LAW OF TREATIES

I) PROVISIONS ON THE COMMON SECURITY AND DEFENCE POLICY
1. The common security and defence policy shall be an integral part of the common foreign and security policy.
It shall provide the Union with an operational capacity drawing on civilian and military assets. The Union may
use them on missions outside the Union for peace-keeping, conflict prevention and strengthening international
security in accordance with the principles of the United Nations Charter. The performance of these tasks shall
be undertaken using capabilities provided by the Member States.
2. The common security and defence policy shall include the progressive framing of a common Union defence
policy. This will lead to a common defence, when the European Council, acting unanimously, so decides. It
shall in that case recommend to the Member States the adoption of such a decision in accordance with their
respective constitutional requirements.
II) [] Article 21 shall be amended as follows:
(a) the first paragraph shall be replaced by the following:
The High Representative of the Union for Foreign Affairs and Security Policy shall regularly consult the
European Parliament on the main aspects and the basic choices of the common foreign and security policy
and the common security and defence policy and inform it of how those policies evolve. He shall ensure
that the views of the European Parliament are duly taken into consideration. Special representatives may be
involved in briefing the European Parliament.[]

III) 2) [] In accordance with Article 16 B of the Treaty on the Functioning of the European Union and by
way of derogation from paragraph 2 thereof, the Council shall adopt a decision laying down the rules relating to
the protection of individuals with regard to the processing of personal data by the Member States when carrying
out activities which fall within the scope of this Chapter, and the rules relating to the free movement of such
data. Compliance with these rules shall be subject to the control of independent authorities.[]
IV) 1. The Union's aim is to promote peace, its values and the well-being of its peoples.
2. The Union shall offer its citizens an area of freedom, security and justice without internal frontiers, in
which the free movement of persons is ensured in conjunction with appropriate measures with respect to
external border controls, asylum, immigration and the prevention and combating of crime.
3. The Union shall establish an internal market. It shall work for the sustainable development of Europe based
on balanced economic growth and price stability, a highly competitive social market economy, aiming at full
employment and social progress, and a high level of protection and improvement of the quality of the
environment. It shall promote scientific and technological advance.
It shall combat social exclusion and discrimination, and shall promote social justice and protection, equality
between women and men, solidarity between generations and protection of the rights of the child.
It shall promote economic, social and territorial cohesion, and solidarity among Member States.
It shall respect its rich cultural and linguistic diversity, and shall ensure that Europe's cultural heritage is
safeguarded and enhanced.





V) PROPERTY, FUNDS, ASSETS AND OPERATIONS OF THE EUROPEAN UNION
Article 1
The premises and buildings of the Union shall be inviolable. They shall be exempt from search, requisition,
confiscation or expropriation. The property and assets of the Union shall not be the subject of any
administrative or legal measure of constraint without the authorisation of the Court of Justice.
Article 2
The archives of the Union shall be inviolable.
Article 3
The Union, its assets, revenues and other property shall be exempt from all direct taxes.
The governments of the Member States shall, wherever possible, take the appropriate measures to remit or
refund the amount of indirect taxes or sales taxes included in the price of movable or immovable property,
where the Union makes, for its official use, substantial purchases the price of which includes taxes of this
kind. These provisions shall not be applied, however, so as to have the effect of distorting competition within
the Union.
No exemption shall be granted in respect of taxes and dues which amount merely to charges for public utility
services.
VI) Article 17
1. Interest rates on loans to be granted by the Bank and commission and other charges shall be adjusted to
conditions prevailing on the capital market and shall be calculated in such a way that the income therefore shall
enable the Bank to meet its obligations, to cover its expenses and risks and to build up a reserve fund as
provided for in Article 22.
2. The Bank shall not grant any reduction in interest rates. Where a reduction in the interest rate appears
desirable in view of the nature of the investment to be financed, the Member State concerned or some other
agency may grant aid towards the payment of interest to the extent that this is compatible with Article 107 of
the Treaty on the Functioning of the European Union.

VII) Principles of legality and proportionality of criminal offences and penalties
1. No one shall be held guilty of any criminal offence on account of any act or omission which did not
constitute a criminal offence under national law or international law at the time when it was committed. Nor
shall a heavier penalty be imposed than the one that was applicable at the time the criminal offence was
committed. If, subsequent to the commission of a criminal offence, the law provides for a lighter penalty, that
penalty shall be applicable.

2. No one shall be liable to be tried or punished again in criminal proceedings for an offence for which he or she
has already been finally acquitted or convicted within the Union in accordance with the law.
Everyone whose rights and freedoms guaranteed by the law of the Union are violated has the right to an
effective remedy before a tribunal in compliance with the conditions laid down in this Article.
Everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial
tribunal previously established by law. Everyone shall have the possibility of being advised, defended and
represented.
Legal aid shall be made available to those who lack sufficient resources in so far as such aid is necessary to
ensure effective access to justice.


VIII) In accordance with Article 6 of the Treaty on European Union, the European Union is founded on the
principles of liberty, democracy, respect for human rights and fundamental freedoms, and the rule of law,
principles which are common to the Member States, and should respect fundamental rights as guaranteed by the
European Convention for the protection of Human Rights and Fundamental Freedoms and as they result from
the constitutional traditions common to the Member States, as general principles of Community Law.
(3) The right to equality before the law and protection against discrimination for all persons constitutes a
universal right recognised by the Universal Declaration of Human Rights, the United Nations Convention on the
Elimination of all forms of Discrimination Against Women, the International Convention on the Elimination of
all forms of Racial Discrimination and the United Nations Covenants on Civil and Political Rights and on
Economic, Social and Cultural Rights and by the European Convention for the Protection of Human Rights and
Fundamental Freedoms, to which all Member States are signatories.
