[Reoublic Act No. 10076] AN ACT DEFINING A DRIVING RE-EXAMINATION FOR THE RENEWAL OF DRIVERS LICENSE, PROVIDING FOR THE RULES, PENALTIES, AND FOR OTHER PURPOSES THEREOF Be it enacted by the Senate and House of Representative of the Philippines in Congress Assembles:
CHAPTER 1 PRELIMINARY PROVISIONS
SECTION 1. Title- This Act shall be known as the Driving Re-Examination of 2013. SECTION2. Declaration of Policy- The State recognizes its duty to maintain and value the life of a human being in every single part of his life such as his safety in a common carrier or in a moving vehicle. SECTION 3. Definition of Terms- For purposes of this Act, the following terms are hereby defined: (a) Driver- a person who drives vehicles, whether for private or public consumption (b) Drivers License- a permission to drive (c) Re-Examination- a test with same rules to freshen the memory and to make sure that rules are being well followed
CHAPTER 2 RULES FOR THE RE-EXAMINATION
SECTION 4. Re-Examination policies- The following are the policies shall be observed for the re-examination: (a) Every driver who shall renew their license shall also undergo a re-examination for driving. (b) The re-examination shall be held on any LTFRB offices sites where licenses are also renewed. (c) The applicant must fill out forms for both the written and the practical tests. (d) The vehicle to be used for the practical test can either be the personal property of the applicant or from the LTFRB office which would be a manual operating car. (e) The practical test would include: 1) Starting the engine. 2) Identifying the parts of the car. 3) Driving in forward and in reverse. 4) Driving on the driving area. 5) Driving while using the signals and following the road signs implanted on the area. (f) The written test would include: 1) Identifying the road signs. 2) Identifying the car parts. 3) Identifying the speed limit in common areas. SECTION 5. Persons to take the re-examination- Persons who will renew their license from the moment the law is enacted. SECTION 6. Implementation- The re-examination shall happen every three years and as a requirement for the renewal of license.
CHAPTER III PENALTIES
SECTION 7. Penalties- Any person not having passed the re-examination shall not be able to obtain the renewal of license and shall subject to a seminar for a period of two weeks. After the seminar he shall have another test for the renewal of his license. Any person found to be driving even in the failure of the test shall be punished with a fine of Php 5,000 on the first offense, a fine of Php 10,000 for the second offense, and a fine of Php 20,000 or arresto mayor for the third offense. A punishment of prision mayor of he failed to take the re- examination and the renewal of license for more than three times.
CHAPTER IV FINAL PROVISIONS
SECTION 8. Appropriations- The amount of One million and Five hundred thousand (Php 1, 500, 000) shall be appropriated annually for the implementation of this act. SECTION 9. Implementing Rules and Regulations- The LTFRB shall formulate the necessary rules and regulations within ninety (90) days from the approval of this Act for the effective implementation. SECTION 10. Separability Clause- If any provision of this Act is held invalid, the other provisions not affected shall remain in full force and effect. SECTION 11. Effectivity- This Act shall take effect fifteen (15) days after the completion of its publication in the Official Gazette or in at least two (2) newspapers of general circulation.
