Vehicle Safety Driving Policy

Vehicle Safety is extremely important to the Office of Consumer Credit Commissioner. Drivers
licenses and driving record checks of applicants will be conducted on those selected for
employment as well as a review for Texas minimum liability automobile coverage and a valid
state inspection for personally owned vehicles to be used for agency business. Employment for
certain positions will be contingent on validation of the applicants current license, and
evaluation of the applicants driving record. Driving record checks will be reviewed on an annual
basis for all employees.

Each employees driving record will be evaluated annually to determine if the employee is an
at-risk driver. An at-risk driver is someone who has multiple and/or serious violations on
their driving records. A general point system is used to make this determination. The point
system is as follows:

1 point = each conviction for a moving violation within the previous 24 months

2 points = each conviction for a moving violation resulting in an accident within the
previous 24 months

5 points = each conviction for a moving violation classified as greater than a class C
misdemeanor within the previous 24 months

If an employees score is 3 or 4, the employees supervisor will be notified of the
employees driving record. A warning will be provided to the employee informing the
employee that any additional violations may affect his or her ability to coordinate travel
with other employees as a driver for any agency-related business.

If an employees score is 5 or above, the employee is considered an at-risk driver. The
employee will lose the privilege to be a driver when travel coordination is required for
any agency-related business for a two-year period. While the employee may drive alone,
he or she will not be eligible to receive reimbursement for mileage under the state
guidelines if travel coordination was required. The two-year suspension begins upon
notice from the Agency.

The maintenance of a valid drivers license and a safe driving record, as well as having Texas
minimum liability automobile coverage and a valid state inspection, for personally owned
vehicles used for agency business are conditions of employment for certain positions.
Certification that personally owned vehicles used for agency business have the Texas minimum
liability automobile coverage and a valid state inspection will be required each year. Agency

management will determine what action will be taken as a result of an employees drivers
license or adverse record status. Personnel action may be up to and including discharge.

The following practices are adopted by the Agency:

1. All agency drivers must have a valid drivers license and an acceptable driving record.

2. Applicable motor vehicle laws must be observed, whether within or outside the state.

3. Seat belts must be worn at all times by drivers and all passengers.

4. All state travel rules and regulations must be followed without exception.

5. Employees who drive for agency business must inform their supervisor if their driving status
changes in such a way that renders them non-compliant with agency policy or become an at-
risk driver.

6. In the event an employee is involved in a traffic accident while on duty, the following action(s)
must be followed:

a. Stop the vehicle immediately at the scene. Then move the vehicle to a safe location if
the vehicle is blocking traffic and can be driven.
b. Aid any injured person(s) and request emergency assistance from police, firefighters, or
emergency personnel.
c. Report the accident by calling law enforcement authorities having appropriate
jurisdiction.
d. Report the accident to your supervisor and to the Workers Compensation Coordinator
in Human Resources. If driving a rental vehicle, report the incident to the rental agency.
e. Do not admit any fault or liability to any other party involved in the accident.
f. Obtain insurance information from the driver of the other vehicle(s).

7. Do not transport non-agency personnel unless authorized to do so and then only in the course
and scope of agency business.
