FAQs ON GENERAL TRANSFERS - 2013



1) Who are supposed to apply for transfer counseling?

A) Persons who have completed maximum permissible tenure in an office, as per guidelines,
must apply for transfer counseling. They will be under compulsory transfer category. Other
persons, who have not completed maximum tenure, as per guidelines, may also apply for
transfer counseling. They will be listed under request category.

2) Whether a person can withdraw his application?

A) Persons who have completed maximum permissible tenure in a particular office cannot
withdraw his application. However, the person who has applied under request category,
can withdraw his applications prior to commencement of counseling process. It is the
responsibility of the applicant to bring this to the notice of the committee about with drawl
of his application before commencement of counseling. Once counseling process is
commenced, he cannot with draw his application.

3) Whether 20 % restriction on number of transfers is applicable or not?
4) Calculate 20% under each category based on cadre strength. If number of persons under
compulsory transfer are less than this limit, then balance number can be considered under
request transfers. If the compulsory list itself is equal or more than the 20% limit, in that
case no request transfers can be made. However, all

cases coming under compulsory
category will be done whether this number is within 20% limit or not.

Note: Previously service period in case of JA/Jr. Steno/Typist/SA/Sr. Steno was 5 years. It is
reduced to 3 years this year. Hence there is likely hood that large number of cases will come
under compulsory transfer list (Actually it is coming to more than 30% and there is no scope
for request transfers). Hence in case of JA/Jr. Steno/Typist/SA/Sr. Steno, total number of

transfers under compulsory list shall be limited to 20% of cadre strength under each
category and to provide small window for Request Transfers, 5% cases can be considered
under Request category over and above 20 % compulsory transfer list. Under Compulsory
Transfer list, the persons who are declared outside 20 % ceiling will not be transferred
compulsorily but they can, if they so desire, can convert their application to Request transfer
list.
Special procedure for preparing compulsory transfer list of JA/Jr. Steno/Typist/SA/Sr:
1. Print compulsory transfer list from system. Say, list contains 45 persons
2. Calculate 20% of cadre strength under each category
i. Total cadre strength of SA: 150
ii. 20% of cadre strength: 20% of 150 = 30
3. Excess persons in list: 45-30=15
4. Delete 15 persons from the list in the reverse order of total service period in the
same office. Starting from least service period till 15 are deleted. Rest of the list will
be Compulsory Transfer list.
5. Before commencement of counseling, give opportunities to these 15 persons
whether they would like to be considered under request transfer list. Who so ever
expresses Yes, take in writing, and those cases will be deemed to have been added
at appropriate serial number (point) in Request Transfer List as per points awarded
to them and their cases will be considered accordingly under Request Transfer List
on their turn in Request Transfer list.
Examples:
Post: Senior Assistant,
Cadre Strength: 150,
20% of Cadre strength (150): 30

Example 1:
a) Application Under Compulsory list: 32
b) Application Under request list: 10
30 cases (Limited to 20%) under compulsory list will be transferred and 8 (5% of 150)
transfers under Request List. (Convert Fraction equal to 0.5 and above to 1. Below 0.5 to 0)
Example 2:
a) Application Under Compulsory list: 24
b) Application Under request list: 10
All (24) under compulsory list will be transferred. 8 (5% of 150) under Request List can be
transferred.
Post: DCTO
Cadre Strength: 150,
20% of cadre strength (150): 30

Example 1:
a) Application Under Compulsory list: 32
b) Application Under request list: 5
All 32 cases under compulsory list will be transferred although 32 is more than 20%. But no
transfers under Request List.
Example 2:
a) Application Under Compulsory list: 24
b) Application Under request list: 10
All (24) under compulsory list will be transferred. 6 (30-24) under Request List can be
transferred.

5) If a person is not able to attend transfer counseling personally, can he depute other person on
his behalf ?

A) Yes. He can depute any person on his behalf to exercise option on his behalf. But he must
authorize such person in writing to represent him in the transfer counseling.

6) Can a person who has filed an application for transfer on request, can choose same post at the
time of counseling?

A) The person who is coming under compulsory transfer category, cannot choose the same
Office (office where he is working at present) for posting even if that post is available at his
turn as he has already completed maximum permissible tenure in that Office. However,
applicant under request category, can choose the same post in same office for transfer if it
is vacant at their turn.


7) The maximum service limit is 3 years for the staff members up to Senior Assistant cadre and 2
years for ACTO and above rank. If a person has worked in the same Office in different
categories, how maximum period will be calculated?

A) The limit for maximum service period in a particular office will be based on current posting
as per guidelines. However, the service period in the Office will include service period under
current posting as well as under other ranks in the same Office. More details given below:

Basically there are two factors:
1. Present posting and limit for that post - For example Senior Assistant - Limit 3 years. ACTO -
Limit 2 years.
2. Total continuous period in office including all posts (Going on leave will not constitute break):
Generally continuous period will be under one post only except where a person on promotion is
posted to same office. In such cases person will be working under more than one post

continuously. In such cases service period under all posts will be counted. But limit will be
applied as per latest post.
Example 1:
As JA - 1 year
As SA - 3 Years
As ACTO - 1 Year
Total Service in Office: 1+3+1=5 Years
Present post: ACTO, Service Limit for ACTO= 2 years
Hence Compulsory transfer as total service is more than 2 years although he worked as ACTO
only for 1 year.
Example 2:
As JA - 3 year
As SA - 2 Years
Total Service in Office: 3+2=5 Years
Present post: SA, Service Limit for SA= 3 years
Hence Compulsory transfer as total service is more than 3 years although he worked as SA only
for 2 year.

8) If two or more individuals got same points, who will be given preference in the transfer
counseling?

If two or more individuals get same points, the preference will be given based on the date of
joining in the C.T. Department. The person who joined earlier will be given preference. In
case of date of joining is also same, the preference will be given to date of birth. The person
whose date of birth is earlier, will be given preference. In case date of birth is also same, the
committee will decide by drawing lottery.
9) What are the guidelines for transfer of Office Bearers of the Associations?

A) The transfers and postings of the Office Bearers of the Associations will be done as per the
Government Orders issued from time to time.

10) If a person has reported for duty after availing long leave but not applied for transfer
counseling, can he participate in transfer counseling?
A) If person has reported for duty after availing long leave or return from deputation from
other office/department prior to announcement of transfer counseling process, his case for
posting will be considered for posting by competent authority as per normal process. He
need not apply for transfer counseling.
B) If person has reported for duty after availing long leave or return from deputation from
other office/department on or after announcement of transfer counseling but prior to last
date fixed for filing application for transfer counseling, he shall apply for transfer counseling
and his case will be considered by committee for posting as per counseling process.
However, if he fails to apply for counseling, his case for posting will be considered for
posting by competent authority after completion of transfer counseling process.
C) If person has reported for duty after availing long leave or return from deputation from
other office/department after last date fixed for filing application for transfer counseling, his
case for posting will be considered for posting by competent authority after completion of
transfer counseling process.
Note: Above guidelines will also apply to candidates reporting for duty to department as
fresh recruitment including appointment by transfer.

11) If a person is drawing his salary in a particular Office but working on O.D. in other Office, will
he be treated in the Office where his salary is being drawn or where he is actually working?

A) His service will be counted at the office from where he is drawing his salary.

12) Can a transfer be done under these guidelines from one local area to another local area?

A) These transfer guidelines are subject to Presidential orders. Hence no transfer posting can
be done under these guidelines which are not in conformity with the Presidential order.
13) Are staff eligible for TTA under this system?
As staff members are being given posting as per choice exercised by them, hence they will
not be eligible for TTA. However, if staff members under compulsory transfer list insist for
TTA, they should inform same before commencement of counseling in writing. In such
cases, their case should be considered by Committee at the end of counseling and posts

given to them as per the discretion of the Committee. No TTA for staff members under
Request Transfer List.
14) What do you mean a person cannot be posted on transfer to same office?
Under Compulsory List: If a person is presently working in CTO Nellore office, on transfer,
under Compulsory list, he CANNOT be posted on transfer to CTO Nellore office.
Under Request List: If a person is presently working in CTO Nellore office, on transfer, under
Request List, he CAN be posted on transfer to CTO Nellore office.

15) What posts are notified as Focal and non Focal in CTO/DC/ADC/SR/CCT office for SA/JA and
equivalent posts?
No posts as Focal or Non Focal for SA/JA and equivalent posts in CTO/DC/ADC/SR/CCT office.
