I tested the waters today, and for the most part I was successfully able to navigate the database and enter information
into Casemap without incident. The one notable exception is that a number of documents hyperlinked in the
Concordance database either will not open in Outlook, or are not visible through Outlook. Luddite that I am, it appears
that either Concordance prefers to use some other application to view the documents (sometimes Concordance offers
me a choice of applications, such as Adobe Acrobat; sometimes it tries to open them using Windows Media Manager,
occasionally with success) or that the documents should not be viewed through Outlook in the first instance (sometimes
Outlook opens a file, but all I can see of the file are random characters and garbled text). told me that Eget a
special tag so that we can mark these problematic files for future reference; until I hear otherwise, when I uncover the
problematic files, I will mark them using tag and move on.

I want to make sure that I have understood our agreement regarding the preservation of documents as Senator Ensign
closes his offices in Nevada and D.C. Our plan to send the IT equipment (computers, servers and blackberries) from his
offices and staff to the Sergeant at Arms (SAA), with instructions to preserve all such IT equipment pending further
instructions by the Department of Justice. Senator Ensign authorizes the Department of Justice to determine which items
of the IT equipment will be preserved and maintained.
As for the hard documents in the Senator's offices, the pre-2006 documents can be released from the document hold and,
thus, no longer need to be preserved. The hard documents from 2006 on are, however, to be preserved and will be
shipped to the SAA with instructions to hold all such hard documents pending further instructions from the Department of
Justice.
Does the above accurately capture our agreement?

Attached are the two checks I mentioned to today. Evidently the recently found the cancelled
checks to Citibank, and they refreshed their recollections about paying for the trip to Hawaii.
On the other issue that and I discussed, Senator Ensign's staff is in the process of closing his office. The staff is
being instructed that the document hold placed on the office in 2009 remains in effect. After my call with today, I
instructed the staff to follow the protocol of sending all things electronic to the Sergeant at the ordinary course,
the Sergeant at Arms would then wipe clean the computers. My understanding is that ill contact the Senate to
prevent the Sergeant at Arms from wiping the computers until he receives notice to do so from you.
I also understand that is contacting Senate Ethics to apprise them of the situation involving the computers.

Per your request, attached are two workfiles listing the devices that will be sent to the Sergeant at Arms over the
next few days. The first file lists the PCs by the last individual using the PC, and the second file lists the
blackberry devices by the last individual using the blackberry. The columns include various identifiers that the
Sergeant at Arms should be familiar with. Just a few points on the PCs: 1) the names that include "Ensign"
followed by a number are interns; 2) the "Storage" items are those that were placed in storage once the
investigation started to make sure they were appropriately preserved. These items apparently include people
who were questioned during the investigation; 3) the items in red and gray have already been returned to the
Sergeant at Arms.
In connection with the blackberries, the devices highlighted in brown should already have been returned to the
Sergeant at Arms. The blue and red highlights are for devices that are still in use. Some of the devices
belonged to interns and are named "Intern" or "Ensign" followed by indentifying letters/numbers.

It was good talking to you and glad you made it back to the office safe and sound. The purpose of this email is to
memorialize the verbal report I gave you this afternoon.
First, you had requested that we add to the list of users whose hard drives are being imaged.
left the Senator's office on or about 1/ 1/ 07, and ard drive would have been wiped and reformatted shortly after
departure. The more likely course is that hard drive was "returned to stock," that is, it was given to the Sergeant at
Arms, who would have wiped and reformatted it before donating it to a school. The other possibility is that it would have
been wiped, reformatted and given to an intern in the Senator's office. At any event, hard drive is no longer
around and available for copying.
Second, we have made good progress on imaging the servers. The two servers in D.C. have already been imaged--the
Exchange server (everything in Outlook, including email, calendar, appointments,etc.) and the D.C. file share (info for DC
staff). In the process of being imaged are the servers for the Las Vegas and Reno offices.
Finally, I mentioned to you that the laptop belonging to (one of the users whose laptop had been imaged)
had developed a serious malfunction that required either prompt reformatting or replacement of the hard drive.
Fortunately hard drive had already been imaged, so we told the IT folks to do what they needed to do.

are not a decision-maker about what gets done. It's up tothe Senator, working with his former staff, tomake the
decisions he needs totoaccommodate his agreement with DOJ. We are happy tocontinue tofacilitate the
1 arrangements, but we cannot make the decisions or give instructions. I suggest that and workout, directly
with the Justice Department, what should be done on behalf of the Senator, and advise and or me, and we will
take care of it fromthere. If the decision is tostore all office hardware for the time being, we can dothat. Fromprior
experience, I would note that whatever is preserved should be clearly labeled, or it will be of limited potential use.

to use their work product, but for now, I promised we'd delete it and we should do so.) The file is
located as follows (file names are approximate as I'm writing this after I sent you the thumb drive):
"Ensign docs to DOJ/key document binder" and is called something like "contents." For what it's
worth, this file also includes their views of what the "key evidentiary documents" are it appears to
be somewhat more than the document binder tabs that accompanied the hard copy report.

Well it took a little doing, but with some VI helpfrom I was able to successfully burn a DVD of
my entire "Ensign" file (which contains all and stuff). This is the universe of electronic files I
had on the case. will be giving you each your own copy of the DVD.
I've moved all of my paper files to 11111.office and it is in 2 drawers marked "Stars and Stripes". Thanks to
hard work, she had created a list of the files and will be working with you guys to continue the
discovery production in including (1)working with to review the files and ensure everything
that needs to be turned over is produced, and (2) Bates-stamping the rest of the SSCE stuff so it can be
produced. As EMI knows, we estimated for the Court that we were hopeful that we could get the majority of
the discovery including SSCE stuff by the end of July.
I've given a box with everything we've received from the SSCE (through MEM so far. Someone
will need to reach out to find out what else, if anything, the SSCE has to give us.

Coburn told POLITICO that he is cooperating with the Justice Department in the investigation of Ensign, and
says he's willing to submit himself to an interview with the FBI or Senate Select Committee on Ethics, which is
conducting a parallel investigation into whether Ensign broke Senate rules.
"We've given them everything they wanted," Coburn said, referring to the Justice Department.
Coburn would not reveal what was in the e-mails he is sharing with federal authorities.
But Cobum's decision to provide potential evidence to the Justice Department is another blow for Ensign, and
could help federal investigators build their case against his fellow Republican colleague.
Coburn is not "the subject of the probe, which is focusing on Ensign's efforts to secure lobbying work for his
founer aide Doug Hampton, whose wife, Cynthia, carried on a nine-month extramarital affair with Ensign that
ended in August 2008."

The Senate on Thursday night quietly approved a resolution that will allow Sen. John Ensign's aides to testify
to a federal grand jury investigating the aftermath of the Nevada Republican's extramarital affair with a fowler
campaign aide.
By voice vote, the Senate approved the resolution that would authorize employees of the Senate to give
testimony to a grand jury in Washington.
Senate aides said that the resolution was necessary because Senate rules would prohibit employees from
testifying outside of the halls of Congress. The rule was put in place as a way to uphold the Senate's
constitutional right under the Speech or Debate clause, which prohibits members of the House and Senate from
being prosecuted for work related to their legislative duties.
The approval came swiftly during the Senate's daily wrap-up remarks. Sen. Mary Landrieu (D-La.)quickly read
through a list of non-controversial measures, including the Ensign resolution, which was approved by
unanimous consent.
The Senate's approval of the resolution is the latest sign that the investigation into the senator's affair and
whether he illegally attempted to cover it up and flouted federal law by helping the lobbying career of his
former mistress' husband continues to move swiftly. Last week, POLITICO first reported that Oklahoma
Republican Tom Coburn Ensign's former roommate - had given scores of e-mails to federal investigators to
assist with their inquiry.

Republican Sen. John Ensign of Nevada, who is under an ethics investigation by the Senate, announced
Thursday that he will resign his seat on May 3.
Ensign had previously said he would not run for re-election in 2012 following revelations that he had an affair
with a female aide who was the wife of another top aide, and that his parents subsequently gave money to the
aides' family.
"While I stand behind my film belief that I have not violated any law, rule, or standard of conduct of the Senate,
and I have fought to prove this publicly, I will not continue to subject my family, my constituents, or the Senate
to any further rounds of investigation, depositions, drawn out proceedings, or especially public hearings,"
Ensign said in the statement. "For my family and me, this continued personal cost is simply too great."
Ensign: There are consequences for sin
Ensign has admitted to having an affair with Cindy Hampton, a campaign aide and the wife of Ensign's former
chief of staff, Doug Hampton. Investigators are looking into efforts by Ensign to assist the Hampton family by
providing a nearly $100,000 payment to them, arranging lobbying work for Doug Hampton, and possibly
meeting with Doug Hampton on a lobbying matter in violation of Senate rules.

In February, the Senate ethics committee announced the appointment of a special counsel for the Ensign
investigation. According to Ensign, the Justice Department has previously told him it would not bring criminal
charges in the case.

"I am gratified that, after extended investigations, both the Department of Justice and the Federal Election
Commission saw no grounds on which to charge me with improper conduct," said Ensign's statement Thursday.
"I was hopeful that, with the closure of these investigations againstme the wear and tear on my family and me
would soon be over. This was not the case."
Ensign, 53, was first elected to the Senate in 2000. He previously was a veterinarian and general manager of the
Gold Strike Hotel and Casino.
After Ensign announced last month he would step down in 2012, two House members from Nevada, Republican
Rep. Dean Heller and Democratic Rep. Shelley Berkley, declared they would run to succeed him.

Nevada Gov. Brian Sandoval, a Republican, is expected to appoint a replacement to serve the rest of Ensign's
