Definition of Wages:

According to section 2(45) of the Bangladesh Labor Code 20006, wages means all
remuneration which is expressed in forms of money. It also includes any bonus or other
additional remuneration of a worker. But the followings are not included within the definition of
wages:
a) The value of any house accommodation supply of light, water, medical attendance or any
other service provided by the employer;
b) Any contribution of the employer to any pension fund or provident fund of a worker;
c) Any travelling allowance;
d) Any sum of money paid by employer to defray especial expenses.

Time of payment of wages: According to section 123 and 124:-
i. The wages of every worker shall be paid before the expiry of the seventh day after the
last day of the wage-period.
ii. Where the employment of a worker is terminated by retirement or retrenchment,
discharge, removal, dismissal or any other reason, then the wages which is earned by him
shall be paid within seven working days from the day of his termination.
iii. All payments of wages shall be made on a working day.
iv. All wages shall be paid in currency money or in bank cheque.

Rules relating to deduction from wages:
According to section 125(1), the following rules relating to deduction from wages of the
workers:
1. Fines imposed under section 25;
2. Deductions for absence from duty;
3. Where any goods or money is expressly entrusted to a worker neglectly damages or
losses that goods or money, then wages shall be deducted from his total wages.
4. Deductions for house accommodation supplied by the employer.
5. Deductions for such services supplied by the employer as the government may authorize.
6. Deductions for recovery of advances received by the worker.
7. Deductions for income-tax.
8. Deductions for any order of a court or other authority competent to make such order.
9. Deductions for payments to co-operative societies approved by the government.
10. Deductions for payments to a scheme of insurance maintained by the Bangladesh post
office.
11. Deductions for contributions to any fund which is formed for the welfare of the workers.
12. Deductions for contribution to CBA.
Appeal: section-135
1. An appeal against the order of the Labor Court under section 132 may be preferred before
the Tribunal within 30 days from the date of order.
2. The employer shall not lie any appeal against the order of a labor court to the tribunal if
the total sum of money which is directed by the labor court to pay the workers through
wages or compensation does not exceed one thousand taka and similarly the workers
shall not lie any such appeal if the sum of money does not exceed five hundred taka.
3. An appeal made by the employer shall be refused if the employer has not deposited the
money with the memorandum of appeal.
4. If any appeal is not made under section 132 of this code, then the order of the labor court
shall be final.
5. The provision of section 5 of the limitation Act, 1908 shall be applicable to appeals under
section 132 of the Bangladesh Labor Court.
It is relevant to discuss the provision of section 132 of this code. This section prescribe some
rules relating to claims arising out of deductions from wages of the workers or delay in payment
of wages to the workers can claim before the Labor Court.
