Developent !" Siri Institutional #rea" $au% &has" Ne' Delhi ( ))**)+ PROCUREMENT PROCEDURES IN ICDS ), R#TION#-E ICDS is expanding to all the blocks of the country. The expansion of the scheme depends on trained personnel and a dedicated channel of supplies to the Projects. It is imperative to focus and streamline the supplies to ICDS Projects in order to minimie disruption in services and ensure smooth delivery of services. To!ards this end" a revie! of procurement procedures of ICDS supplies has been mooted. #itherto" the procedures !ere available in the form of $overnment %rders &$%s' and Circulars issued by the then Department of (omen ) Child Development and the present *inistry of (omen ) Child Development. The $%s + Circulars are generally comprehensive and meticulous albeit limited to the subject at hand. It is proposed to consolidate the Procurement Procedures in the form of a ready reckoner on the lines of Procurement Procedures issued for Sarv Shiksha ,bhiyan &SS,' to facilitate the implementing partners in procuring ICDS items in a timely" transparent and judicious manner. ., SC$EM#TIC P#TTERN The scheme of Integrated Child Development Services is a centrally sponsored programme and implemented through the State $ovts. !ith cent percent financial assistance from the Central $overnment for inputs other than supplementary nutrition. Since the States !ere not providing ade-uately for supplementary nutrition due to financial constraints" the Central $ovt. has" from the year .//01/2" decided to provide financial assistance to the States upto 0/3 of the financial norms or 0/3 of the actual expenditure incurred by the States on supplementary nutrition" !hichever is less. The scheme further provides that Central Social (elfare 4oard" 5oluntary %rganiations" local bodies" P6Is &!herever these are functioning efficiently' etc. are to be actively involved in this programme for implementation" soliciting community support etc. . The cost of all inputs as provided in the scheme is met by the *inistry of (omen and Child Development in the centrally sponsored Projects. The implementation of the ICDS Scheme necessarily entails procurement of infrastructure" services and other operational inputs vi. *edicine 7its" PS8 7its" items for Supplementary 9utrition" I8C *aterial" 8-uipment and :urniture and 5ehicles" !ithin the parameters of the Scheme. The responsibility for the implementation of ICDS Scheme rests !ith the State $ovts. and therefore the a!ard and administration of contracts under the scheme rest !ith the State $ovts. It should be ensured that the ICDS funds are used only for the purposes for !hich they are granted" !ith due attention to considerations of economy and efficiency and !ithout regard to political or other non1economic influences or considerations. /, SUPPORT 0OR IMP-EMENTIN1 ICDS The nature of support in the scheme can be broadly divided into the follo!ing categories; i' Infrastructure < 4uilding+accommodation for ,(C ii' Services including recruitment of personnel iii' Items of operational inputs Infrastructure2 The Scheme provides that accommodation of ,ngan!adi Centre shall be provided by the community free of rent. #o!ever" !herever such accommodation is not available" a provision for payment of rent for ,(C is available depending on the location of ,(C < =rban" rural and tribal. Services and Recruitent of Personnel2 ,ll ICDS functionaries are State $ovt. employees" except ,((s and #elpers !ho are honorary !orkers. The ,((s and #elpers are paid fixed amount of monthly honorarium as may be decided by the $ovt. from time to time. The regular employees are recruited by the State $ovt. as per the recruitment rules and conditions of services are applicable to each category.

The procedures to be follo!ed in making public procurement must confirm to the follo!ing yardsticks ;1 i' 4ulk re-uirement of store for state office and district level offices should be assessed at the beginning of the financial year. ii' The specifications in terms of -uality" type etc." as also -uantity of goods to be procured" should be clearly spelt out keeping in vie! the specific needs of the procuring organiation. It should also be mentioned to the *(CD that except for the carry for!ard of the procurement" all other procedures remain unchanged 1 It shall be ensured that the procurement is based on actual need D :, MET$ODS O0 PROCUREMENT UNDER ICDS >. %pen tenders .. Cimited tenders ?. Single Tender B. (ithout Tender and 0. Through Cocal Community :,) Open Tenders %pen Tender is the competitive bidding procedure normally used for public procurement in the country and may be the most efficient and economic !ay of procuring goods by their nature or scope. The procedure shall provide for ade-uate competition in order to ensure reasonable prices" and methods used in the evaluation of tenders and the a!ard of contracts shall be made kno!n to all bidders and not be applied arbitrarily. Steps; 5arious steps involved in procurement under %pen Tender procedure are given belo!; &a' 9otification+,dvertising &b' Issue of tender documents &c' Submission of tender documents &d' Public opening of tender &e' 8valuation &f' Selection of lo!est evaluated responsive tender based on post -ualification &g' 9egotiation !ith C1I &if necessary' &h' Contract a!ards" and &i' Contract performance Notification/Advertising: Timely notification of bidding opportunities is essential in competitive bidding;1 &a' Invitation to bid shall be published in ne!spapers and at least in one national 8nglish daily" if estimated value is 6s..0 lakhs and above. &b' State $ovt. having its o!n !ebsite should also publish all its advertised tender en-uiries on the !eb site and provide a link !ith 9IC !ebsite. It should also give its !ebsite address in the advertisements in ne!spapers. A &c' If it is noted in the invitation for tender that 8arnest *oney is to be deposited by the supplier+contractor" the bid of a supplier+contractor not complying !ith this re-uirement shall be rejected. In the case of deposit of 8arnest *oney" the existing StateHs procedure may be follo!ed. #o!ever" it is desirable that a level playing field be created in this regard. &d' In a package the 8arnest *oney is indicated taking into account all the items. This cannot be changed later on. %nce it is decided that the contract is for a package" the 8arnest *oney for that package is to be indicated and the same cannot be changed according to each item. &e' The last date for receipt of tender shall be the day follo!ing the date for close of the sale of tender documents. &f' %rdinarily" the minimum time to be allo!ed for submission of bids should be three !eeks from the date of publication of the tender notice or availability of the bidding document for sale" !hichever is later. Tender Documents: ,ll $ovt. purchases should be made in a transparent" competitive and fair manner" to secure best value for money. Standard State $overnmentHs tender documents should be used. The sale of tender document should begin only after the publication of notification for tender in ne!spaper. The tender documents shall furnish all information necessary for a prospective bidder to prepare a tender for the goods to be provided. The text of the bidding document should be self contained and comprehensive !ithout any ambiguities. ,ll essential information !hich a bidder needs for sending responsive bid" should be clearly spelt out in the bidding document in simple language. The bidding document should contain" inter1alia;1 a' the criteria for elibility and -ualifications to be met by the bidders such as minimum level of experience" past performance" technical capability" manufacturing facilities and financial position etc.G b' eligibility criteria for goods indicating any legal restrictions or conditions about the origin of goods etc." !hich may re-uired to be met by the successful bidderG c' the procedure as !ell as date" time and place for sending the bidsG d' date" time and place of opening of the bidG e' terms of deliveryG E f' special terms affecting performance" if any. The basis for tender evaluation and selection of the lo!est evaluated tender shall be clearly outlined in the instructions to tenders and+or the specifications. Tender documents should be made available to all !ho seek them" regardless of registration status and they should be allo!ed to bid. Technical Specification: Technical specifications and -uantity re-uired should be prepared before tendering. Specifications for the items to be procured should be dra!n up in every case !ith clarity. 9o deviations from the specifications after opening of tender should be allo!ed. Validity of Tender: 4idders shall be re-uired to submit tender valid for the period specified in the tender documents. 9ormally" the bid valid period shall not exceed E/ days. Earnest Money: To safeguard against a bidderHs !ithdra!ing or altering its bid during the bid validity period in the case of advertised or limited tender en-uiry" 4id Security &also kno!n as 8arnest *oney' is to be obtained from the bidders except those !ho are registered !ith the Central Purchase %rganisation of the State $ovt." 9ational Small Industries Corporation &9SIC' or the concerned State *inistry or Department. The bidders should be asked to furnish bid security along !ith their bids. ,mount of bid sercurity should ordinarily range bet!een .3 to 03 of the estimated value of the goods to be procured. The exact amount of bid security" should be determined accordingly by the State Department and indicated in the bidding documents. The bid security may be accepted in the form of ,ccount Payee Demand Draft" :ixed Deposit 6eceipt" 4ankerHs Che-ue or 4ank $uarantee from any of the commercial banks in an acceptable form" safeguarding the purchaserHs interest in all respects. The bid security is normally to remain valid for a period of forty1five days beyond the final bid validity period. 4id securities of the unsuccessful bidders should be returned to them at the earliest after expiry of the final bid validity and latest on or before the ?/ th day after the a!ard of the contract. Standards and Technical specifications: ,s far as possible" the implementing agency shall specify the generally accepted standards of technical specifications. =nbiased technical specification shall be prepared !ith no mention of brand names and catalogue numbers. >/ Tender documents should State clearly !hether the bid prices !ill be fixed or price adjustment !ill be made to reflect any changes in major cost components of the contract. Terms and Methods of Payment: Payment terms shall be in accordance !ith the practices applicable to the specific goods+items and !orks. Tender documents should specify the payment method and terms offered. onditions of ontract: The contract documents shall clearly define the scope of !ork to be performed" the goods+items to be supplied" the rights and obligations of the implementing agency and of the Supplier or Contractor" and the functions and authority of the engineer" architect" or construction manger" if one is employed by the implementing agency" in the supervision and administration of the contract. Performance Security: i' To ensure due performance of the contract" Performance Security is to be obtained from the successful bidder a!arded the contract. Performance Security is to be obtained from every successful bidder irrespective of its registration status" etc. Performance Security should be for an amount of 03 to >/3 of the value of the contract. Performance Security may be furnished in the form of an ,ccount payee Demand Draft" :ixed Deposit 6eceipt from a Commercial bank" 4ank $uarantee from a Commercial bank in an acceptable form safeguarding the purchasers interest in all respects. ii' Performance Security should remain valid for a period of sixty days beyond the date of completion of all contractual obligations of the supplier including !arranty obligations. iii' 4id security should be refunded to the successful bidder on receipt of Performance Security. Tender opening: The time for the tender opening should be the same as the deadline for receipt of tenders or promptly thereafter. Tenders shall be opened in public" that is" bidders or their representatives shall be allo!ed to be present. ,ll tenders received should be opened and the name of the bidder and total amount of each bid shall be read out at the time of bid opening. 9o bid should be rejected at bid opening except late tenders" !hich shall be returned unopened to the bidder. >> *inutes of bid opening must be prepared. Confidentiality; ,fter the public opening of tenders" information relating to the examination" clarification" and evaluation of tenders and recommendations concerning a!ards shall not be disclosed to bidders or other persons not officially concerned !ith this process until the successful bidder is notified of the a!ard. E;aination of Tenders &a' The implementing agency shall ascertain !hether the tenders. &i' meet the eligibility re-uirements specified &ii' have been properly signed &iii' are accompanied by the re-uired securities and are valid for the period specified in the tender document &iv' are substantially responsive to the tender documents" and &v' are other!ise generally in order &b' If a bid is not substantially responsive" that is" it contains material deviations from or reservations to the terms" conditions" and specifications in the tender documents" it shall not be considered further. The bidder shall not be permitted to correct or !ithdra! material deviations or reservations once tenders have been opened. Tender Evaluation and Coparison &a' 4ids received should be evaluated in terms of the conditions already incorporated in the bidding documentsG no ne! condition !hich !as not incorporated in the bidding documents should be brought in for evaluation of the bids. Determination of a bidHs responsiveness should be based on the contents of the bid itself !ithout recourse to extrinsic evidence. &b' 4idders should not be permitted to alter or modify their bids after expiry of the deadline for receipt of bids. &c' 9egotiation !ith bidders after bid opening must be severely discouraged. &d' Contract should ordinarily be a!arded to the lo!est evaluated bidder !hose bid has been found to be responsive and !ho is eligible and -ualified to perform the contract satisfactorily as per the terms and conditions incorporated in the corresponding bidding document. >. &e' The implementing agency shall prepare a detailed report on the evaluation and comparison of tender setting forth the specific reasons on !hich the recommendation is based for the a!ard of the contract. E;tension of 8alidit5 of Tender2 ,n extension of bid validity" if justified by exceptional circumstances" shall be re-uested in !riting from all bidders" &of valid tenders only' before the expiration dated only !ith the prior approval of the ,ccepting ,uthority. 4idders shall have the right to refuse to grant such an extension !ithout forfeiting their 8arnest *oney" but those !ho are !illing to extend the validity of their bid shall be re-uired to provide a suitable extension of 8arnest *oney. Post <ualification of 3idders2 If bidders have not been pre1-ualified" the implementing agency shall determine !hether the bidder !hose bid has been determined to offer the lo!est evaluated cost has the capability and resources to effectively carry out the contract as offered in the bid. The criteria to be met shall be set out in the tender documents" and if the bidder does not meet them" the bid shall be rejected. In such an event" the implementing agency shall make a similar determination for the next lo!est evaluated bidder. #'ard of Contract; &a' Implementing agency shall a!ard the contract" !ithin the period of the validity of tenders" to the bidder !ho meets the appropriated standards of capability and resources and !hose bid has been determined &i' to be substantially responsive to the tender documents and &ii' to offer the lo!est evaluated cost. &b' Single offers received in response to the call for open tenders should also be considered for a!ard if it is determined that publicity !as ade-uate" bid specifications+conditions !ere not restrictive or unclear and bid prices are considered reasonable. Repeat Orders Purchases under open tender method may be increased over the -uantity originally ordered as per the prevailing State procedure by repeat orders after recording reasons" provided that such orders shall not be given after a period exceeding one month from the date of the expiry of last supply made and also subject to the condition that prices have since not reduced and purchases !ere not made on urgent basis. >? Re9ection of #ll Tenders &a' Tender documents usually provide that implementing agency may reject all tenders. 6ejection of all tenders is justified !hen there is lack of effective competition" or tenders are not substantially responsive. #o!ever" lack of competition shall not be determined solely on the basis of the number of bidders. If all tenders are rejected" the implementing agency shall revie! the causes justifying the rejection and consider making revisions to the conditions of contract" design and specifications" scope of the contract" or a combination of these" before inviting ne! tenders. &b' If the rejection of all tenders is due to lack of competition" !ider advertising shall be considered. If the rejection is due to most or all of the tenders being non1responsive" ne! tenders may be invited. &c' 6ejection of all tenders and re1inviting ne! tenders" irrespective of value" shall be referred to the competent authority for approval. :,. -iited Tender &a' $oods including office e-uipment" furniture" computers" !eighting scales" reading material" supplementary nutrition" hiring of vehicles" PS8 kits" medicine kits and operation and maintenance of e-uipment estimated to cost upto the financial ceiling prevailing in States or less per contract may be procured under contracts a!arded under the Cimited Tender System. &b' Cimited Tender is a procurement method based on comparing price -uotations obtained from several suppliers" usually at least three to ensure competitive prices. ,s far as possible" Cimited Tender en-uires !ill be issued to those firms" !hich are borne on the list of approved contractors+suppliers. &c' The re-uests for -uotations shall be made indicating the description specification and -uantity of the goods" as !ell as desired delivery time and place. Iuotations shall also be obtained by telex or facsimile. The evaluation shall follo! sound public or private sector practices. The terms of the accepted offer shall be incorporated in a purchase order. >B Steps for -iited Tender Procureent &a' Identifying items for purchase" &b' Caying do!n specifications for the items identified" &c' 8stimating total numbers and costs of items identified based on approximate unit costs. &d' Identifying likely agencies from !hom -uotations can be invited &minimum three" but A1>/ agencies !ould ensure more competitive rates'" &e' %btaining approvals of competent authority for items to be purchase along !ith specifications" estimated costs and agencies from !hom -uotations should be invited" &f' Issuing letters of invitations based on approvals" &g' Processing -uotations received" obtaining orders to competent authority for placing of orders for supply. &h' Issuing letters placing orders for supply" specifying period in !hich the delivery is to be completed" &i' 8nsuring inspection of items at the point of production &before delivery' for proper -uality control. The inspection is re-uired to be undertaken by a group constituted by the implementing agency" &j' 8nsuring timely supply of items" and &k' *aking payments after delivery in satisfactory condition. :,/ Sin4le Tender &a' , Single Tender system may be adopted in case of articles !hich are specifically certified as of propriety nature or in cases !here only a particular firm is the manufacturer of the articles demanded. $oods including books" teaching materials" child1learning items and operation and maintenance of e-uipment etc may be procured under contracts a!arded under the single tender system. &b' The single tender system !ithout competitions shall be an appropriate method under the follo!ing circumstances; &i' 8xtension of existing contracts for goods a!arded !ith the prescribed procedures" justifiable on economic grounds" >0 &i' Standardiation of e-uipment or spare parts to be compatible !ith existing e-uipment may justify additional purchases from the original supplier &ii' The re-uired item is proprietary and obtainable only from one source" &iii' 9eed for early delivery to avoid costly delays" and &iv' In exceptional cases" such as in response to natural disasters. &v' 6ate contracts of Directorate $eneral of Supplies and Disposals &D$S )D' and of the State $overnments shall also be an appropriate method under Single Tender system :,6 Procureent 'ithout Tender Purchase of items or group of items estimated to cost less than the financial ceiling prevailing in the State on each occasion may be made !ithout inviting tenders+-uotations" provided this does not involve any splitting of purchases.
