NOTIFICATION
New Delhi , the 4th May, 2010
S.O . 1002 (E).- In exerci se of the powers conferred
. by Secti ons 6, 8 and 25 of the Envi ronment (Protecti on)
Act, 1986 (29 of 1986), theCentral Government hereby make
the followi ng rules to amend the Batteri es (Management
and Handli ng) Rules, 2001 namely,-
I. (I) These rules may be called Batteri es
(Management and Handli ng) Amendment Rules, 2010 .
(2) They shall come i nto force on the date of thei r
publi cati on i n the O ffi ci al Gazette.
2. In the Batteri es (Management and Handli ng)
Rules, 2001 (herei nafter referred to as the sai d rules), i n rule
3, for clause (I), the followi ng clause shall be substi tuted,
namely,-
" (f) bulk consumer- means a consumer such li S the
Departments of Central Government li ke Rai lway~.

Defence, Telecom, Posts and Telegraph, the
Departments of StateGovernment, theUndertaki ngs,
Boards and other agenci es or compani es who
purchase hundred or more than hundred batteri es
per annum;" .
3. Inthesai d rules, i n rule4,-
(i ) after sub- rule (xi ), the followi ng sub- rule shall be
i nserted, namely.'-
" (xi i ) ensure that thenew batteri es sh~1l besold only
to the regi stered dealers" ;
(i i ) after sub- rule (xi i ) as so i nserted, the followi ng
Note shall be i nserted, namely.'-
" Note: The assemblers and recondi ti oners are
excluded fromthe purvi ew of responsi bi li ti es as
speci fi ed i nsub- clauses (i v), (vi i ), (i x) and(xi i )." .
4. Inthesai d rules, for rule 5, thefollowi ng ruleshall
be substi tuted, namely,.'-
" 5. Regi strati on of i mporters. - (i ) thei mporters shall
get regi stered asper FormI wi th theCentral Polluti on
Control Board for a peri od of fi ve years and a
provi si on - of cancellati on for fai lure i n collecti on of
therequi red number of used batteri es as per thesai d
ru'les, non- submi ssi on of ti mely half yearly returns
to 'theState Polluti on Control Boards wi th a copy to
the Central Polluti on Control Board, renewal of the
regi strati on shall be as per the compli ance status:
Provi ded that theregi strati on granted to the i mporter
shall not be cancelled unless he has been gi ven a
reasonable opportuni ty of heari ng;
(i i ) an appeal shall li eagai nst any order of suspensi on
or cancellati on or refusal of regi ~trati on passed by
the Member- Secretary of the Central Polluti on
Control Board or any other offi cer desi gnated by the
Central Polluti on Control Board;
(i i i ) the appeal shall be i n wri ti ng and shall be
accompani ed wi th a copy of the order appealed
agai nst and shall be made wi thi n peri od of thi rty
days fromthe date of passi ng of the order." .
5. In the sai d rules, i n rule 7, after clause (vi ), the
followi ng clause shall bei nserted, namely,-
" (vi i ) (a) regi strati on wi th State Polluti on Control
Board for fi veyears and a provi si on of cancellati on
for fai lure i n collecti on of the requi red number of
used batteri es as per the sai d rules, non- submi ssi on
of ti mely half yearly returns to the State Polluti on
Control Boards, renewal of the regi strati on shall be
asper thecompli ance status, to submi t detai ls asper
FormIV, regi strati on would beconsi dered asdeemed
regi stered i f not objected to wi thi n thi rty days:
Provi ded that the regi strati on granted to the dealer
shall not be- cancelled unless he has been gi ven a
reasonable opportuni ty of heari ng;
(b) an apeal shall li eagai nst any order of suspensi on
or cancellati on or refusal of regi strati on passed by
the Member- Secretary of the State Polluti on Control
Board or any other offi cer desi gnated by the State
Polluti onControl Board;
(c) the appeal shall be i n wri ti ng and shall be
accompani ed wi th a copy of the order appealed
agai nst and shall be made wi thi n peri od of thi rty
days fromthe date of passi ng of the order." . ,
6. Inthesai d rules, i nrule 8for clause(i v), followi ng
clause shall be substi tuted, namely,-
" (i v) makeavai lable all records relati ng to recei pt of
used batteri es, sources, quanti ti es and metal yi eld to
besubmi tted to theState Polluti on Control Board for
i nspecti on;" .
7. In the sai d rules, i n rule 9, i n sub- rule (3); for the
fi gures" 120" , the fi gures " 90" shall be substi tuted.
8. Inthesai d rule, i nForm1,-
(i ) under the headi ng relati ng to " Form for fi lli ng
returns of sale of new batteri es and collecti on of
used batteri es, for the words manufacturer/
assembler/recondi ti oner" , thewords " manufacturer/
i mporter/ bulk consumer" shall be substi tuted;
(i i ) i ncolumn I, for theexi sti ngentry, theentry " Name
and Address of the manufacturer/i mporter/bulk
consumer" shall be substi tuted;
(i i i ) i ncolumn 3, i ntheexi sti ng entry. after theword
" sold" , thewords " i mporters or consumers" shall be
i nserted.
9. In the sai d rules, for the FormIV and the entri es
relati ng thereto, thefollowi ng Formand entri es shall be
substi tuted, namely:-
