AMENDMENT OF THE TOWN-PLANNING SCHEME OF BAINSVLEI


By virtue of section 29(3), read with section 30 of the Townships
Ordinance, 1969 (Ordinance No. 9 of 1969), I, M.J. Zwane, Member of
the Executive Council of the Province responsible for Cooperative
Governance, Traditional Affairs and Human Settlements, hereby give
notice that I have amended the Town-Planning Scheme of Bainsvlei as
set out in the Schedule, and that a copy of such amendment will be
open for inspection during office hours at the offices of the Townships
Board and Mangaung Local Municipality.

DECLARATION OF TOWNSHIP: KUTLWANONG: EXTENSION 12


By virtue of the powers vested in me by section 14(1) of the Townships
Ordinance, 1969 (Ordinance No. 9 of 1969), I, M.J. Zwane, Member of
the Executive Council of the Province responsible for Cooperative
Governance, Traditional Affairs and Human Settlements, hereby
declare the area represented by General Plan S.G. No. 1248/2009 as
approved by the Surveyor General on 28 August 2009 to be an
approved township under the name Kutlwanong, Extension 12, subject
to the conditions as set out in the Schedule.

WYSIGING VAN DIE DORPSAANLEGSKEMA VAN BAINSVLEI


Kragtens artikel 29(3), saamgelees met artikel 30 van die Ordonnansie
op Dorpe, 1969 (Ordonnansie No. 9 van 1969), gee ek, M.J. Zwane,
Lid van die Uitvoerende Raad van die Provinsie verantwoordelik vir
Samewerkende Regering, Tradisionele Sake en Huisvestings, hiermee
kennis dat ek die Dorpsaanlegskema van Bainsvlei gewysig het soos in
die Bylae aangedui, en dat n afskrif van gemelde wysiging gedurende
kantoorure by die kantore van die Dorperaad en Mangaung Plaaslike
Munisipaliteit ter insae beskikbaar is.

Kragtens die bevoegdheid my verleen by artikel 14(1) van die
Ordonnansie op Dorpe, 1969 (Ordonnansie No. 9 van 1969), verklaar
ek, M.J. Zwane Lid van die Uitvoerende Raad van die Provinsie
verantwoordelik vir Samewerkende Regering, Tradisionele Sake en
Huisvestings, hierby die gebied voorgestel deur Algemene Plan L.G.
No. 1248/2009 soos goedgekeur deur die Landmeter-Generaal op
28 Augustus 2009 tot n goedgekeurde dorp onder die naam
Kutlwanong, Uitbreiding 12, onderworpe aan die voorwaardes soos in
die Bylae uiteengesit.

CONDITIONS OF ESTABLISHMENT AND OF TITLE

The township KUTLWANONG EXTENSION 12, situated on Portion 38
(of 37) of the farm New Kameeldoorns No. 139, Administrative district
Odendaalsrus, Province Free State consisting of 218 erven, numbered
10068 to 10285 and streets as indicated on General Plan S.G. No.
1248/2009.


A. CONDITIONS OF ESTABLISHMENT

A.1 The rights to all minerals, precious and base metals are reserved
in favour of the Matjhabeng Municipality.

A.2 Since this land is subject to unfavourable foundation conditions,
foundations for new buildings and extensions to existing buildings
should be designed by a Professional Civil Engineer as
prescribed by the National Building Regulations and such
Engineer as prescribed by the National Building Regulations and
such Engineer must pay attention to the Geotechnical Report
with reference to the soil conditions of the township which report
is available at the Municipal offices in Welkom.

A.3 The erven of this town are classified in the following groups and
are further subject to the conditions of title as set out in
paragraph B:

B. CONDITIONS OF TITLE

The conditions of title mentioned in paragraph A, are applicable
and as follows:

IN FAVOUR OF THE MATJHABENG MUNICIPALITY

B.1 This erf shall be subject to a servitude of 2 metres wide along the
rear boundary, 1 meter along the side and street boundary, as
well as any other servitude which is shown on the General Plan
of the township, for the installation of municipal service
connections over and under the erf and the officials of the
Municipality shall at all times have free access thereto for the
purpose of the construction, maintenance and repair of the
services. Above-mentioned servitudes may be relaxed to 0 (nil)
metres by the Municipality on one of the side boundaries.

Die dorp KUTLWANONG UITBREIDING 12, gele op Gedeelte 38
(van 37) van die plaas New Kameeldoorns No. 139, Administratiewe
distrik Odendaalsrus, Provinsie Vrystaat en bestaan uit 218 erwe,
genommer 10068 tot 10285 en strate soos aangedui op die Algemene
Plan L.G. No. 1248/2009.


A. STIGTINGSVOORWAARDES:

A.1 Die regte op alle minerale, edel en onedele metale word ten
gunste van die Matjhabeng Munisipaliteit voorbehou.

A.2 Aangesien die gebied onderhewig is aan ongunstige
funderingstoestande moet fondasies vir nuwe geboue en
aanbouings aan bestaande geboue deur n Professionele Siviele
Ingenieur ontwerp word soos voorgeskryf deur die Nasionale
Bouregulasies en sodanige Ingenieur moet ag slaan op die
Geotegniese-verslag, met betrekking tot die grondtoestande van
die dorpsgebied, wat ter insae l by die Munisipale kantore te
Welkom.

A.3 Die erwe van hierdie dorp word in die hierondervermelde
gebruikstreke ingedeel en is verder onderworpe aan die
eiendomsvoorwaardes soos uiteengesit in paragraaf B:

B. EIENDOMSVOORWAARDES

Die eiendsvoorwaardes wat in paragraaf A hierbo vermeld word,
is van toepassing en is as volg:

TEN GUNSTE VAN DIE MATJHABENG MUNISIPALITEIT

B.1 Hierdie erf is onderhewig aan n serwituut van 2 meter wyd langs
die agter grens, 1 meter langs die sygrense en die straatgrens,
sowel as enige ander serwituut wat op die Algemene Plan van
die dorp aangedui is, vir die aanl van munisipale
diensgeleidings oor of onder die erf, en die amptenare van die
Munisipaliteit het alle tye vrye toegang daartoe vir die doel van
die konstruksie, instandhouding en herstel van die dienste.
Gemelde serwitute kan deur die Munisipaliteit verslap word om 0
(nul) meter te wees op een van die sygrense.

B.2 Buildings on this erf may primarily be used for residential
purposes. The following uses may be permitted with the
consent of the Municipality, namely places of public worship,
places of instruction, social halls, sport and recreational
purposes, institutions and medical suites and special uses.


Permissible coverage: 60%

B.3 Buildings on this erf may primarily be used for business
purposes. The following uses may be permitted with the
consent of the Municipality, namely residential uses, places of
public worship, places of instruction, social halls, sport and
recreational purposes, institutions and industries. Noxious
industries are prohibited on this erf.

Permissible coverage: 70%
Provision of parking:
Business 2,5 parking space per 100m gross leasible area
(gla)

B.4 Buildings on this erf may primarily be used for places of public
worship, places of instruction, social halls, sports and
recreational purposes and institutions. Residential buildings
and the use of the erf for special purposes may only be
permitted with the consent of the Municipality.

Permissible coverage: 70%
Provision of parking:
Church 1 parking space per 6 seats
Crche & Clinic 1 parking per 20m gross floor space.
Loading facilities must be provided to the satisfaction of the
Municipality.

B.5 These restrictions shall lapse when a Town Planning Scheme
comes into operation in this area. The stipulations, limitations
and controls of the said Town-Planning Scheme pertaining to
land-uses, density, coverage, building lines and parking
requirements will then be applicable to the erf.

In these conditions the following meanings are applicable:

Residential building means a building designed or used primarily for
human habitation and associated uses;


Place of instruction means land uses for or a building designed for or
primarily used as a school technical college lecture hall institute
or other educational centre, and includes a crche, a convent or
monastery, a public library, an art gallery, a museum and a
gymnasium;

Business purposes means the use of a building and/or land for
offices, show rooms, restaurants, shops, caf, industry of public
garage.

B.2 Geboue wat op die erf opgerig word, mag hoofsaaklik vir
residensile doeleindes gebruik word. Die eiendom mag slegs
met die toestemming van die Munisipaliteit vir openbare
godsdiensbeoefening, plek van onderrig, gemeenskapsale, sport
en ontspanning, inrigtings, mediese suites en spesiale
doeleindes gebruik word.

Toelaatbare dekking: 60%

B.3 Geboue wat op hierdie erf opgerig word, mag hoofsaaklik vir
besigheidsdoeleindes gebruik word. Die eiendom mag slegs met
die toestemming van die Munisipaliteit vir residensile
doeleindes, openbare godsdiensbeoefening, onderrig, gemeen-
skapsale, sport en ontspanning, inrigtrings of industrie gebruik
word. Hinderlike industrie is verbode op die erf.

Toelaatbare dekking: 70%
Voorsiening van parkering:
Besigheid 2.5 parkeerplek per 100m bruto verhuurbare
vloeroppervlak (bvo)

B.4 Geboue wat op die erf opgerig word, mag hoofsaaklik vir
openbare godsdiensbeoefening, onderrig, gemeenskapsale,
sport en ontspanning of inrigtings gebruik word. Die eiendom
mag slegs met die toestemming van die Munisipaliteit vir
residensile en spesiale doeleindes gebruik word.

Toelaatbare dekking: 70%
Voorsiening van parkering:
Kerk 1 parkeerplek per 6 sitplekke
Crche & Kliniek 1 parkeerplek per 20m bruto vloeroppervlak.
Op- en aflaaigeriewe moet tot bevrediging van die Munisipaliteit
voorsien word.

B.5 Hierdie voorwaardes sal verval sodra n Dorpsaanlegskema in
die area inwerking tree. Die bepalings, beperkings en kontroles
van sodanige Dorpsaanlegskema met betrekking tot grond-
gebruik, digtheid, dekking, boulyne en parkeervereistes sal dan
van toepassing wees op die erf.

In hierdie voorwaardes beteken:

Residensile doeleindes n gebou ontwerp vir of hoofsaaklik gebruik
vir bewoning deur mense en die gebruike hiermee saam
toegelaat;

Plek van onderrig grond wat gebruik word of n gebou wat ontwerp
is of hoofsaaklik gebruik word vir n skool, tegniese college,
lesingsaal, instituut of ander opvoedkundige sentrum en ook n
kleuterskool, n monnikke- of nonneklooster, n openbare
biblioteek, n kunsgallery, n museum en n gimnasium;

Besigheidsdoeleindes die gebruik van n gebou en/of grond vir
kantore, uitstallokale, restaurante, n winkel, kafee, industrie of
openbare garage.
