GOVERNMENTS MOTION TO DISMISS INDICTMENT

COMES NOW, the United States Attorney for the Southern District of Texas,
KENNETH MAGIDSON, through Assistant United States Attorney Elizabeth
Karpati, moving the Court to dismiss without prejudice the Indictment in the
above-captioned matter for the following reasons:
1. On August 20, 2014, Defendant was indicted by the Grand J ury for the
offense of Illegal Re-Entry After Deportation pursuant to 8 U.S.C.
1326(a) and (b)(1).
2. In the interest of justice, the United States now moves to dismiss the
Indictment in this case without prejudice.
3. Counsel for the defendant has not been determined.
WHEREFORE, the United States respectfully requests the Court to grant
this motion.
