I tested the waters today, and for the most part I was successfully able to navigate the database and enter information
into Casemap without incident. The one notable exception is that a number of documents hyperlinked in the
Concordance database either will not open in Outlook, or are not visible through Outlook. Luddite that I am, it appears
that either Concordance prefers to use some other application to view the documents (sometimes Concordance offers
me a choice of applications, such as Adobe Acrobat; sometimes it tries to open them using Windows Media Manager,
occasionally with success) or that the documents should not be viewed through Outlook in the first instance (sometimes
Outlook opens a file, but all I can see of the file are random characters and garbled text). told me that Eget a
special tag so that we can mark these problematic files for future reference; until I hear otherwise, when I uncover the
problematic files, I will mark them using tag and move on.

I want to make sure that I have understood our agreement regarding the preservation of documents as Senator Ensign
closes his offices in Nevada and D.C. Our plan to send the IT equipment (computers, servers and blackberries) from his
offices and staff to the Sergeant at Arms (SAA), with instructions to preserve all such IT equipment pending further
instructions by the Department of Justice. Senator Ensign authorizes the Department of Justice to determine which items
of the IT equipment will be preserved and maintained.
As for the hard documents in the Senator's offices, the pre-2006 documents can be released from the document hold and,
thus, no longer need to be preserved. The hard documents from 2006 on are, however, to be preserved and will be
shipped to the SAA with instructions to hold all such hard documents pending further instructions from the Department of
Justice.
Does the above accurately capture our agreement?

Attached are the two checks I mentioned to today. Evidently the recently found the cancelled
checks to Citibank, and they refreshed their recollections about paying for the trip to Hawaii.
On the other issue that and I discussed, Senator Ensign's staff is in the process of closing his office. The staff is
being instructed that the document hold placed on the office in 2009 remains in effect. After my call with today, I
instructed the staff to follow the protocol of sending all things electronic to the Sergeant at the ordinary course,
the Sergeant at Arms would then wipe clean the computers. My understanding is that ill contact the Senate to
prevent the Sergeant at Arms from wiping the computers until he receives notice to do so from you.
I also understand that is contacting Senate Ethics to apprise them of the situation involving the computers.

Per your request, attached are two workfiles listing the devices that will be sent to the Sergeant at Arms over the
next few days. The first file lists the PCs by the last individual using the PC, and the second file lists the
blackberry devices by the last individual using the blackberry. The columns include various identifiers that the
Sergeant at Arms should be familiar with. Just a few points on the PCs: 1) the names that include "Ensign"
followed by a number are interns; 2) the "Storage" items are those that were placed in storage once the
investigation started to make sure they were appropriately preserved. These items apparently include people
who were questioned during the investigation; 3) the items in red and gray have already been returned to the
Sergeant at Arms.
In connection with the blackberries, the devices highlighted in brown should already have been returned to the
Sergeant at Arms. The blue and red highlights are for devices that are still in use. Some of the devices
belonged to interns and are named "Intern" or "Ensign" followed by indentifying letters/numbers.

It was good talking to you and glad you made it back to the office safe and sound. The purpose of this email is to
memorialize the verbal report I gave you this afternoon.
First, you had requested that we add to the list of users whose hard drives are being imaged.
left the Senator's office on or about 1/ 1/ 07, and ard drive would have been wiped and reformatted shortly after
departure. The more likely course is that hard drive was "returned to stock," that is, it was given to the Sergeant at
Arms, who would have wiped and reformatted it before donating it to a school. The other possibility is that it would have
been wiped, reformatted and given to an intern in the Senator's office. At any event, hard drive is no longer
around and available for copying.
Second, we have made good progress on imaging the servers. The two servers in D.C. have already been imaged--the
Exchange server (everything in Outlook, including email, calendar, appointments,etc.) and the D.C. file share (info for DC
staff). In the process of being imaged are the servers for the Las Vegas and Reno offices.
Finally, I mentioned to you that the laptop belonging to (one of the users whose laptop had been imaged)
had developed a serious malfunction that required either prompt reformatting or replacement of the hard drive.
Fortunately hard drive had already been imaged, so we told the IT folks to do what they needed to do.

are not a decision-maker about what gets done. It's up tothe Senator, working with his former staff, tomake the

blackberry devices by the last individual using the blackberry. The columns include various identifiers that the
Sergeant at Arms should be familiar with. Just a few points on the PCs: 1) the names that include "Ensign"
followed by a number are interns; 2) the "Storage" items are those that were placed in storage once the
investigation started tomake sure they were appropriately preserved. These items apparently include people
whowere questioned during the investigation; 3) the items in red and gray have already been returned tothe
Sergeant at Arms.
In connection with the blackberries, the devices highlighted in brown should already have been returned tothe
Sergeant at Arms. The blue and red highlights are for devices that are still in use. Some of the devices
belonged tointerns and are named "Intern" or "Ensign" followed by indentifying letters/numbers.

so, since they i nadvertently i ncluded i t on thi s di s c. The file
in question is a summary chart (in MS Word), about 20 pages long, listing in chronological order all
the key documents/events. (Who knows, in the future we may want to negotiate with them to get
to use their work product, but for now, I promised we'd delete it and we should do so.) The file is
located as follows (file names are approximate as I'm writing this after I sent you the thumb drive):
"Ensign docs to DOJ/key document binder" and is called something like "contents." For what it's
worth, this file also includes their views of what the "key evidentiary documents" are it appears to
be somewhat more than the document binder tabs that accompanied the hard copy report.
Good luck; let me know if you need anything else. If I have contact with SSCE, shall I assume I can tell them about this
development?

Well it took a little doing, but with some VI helpfrom I was able to successfully burn a DVD of
my entire "Ensign" file (which contains all and stuff). This is the universe of electronic files I
had on the case. will be giving you each your own copy of the DVD.
I've moved all of my paper files to 11111.office and it is in 2 drawers marked "Stars and Stripes". Thanks to
hard work, she had created a list of the files and will be working with you guys to continue the
discovery production in including (1)working with to review the files and ensure everything
that needs to be turned over is produced, and (2) Bates-stamping the rest of the SSCE stuff so it can be
produced. As EMI knows, we estimated for the Court that we were hopeful that we could get the majority of
the discovery including SSCE stuff by the end of July.
I've given a box with everything we've received from the SSCE (through MEM so far. Someone
will need to reach out to find out what else, if anything, the SSCE has to give us.

Here is my projection based on several assumptions that I've identified in the estimate. I am happy to adjust
the assumptions as you see fit.
Assuming that we are up and running with the database and have received and uploaded all of Ensign's
documents by next Monday, June 14th (and assuming that we have a team of attorneys set up this week so that
they can read the necessary 302s and receive a briefing of what we're looking for in the document review by
the week's end) -we calculate 19 working days (M-F) between June 14 and July 9. Based on our review to this
point, we estimate a person can review on average 100 pages per hour, so 800 pages per 8 hour day. This
would mean 1 person could review 15,000 between June 14 and July 9. We would need 100 people to review
1.5 million pages in that time. We have approximately 60,000 pages in the database right now and are
expecting over 500,000 documents, which Ensign's legal team predicts may be between 1.5 and 3 million pages
as many of the documents are multiple pages.
If we wanted the review to be completed by July 30 (34 days between June 14 and July 30), based on our
assumptions above, 56 people would be able to review 1.52 million pages and 100 people would be able to
review 2.72 million pages.
As you can see, this estimate is based on 8 -hours per day of review and only M-F, no weekends or holidays.
Also, from our own review to date, sometimes we reviewed at a pace faster than 100 per hour, sometimes
slower depending on the nature of the documents. Without having seen any of the documents from Ensign,
we have no way to further inform this variable.
Please let me know if you need additional information or want me to alter any of the assumptions.

asked me to fill you all in on the following:
During my almost 5 year employment with Selling Source as the lead Network
Manager of Systems Administration & Help Desk, I was routinely instructed via
to work with others to delete email data between specific dates and sometimes pertaining to specific
matter. Furthermore, we were instructed to turn over all back up contained
the deleted information. not go to our regular off-site storage provider (Iron Mountain)
instead, they would go to residence. Those tapes are then stored in two secret
locations (Which I know) in the house in the upstairs and downstairs master bedrooms.
The following members of the staff were routinely to this type of request, myself
and Al l senior members of the IT staff.
|maintains a separate email/CRM system (Goldmine) from the Selling
Exchange environment. Al l back up tapes from this system are turned over to and kept by
The front end Goldmine server is maintained and is housed in the Selling Source server room.
The back end of this mail system, the mail store, is maintained by and is kept at the
data center. It is known as Server" and is running Postfix with a MySQL back end database.
In speaking with my former staff I learned that he was instructed to restore specific back
up tapes given to him for the purposes of the Ensign investigation. through the
data himself before asking that the data be removed from the system again and requesting all the tapes back.

First of all, want to thank both you and helping us out in getting our database set up and running.
been good enough to get all our databases merged, and to have all the native files linked on the Ensign production.
In order to expedite our review of the voluminous database, had a few questions you. First, understand that the
documents in our databases are housed on the DOJ IT server. But is it possible for us to access that server remotely by
using our authorized tokens? Yes.
Second, if it is possible to remotely access the database server, can we get 2 DOJ laptops and tokens assigned out to the
FBI in Manassas so that our agents can also review documents? We barely have enough laptops to cover our CRM folks
and we do not provide IT equipment to other agencies. That said, give me a day or so to kick an idea around with a few
people. will get back to you on it by early next week.

For some reason I could not find your cellular phone number in my file so I was unable to call you

Senator Ensign setting up a false email account to further conceal the affair and its aftermath.
Please let me know your thoughts on the letter so that I can finalize it and send it to you as soon as

trips to LV in order to best serve the Senator.
In the information I provided you last week the bottom line is Allegiant would like DOT to reconsider its
position on fuel surcharge pricing. Today it is not allowed in the and fees section of pricing and
considered deceptive advertising practices i f the price is not determined at the time a ticket is booked.
It is my understanding office has seen the Docket I provided you as well as Can
you please confirm as well as gain an understanding as to their position on this issue. It is my understanding the
helpful in this matter.
Since FAA Reauthorization is not going to be the vehicle to address this issue we need to look for another way
to possibly amend this If not addressed the airline industry stands to lose billions as well as lose a
significant number of carriers which will further impact consumer prices.

Senator Pays for a Dozen Law Firms
U.S. Sen. John (R-Nev.) reported $551,000 in payments his campaign fund to 12 different law
in the third quarter year, and to an e-discovery firm as the senator laces multiple ethics
investigations.
The Las Vegas reported Sunday that the in payments results from an offer Ensign made
to his staff, pledging to pay their legal fees i f any of them get drawn into the ethics investigations. The Senate
Ethics Committee and the U.S. Justice Department are investigating whether Ensign violated ethics rules or

An Ensign spokeswoman did not respond to a request about whom the other firms are representing. of
the firms also did not respond to requests for comment.
The campaign reported paying an additional to Equivalent Data, an e-discovery company in Texas.

The Senate on Thursday night quietly approved a resolution that will allow Sen. John Ensign's aides to testify to
a federal grand jury investigating the aftermath of the Nevada Republican's extramarital affair with a former
campaign aide.
By voice vote, the Senate approved the resolution that would authorize employees of the Senate to give
testimony to a grand jury in Washington.
Senate aides said that the resolution was necessary because Senate rules would prohibit employees from
testifying outside of the halls of Congress. The rule was put in place as a way to uphold the Senate's
constitutional right under the Speech or Debate clause, which prohibits members of the House and Senate from
being prosecuted for work related to their legislative duties.
The approval came swiftly during the Senate's daily wrap-up remarks. Sen. Mary Landrieu (D-La,)quickly read
through a list of non-controversial measures, including the Ensign resolution, which was approved by
unanimous consent.
The Senate's approval of the resolution is the latest sign that the investigation into the senator's affair - and
whether he illegally attempted to cover it up and flouted federal law by helping the lobbying career of his
former mistress' husband - continues to move swiftly. Last week, POLITICO first reported that Oklahoma
Republican Tom Coburn - Ensign's former roommate - had given scores of e-mails to federal investigators to
assist with their inquiry.

Corrupt politicians in Washington, take heart.
The headlines are full of stories alleging criminal wrongdoing by members of Congress and other high-profile
federal officialsSenator John Ensign of Nevada, Representative Charles Range! of New York, most
prominently.
But there's no indication the Justice Department is doing much to put any of them behind bars anytime soon.
"Public Integrity is in total disarray," said Melanie Sloan, a former Justice Department prosecutor.
In fact, current and former department officials fear the department under Attorney General Eric Holder is
mostly out of the businessat least for-nowof bringing criminal charges against corrupt federal lawmakers
and other powerful goverrnnent officials in Washington.
These officials tell The Daily Beast that several important cases before the department's 30-lawyer Public
Integrity section have stalled, if not died outright, in part as a result of last year's debacle in the corruption case
against former Republican Senator Ted Stevens of Alaska.
His convictionfor violating ethics laws by failing to report expensive gifts from friendswas overturned last
April amid allegations of
misconduct by Public Integrity lawyers during the Bush administration. The
prosecutors have denied wrongdoing but remain under investigation over
- Charges that they withli.61d evidence
from the senator's lawyers and lied to a judge.
"Public Integrity is in total disarray," said Melanie Sloan, a former career prosecutor at the Justice Department
who now runs Citizens for Responsibility and Ethics in Washington, a corruption-watchdog group. "The section
is rudderless. There are a couple of good people left, but they don't have any guidance."
Barbara Van Gelder, a prominent white-collar defense lawyer who has repeatedly gone up against the Public
Integrity section, said the Stevens case was a "Chilean-like seismic event" for the anti-corruption unit.
"The aftershocks are still being felt," said Van Gelder, another farmer career federal prosecutor. "That may be
why we haven't seen any big indictments for a. while."
In the 11 months since the Stevens case collapsed, the Public Integrity section has not brought a single
corruption indictment against a nationally known politician or prominent federal official.
And while the unit's prosecutors have pursued criminal investigations in several state and local cases,
department officials acknowledge that no high-profile indictment of any official in Washington is imminent.
The situation is yet another public-relations headache for Holder, who is already under fire from Democrats and
Republicans alike for his apparent flip-flopping on where to try terror suspectsin civilian courts or military
tribunals. The White House appears on the verge of overruling Holder's original plan to try a group of alleged
9/11 plotters in a civilian court in Manhattan.
The attorney general came under fresh attack from G.O.P. lawmakers last week with the disclosure that he did
not provide senators who voted on his confirmation last year with several legal briefs that he signed in
contentious cases before the Supreme Court, including a landmark terrorism case.
Holder began his career at the Justice Department in the 1970's as a prosecutor in the Public Integrity section.
On becoming attorney general, Holder pledged to make a priority of public corruption cases; that may help
explain why his aides are pushing back hard against any suggestion of turmoil among the department's
corruption prosecutors.
In an interview with The Daily Beast, Assistant Attorney General Lanny Breuer, who leads the department's
criminal division, said that Public Integrity lawyers were deep into several important corruption investigations
that cannot now be discussed publicly.
The unit is "working on a lot of cases and they are using aggressive techniques," he said. "Pound for pound,
these lawyers are terrific. They aren't reeling. Not at all. If this was a section in turmoil, people wouldn't be
fighting to get in to work there."

the Stevens-case-was !a_galvanizing_experience, a learning experience" for the department.
But he denied that it had hindered the Public Integrity unit in pursuing new investigationsprobes that in the
past have often have taken years to bear fruit in the fooli of indictments.
"I'm exceedingly proud of what we've accomplished," he said. "There's no doom and gloom."
Breuer and his colleagues are up against the perception in the criminal defense bar and among a number of
federal judges that the Stevens case proved there was disarrayand even dishonestyamong the department's
top corruption prosecutors.
In January, the department quietly dropped
-
what had been one of its most
-high-profile corruption
investigationsa four-year criminal probe of a powerful member of the House Appropriations Committee,
Representative Alan B. Mollohan.
The West Virginia Democrat had been under investigation over the propriety of hundreds of millions of dollars
, in federal earmarks funneled to organizations run by friends who were his business partners and campaign
contributors. Mollohan portrayed the end of the inquiry as an exoneration and is seeking his 15th term in the
House in the November elections.
Last Thursday, a federal magistrate in Arizona dealt a serious blow to Public Integrity's two-year-old corruption
case against a former House Republican, Rick Renzi.
The magistrate ruled that the department had illegally recorded phone calls between Renzi and his lawyers and
recommended that the recordings be barred from use as trial evidence.
The section is reportedly involved in the criminal investigation of Senator John Ensign over allegations that he
steered lobbying work to an embittered former aide who happened to be the husband of the senator's one-time
mistress. But legal watchdog groups say the department has been painfully slow to catch up with months-old
news reports on the Ensign scandal. (The Justice Department will not confirm that it is investigating Ensign).
There appeared to be some rare good news for the Public Integrity section last week with the announcement of
its new permanent director, Jack Smith, a respected federal prosecutor from New York who had recently
worked on war-crimes cases at the International Criminal Court in The Hague.
The section has been without a permanent leader since last fall, when William Welch H stepped down in the
wake of the Stevens mess. Welch was among the lawyers facing a court-ordered investigation of the bungling of
the senator's trial. Department officials would not say at the time if Welch's departure was directly related to
the Stevens case. Welch has said he observed "the department's highest ethical standards" in his work on the
trial.
Several Washington lawyers who are veterans of the Public Integrity section said the unit retained a number of
talented prosecutors and that there was optimism within the department that the unit would overcome the taint
created by the Stevens case.
"I talk to a few people over there, and people are upset about what's happened in Stevens," said Andrew C.
Lourie, a former chief of the section. "Do people wish it hadn't happened? Yes. But on a day to day basis,
morale is not so bad."
The challenges keep coming, though. The work of Public Integrity prosecutors is expected to be hindered,
possibly severely, when the Supreme Court rules this year on the constitutionality of an anti-corruption law that
has long been a favorite tool for federal prosecutors.

In oral arguments, the justiees-
strongly suggested they would overturn the law, which makes it a crime for an
official to deprive the public of "honest services," even if there is no proof of a bribe or other payoff.
Peter Zeidenberg, a former Public Integrity trial lawyer, said he thought the Justice Department would need to
rethink the way it prosecutes public officials if the law is overturned, as expected.
He said the Public Integrity section had relied on the law in obtaining many of its most important convictions.
"If you look through Public Integrity indictments, honest-services fraud is part and parcel of most cases," he
said.
Another veteran of the Public Integrity section, speaking on condition that he not be identified because he has
several cases.pending before the Justice Department, put it bluntly.
"If that law is overturned, half of the investigations at Public Integrity evaporate overnight," he said: "Forget the
Ted Stevens nightmare. It's the United States Supreme Court that could put Public Integrity out of business."

WASHINGTON The FBI has begun contacting people connected to the Sen. John Ensign scandal, a sign the
agency might be initiating a criminal investigation, sources confirmed this morning.
Agents have requested to meet with former Ensign aides in what appears to be a preliminary look at the matter
involving the senator and Doug Hampton, a former administrative assistant who has accused Ensign of
circumventing the law in an attempt to smooth over an affair he had with Hampton's wife,
The queries, which have come through phone calls in the past week, suggest there is little urgency at this point,
sources said.
The FBI's action follows on the heels of a movement in a separate investigation of Ensign being conducted by
the Senate Ethics Committee. The committee last month issued subpoenas to several Ensign associates and
people who worked in his office.
Among the reported recipients of Senate subpoenas were former chief of staff John Lopez and Mike Slanker, a
longtime Ensign political consultant and fowler staff director at the National Republican Senatorial Committee.
Regarding the FBI probe, "Lopez has been contacted, and I expect others have been as well," a source said this
morning.

Republican Sen. John Ensign of Nevada, who is under an ethics investigation by the Senate, announced
Thursday that he will resign his seat on May 3.
Ensign had previously said he would not run for re-election in 2012 following revelations that he had an affair
with a female aide who was the wife of another top aide, and that his parents subsequently gave money to the
aides' family.
"While I stand behind my film belief that I have not violated any law, rule, or standard of conduct of the Senate,
and I have fought to prove this publicly, I will not continue to subject my family, my constituents, or the Senate
to any further rounds of investigation, depositions, drawn out proceedings, or especially public hearings,"
Ensign said in the statement. "For my family and me, this continued personal cost is simply too great."

Ensign has admitted to having an affair with Cindy Hampton, a campaign aide and the wife of Ensign's former
chief of staff, Doug Hampton. Investigators are looking into efforts by Ensign to assist the Hampton family by
providing a nearly $100,000 payment to them, arranging lobbying work for Doug Hampton, and possibly
meeting with Doug Hampton on a lobbying matter in violation of Senate rules.

In February, the Senate ethics committee announced the appointment of a special counsel for the Ensign
investigation. According to Ensign, the Justice Department has previously told him it would not bring criminal
charges in the case.

"I am gratified that, after extended investigations, both the Department of Justice and the Federal Election
Commission saw no grounds on which to charge me with improper conduct," said Ensign's statement Thursday.
"I was hopeful that, with the closure of these investigations againstme the wear and tear on my family and me
would soon be over. This was not the case."
Ensign, 53, was first elected to the Senate in 2000. He previously was a veterinarian and general manager of the
Gold Strike Hotel and Casino.
After Ensign announced last month he would step down in 2012, two House members from Nevada, Republican
Rep. Dean Heller and Democratic Rep. Shelley Berkley, declared they would run to succeed him.

Nevada Gov. Brian Sandoval, a Republican, is expected to appoint a replacement to serve the rest of Ensign's
