KARNATAKA SHOPS AND COMMERCIAL ESTABLISHMENTS ACT, 1961.

Objectives:
To regulate the conditions of work for employees in shops and establishments in the state of
Karnataka

The Act extends to all shops and commercial establishments in the State of Karnataka.
Commercial establishment means any premises not being a factory or a shop where any
business, trade, manufacture or any work in connection or ancillary thereto, and includes
premises where journalistic or printing work or business of banking , insurance, stocks and
shares, brokerage and produce exchange is carried on or which is used as theatre, cinema or
other place of public entertainment or amusement, where the proisions of the !actories Act
don"t apply.
Shop means any premises where any wholesale or retail trade or business is carried on, or where
serices are rendered to customers, and includes all offices, godowns, or warehouses whether in
the same premises or not which are used in connection with such trade or business

#$% This Act may be called the Karnataka Shops and Commercial &stablishments Act, $'($.
#)% *t extends to the whole of the State of Karnataka.
#+% *t shall come into force on such date as the State ,oernment may be notification appoint.
#-% #a% *t shall apply, in the first instance, to the areas specified in the Schedule to this Act, and
to such other areas in which any of Acts repealed by Section -) applied.
#b% *t shall apply, to any other area with effect from such date as the State ,oernment may be
notification specify which date shall not be earlier than the expiry of three months from the date
of publication of such notification in the .fficial ,a/ette.

*n this Act, unless the context otherwise re0uires,11
#a% 2Adult2 means a person who has completed his eighteenth year3
#b% 2Apprentice2 means a person aged not less than fourteen years, who is employed whether on
payment of wages or not for the purpose of being trained in any trade, craft or employment in
any establishment3
#b a% 24anking company2 means,11

#ii% the banking company as defined under the 4anking 5egulations Act, $'-'3
#iii% the State 4ank of *ndia constituted under the State 4ank of *ndia Act, $'663

#% a corresponding new 4ank constituted under the 4anking Companies #Ac0uisition and

#c% 2Child2 means a person who has not completed his fourteenth year3
#d% 2Closed2 means not open for the serice of any customer or for any business connected with
the establishment3

#$% ;oting in this Act shall apply to1
#a% .fficers of or under the Central or State ,oernments or local authorities, except commercial
undertakings3
#b% any railway serice, water transport serice, postal, telegraph or telephone serice, any
system of public conserancy or santiation or any industry, business or undertaking which
supplies power, light or water to the public3
#c% railway dining cars3
#d% establishments for the treatment or care of the sick, infirm, or the meantally unfit3
Secti$%: -: Re.ist'"ti$% $+ Est"b!is&)e%ts
#$% <ithin the period specified in sub1section #+%, the employer of eery establishment shall send
to the *nspector of the area concerned, a statement in the prescribed form together with such
fees as may be prescribed, containing,111
#a% the name of the employer and the manager, if any3
#b% the postal address of the establishment,
#c% the name, if any, of the establishment3 and
#d% such other particulars as may be prescribed.
#)% .n receipt of the statement and the fees, the *nspector shall, on being satisfied about the
correctness of the statement, register the establishment, in the register of establishments in such
manner as may be prescribed, and shall issue, in a prescribed form, a registration certificate to
the employer. The registration certificate shall be prominently displayed at the establishment.
#+% <ithin thirty days from the date mentioned in column #)% below in respect of an
establishment in column #$%, the statement together with fees shall be sent to the *nspector
under sub1section #$%.

#-% A registration certificate issued under sub1section #)%, shall be alid for fie years and shall
be renewed before the expiry of the period of registration certificate on payment of such fees and
in such manner as may be prescribed.
#6% The registration certificate issued or renewed before the commencement of the Karnataka
Shops and Commercial &stablishments #Amendment% Act, $''8 shall, on such commencement,
continue to be alid till the expiry of the period of registration certificate already granted and the
employer of eery such establishment shall renew his registration certificate before the expiry of
such period in accordance with sub1section #-%.
Secti$%: /: C&"%.e t$ be c$))0%ic"te1 t$ I%sect$'
*t shall be the duty of an employer to notify to the *nspector, in the prescribed form, any change
in respect of any information contained in his statement under Section -, within fifteen days after
the change has taken place. The *nspector shall, on receiing such notice and on being satisfied
about its correctness, make the change in the register of establishments and shall amend the
registration certificate or issue a fresh registration certificate, if necessary.

The employer shall, within fifteen days of his closing the establishment, notify to the registration
in writing the date of such closure and return the registration certificate. The *nspector shall, on
receiing the information and being satisfied about its correctness, remoe such establishment
from the register of establishments and cancel the registration certificate>
?roide that if the *nspector does not receie the information, but is otherwise satisfied that the
establishment has been closed, he may remoe such establishment from such register.
Secti$%: 6A: Iss0e $+ "$i%t)e%t $'1e's
&ery employer, employing any person in or in connection with his establishment, shall issue an
appointment order in writing indicating the name, designation, wage scale of such person and
terms and conditions of his employment and sere the same on such person within thirty day
from the date of appointment in his establishment>
?roided that in case of employees appointed in any establishment prior to the commencement of
the Karnataka Shops and Commercial &stablishments #Amendment% Act, $''8, the employer of
such establishment shall, if he has not yet issued any appointment order in writing to such
employee, communicate in writing to the employee incorporating therein his name, designation
and wage scale and the terms and conditions of employment and sere the same on him within
thirty days from the date of such commencement.

Secti$%: 2: D"i!# "%1 3ee4!# &$0's
#$% ;o employee in any establishment shall be re0uired or allowed to work for more than nine
hours on any day and forty1eight hours in any week.
?roided that the total number of hours of work including oertime shall not exceed ten hours in
any day except on days of stock1taking and preparation of accounts>
?roided further that the total number of oertime hours worked by an employee does not
exceed fifty in a period of three continuous months.
#)% ;o young person x x x x x shall be allowed to work in any establishment for more than fie
hours in a day.
Secti$%: 5: E(t'" 3".es +$' $ve'ti)e 3$'4
#$% <here an employee works in any establishment for more than nine hours in any day or for
more than forty1eight hours in any week he shall in respect of such oertime work be entitled to
wages at twice the rate of normal wages.
#)% !or the purposes of this section 2normal wages2 means the basic wages plus such
allowances, including the cash e0uialent of the adantage accruing through the concessional sale
to workers of foodgrains and other articles, as the worker is for the time being entitled to, but
does not include a bonus.
#+% The cash e0uialent of the adantage accruing through the concessional sale to a worker of
foodgrains and other articles shall be computed as often as may be prescribed on the basis of the
maximum 0uantity of foodgrains and other articles admissible to a standard family.
&xplanation $.12Standard family2 means a family consisting of an employee, his or her spouse
and two children below the age of fourteen years re0uiring in all three adult consumption units.
&xplanation ).12adult consumption unit2 means the consumption unit of a male aboe the age of
fourteen years, and the consumption unit of a female aboe the age of fourteen years and that of
a child below the age of fourteen years shall be calculated at the rates of : and ( respectiely of
one adult consumption unit.
#-% The ,oernment may make rules prescribing,111
#a% the manner in which the cash e0uialent of the adantage accruing through the concessional
sale to a worker of foodgrains and other articles shall be computed,
#b% the registers that shall be maintained in an establishment for the purpose of securing
compliance with the proisions oft his section.

The periods of work of an employee in an establishment each day shall be so fixed that no period
shall exceed fie hours and that no such person shall work for more than fie hours before he has
had an interal of rest at least one hour.
Secti$%: 16: S'e"17$ve'
The periods of work of an employee in an establishment shall be so fixed that, inclusie of his
interal for rest, they shall not spread1oer more than twele hours in any day.

Secti$%: 11: Oe%i%. "%1 c!$si%. &$0's
#$% ;o establishment shall on any day, be opened earlier than and closed later than such hours
as may be fixed by a notification issued by the State ,oernment>
?roided that any customer who was being sered or was waiting to be sered in any
establishment at the hour fixed for its closing may be sered during the 0uarter of an hour
immediately following such hour.
Secti$%: 1*: 8ee4!# H$!i1"#s
#$% eery establishment shall remain closed for one day of the week. The employer shall fix such
date at the beginning of the year, or within thirty days from the date of commencement of
establishments, as the case may be notify it top the *nspector and specify it in a notice
prominently displayed in a conspicuous place in the establishment. The employer shall not alter
such date more often than once in three months, shall notify the alteration to the *nspector, and
shall make the necessary change in the notice in the establishment.
#)% ;otwithstanding anything contained in sub1section #$%, the State ,oernment may allow an
establishment to remain open throughout the week if it is satisfied that the establishment
employs additional staff for meeting the re0uirements of sub1section #+% of this section.
#+% &ery employee in an establishment shall be gien at least one whole day in a week as a
holiday for rest>
?roided that in establishments in which rest for one1and1a1half days in a week is allowed, such
period of rest shall be continued.
#-% *t shall not be lawful for an employer to call an employee at, or for an employee to go to, his
establishment or any other place for any work in connection with the business of his
establishment on a weekly holiday gien to the employee under sub1section #+% or on a day on
which such establishment remains closed.
#6% ;o deduction shall be made from the wages of an employee in any establishment on account
of the holiday gien to him under sub1section #+%. *f any employee is employed on daily wages,
he shall nonetheless be paid his wages for the weekly holiday.

Sae as proided bu or under any other enactment for the time being in force, no person shall
carry on, in or adjacent to a street or public place, the sale of any goods after the hour fixed
under Section $$ for the closing of establishments dealing in the same class of goods in the
locality in which such street or public place is situated>
?roided that nothing in this section shall apply to the sale of newspapers and such other articles
as may be exempted by notification by the State ,oernment
Secti$%: 1-: A!ic"ti$% $+ C&"te'
The ?roisions of this Chapter shall not operate to the prejudice of any rights to which an
employee may be entitled under any other law or under the terms of any award, agreement or
contract of serice>

?roided that where such award, agreement or contract of serice proides for a longer leae
with wages or weekly holidays than are proided in this Chapter, the employee shall be entitled to
only such longer leae or weekly holidays, as the case may be.

#$% &ery employee in an establishment shall be entitled to leae with wages and shall be to
aail such leae for the number of days calculated at the rate of.1
#i% one day for eery twenty days of work performed by him in case of an adult3
#ii% one day for eery fifteen days of work performed by him in case of a young person3
&xplanation.1 !or the purpose of this sub1section,11
#a% any day of lay1off, by agreement or contract as permissible under the standing order or for
any other reasons beyond the employer"s control3
#b% in the case of female employee, maternity leae for any number of days not exceeding
twele weeks3 and
#c% the leae earned in the year prior to that in which the leae is injoyed3s.
Shall be deemed to be days on which the employee has worked in an establishment for the
purposes of computation of leae under this section, but the employee shall not earn leae for
that period.#)% x x x x .
Secti$%: 16: 8".es 10'i%. !e"ve e'i$1
#$% !or the leae allowed to him under Section $6, an employee shall be paid at the rate e0ual to
the daily aerage of his total full1time earnings for the days on which he worked during the
month immediately preceding his leae, exclusie of any oertime wages and bonus but inclusie
of dearness allowance and the cash e0uialent of the adantage accruing through the
concessional sale to the employee of foodgrains and other articles.
#)% The cash e0uialent of the adantage accruing through the concessional sale to the employee
of foodgrains and other articles shall be computed as often as may be prescribed on the basis of
the maximum 0uantity of foodgrains and other articles admissible to a standard family.
&xplanation.1The explanations to sub1section #+% of Section : shall be applicable for purposes of
determining standard family under this sub1section.
Secti$%: 12: P"#)e%t i% "1v"%ce i% ce't"i% c"ses
An employee who has been allowed leae for not less thgan four days in the case of an adult, and
for not less than fie days in the case of a young person, shall before his leae begins, be paid
the wages due for the period of leae allowed.
Secti$%: 15: M$1e $+ 'ec$ve'# $+ 0%"i1 3".es
Any sum re0uired to be paid by an employer under this Chapter but not paid by him shall be
recoerable as delayed wages under the proisions of the ?ayment of <ages Act, $'+( #Central
Act *@ of $'+(%.
Secti$%: 19: P$3e' t$ )"4e '0!es

The State ,oernment may, to carry out the purposes of this Chapter, make rules directing
employers to keep registers containing such particulars as may be prescribed and re0uiring the
registers to be made aailable for examination by *nspectors.
Secti$%: *6: P$3e' t$ e(e)t est"b!is&)e%ts
<here the State ,oernment is satisfied that the leae rules applicable to employees in an
establishment proide benefits which in its opinion are not less faourable than those for which
this chapter makes proision, it may, by notification, exempt the establishment from all or any of
the proisions of this Chapter, subject to such conditions as may be specified in the notification.
Secti$%: *1: A!ic"ti$% $+ t&e P"#)e%t $+ 8".es Act
#$% ;otwithstanding anything contained in the ?ayment of <ages Act, $'+( #Central Act *@ of
$'+(%, #referred to in this section as "the said Act"%, the State ,oernment may, by notification,
direct that subject to the proisions of sub1section #)%, the said Act or any of the proisions
thereof as in force on the date of passing of this Act by the State Aegislature shall apply to all or
any class of employees and their employers in establishments to which this Act applies, and
thereupon, the said Act or the proisions thereof shall be applicable to the employers and
employees, as if enacted in this Act.
#)% .n the application of the proisions of the said Act to any establishment under sub1
section #$%, the *nspector appointed under this Act shall be deemed to be the *nspector
for the purpose of the enforcement of the proisions of the said Act within the local limits
of his jurisdiction.
Secti$%: **: A!ic"ti$% $+ t&e 8$'4)e%9s C$)e%s"ti$% Act
The proisions of the <orkmen"s Compensation Act, $')+ #Central Act @*** of $')+%, as in force
on the date of passing of this Act by the State Aegislature, and the rules made there under by the
State ,oernment for the time being in force shall mutatis mutandis apply to employees and
employers of shops and commercial establishments.

;o child shall be re0uired or allowed to work in any establishment.
Secti$%: */: P'$&ibiti$% $+ e)!$#)e%t $+ 3$)e% "%1 #$0%. e's$%s 10'i%. %i.&t
;o <oman, or a young person shall be re0uired or allowed to work whether as an employee or
otherwise in any establishment during nights.
?roided that the State ,oernment may, by notification exempt anyestablishment of *nformation
Technology or *nformation Technology enabled serice from the proisions of this section relating
to employment of women during night subject to the condition that the establishment proides
facilities of transportation and security to such women employees and subject to any other
condition as may be specified in the notification.2

Secti$%: *6: I%sect$'s
#$% The State ,oernment may by notification appoint such persons or such class of persons as
it thinks fit, to be *nspectors and Assistant *nspectors for the purposes of this Act within such
local limits as it may assign to them respectiely.
#)% The State ,oernment may, by ;otification, appoint such public officers as it thinks fit to be
Additional *nspectors, for all or any of the purposes of this Act, within such local limits as it may
assign to them respectiely.
#+% *n any area where there are more *nspectors than one, the State ,oernment may, by
;otification, declare the powers which such *nspectors shall respectiely exercise.
#-% The Commissioner of the Aabour in Karnataka shall be the Chief *nspector for the purposes of
this Act, for the whole of the State of Karnataka.
Secti$%: *2: P$3e's "%1 10ties $+ I%sect$'s
Subject to any rules made by the State ,oernment in this behalf, an *nspector may, within the
area in his jurisdiction,11
#a% enter, at all reasonable times and with such assistants, if any, being persons in the serice of
the State ,oernment, as he thinks fit, any place which is or which he has reasons to beliee is,
an establishment3
#b% make such examination of the premises and of any prescribed registers, records and notices,
and take on the spot or otherwise, eidence of any person as he may deem necessary, for
carrying out the purposes of this Act3 and
#c% &xercise such other powers as may be necessary for carrying out the purposes of this Act>
?roided that no person shall be re0uired under this section to answer any 0uestion or gie any
eidence tending to incriminate himself.
Secti$%: *5: I%sect$'s t$ be 0b!ic se'v"%ts
&ery person appointed or declared under Section )( to be an *nspector shall be deemed to be
apublic serant within the meaning of Section )$ of the *ndian ?enal Code.
Secti$%: *9: E)!$#e' t$ '$10ce 'e.iste's, 'ec$'1s, etc., +$' i%secti$%
&ery employer shall on demand, produce for inspection of an *nspector, all registers, records and
notices re0uired to be kept under and for the purposes of this Act.
Secti$%: ,6: Pe%"!ties
#$% <hoeer contraenes any of the proisions of Sections -,6,(, (1A, 8,',$9,$$,$),$+,$6,$(, B
B, )6 and +', shall, on coniction, be punished with fine, which, for a first offence, may extend to
one thousand rupees and for a second or any subse0uent offence, may extend to two thousand
rupees.
#)% <hoeer contraenes any of the proisions of Sections :, $8, )' and +- shall, on coniction,
be punished with a fine which may extend to two hundred and fifty rupees.

#+% <hoeer contraenes the proisions of Section )-, shall be punishable with imprisonment
for a term which shall not be less than three months but which may extend to six months
or with fine which shall not be less than ten thousand rupees, but which may extend to
twenty thousand rupees or with both, for the first offence and for the second and
subse0uent offences, he shall be punishable with imprisonment of a term which shall not
be less than six months but which may extend to one year.

#$% ;o prosecution under this Act or the rules or orders made there under shall be instituted
sae on a complaint in writing by an *nspector.
#)% ;o court inferior to that of a magistrate of the Second Class shall try any offence punishable
under this Act or any rules or orders made thereunder.
Secti$%: ,*: Li)it"ti$% $+ '$sec0ti$%s
;o court shall take cogni/ance of any offence under this Act or any rule or order made
thereunder, unless complaint thereof is made within six months from the day on which the
offence is alleged to hae been committed.

Any person who wilfully, obstructs an *nspector in the exercise of any power conferred on him
under this Act, or any person lawfully assisting an *nspector in the exercise of such power or who
fails to comply with any lawful direction made by an *nspector, shall be punishable with fine which
may extend to fie hundred rupees.

Subject to the general or special orders of the State ,oernment, an employer shall maintain
such registers and records and display on the premises of his establishment, such notice as may
be prescribed. All such registers and records shall be kept on the premises of the establishment
to which they relate.

;othing in this Act shall affect any rights or priileges which an employee in any establishment is
entitled to under any other law, contract, custom or usage, applicable to such establishment, or
any award, settlement or agreement binding on the employer and the employee in such
establishment, if such rights or priileges are more faourable to him than those to which he
would be entitled under this Act.

;o suit, prosecution or other legal proceedings shall lie against the State ,oernment or any
officer of the State goernment for anything which is in good faith done or intended to be done
under this Act.
Secti$%: ,2: De!e."ti$% $+ $3e's
#$% The State ,oernment may, by notification, authorise any officer or authority, subordinate to
it, to exercise any one or more of the powers ested in it by or under this Act, except the powers
under sub1sections #+% and #-% of Section $, sub1sections #+% and #-% of Section +, Section )9

Section )$, Section )( and Section -9 subject to such restrictions and conditions, if any, as may
be specified in the notification.
#)% The exercise of the powers delegated under sub1section #$% shall be subject to control and
reision by the State ,oernment or by such persons as may be empowered by it in that
behalf. The State ,oernment shall also hae power to control and reise the acts and
proceedings of any person so empowered.
Secti$%: ,5: P$3e' $+ :$ve'%)e%t t$ s0se%1 '$visi$%s $+ t&e Act 10'i%. +"i's "%1
+estiv"!s
.n any special occasion in connection with a fair or festial or a succession of public holidays, the
State ,oernment may, by notification, suspend for a specified period the operation of all or any
of the proisions of this Act.

#$% ;o employer shall remoe or dismiss an employee who has put in serice under him
continuously for a period of not less than six months, except for a reasonable cause and unless
and until one month"s preious notice or pay in lieu thereof has been gien to him>
?roided that where misconduct of an employee is brought on record with proof at an en0uiry
held for the purpose, he shall not be entitled to the notice or pay in lieu of such notice.
#)% An employee remoed or dismissed under sub1section #$% shall hae a right of appeal to such
officers haing jurisdiction oer such areas or such classes of employees as may be prescribed on
the ground that there was no reasonable cause for the remoal or dismissal or that he has not
been guilty of misconduct as held by the employer.

#$% The State ,oernment may, by notification, make rules to carry out the purposes of this Act.
#)% *n particular and without prejudice to the generality of the foregoing power, rules made
under sub1section #$% may proide in respect of the health and safety and welfare of employees.
#+% *n making rules under this section, the State ,oernment may proide that a contraention
of any rule shall be punishable with a fine which may extend to two hundred and fifty rupees.
#-% The power to make rules conferred by this section is subject to the condition of the rules
being made after preious publication.
Secti$%: -1: N$ti+ic"ti$%s "%1 '0!es t$ be !"i1 be+$'e t&e St"te Le.is!"t0'e
&ery notification issued under sub1section #+% and sub1section #-% of Section +, sub1section #$%
of Section )$ and sub1section #$% of Section +8 and eery rule made under Section -9 shall be
laid as soon as may be after it is issued or made before each Couse of the State Aegislature while
it is in session for a total period of thirty days which may be comprised in one session or in two
successie sessions and if before the expiry of the session in which it is so laid or the session
immediately following, both Couses agree in making any modification in the notification or rule or
both Couse agree that the notification or rule should not be made, the notification or rule, as the
case may be, shall thereafter hae effect only in such modified form or be of no effect, as the
case may be3 so howeer that any such modification or annulment shall be without prejudice to
the alidity of anything done preiously under that notification or rule.

4ombay Area, the Cyderabad Shops and &stablishments Act, $'6$ #Cyderabad Act B of $'6$%, as
in force in the Cyderabad Area, the Dadras Shops and &stablishments Act, $'-8 #Dadras ACt
BBB@* of $'-8%, as in force in the Dadras Area, and the Dysore Shops and &stablishments Act,
$'-: #Dysore Act ** of $'-:%, as in force in the Dysore Area, are hereby repealed>

be applicable in respect of such repeal and Section : and )- of the said Act shall be applicable as
if the said Acts had been repealed and re1enacted by this Act.

.n and from such date on which this Act applies to any area of the State, the <eekly Colidays
Act, $'-) #Central Act B@*** of $'-)%, shall in such area stand repealed>
?roided that such repeal shall not affect,11
#a% the preious operation of the said enactment or anything duly done or suffered thereunder3
or
#b% any right, priilege, obligation or liability ac0uired, accrued or incurred under the said
enactment, or
#c% any penalty, forfeiture or punishment incurred in respect of any offence committed against
the said enactment3 or
#d% any inestigation, legal proceeding or remedy in respect of any such right, priilege,
obligation, liability, forfeiture or punishment as aforesaid, and any such inestigation, legal
proceeding or remedy may be instituted, continued or enforced and any such penalty, forfeiture
or punishment may be imposed as if this Act had not been applied to that area.

*f any difficulty arises in giing effect to the proisions of this act in conse0uence of the transition
to the said proisions from the proisions of the Acts in force immediately before the
commencement of this Act, the State ,oernment may by notification, make such proisions as
appear to it to be necessary or expedient for remoing the difficulty.
