ISSUE(S): Patricia Smith of the Castle in the Sand Hotel is requesting the
street end of 37

Street from the alleyway to the dune line be
closed from Friday, October 3 until Sunday, October 6, 2014, for
Rockin Ravens Weekend.

SUMMARY: This event is based around the Ravens vs. Colts football game on
Sunday, October 6, 2014.

Castle in the Sand Hotel will host a welcome reception Friday
night at Coconuts Beach Bar and Grill with live music until 9 p.m.

Saturday afternoon there is a tailgate party and pig roast on the
hotel patio and volleyball courts with a caterer and live music
until 10 p.m. Comfort stations and tables will be set up on the
east end of 37
th
St. from the alley to the dune line.

Sunday is game day with an inflatable 11 tall screen set on the
volleyball courts to view the game with live music.

FISCAL IMPACT: Potential positive economic impact from lodging, food and
beverage, recreation and other incidental expenditures related to
this event.

RECOMMENDATION: Approve as presented.

Things to Note:
This event centers around the Castle in the Sand Hotel and its outdoor property. A welcome reception Friday night at

ISSUE(S): John Tartufo of the Red Knights International Firefighters
Motorcycles Club Maryland Chapter 3 has requested to extend his
3-year event approval to include the September 11, 2016, event.

SUMMARY: This annual event is a memorial motorcycle ride to remember the
tragic events of 9/11. The ride begins at 27th Street on the
Boardwalk and proceeds to the Firefighters Memorial. There is a
short service at the Memorial. Participants then ride out of Ocean
City.

All appropriate documents have been supplied. There have been no
changes or additions requested from previous years. The event will
remain the same as in the past.

FISCAL IMPACT: Potential, positive economic impact from lodging, food and
beverage, recreation and other incidental expenditures.

RECOMMENDATION: Approve as presented.

Ocean City Private Events 3-Year Approval

Name of Event: 9/11 Parade of Brothers
Date of Event: September 11, 2016
Cost to the Town of Ocean City to support this event: $1,295.01


Things to Note:
John Tartufo for the Red Knights International Firefighters Motorcycle Club Maryland Chapter 3 was
granted a 3-year event approval for the 9/11 Parade of Brothers. The dates approved were September 11 in
the years 2013, 2014 and 2015.
John Tartufo for the Red Knights International Firefighters Motorcycle Club Maryland Chapter 3 would
like to continue this provision, and requests Council approved this event for September 11, 2016.
All appropriate documents have been supplied and fees have been paid.


Comments from Department Representatives:
PUBLIC WORKS: This event has been ongoing for many years. Will provide a PA system with podium
at North Division Street, post the south side of North Division Street no parking from 6:00 am until 2:00
pm, place six (6) American flags around the memorial, and place cones from Mikes Bikes to the Concrete
Pad to allow bikes clear passage. Expected cost to the department for this event is $945.01.
OCPD Will assign two (2) officers to lead/follow the event, and to escort over the Route 50 Bridge.
Approximate cost to the department is $350.00.
RISK MANAGEMENT Annual event without any incidences. Insurance to be obtained and certificate
submitted prior to event. Hold harmless to be signed.
FIRE MARSHAL, TRANSPORTATION, TOURISM, OCBP, PUBLIC WORKS, EMERGENCY
SERVICES, OCCC and REC & PARKS No comments, concerns or costs.

ISSUE(S): Jay Knerr, on behalf of the Maryland International Kite Expo.,
Inc., requested the 3-year event approval be extended to include
Sunfest Kite Festival on September 22-25, 2016.

SUMMARY: This event consists of kite competitions, games, mass kite
ascensions, workshops, kite flying displays and music being
played from a sound system.

Beach Patrol requests the following:

1) The event set up at least 30-feet from the concrete pad and
ensure this area stay open and free of spectators.
2) The event not interfere with patrol of the beach.
3) The flying area not extend to the jetty, so SRTs may get
around this area in case of an emergency.
4) Playing fields must also not extend any further than the
wooden walkways that run perpendicular to the Boardwalk.

FISCAL IMPACT: Potential positive economic impact from lodging, food and
beverage, recreation and other incidental expenditures related to
this event.

RECOMMENDATION: To approve the continuation of the 3-year event approval with
staff caveats.

Ocean City Private Events 3-Year Approval

Name of Event: Sunfest Kite Festival

Things to Note:
Jay Knerr for the Maryland International Kite Expo was granted a 3-year event approval for the Sunfest Kite Festival.
The dates approved were for September 19-22, 2013, September 18-21, 2014 and September 24-27, 2015.
Jay Knerr for the Maryland International Kite Expo would like to continue this provision, and requests Council
approves this event for the date of September 22-25, 2016.
All appropriate documents have been supplied and fees have been invoiced.


Comments from Department Representatives:
Public Works The organizer is requesting PW deliver 30 tables and 100 chairs to the Kite Loft on 5
th
Street. Please
note the department only has 30 chairs available for this event. Therefore, request additional chairs be supplied by
R&P if all are not being used for Sunfest.
Transportation Boardwalk trams will be in operation during the event.
Rec. & Parks Volleyball poles and light poles may be in the festival footprint. The nets can come down, but the
posts will remain in place. Also, does not have any chairs available for private event use.
Risk Annual event without incidences. Insurance certificate to be obtained and submitted naming TOC M&C as
additional insured and hold harmless agreement signed prior to event.
OCBP It is imperative that as beach events set up they do not interfere with the normal patrolling of the beach for
safety or beach patrons who are there to enjoy a day at the beach and are not a part of the kite event. They must set up
at least 30-feet off the eastern most edge of the train lane or the Boardwalk to allow BP vehicles to enter, exit and
traverse the beach. They must also take responsibility to keep that area open and that their spectators do not set up in
that area. They must also assure the north end of the flying area does not extend to the jetty and leave ample room for
families setting up on the beach. In previous years they have left NO way to get around the jetty without having to
drive in their marked off areas. In an emergency, this could cost valuable response time. Also, they must not extend
their areas any further east than the wooden walkways that are placed perpendicular to the Boardwalk and extend to
the waters edge. This allows a buffer zone between the flying area and the beach patrons who are not involved with
the event. This also allows an area of beach that is clear between the event and the beach patrons, and is used for an
emergency vehicle response lane. Recent changes in the width of the beach will make co-existing with the normal
beach population very difficult. Participants in the Sunfest Kite festival must understand that there are others who will
be using the beach that are not here for the festival and should conduct themselves accordingly.

ISSUE(S): Purchase Microsoft Software Assurance licenses for FY 15

SUMMARY: FY 15 budget includes software licenses for 50 new Virtual Desk top
stations. Each station requires Microsoft Office and operating
system licenses. SHI holds the Maryland State Contract for this
software (Contract #060B2490024).

FISCAL IMPACT: $11,381 ($10,900 included in FY15 Budget, overage will be offset
by savings from corresponding hardware purchase which was $744
under budget)

ISSUE(S): FY15 Annual Concrete Sidewalk Repair and Replacement Contract

SUMMARY: Bids for the FY15 Concrete Maintenance Contract were opened at
the August 26 work session. The low bid for this work was
tendered by Worth Construction, Inc. in the amount of
$ 64,300.00. I have reviewed Worths bid documents and found
them compliant with the contract documents.

FISCAL IMPACT: Funding is covered by each Department that has concrete
sidewalk work in their respective FY 2015 Budget.

RECOMMENDATION: Proceed with bid award to Worth Construction, Inc.

RE: Continuation of public hearing to close and sell City right-of-way
DATE: August 13, 2014


ISSUE(S): Public hearing to close and convey portion of Seabay Drive north
of 61
st
St. and request to convey portion of land along west side
of Tennis Center property (continuation from August 18, 2014).

SUMMARY: The developer of the old OC Health and Racquet property is
interested in acquiring a portion of the Seabay Drive Right-of-
Way between 61
st
Street and the State Highway Rt 90 Right of
Way along with an adjacent 20 strip of land at the tennis center.

The Notice of the Public Hearing was advertised in the local
paper and mailed to all property owners within 500 of the site.

FISCAL IMPACT: To be determined.

RECOMMENDATION: Staff has no objection to the closure and sale with the following
comments:

1) Developer provides an access easement to the city over the 8
landscape buffer for occasional maintenance of the tennis courts
and a potential future well site.
2) Improvements to 61
st
Street as shown and potential shared
use of the parking spaces with the tennis center be part of the
future sale negotiations.
3) The dedicated tree to Lucinda Kurtz is preserved in either its
current location or relocated in the immediate vicinity
4) The next steps will be to have the property appraised at the
developers expense and negotiate a sale price.

POLICY AND PROCEDURE MANUAL

SECTION: Property Management
PPM 700-1 SUBJECT: Sale of Real Property

In accordance with the Ocean City Charter C-414 Powers of Council Enumerated, The
Council shall have, in addition, the power to pass ordinances not contrary to the laws
and Constitution of this State, for the following purposes:
. . .

(49) Property To acquire by conveyances, purchase or gift, real or leasable property
for any public purposes; to erect buildings and structures thereon for the benefit of the
town and its inhabitants; and to convey any real or leasehold property when no longer
needed for public use, after having given at least twenty (20) days public notice of the
proposed conveyance; to control, protect and maintain public buildings, grounds and
property of the town.

Based upon this charge, the following policy is hereby adopted with regard to disposal
of municipal property.

1. When the Council decides that property no longer serves a public purpose it shall
cause a public hearing to be scheduled with a 20-day notification period. If an
individual, or other legal entity, wishes to purchase public property that is
believed to no longer serve a public purpose, they may appear before the
Council for a determination on whether to proceed to a public hearing on the
specific property. If the request is initiated from an individual or other legal entity,
that individual or entity shall pay the cost of advertising for the public hearing
notice.

2. Once the public hearing is completed, the Mayor and Council will cause an
appraisal to be done of the property. The cost of the appraisal will be borne by
the Town if the proposed sale was initiated by the Town or by the proposed
buyer if initiated by them.

3. Upon receipt of the appraisal, the Mayor and Council will review the appraisal
and either negotiate the price, terms and conditions with the proposed buyer or
put the property out for public bid or public auction.

4. If the property is put out for bid or auction, a notice shall be placed in the paper of
record notifying interested parties of the property offer. Bids shall be submitted in
a sealed bid format to the City Managers office by noon of the day due.

5. The Mayor and City Council shall open bids at their work session. The Town
reserves the right to reject any and all bids.

6. If a determination is made to accept the high bid, the Council shall direct the City
Solicitor to draft the appropriate ordinance allowing the conveyance of the
property.

7. Settlement shall occur no later than 90 days after the passage of the ordinance.
