RODOLFO DE LARA, Presiden hereinafter referred to as the
EMPLOYER.

ADD FORCE PERSONNEL SERVICES, INC., a duly registered
and existing hilippine company with postal address at ,- Magallanes
Street, "ebu "ity, represented in this agreement by MA. SOCORRO
MANDAPAT, S!"es !nd M!r#ein$ M!n!$er hereinafter referred to
as %e RECRUITMENT AGENCY.
.hereas, both parties set forth the following agreement:
ARTICLE & ' GENERAL PROVISIONS
&.& T%e RECRUITMENT AGENCY shall supply the manpower re/uirements of the
EMPLOYER which shall be advised by the EMPLOYER in the form of 0ob order
indicating the number re/uired for each position and the /ualification standard1
&.( T%e RECRUITMENT AGENCY shall ma*e available to the EMPLOYER pre+
screened application as re/uisitioned but its representative who shall have final authority
on the selection of the personnel for employment1
&.) The services of the RECRUITMENT AGENCY shall be to source, recruit, pre+/ualify
through s*ills testing, and to present candidates2 3(s 4ersonnel 3ualification
(escription5 to the EMPLOYER* and upon approval by EMPLOYER of candidates to
mobili6e for immediate deployment and therefore prepare complete travel document
papers for approval by the hilippine (epartment of 7abor and 'mployment, (epartment
of 8oreign Affairs, and other government agencies in the hilippines concerned with
overseas recruitment of 8ilipino .or*ers, to secure necessary security clearance, valid
passports and travel clearance and assist in the scheduling, tic*eting and sending+off of
wor*ers to the 0obsite1
&.+ The EMPLOYER shall authori6e the RECRUITMENT AGENCY as its
agent9representative in the hilippines in all matters involving the recruitment and hiring
of 8ilipino wor*ers for its company1
ARTICLE ( ' TRAVEL ARRANGEMENT
(.& The RECRUITMENT AGENCY shall be solely responsible for the cost of securing
visas and9or wor* permits in the 0obsite9s of the accepted wor*ers and their tic*eting1
ARTICLE ) ' EMPLOYMENT CONTRACT
).& The accepted wor*ers shall ta*e up employment under Master 'mployment "ontract
4M'"5 herein attached as :Annex A; which forms an integral part of this Agreement,
which provides among others, for wages, regular wor* hours, overtime pay, wor*men2s
compensation, 0ust causes for termination, transportation for remains and belongings in
case of death1
).( <n case of renewal of the employment contract of the EMPLOYER with the same
employee, said employee shall be entitled to a salary ad0ustment in accordance with the
company2s pay scale1
ARTICLE + ' RESPOSI,ILITY OF THE PRINCIPAL
+.& The EMPLOYER shall assist the employee in the regular remittance of his monthly
basic salary to his designated beneficiaries in the hilippines through normal channels1
+.( The EMPLOYER shall exert possible efforts to enhance the welfare and protect the
rights of 8ilipino wor*ers hired in the Agreement in accordance with the laws of the
country+0obsite9s and in accordance further with the best possible treatment already
extended to foreign wor*ers at the 0obsite9s1
+.) <t is understood that any problem that may arise or incur by the wor*er4s5 at the 0ob site
such as but not limited to accommodation, delayed and9or non+payment of salary and
overtime pay of wor*ers and other factors, the RECRUITMENT AGENCY shall be
solely responsible and not the EMPLOYER.
ARTICLE - ' .OINT AND SEVERAL O,LIGATION OF THE
PRINCIPAL AND THE RECRUITMENT AGENCY
-.& That the herein parties shall be 0ointly and severally liable for any liability that may arise
in connection with the recruitment and hiring of the wor*ers including the full
implementation of the employment contract of the hilippine 7abor laws1
ARTICLE / ' SETTLEMENT OF DISPUTES
/.& All claims and complaints relative to the employment contract of the wor*ers shall be
settled in accordance with the company policy, rules and regulations1 <n case the wor*er
contests the decision of the EMPLOYER, the matter shall be settled amicably with the
participation of the hilippine =verseas 'mployment Administration 4='A5
representative and any authori6ed representative of the hilippine 'mbassy9"onsulate
nearest the site of employment1
ARTICLE 0 ' GUARANTEE
0.& The RECRUITMENT AGENCY guarantees that wor*ers to be sent to the pro0ect site
are physically fit and /ualified for the position they have applied for1 <f a wor*er is found
physically unfit when he arrives in the 0obsite, the RECRUITMENT AGENCY shall
assume the repatriation cost 4airfare bac* to Manila5 of the wor*er, provided the wor*er
will be sent bac* within ,0 days from the date of arrival in the pro0ect site1
0.( The RECRUITMENT AGENCY2s guarantee of the competence of the wor*ers covers
only the wor*ers it presented to the EMPLOYER1 The name+hired wor*ers are not
covered under this guarantee1 <f a wor*er is found not capable of doing his 0ob, the
RECRUITMENT AGENCY shall assume the repatriation cost 4airfare bac* to Manila5
and the cost of airfare to the 0ob site of his replacement, provided the wor*er will be sent
bac* within ,0 days from the date of arrival in the pro0ect site1
ARTICLE 1 2 SERVICE FEES
1.& The service fees that will be charged to the EMPLOYER is 20000100 per successfully
deployed wor*er which will be billed upon deployment and payable through telegraphic
transfer to the account of the RECRUITMENT AGENCY.
ARTICLE 3 ' EMPLOYMENT TERMS AND CONDITIONS
3.& The RECRUITMENT AGENCY will provide decent housing accommodation to the
wor*er and will ensure their easy access for the procurement of food if in case food is not
provided1
3.( The RECRUITMENT AGENCY shall provide free airfare from the point of recruitment
to the pro0ect site, and their return to the hilippines upon completion of the 'mployment
"ontract1
3.) (uration of initial employment contract shall be per 'mployment "ontract1 The
employees shall be eligible for gratuity pay in accordance with the 7abor laws of host
country1
ARTICLE &4 ' AMENDMENTS
&4.& <n the event the terms of this agreement shall be affected by the national policies and
future legislation of the hilippines and9or the host country, this Agreement shall be
amended or modified accordingly upon mutual consent of both parties1
ARTICLE && ' TERMINATION
&&.& This Manpower Supply Service Agreement shall be in effect for a period of four 4>5 years
from date of signing1 This is in accordance with the validity period of
accreditation9registration with (=7'9='A which is also for four 4>5 years1 ?nless
terminated by either party with prior thirty 4@05 days written notice, this agreement will
remain valid for four 4>5 years1 <n any case, the responsibilities of the parties shall be in
effect up to the completion of the last employment contract signed with the recruited
wor*ers and the right of the wor*ers recruited under this Agreement must be recogni6ed
and the terms and conditions of the contract of employment shall be strictly adhered to
and complied with1
&&.( ?nless either party so notifies the other of the termination of this Agreement, it shall be
renewed every four 4>5 years1
ARTICLE &( ' GOVERNING LAWS
&(.& The terms and conditions of this contract shall be the laws between parties and shall be
interpreted in accordance with the laws of the hilippines but not to the exclusion of and
pre0udice to the laws of the country site of employment, <nternational 7aws, covenants
and practices1
