders should have TENDER FOR FRESH RAW CHILLED/PASTEURISED
MIXED MILK separately super scribed on top of the respective envelope and
addressed to the Managing Director, The Punjab State Cooperative Milk Producers
Federation Ltd., SCO:153-155, Sector:34A, Chandigarh.

A
SPECIFICATIONS FOR ACCEPTANCE OF FRESH RAW CHILLED/PASTEURISED MIXED
MILK.
A. Fresh Raw Chilled/Pasteurized Mixed Milk must be organoleptically pure, fresh,
chilled, free from abnormal taste & flavor, and should be neither sour nor neutralized.
The milk should not contain any added SMP, Butter Oil/Butter etc. The milk should be
free from sediments, extraneous matter, preservatives, adulterants and free from

insects both at the man hole as well as at the bottom outlet. Milk should be supplied in
SS insulated Milk tankers with safety features of stairs & platforms. Clean gasket at man
hole & both unloading outlet valve as well as man hole lid should have temper proof
sealing & locking system.
B. Fresh Raw Chilled/pasteurized Mixed Milk should meet following parameters for its
acceptance at receiving Milk Plant:

PROCEDURE FOR CONDUCTING TESTS:I.

FAT ESTIMATION:
The fat would be determined by Gerber Method/ Milko Tester/ Milko Scan.

II.

SNF ESTIMATION:SNF would be estimated by Milkoscan/Lactometer or volumetrically by using correction


factor derived from Gravimetric Analysis.

III. Others as per laid down/recommended standard dairy practices.
