RENTAL AGREEMENT

THIS RENTAL AGREEMENT IS MADE AND EXECUTED ON THIS, THE 6th DAY OF AUGUST
2011 AT COIMBATORE, TAMILNADU.
BY AND BETWEEN
WHEREAS the Owner is absolutely entitled to the Scheduled premises, including all the Fixtures, Land
and the First Floor Flat with 2 Bed Rooms, Drawing Room, Dining Room, Kitchen, and Foyer located at
Albert Bethel, F2, No. 16, Kasturibai III Street, Bharathi Nagar, Ganapathy, Coimbatore -641006,
hereinafter referred to as the Scheduled Premises/Scheduled Fixtures.
AND WHEREAS the Tenant herein has approached and offered the Owner herein to obtain the above
said Scheduled Premises/Fixtures on rent for which the Owner has agreed to let out the same for an
initial period of 11 months, which can be extended with mutual agreement on the terms and conditions
stipulated herein and agreed to between the parties here to.
NOW THIS AGREEMENT WITNESSES AS FOLLOWS:
1. AGREEMENT PERIOD:
This agreement is for an initial period of eleven months commencing from 1st August 2011 and
ending on 31st July 2012 and can be renewable for another 11 months i.e. from 11st August 2012
and ending on 31st July 2013 with 20% enhancement as agreed between the parties to this
agreement from time to time.
2. PURPOSE OF THE AGREEMENT:
The Tenant shall use the premises for residential purpose only and shall not sublet any part or
whole of the same nor use it for any other purpose, and shall use it for the usage of the Tenant
only.
3. RENT AND MODE OF PAYMENT:
The Tenant hereby agrees to pay the Owner a sum of Rs. 10,000/- (Rupees Ten Thousand Only)
per month towards the rent for the rented out premises on or before 5th of every month, according
to the English calendar, from the day of taking possession of the same.
4. EXTENSION OF AGREEMENT:

On completion of the initial tenancy period of 11 months, the rental agreement can be extended for
a further period of 11 months with an increase in rent of 20%; any further extension will be on
mutually agreed terms.
5. SECURITY DEPOSIT:
The Tenant has this day paid a sum of Rs. 50,000/- (Fifty Thousand Rupees Only) towards deposit
in respect of the rented out premises/Fixtures and this amount of deposit of Rs. 50,000/- shall be
repaid by the Owner without any interest there on, to the Tenant after adjusting the dues payable
(including rental dues and damages to the scheduled premises/fixtures) by the Tenant, if any, at the
time of the Tenant handing over the possession of the Scheduled Premises/Fixtures.
6. NON-PAYMENT OF RENT:
If the monthly rent remains unpaid for two (2) months after the days herein appointed for
payment, it shall be lawful for the Owner by giving (1) One month advance notice to the Tenant to
take possession of the said Scheduled Premises/Fixtures without prejudice to any claim which
either of the parties hereto may have against the other or others respect to any breach, nonobservance of any of the convents and conditions herein contained.
7. PAYMENTS TOWARDS ELECTRICITY / WATER CHARGES MAINTANANCE:
The Tenant shall pay the charges towards Electricity and Water, to the concerned authorities in
time with effect from taking possession of the Schedules Premises and the original copies of
receipts of such payments are to be submitted to the Owner from time to time. If any of the above
charges are paid by Owner during the subsistence of the rental agreement, for the relevant period,
the Tenant shall reimburse the same to the Owner. Arrears of these charges, if any, pertaining to
the period prior to the occupation of the said Scheduled Premises by the Tenant shall be paid by
the Owner.
8. PAYMENTS TOWARDS MUNICIPAL TAX:
Taxes like Municipal Tax including Property Tax etc., including arrears of these statutory
payments, if any, shall be paid by the Owner.
9. MAINTENANCE OF THE SCHEDULED PREMISES:
The Tenant shall keep the premises in good and habitual condition and after expiry of the
agreement, shall hand over the possession of the said rented out premises to the Owner in the
same condition as allotted to him at the time of commencement of this agreement subject to
normal wear and tear.
10. REPAIRS:
Minor repairs viz., replacing of the fuses, bulbs and setting right the leakage of water taps, door
locks etc., and the repairs which may occur on account of acts and omissions on the part of the
Tenant shall be carried out by the Tenant at his own cost and the major repairs, if any, for damages
caused by any unforeseen calamity, normal wear and tear shall be carried out by the Owner at the
cost of the Owner.
11. ALTERATIONS:
The Tenant shall not make any structural additions, alterations, and changes and shall not cause
any kind of damage to the building, fixture, electric wiring and electrical, water and sanitary
fittings.

12. RIGHT TO ENTRY:


The Owner or his authorized representatives shall be permitted to inspect the Scheduled Premises,
with prior intimation to the Tenant, and carry out repairs, if any, at all reasonable times as and
when necessary.
13. NOTICE OF TERMINATION OF AGREEMENT:
Not with standing, what is stated above, this agreement is terminable by either Party to this
agreement by giving One (1) calendar month notice in writing to the other Party
14. MODE OF ISSUE OF NOTICE:
Any notice sent by registered post by either party to the address mentioned hereinabove, shall be
deemed to have been properly served for any of the purposes mentioned herein.
15. DISPUTE RESOLUTION:
Any dispute arising between the Owner and the Tenant pertaining to this agreement is subject to
the Civil Courts Jurisdiction of Coimbatore. No other courts have the Jurisdiction.
16. PEACEFUL POSSESSION:
The Owner hereby covenants with the Tenant that on the Tenant paying the rent hereby reserved
and performing and observing covenants and conditions herein contained shall peacefully and
quietly hold, possess and enjoy the said Scheduled Premises/fixtures during the said term without
any interruption or disturbances by the Owner or anybody claiming through him.
17. VACATION OF THE SCHEDULES PREMISES:
The Tenant shall vacate the above said residential premises/fixtures on completion of the agreed
terms and conditions after stipulated period or on termination of tenancy by the Owner unless an
agreement is entered for extension of tenancy.
18. SCHEDULE OF PROPERTY:
All that said residential premises of the Two Bedroom Flat in the Ground Floor of

herein with their free will and consent without any coercion, fraud, misrepresentation, duress and undue

influence etc., and after having fully understood the contents of this rental agreement in presence of the
