TO THE HONORABLE JUDGE OF SAID COURT:
COME NOW JERRY JONES AND THE DALLAS COWBOYS FOOTBALL CLUB.
LTD., Defendants in the above-styled and numbered cause ("Defendants"), and file this
Emergency Motion for Temporary Sealing Order (the "Motion"). In support t h r o f ~ Defendants
would respectfully show the Court as follows:
I.
1. Courts have recognized that the public has a common law right to inspect and
copy judicial records. Nixon v. Warner Commc 'ns, Inc., 435 U.S. 589, 597 (1978); Bela Broad.
Corp. v. Clark, 654.F.2d 423, 429 (5th Cir. 1981). However, the public's common law right is
not absolute. Nixon, 435 U.S. at 598; see Bela, 654 F.2d at 430. "Every court has supervisory
power over its own records and tiles, and access has been denied where court files might have
become a vehicle for improper purposes." Nixon, 435 U.S. at 598. Thus, the co1nmon law merely
establishes a presumption of public access to judicial records. SEC v. Van Waeyenberghe, 990
F.2d 845, 848 (5th Cir. 1993). While other circuits have held that there is a strong presun1ption in
favor of the public's common law right of access to judicial records, the Fifth Circuit has refused

to assign a particular weight to the right. See Bela, 654 F.2d at 434 ("[T]he presumption-
however gauged-in favor of public access to judicial records-[ is] one of the interests to be
weighed.").
2. In Texas, the standard for sealing court records is found in Rule 76a of the Texas
Rules of Civil Procedure. Under Rule 76a, court records may be sealed if there is a ''specific,
serious and substantial interest" that outweighs the presumption of openness and any probable
adverse effect that sealing will have on general public health or safety. See TEX. R. Civ. P. 76a.
In this case, the interests favoring nondisclosure far outweigh the presumption of openness and
any probable adverse effect that sealing will have on general public health or safety.
Accordingly, Defendants hereby move to seal the court records in the above-styled cause.
II.
3. Plaintiff filed the instant lawsuit on September 9, 2014 against Defendants Jerry
Jones and the Dallas Cowboys Football Club, Ltd. The lawsuit contains salacious allegations
against Mr. Jones, a prominent member of the Dallas con1n1unity. The outrageous allegations
against Defendants have no factual basis whatsoever. Sin1ply put, they are false.
4. Plaintiff filed Plaintiff's First Amended Original Petition ("Plaintiff's Amended
Petition"), in which Plaintiff added as defendants Levi McCathern and the McCathern Law Firm,
on September 22, 2014. Plaintiff's Amended Petition contains even more defamatory, false
statements regarding Defendants. Plaintiff's Amended Petition was filed after the Court entered
an order requiring that Plaintiff brief the legal analysis, theories, factual basis and precedent that
supports any of Plaintiff's pleas in avoidance of the statute of litnitations tolling argun1ents. In an
attempt to rectify same, Plaintiff makes the conclusory allegation that but-for Defendants'
actions, Plaintiff would have filed her lawsuit well before any applicable statute of limitations

deadlines.

Although one would expect Plaintiff to have personal knowledge regarding payments
made to her over the course of 3 years, Plaintiff contends, "'[u]pon information and belief,
Defendants ... sent payments to Plaintiffs bank account from 2009 at least through July 2013."

Plaintiff further contends "'each payment to Plaintiff constitutes a new accrual date" for purposes
of the statutes of limitations.

Like Plaintiffs original petition, it is readily apparent that
Plaintiffs Amended Petition is deficient on its face and the claims asserted therein are barred by
the statute of limitations.
5. On or about Septen1ber 9, 2014, Defendants filed Defendants' Emergency Motion
to Seal Court Records, which motion was granted on the same date. The Ten1porary Order
Sealing Court Records was vacated.
6. After the original petition was filed, this lawsuit received substantial publicity and
excessive attention from the media. See Exhibit A, Affidavit of Matthew Valeriane, and Exhibits
A-1 through A-23 thereto. One article on Deadspin.com, titled Woman Who Took Jerry Jones
Pies Files Lawsuit Alleging Sexual Assault, which attaches a copy of the petition, has been
viewed by almost 200,000 people.

There are over 140 comments to the article, and the article
has been shared on the social media over 1,200 times.

regarding the lawsuit have over 4 70, 460, 586, 410, and 566 comments respectively, for a
total of 3,332 comments on just these six (6) articles.
7. "This Court has a duty to preserve the defendant's right to a fair trial by an
in1partial jury and, if possible, to ensure that potential jurors will not be prejudiced by pretrial
publicity." In re Houston Chronicle Publ. Co., 64 S.W.3d 103, 108 (Tex. App.-Houston [14th
Dist.] 2001, orig. proceeding). Here, such pretrial publicity is no longer a reasonable prediction
based on the scandalous nature of the allegations and the high-profile defendants involved, but is
certain and already demonstrated by the pretrial publicity of the case thus far. Due to the already
considerable amount of national publicity surrounding the case, and in the interests of justice, an
order sealing the court records is warranted. See United States v. Richard, 943 F.2d 115, 118-19
(1st Cir. 1991) (holding that concerns about the defendants fleeing and excessive trial publicity
were legitin1ate reasons to seal an indictment), cited with approval in United States v. BP Prods.
N. Am. Inc., No. H-07-434, 2008 U.S. Dist. LEXIS 12893, at *54 (S.D. Tex. Feb. 21, 2008).
8. Moreover, if the records in this case are not sealed, Defendants will be
significantly harmed in their business. The potential for dire consequences is substantial.

business community, will be substantially harmed. This lawsuit, which has been pending for less
than a month, has already been described as a "highly publicized legal case."

Com1nentators
have acknowledged that the lawsuit "has made international news as details are being
revealed."

Commentators have opined that "[ e ]ven if the charges are lies, they come at a very
bad time for Jerry Jones and the NFL" and the "Dallas Cowboys may take a hit on this when it
cmnes to public perception."

9. Defendants respectfully request this Court immediately sign a Temporary Order
Sealing Court Records, sealing the record of this case, to include any and all pleadings, motion
and discovery itetns that may be filed in the papers of this cause until such time as Plaintiff can
produce sufficient admissible evidence that the outrageous allegations contained in her pleadings
have merit; and upon hearing, sign an Order Sealing Court Records.
10. Plaintiff has accused Defendants of unfounded but very senous and salacious
actions. Such accusations shock the conscience and are extremely inflamn1atory. The sealing of
these records does not have an adverse effect on general public health or safety, as the
accusations made are being used solely for scandalous and libelous purposes. In addition, no less
restrictive means than sealing records will adequately and effectively protect the specific interest
asserted because any public access to the accusations and information contained in the pleadings,
with no evidence of their merit, would cause and has caused immediate and irreparable harm to
Defendants, to Defendant's family, to Defendants' reputation in the community, and would
result in incalculable damage to Defendants' business interests.

11. Rule 76a of the Texas Rules of Civil Procedure authorizes the issuance of a
temporary sealing order upon motion and notice to the parties upon a showing of compelling
need that immediate and irreparable injury will result to a specific interest before notice can be
posted and a hearing held. Here, immediate and irreparable injury will result to Defendants,
Defendant's family, Defendants' reputation in the community, and Defendants' business
interests before notice can be posted and a hearing held. Therefore, it is respectfully requested
that this Court immediately issue a temporary sealing order.
12. In this case, the interests favoring the nondisclosure far outweigh the public's
common law right of access. Plaintiff has accused Defendants of unfounded but very serious and
salacious criminal actions against her. Such accusations shock the conscience and are extremely
inflammatory. The accusations made against not only the Movant but also a multitude of other
individuals and corporate entities in Plaintiff's pleadings could all be used for scandalous or
libelous purposes. Public access to the accusations and information contained in the pleadings,
with no evidence of their merit, would cause immediate and irreparable harm to Defendants, to
Defendant's family, to Defendants' reputation in the community, and would result in
incalculable damage to Defendants' business interests.
WHEREFORE, PREMISES CONSIDERED, Defendants JERRY JONES and the
DALLAS COWBOYS FOOTBALL CLUB, LTD. respectfully request the Court to seal all
records pertaining to this proceeding, including all pleadings, motions and discovery items that
may be filed or unfiled in the papers of this cause, and for such further and additional relief, both
at law and in equity, to which they may be justly entitled.

apparently too much resistance from Weckerly, Jones did what perhaps billionaires do. He had
his large personal security men lift Weckerly and the two other women from the ground and pack
them out of the club.
Jones started out as friendly guy with a desire to party. He offered to put his super bowl
ring on Weckerly's finger. He even posed with a kneeling woman after she spent special time
with him with his shirt out and his pants unzipped.
Weckerly did not know Jones and agreed to meet him as suggested by the other two

everyone to go dancing. As the night progressed and alcohol kicked in, Weckerly became
increasingly uncomfortable and continued to refuse Jones' advances. Throughout the evening
with Weckerly and the other ladies, Jones moved with large security men.
After being forcefully removed from the club, Weckerly was humiliated, fearful and
angry. No one challenged Jones and his disrespectful behavior. Weckerly cried and wondered
how she could fight and win against a billionmre.
Now, Jones continues to use wealth, power and influence to explam away the photos as a
"misrepresentation." On the contrary, the photos were a prelude to Jones' sexual, unwanted and
illegal use of hands against Weckerly. Weckerly can prove it and was never part of an extortion
plot against Jones.

The lawsuit claims that on the evening when the photos were taken, back in 2009, Jones repeatedly
groped Weckerly, forcibly penetrated her vagina with his fingers, and made her watch as he received oral

quiet about what happened, and coerced her into signing some sort of non-disclosure agreement. You

knowingly wanted Plaintiff to see said oral sex act. Plaintiff did not want to see Defendant

OK, for everyone who missed the original story, the woman in the picture is NOT the woman we are
talking about. The woman we are talking about is the woman who took the picture. According to the
original article, as far as I can remember, she is a friend of the women who are in the pictures, and on the
evening in question she went out with her friends. Sometime during the evening, they ran into Jerry at a
bar or club, and the friends hooked up with him, and while the friends had fun with Jerry (shiver) she
took pictures for them and then, well, then .... apparently she got sucked into a horrible alternate reality
sponsored by the nightmare demons of football culture. So, just for clarity, the woman in the picture is

An attorney for Jones denied the accusations made against one of the best-known team

"These allegations are completely false," attorney Levi McCathern said on Wednesday. "This

unless of course, you're doing something illegal. I think the time frame of 5 years, she thinks, speaks

accused of sex assault; attorney denies
STORY HIGHLIGHTS (CNN) --A former exotic dancer has filed a lawsuit against Dallas
Cowboys owner Jerry Jones, accusing him of sexual assault.
In the suit filed Monday in Dallas County, Jana Weckerly claims that
Jones assaulted her in 2009 and that the Dallas Cowboys knew
about and covered up the incident.
Weckerly is seeking "monetary relief of over $1 ,000,000," according
to the suit.
Reaction from the Cowboys was swift
Levi McCathern, an attorney representing the team, called the
allegations "completely false" and "a shakedown.
"The legal complaint is unsupported by facts or evidence of any
kind," McCathem said a written statement. 'This is nothing more
than an attempt to embarrass and extort Jerry Jones."
Weckerly's attorney says his client is in hiding. The suit claims that
the 2009 incident caused the 27-year-old to fear for her life.
In the aftermath, the suit says, Weckerly has suffered depression,
dealt with substance abuse and has attempted suicide.
The suit is not clear on exactly when the alleged assault occurred,
saying it happened "sometime in May or June." But the suit alleges
that the owner penetrated Weckerly with his fingers and forced her to
touch his genitals without her consent.

the owner and generaltnanager, claiming was sexually assaulted.
"These allegations are con1pletely false," Jones' attorney Levi McCathem

A woman in Dallas filed a lawsuit this week that accuses owner Jerry Jones of
sexual assault. The woman, Jana Weckerly, claims she was the person
of Jones that were released in August.
Weckerly alleges that the sexual assault happened on the night the pictures were taken in
June 2009. In the lawsuit, Weckerly claims that Jones "forcibly touched her butt, forcibly
touched her breasts, forcibly kissed her and forcibly touched her genitals."
Weckerly, 27, is seeking more than $1 million in damages.
The Cowboys are also named as a defendant in the lawsuit. The team is being sued for
"failing to investigate the allegations" and "failing to report the crimes to law enforcement,"
among other things.
In Jones' lawyer, Levi McCathern, called the allegations
"completely false." McCathern also called the lawsuit a "money grab."

accused of sexual assault by a former exotic dancer in a lawsuit filed in a Dallas court,
Sports Illustrated reported on Tuesday

Thomas D. Bowers, an attorney for Jana Weckerly, filed the suit in district court on
Monday, according to a copy of the lawsuit obtained by Sl (http:/ /cdn-

In it, Weckerly claims Jones forcibly grabbed and kissed her ~ ~ s o m t i m in May or June
2009," and performed sexual acts both on Weckerly and with another woman in the
presence of Weckerly, all without Weckerly's consent.
Levi McCathern, an attorney for Jones, denied Weckerly's claims in a statement
forwarded to Pro Football Talk on Tuesday

reportedly were part an alleged extortion plot and to which jones last month

misrepresented photos taken at a restaurant five years ago for their own purposes.

Those photos first came to light in a bizarre, rambling manifesto by a Kansas man

The lawsuit names both Jones, 71, and Dallas Cowboys (/nfl/team/dallas-
cowboys/67043) Football Club Ltd., as defendants and claims Weckerly underwent
llsevere emotional distress" and suffered "severe injuries as a direct and proximate
result" of Jones' "extreme and outrageous conduct."
The suit also claims that Jones and the Cowboys conspired to cover up the assault,
threatening, bullying and intimidating Weckerly, and demands damages of more than
$1 million.

happened more than 5 years ago, it is past the statute of limitations for this type of complaint. Jerry may have
some splaining to do at home but this should not go any further than it has.

infractions of the law and are not guilty of anything. With cameras even in elevation what we need is a right
to privacy. When a person commits an act of aggression towards another person a negative response should
be expected. If either of these two were cops nothing would be said. A few weeks ago a cop beat a poor,
homeless, defenseless, old woman yet in a couple of weeks there is not a single mention of that in the news.
We need more privacy in this country.

A spokesman for Jones, who has been married for 50 years, said the photographs were part of 'a shake down'
According to the two women in the photographs are former strippers from Dallas called
Lindzie, blonde and Jordan, brunette. The pair are understood to be consulting their own lawyers.
Ms Weckerly claimed that Jones had 'forcibly rubbed' or grabbed her buttocks and breasts multiple
times without her consent.
The 27-year-old former exotic dancer also claims that Jones forced her to 'touch/and or rub' his penis
and that 'forcibly penetrated' her with his fingers.
The court document said that Jones forced her to watch a second woman perform a sex act on him.
According to the document, seen my MaiiOnline: The conduct of defendant Jerry Jones was in
violation of state and federal criminal statutes regarding sexual abuse.'
Ms Weckerly claims that Jones' actions constitute 'extreme and outrageous conduct', accusing both
the businessman and the football club of intentionally causing 'severe emotional distress'.
The law suit also claims that the Dallas Cowboys failed to supervise Jones properly and should have
introduced 'policies for the protection of females'.
The document said: The reputation of Jerry Jones and Cowboys and the desire to avoid scandal were
vastly superior and more important to the Cowboys than the welfare of the plaintiff and other victims
who have been sexually abused by Jerry Jones.'

Ms Weckerly accused the Dallas Cowboys of 'fostering an environment and culture where abuse of
females could flourish'. She said Jones had 'dangerous sexual propensities' towards women.
The court document also claims that Jones and the Dallas Cowboys tried to cover up the alleged
assault while Ms Weckerly said she was in fear for her life.

Jones told the paper: 'Someone has misrepresented photos taken at a restaurant five years ago for
their own purposes. I'm just not going to comment on it.'
However, Ms Weckerly's lawyer Thomas Bowers said his client was in counselling and is taking
medication to cope with the trauma.
He said: 'If anybody did something wrong, it was the Cowboys and Jerry Jones," Bowers said.
"Sometimes powerful people think they can get by with anything.
'It's amazing how athletes are held to a different standard than the owners, who are allowed to do
things an athlete would probably lose his job for. So, it'll be very curious to see what the league
does with this.'
However, the Dallas Cowboys dismissed Ms Weckerly's claims. In a statement issued to
club spokesman Rich Dalrymple said they would be contesting the case.
He said: 'These allegations are completely false.
'This is nothing more than an attempt to embarrass and extort Jerry Jones. This is a shakedown by
a lawyer who is a solo practitioner just trying to make a name for himself.The alleged incidents
would have been more than five years old. We intend to vigorously contest this complaint and
expect it will be shown for what it is- a money grab. Due to the seriousness of these baseless
allegations, we have also involved law enforcement.'

A lawyer for said a lawsuit filed against the Dallas Cowboys owner
that accuses him of sexual assault is a "money grab" and an attempt to extort
Jones.
The lawsuit was filed by 27, a former exotic dancer from Ardmore,
Oklahoma, who said Jones fondled her genitals in June 2009 at a Dallas hotel and
forced her to watch while Jones, then 66, received oral sex from another woman,
the Da lias Morning News reported.
Weckerly is seeking $1 million in damages, according to the suit.
She is the person who took photographs of Jones with two other women that
were released on the Internet earlier this year, the Morning News said.
When those photos were released last month as part of a manifesto by
Wichita, Kansas, Jones said the photos "misrepresented" what
happened that night.
Jones' lawyer, said the court sealed the case on Tuesday, the
Morning News reported.
McCathern released this statement, the Morning News said: "These allegations
are completely false. The legal complaint is unsupported by facts or evidence of
any kind. This is nothing more than an attempt to embarrass and extort
is a money grab by a lawyer who is a solo practitioner just trying to
make a name for himself. The alleged incidents would have been more than five
years old.
"We intend to vigorously contest this complaint and expect it will be whow for
what it is-- a shakedown. Due to the seriousness of these baseless allegations,
we have also involved law enforcement."
Weckerly's lawyer, of Dallas, said Weckerly has been in
counseling and taking medicine to help her deal with the trauma from the

incident, the Morning News reported.
He said the incident occurred at a five-star hotel in Dallas.
Bowers said that after the alleged incident, Jones and the women went to a
dance floor, where Jones continued to make advances.
"After apparently too much resistance from Weckerly, Jones did what perhaps
billionaires do," the Morning News quoted Bowers in a release. "He had his large
personal security men lift Weckerly and the other two women from the ground
and pack them out of the club."
The Morning News said it could not reach Weckerly on Tuesday and that a
spokesman for the National Football League declined to comment.

It's just that his three interceptions in a disastrous return for Dallas raised all sorts of questions that
haven't come up before.
Was he ready or rusty? Can he still make all the throws coming off a herniated disk? Will he ever be
the same?
Maybe the more important issue is how he bounces back from a 28-17 loss to San Francisco with the
Cowboys needing the good Romo more than ever because of big questions about their defense.
"I think that it's easy to be critical because of those turnovers there, the early turnovers,
owner Jerry Jones said after Romo threw all three picks in the first half
"I don't know if the turnovers hurt us any worse than when we had turnovers in the years when he
didn't have back problems."
Romo had issues beyond the interceptions. He was jumpy in the at times, and a easy
target on all three sacks for the 49ers. He wasn't in sync with his receivers several times, and missed
badly on some throws.
Watching him struggle made it difficult to forget that he didn't get any work in the
offseason and took frequent days off during training camp. Most starters get three preseason games,
even if for just a handful of snaps in the first one. Romo only in two exhibition games this year.
Still, coach Jason Garrett isn't a big believer in the rust factor.
"You guys can go back and count up the plays he played last year in the preseason relative to the
plays he played this year. I bet it's pretty similar," Garrett said Monday. "Was he as sharp as he's
been in his life? No. He made some bad decisions in this game that really hurt us. There were some
other throws that weren't perfect. But there were some good throws too."
Before Sunday, Romo had never thrown more than one interception in an opener. And
previous seasons has he followed a three-interception game with more than one

for 281 yards with a late touchdown. "There were a couple of bad decisions that I made that I have to
go back and correct going forward."
That starts Sunday at the Tennessee Titans, who intercepted Alex Smith three times in a 26-10 win
over Kansas City.
"Tony will be fine," said tight end Jason Witten, who was limited to two catches for 14 "He'll

Dallas Cowboys owner Jerry Jones is fighting allegations made by a former exotic
dancer who claims he sexually assaulted her in 2009.
In the civil complaint filed Monday, Jana Weckerly is seeking more than $1 million
damages. She alleges in the complaint that Jones grabbed her breasts and buttocks
multiple times without her consent. She also alleges that Jones forcibly kissed her
and made her watch as he received oral sex from another woman.

The suit states the alleged incident occurred sometime in May or June of 2009 and
that the Dallas Cowboys knew about it and covered it up. The suit claims Weckerly
has dealt with depression, substance abuse and suicide attempts.
Levi McCathern, attorney for the Dallas Cowboys, released a statement Wednesday
in response to the lawsuit brought against Jones.

The allegations come as the NFL is reeling from another scandal. Ray Rice was cut
from the Baltimore Ravens and indefinitely suspended from the NFL on Tuesday
after of the running back knocking out his then-fiancee and now-wife

Jones is not the only NFL owner under scrutiny. Indianapolis Colts owner Jim lrsay
is currently serving a six-game suspension after he pleaded guilty to a misdemeanor
count of operating a vehicle while intoxicated. lrsay was also fined $500,000, the
maximum allowed under league rules.

(CNN) -- A former exotic dancer has filed a lawsuit against Dallas Cowboys owner Jerry
Jones, accusing him of sexual assault.
In the suit filed Monday in Dallas County, Jana Weckerly claims that Jones assaulted her in
2009 and that the Dallas Cowboys knew about and covered up the incident.
Weckerly is seeking "monetary relief of over $1 ,000,000," according to the suit.
Reaction from the Cowboys was swift.
Levi McCathern, an attorney representing the team, called the allegations "completely false"
and "a shakedown."
"The legal complaint is unsupported by facts or evidence of any kind," McCathern said in a
written statement. "This is nothing more than an attempt to embarrass and extort Jerry
Jones."

Weckerly's attorney says his client is in hiding. The suit claims that the 2009 incident caused
the 27-year-old to fear for her life.
In the aftermath, the suit says, Weckerly has suffered depression, dealt with substance
abuse and has attempted suicide.
The suit is not clear on exactly when the alleged assault occurred, saying it happened
"sometime in May or June." But the suit alleges that the owner penetrated Weckerly with his
fingers and forced her to touch his genitals without her consent.
McCathern pledged to fight the complaint. He added that law enforcement is now involved
"due to the seriousness of these baseless allegations."
What if Roger Goodell ran the NBA and Adam Silver captained the NFL?
The allegations against the Cowboys owner is the latest distraction for the NFL, pulling the
spotlight from its early season games.
Ravens running back Ray Rice was cut from the team and indefinitely suspended from the
league this week after video surfaced showing the moment he delivered a punch to his then-
fiancee that knocked her out.
The league was ridiculed by some for initially suspending Rice for only two games, a
position it did not change until after the video was made public.

NFL Commissioner Roger Goodell said he does not rule out the possibility of Rice returning
to the league someday.
Another team owner, Jim lrsay of the Indianapolis Colts, is currently serving a six-game
suspension and had to pay a $500,000 fine after pleading guilty to one misdemeanor count
of operating a vehicle while intoxicated.
The $500,000 fine is the maximum allowed under league rules.

A former exotic dancer allegedly responsible for taking those racy MOST POPULAR
pictures of Jerry Jones with several strippers has filed a civil suit
against the Dallas Cowboys and the team's owner.
J ana Weckerly seeks more than a million dollars in damages. Attomey Thomas Bowers III
filed the suit in the district court of Dallas County a few hours after ,Jones's Cowboys
dropped the opener at home to the San Francisco 49ers.
The Oklahoma woman alleges that Jones fondled, kissed, and digitally penetrated her
without her consent. "Defendant JERRY JONES intentionally and knowingly received oral
sex from another female while in the presence of Plaintiff," the suit alleges. "When

he knew that Plaintiff was present and intentionally and knowingly wanted Plaintiff to
said oral sex aet."
The stripper alleges that exposure to such indeeent conduct resulted in emotional distress
and likely damages future career prm;pects. a result of the eon duct and incidents
described herein," the brief contends, "Plaintiff has suffered many other damages,
including loss of self esteem, loss of trust, depression, substance abuse, and suicide
attempts."
The described incidents allegedly took place in 2009.
"Because the jury could potentially determine that fair and reasonable damages are in
excess of $1,ooo,ooo in this case," the petition "Plaintiff must state that she seeks
monetary relief of over $1,ooo,ooo so as not limit what the jury may award in this
case."
