Defender, Attorney Yossi Saka, refuses to answer on Defendant Rotem's
demands
For over a decade the courts have been abusing whistle-blower Rafi Rotem. The
refusal of Attorney Yossi Saka, who purports to appear as Public Defender, to
answer on Rotem's reasonable demands, pertaining to a hearing, scheduled for
next Monday, increase the concern of perversion of justice and Fraud upon the
Court. The time has come for the National Public Defender, Attorney Dr Yoav
Sapir to intervene in what is taking place in the Tel Aviv Magistrate Court!

OccupyTLV, September 12 - for over a decade, the courts have been abusing whistle-blower
Rafi Rotem. In parallel, all justice and law enforcement agencies are refusing to investigate the
corruption of senior officers in the Tax Authority, which he exposed, and to provide Rotem
equal protection under the law.
Now, Rotem is criminally prosecuted by the Tel Aviv Police (in Israel, police can prosecute!)
for "insulting public employees".
A series of attorneys appeared in the Tel Aviv Magistrate Court, purportedly through the Public
Defender's office, but none of them filed a Certificate of Counsel of Record in court, and none
of them was duly appointed or replaced by Judge Yael Pradelsky.
Moreover, the conduct of such attorneys as counsel of defendant Rotem raise serious concern
of perversion of justice and Fraud upon the Court.
For example, one of these attorneys, Sadeh, purportedly provided his consent without the
Defendants knowledge or agreement, for conduct pursuant to Article 144 of the Criminal
Procedure Law, which permits admission of evidence without witnesses. However, the
evidence suggests that the minutes and decision in this matter were falsified by Judge
Pradelsky and were also never duly served, leaving them of dubious force of effect.
After purported Public Defender Attorney Yossi Saka clarified that he was in conflict of
interest, relative to representing Rotem, and that he was seeking to be relieved from Rotem's
representation, Rotem instructed Saka in writing:
a. That Rotem objects to Attorney Saka representing him on Monday's hearing in any matter,
except for Saka's request to be relieved from representation of Rotem, and

b. That Rotem demands to receive from Attorney Saka within 7 days copies of all papers in this
case, which are in Attorney Saka's possession.
Letters in this regard were forwarded to Attorney Saka by fax and by email. Verbally, Attorney
Saka confirmed their receipt. However, when attempt was made to serve his my hand with such
letters, he refused to accept them...
Now, Attorney Saka refuses to address Rotem's demands.
Following is the latest correspondence in this matter.
The time has come for National Public Defender Attorney Dr Yoav Sapir to intervene in what is
taking place in the Tel Aviv Magistrate Court under his authority and responsibility!
One should also hope that media will appear on Monday in the Court to cover what will take
place there, in view of these latest developments.

However, I cannot find in your response any reference to Mr Rotem's letters in the following
matters:
a) Pursuant to Mr Rotem's objection and your statement of Conflict of Interest, will you abstain
from representing Rotem in the hearing on Monday in any matter, except for your request
to be replaced by another attorney, duly appointed?
b) Would you comply with Mr Rotem's demand to accept copies of all records in this case,
which are in your possession, as requested and within the time requested?
Your immediate response in these matters is essential for the safeguard of the fundamentals
of Fair Hearing in a case, where Defendant's Liberty may be deprived.

case was forwarded to the Public Defender's office for assigning a new attorney for
your representation by them. Indeed, the hearing, which was scheduled for
September 15, 2014, was scheduled by initiative of the Court and not by my
