BEITENACTEDBYTHELEGISLATUREOFTHESTATEOF(STATE):
Section1.ShortTitle.ThisActmaybecitedastheCreatingHelpfulOptionsforInstitutions,
Corporations,andEnterprise(CHOICEAct)Actof(YEAR).
Section2.Thelegislaturefindsanddeclaresallofthefollowing:
(A)ThebulkcollectionofelectronicdataormetadataofthepeopleoftheStateof(STATE),
without,informed,affirmativeconsent,orawarrantbaseduponprobablecause,andparticularly
describingtheperson,placeorthingtobesearchedorseized,oractinginaccordancewitha
legallyrecognizedexceptiontothewarrantrequirements,constitutesanunreasonablesearch
andseizureandviolatestherighttoprivacyofthePeopleofthisstate.
(B)ItisthisStatesprerogativetofreelychoosetoawardcontractstothosecorporationsand
otherbusinessentitiesthatdonotactivelyandvoluntarilyassistintheviolationoftherightto
privacyofthePeopleofthisstateasdescribedinSection2(a).
(C)Itisthepolicyofthisstatetorefusetoawardcontractstothosecorporationsandother
businessentitiesthatarefoundtobeactively,knowingly,andvoluntarilyassisting,orproviding
materialsupportorresourcesto,thebulkcollectionofelectronicdataandmetadataofthe
peopleoftheStateof(STATE),without:
(1)Informed,affirmativeconsentofthepersonorpersonswhoseelectronicdataor
metadataisbeingcollected,or
(2)Awarrantbaseduponprobablecause,andparticularlydescribingtheperson,place
orthingtobesearchedorseized,or
(3)Actinginaccordancewithalegallyrecognizedexceptiontothewarrantrequirements.
Section3.Procurement,service,andothercontractsprohibitedtoentitiesfacilitatingprivacy
violations.
(A)Uponanofficialdeterminationbyacourtofthisstatethatacorporationorotherbusiness
entityisactively,knowingly,andvoluntarilyassisting,orprovidingmaterialsupportorresources
to,thebulkcollectionofelectronicdataandmetadataofthepeopleoftheStateof(STATE)
without,informed,affirmativeconsent,orawarrantbaseduponprobablecause,andparticularly
describingtheperson,placeorthingtobesearchedorseized,oractinginaccordancewitha
legallyrecognizedexceptiontothewarrantrequirements,thisstateanditspoliticalsubdivisions
shallnot:
(1)Contractforanynewbusinesswiththecorporationorotherbusinessentityfoundto
beinviolationofSection3(a).
(2)Reneworextendanyexistingcontractwiththecorporationorotherbusinessentity
foundtobeinviolationofSection3(a).
(B)Nothinginthissectionshallbeconstruedto:
(1)Prohibitanycorporationorotherbusinessentityfromcooperatingwithfederal
authoritieswhenrequiredunderfederallaw,or
(2)Createanypower,dutyorobligationinconflictwithanyfederallaw.
Section4.CorporateCertification
(A)Acorporationorotherbusiness,priortoenteringintoacontractwiththeStateof(STATE),or
withapoliticalsubdivisionoftheStateof(STATE),mustexecuteacertification,underoath,
subjecttothepenaltyofperjury,andfileitwiththeSecretaryofState,onaformprovidedbythe
secretaryofstate,affirmingthatitisnotactively,knowingly,andvoluntarilyassistingorproviding
materialsupportorresourcestothebulkcollectionofelectronicdataandmetadataofthepeople
oftheStateof(STATE),without:
(1)Informed,affirmativeconsentofthepersonorpersonswhoseelectronicdataor
metadataisbeingcollected,or
(2)Awarrantbaseduponprobablecause,andparticularlydescribingtheperson,place
orthingtobesearchedorseized,or
(3)Actinginaccordancewithalegallyrecognizedexceptiontothewarrantrequirements.
(B)Saidcertificationisandshallbeconsideredanongoingaffirmationuntilrescindedoruntilthe
expirationofthecorporationsorotherbusinessentityscontractualrelationshipwiththeStateof
(STATE)orapoliticalsubdivisionofthestateof(STATE).
(C)Acorporationorotherbusinessmayatanytimerescindsaidcertificationbyservingthe
SecretaryofStatewithnotice,andtheSecretaryofStateshallimmediatelyforwardacopy
thereoftotheAttorneyGeneral.
Section5.Enforcement.
(A)Anagencyofthisstateorapoliticalsubdivisionofthisstatemaynotreceivestategrant
fundsiftheagencyorpoliticalsubdivisionisfoundtohave,byconsistentactions,actively,
knowinglyandvoluntarilyviolatedSection3ofthisAct.
(1)Stategrantfundsfortheagencyorpoliticalsubdivisionshallbedeniedforthefiscal
yearfollowingtheyearinwhichafinaljudicialdeterminationinanactionbroughtunder
thissectionismadethattheagencyorpoliticalsubdivisionhasbyconsistentactions,
actively,knowinglyandvoluntarilyviolatedSection3ofthisAct.
(B)Anycitizenresidinginthejurisdictionofthisstateorapoliticalsubdivisionofthisstatemay
fileacomplaintwiththeattorneygeneralif,atthetimeofthecomplaint,thecitizenoffers
evidencetosupportanallegationthatthestateorpoliticalsubdivisionhasadoptedarule,order,
ordinance,orpolicyunderwhichthestateorpoliticalsubdivisionviolatesSection3ofthisAct.
(C)IftheattorneygeneraldeterminesthatacomplaintfiledunderSection4(B)ofthisactagainst
thisstateorapoliticalsubdivisionofthisstateisvalid,theattorneygeneralmayfileapetitionfor
awritofmandamusorapplyforotherappropriateequitablereliefinadistrictcourtinwhichthe
principalofficeofthestateorpoliticalsubdivisionofthisstateislocatedtocompelthestateor
politicalsubdivisiontocomplywithSection3ofthisAct.
(1)Theattorneygeneralmayrecoverreasonableexpensesincurredinobtainingrelief
underthisSection,includingcourtcosts,reasonableattorney'sfees,investigativecosts,
witnessfees,anddepositioncosts.
(D)Theattorneygeneralmaydefendanyagencyorpoliticalsubdivisionofthisstatethatthe
federalgovernmentattemptstosueorprosecuteforanactionoromissionconsistentwiththe
requirementsofthissection.
Section6.Severability
Theprovisionsofthisactareherebydeclaredtobeseverableandifanyprovisionofthisactor
theapplicationofsuchprovisiontoanypersonorcircumstanceisdeclaredinvalidforany
reason,suchdeclarationshallnotaffectthevalidityoftheremainingportionsofthisact.
Section7.EffectiveDate
ThisacttakeseffectuponapprovalbytheGovernor.
