The "Inconvenient Truth" About ObamaCare

If you've ever been on a used car lot, you have experienced one of the great truisms in sales - often the
harder the pitch, the weaker the product. And from the beginning, we've seen an unprecedented effort
by the Obama administration to polish up its lemon of a health care overhaul and to convince the
American people they're getting a luxury vehicle.

We know about the "misleading" advertisements featuring former television star Andy Griffith, the high-

priced marketing firm, hired by the Obama administration to craft its messaging, the massive internet
search engine campaign - all at taxpayer's expense.

We know about these things because Judicial Watch has done the gritty work of forcing the release of
government records. (The total cost of the ObamaCare propaganda campaign was estimated to be as
high as $200 million, by the way.)

And regarding the purpose of this propaganda machine, remember this gem from documents we
uncovered from HHS? "Health and program-related messages are processed by the target audience
according to a particular reality, which he or she experiences. Attitudes, feelings, values, needs, desires,
behaviors and beliefs all play a part in the individual's decision to accept information and make a
behavioral change."

That one still creeps me out as it is the exact description of brainwashing.

But this week, courtesy of the Wall Street Journal, we learned that the Obama administration
considered, but rejected, telling the truth about ObamaCare's destructive effects

Per The Wall Street Journal:

As President Barack Obama pushed for a new federal health law in 2009, he made a
simple pledge: If you like your insurance plan, you can keep your plan. But behind the
scenes, White House officials discussed whether that was a promise they could keep.

When the question arose, Mr. Obama's advisers decided that the assertion was fair,
interviews with more than a dozen people involved in crafting and explaining the
president's health-care plan show.

But at times, there was second-guessing. At one point, aides discussed whether Mr.
Obama might use more in-depth discussions, such as media interviews, to explain the
nuances of the succinct line in his stump speeches, a former aide said. Officials worried,
though, that delving into details such as the small number of people who might lose
insurance could be confusing and would clutter the president's message.

"You try to talk about health care in broad, intelligible points that cut through, and you
inevitably lose some accuracy when you do that," the former official said.

You read that right. Government officials were worried the truth would clutter the president's message.
And so they kicked accuracy to the curb in favor of "simpler" falsehoods.

(Actually, the president's promise was even stronger than described by the Journal: "if you like your
health care plan, you'll be able to keep your health care plan, period. No one will take it away, no
matter what." [Emphasis added.])

Now that ObamaCare is law, we now know the truth. The Journal continues...

The breadth of Mr. Obama's statement proved to be a miscalculation. Mr. Obama
repeated the claim, with only occasional caveats, through this week, when a flurry of

cancellation notices from insurers to customers around the country prompted him to
recalibrate.

In other words, the "if you like your plan you can keep it" Obama mantra turns out to be a bold-faced lie
and the president is trying to save face (or lie about his initial lies) while acknowledging what cannot be
ignored.

According to industry experts, as many as 10 million Americans will have their health care plans
terminated by year's end, leaving them with skyrocketing out-of-pocket expenses. You see, health
insurers read the writing on the wall. Existing plans will surely die out if there are no new customers. So
why keep them on life support?

Of course, the Obama administration saw this coming. They knew plans would be cancelled. In fact, that
was one of their principle goals, to have more Americans leave their health insurance plans and enter
into "improved" plans offered through Healthcare.gov exchanges. But this proved to be an
"inconvenient truth" that would surely undermine the president's bumper sticker campaign message.
And they couldn't take that risk - 10 million Americans be damned.

By the way, the Obama excuse that ObamaCare only changed the plans in the individual insurance
market is also misleading. Employers who provide health insurance have also been forced to curtail
wages, hours, and jobs to comply with the ObamaCare mandate. If you have a job with health insurance
and get laid off, you will lose your health insurance as surely as the millions of individuals now receiving
ObamaCare-caused cancellation notices.

The net result for the president is some very real trouble. Democrats in Congress who voted for this
monstrosity are nervous, and the leftist press is having an increasingly difficult time making
lemonade. (Even Obama defender and television host John Stewart is "tired of all the ObamaCare lies."
This scandal has all but shredded, for those few who still believed it, the notion of Obama's having the
most transparent administration in history.)

And now, the Obama administration has given up on recalibration in favor of distraction, by arguing that
it doesn't matter, because these people will ultimately have better health plans. The American
Enterprise Institute's Jonah Goldberg demonstrates the folly of this argument:

If a landlord promises you can keep your dog when you move into an apartment, but
then after you sign the lease he takes your dog and replaces it with a stuffed one, he
wasn't telling you the truth. The landlord's view that the new dog is better ("No mess!
No noise!") is utterly irrelevant to the question of whether the landlord lied - and it
doesn't make you a fool for preferring your old dog, either.

At any rate, it doesn't appear to be working. The American people are too smart. We saw ObamaCare
for what it was - a watered down version of health care socialism - and that's why the public has never
supported it. (Or "make a decision to accept information and make a behavioral change," to use the
administration's creepy Big Brother language.)

Judicial Watch and other conservatives always knew that ObamaCare, conceived in corruption and
secrecy, was full of lies and would lead to the destruction of health insurance system that is taking place
now.

The lying president will try to power his way through this credibility crisis. And I'm sure the media, now
going after him for a bit, will get back on board with Obama.

In the meantime, Judicial Watch will persist and seek truth and accountability. We have many pending
ObamaCare open records investigations, but this week we began a new, massive, and nationwide
investigation of the ObamaCare debacle. I will provide you more details later, but rest assured that we
are on the case!


A Sweetheart No-Bid Contract for Obama-Connected Marketing Firm?

The government contracting process is supposed to be transparent, fair, and subject to open bidding so
the American people can have confidence that politicians and their appointees in the federal
bureaucracies do not engage in the behavior of rewarding campaign donors with sweetheart deals.

Note I said supposed to be transparent, fair and open. Often it is not, as evidenced by an apparently
corrupt arrangement between the Obama USDA and an Obama-connected marketing firm.

This week we announced the release of 44 pages of documents revealing that in 2010, the USDA
evidently violated federal law by giving a $100,000 no-bid contract to a marketing firm with close ties to
President Obama's 2008 and 2012 presidential campaigns. The funds were for the purpose of
spearheading Michelle Obama's "Let's Move" obesity initiative.

How close were the ties?

Top executives of the firm Shepardson, Stern, and Kaminsky (SS+K) previously held key positions on
Obama campaign staffs, and the firm produced advertising for the 2012 Obama campaign, including the
controversial "Your First Time" TV commercial, which compared voting to losing one's virginity.

Importantly, even the USDA has admitted that the contract might have been unlawful. Following the
early February 2010 delivery of the SS+K materials, the USDA, in an apparent effort to justify the no-bid
contract, produced a "Request for Ratification of an Unauthorized Commitment" conceding possible
violations of Federal Acquisition and Agriculture Acquisition regulations.

The Request said the USDA employee "was not aware of the contracting process" and that "the
importance of this program necessitated an aggressive schedule that hindered his ability to research the
process."

Let me cut through the bureaucrat-speak for a moment: What the Obama administration argues here is
that the urgent need to advance Michelle Obama's obesity initiative was of greater importance than
following the law! And the person who presided over the contract allocation did not even have a basic
understanding of the contracting process.

Once again, we see the perfect storm of incompetence, corruption and cover-up from this
administration.

The records also reveal that in early April the Deputy Director of the USDA Office of Procurement &

Property Management sent an email to the project director asking, "What did we get for our money?"
Also, the commitment might have been "unauthorized."

The documents obtained by JW on October 22, 2013, were in response to a June 13, 2013, Freedom of
Information Act (FOIA) request seeking the following information from January 1, 2010, to the present:
Any and all contracts between USDA and SS+K, a creative marketing firm located at 1717 Rhode
Island Avenue NW, Suite 660, Washington, DC 20036 and Pine Street, 30th Floor, New York, NY
10005.
Any and all records of communication between any official, employee, or representative of the
United States Department of Agriculture and any officer, employee, or representative of SS+K.

According to the documents, the USDA awarded SS+K the "unauthorized commitment," no-bid contract
to produce the "Let's Move" logo, slogan, and artwork for Michelle Obama's campaign, as well as the
creative design for the "Let's Move" website, which right now features characters from the Muppets as
well as photos of Michelle Obama dancing/exercising.

(Perhaps we can all agree, liberals and conservatives, that any government-funded campaign that
involves puppets does not rise to the level of an "urgent need" that requires government officials to
ignore the rule of law.)

SS+K evidently delivered the completed project in February 2010 with a 30-day invoice. On April 5, 2010,
Jodey Edwards, Deputy Director, USDA, Office of Procurement & Property Management, sent an email
to USDA Administrative Officer Yvette Ward asking, "What did we get for our money ... any deliverable?
I know this is an unauthorized commitment: however the[y] still must provide evidence of what is being
paid for ..."

To say that SS+K saw a precipitous rise in its government contracting business after Obama took office
would be an understatement.

Prior to the $100,000 "Let's Move" no-bid contract, SS+K also received contracts totaling $2 million from
the Obama Department of Education for the "TEACH" teacher recruitment campaign in 2010. Previous
to the Obama election, the firm, founded in the early 1990s, had landed only one government contract,
a $50,000 contract from the Department of Defense in 2002.

This increase in government business - from $50,000 to $2.1 million - comes as no surprise given the
connections of the company's higher-ups.

The firm's founding partner, Robert Shepardson, previously led SS+K's work on the Obama campaigns in
2008 and 2012. Marty Cooke, who also worked on the "Let's Move" account for SS+K, was the creative
director during the Obama '08 campaign. SS+K vice president Mike Moffo is the former National Director
of Special Projects for the Obama 2008 campaign. Other SS+K clients include the AFL-CIO, George Soros'
Open society Foundation, and the Democratic National Committee.

Look, this is as much a sweetheart deal as I have ever seen and I have seen a lot of them. Just as with the
no-bid contract for the disastrous ObamaCare website, it is clear Barack Obama is paying off his friends
out of the public treasury. And for the USDA to try to justify its sleight of hand by claiming that the
"importance" of the program "necessitated an aggressive schedule" is both disingenuous and insulting.

up to the podium. The first mike didn't work. Neither did the second one. So Prime
Minister Netanyahu, standing next to the lectern, used a third mike - starting his
presentation without losing a beat.

So he stood there without notes and starting taking about Iran. He only moved over to
the lectern, where an assistant placed his notes, after he completed his message about
Iran and moved on to greet people by name [from "I know that there have been many
times that we have stood together......"]

When I spoke with Americans at Binyanei Heuma in Jerusalem before PM Netanyahu's
address there were those who were confident that Netanyahu would talk against Iran
but avoid being confrontational with America ("after all," more than one observed, "we
are a mixed crowd.").

But as our prime minister noted, "when it comes to the question of Jewish survival and
the survival of the Jewish state, I will not be silenced, ever."

So its not the time to be pleasant or politically correct or worry about offending some
American Jews.

"And what is being offered now, and I'm continuously updated in detail. I know whereof

Then again, there were other visiting American Jews who told me that they have friends
who were, up to now, diehard supporters of President Obama but the most recent
developments shocked them and turned them around.

Hardly a reliable survey.

One thing is clear: for the next two weeks it is our fervent hope that friends of Israel in
America and around the world heed Netanyahu's call:

"When it comes to the question of Jewish survival and the survival of the Jewish state, I
will not be silenced, ever."

"Where Are the American People?"

Either they're asleep, or on numbing narcotics, or have decided they just don't give a
damn any longer what happens in the world -- so that the fact that their president is
surrendering America's proud and exceedingly important international role is just fine
with them.

Please! do not write to me explaining what happened to America. The above is
rhetorical flourish by way of introduction to what I am seeing. I cannot fix America, and
whether Americans are asleep or on something, the result is the same: America's proud
and important role in the world is being swiftly abandoned. I grieve for this. The
implications are terrifying.

And the bottom line here, of course, is that the president of the United States is
destroying America. I think Americans have yet to face the profound consequences of
what is being wrought.

The core of what I am referring to is, of course, Iran. What has become shockingly clear
is that Obama has capitulated to Iran. Talks have been going on in Geneva between
Iran and P5 (the permanent members of the UN Security Council -- the US, France,
Britain, Russia and China) + 1 (Germany).

What had been on the verge of being finalized just days ago was a horrendous
agreement. It would have required Iran to stop enriching at the 20% level, but would
have permitted the continuation of enrichment at the 3.5% level, with enrichment
continuing at all sites. Nothing would have been dismantled and there would have been
no limit on the number of centrifuges that Iran would continue to possess (estimated at
19,000).

In return for this, there would have been a considerable reduction in sanctions -- the
unfreezing of $3 billion in fuel funds, an easing of sanctions on the petrochemical and
gold sectors, an easing of sanctions on replacement parts for planes, and a loosening of
restrictions in the Iranian car industry.

One source quoted by the JPost called this "very grave" -- a situation that might lead to
the collapse of all sanctions. It would not stop the Iranian nuclear project, but merely
give the Iranians "breathing space."

As the JPost explained, "Once major international transactions begin, a dynamic will kick
in that will lead to a collapse of sanctions."

"The Americans folded," said the source, "maybe because they very much want to
reach an agreement and be done with this."

"...The Iranians are the ones who came crawling to the negotiations, begging for an
easing of sanctions, otherwise their regime will fall, and what's incredible is that it
seems that the Americans are more eager than them (sic) to reach an
agreement." (Emphasis added here and above)

What has to be emphasized here is that this was to be an "interim" agreement: it was
not intended to dismantle Iran's ability to make a bomb. It involved only a
"freeze." As all enrichment facilities and equipment would stay in place, the Iranians
could start up again whenever they pleased. And it would be too late to re-start the
sanctions program that would prevent them from taking this step.

Needless to say, Israeli Prime Minister Binyamin Netanyahu went ballistic over
this. Israel has again and again advised the international community that only if Iran no
longer has the capacity to develop a bomb could a deal be considered a success. Aside
from the enrichment facilities, there is also the heavy water plant at Arak.

On Friday morning, he met on this issue at the airport with Secretary of State Kerry, who
was leaving for Geneva. This was a suddenly announced trip and it is widely thought
that Kerry took himself there to secure credit for the deal he anticipated would be
finalized shortly.

Then, later, on learning more about what was transpiring in Geneva, Netanyahu met
with reporters, and said (emphasis added):

"I understand that the Iranians are walking around very satisfied in
Geneva -- as well they should be because they got everything and paid
nothing. Everything they wanted; they wanted relief of sanctions after
years of a grueling sanctions regime, they got that. They are paying

nothing because they are not reducing in any way their nuclear
enrichment capability."

He explained that, "the international community got a bad deal, a very bad deal" while
Iran "got the deal of the century."
And then he made it clear that, "Israel utterly rejects [the deal] and what I am saying is
shared by many in the region, whether or not they express that publicly. Israel is not
obliged by this agreement and Israel will do everything it needs to do to defend itself
and the security of its people."

With this statement, the prime minister has put the world on notice. No one can ever
say he/she didn't know that Israel was going to/on the cusp of deciding to hit Iran.

I am keenly aware of the balancing act Netanyahu is engaged in, with regard to
hitting Iran. If negotiations fail (and more on this below), this becomes an appropriate
time. If a bad deal is struck, then he must face the ire of the international community,
which will claim it had been on the edge of securing a peaceful situation, when he, a
warmonger, upset the dynamic. That doesn't mean that he wouldn't do it anyway. Not
at all.

But I have the sense of his weighing various options with the utmost seriousness
possible. And I also have a vivid and painful awareness of the fact that the window of
opportunity for Israel to act is going to close very very soon.

I make no secret of my conviction that, as matters stand, he must hit. But there is no
certainty yet. In fact, there will be no certainty until it's been done.

Netanyahu has spoken repeatedly about the need to tighten the screws on Iran with
regard to the sanctions. This is apparently in the hope that it might yet cause the
implosion of the current regime, or, far more likely, weaken it sufficiently so that the
mullahs hold off on crossing that red line -- especially as Israel presents a credible
threat.

Yet, as matters have transpired in the last days, this is an unlikely prospect.


When Netanyahu made his statement on Friday, he believed the deal was about to be
finalized. What happened yesterday, however, is that France - as I understand it, and
astonishingly - took Netanyahu's warnings seriously and pulled back from
agreement. The French referred to the prospective arrangement as a "sucker's deal,"
and so at present there is no deal.

Some reports have the other P5 + 1 parties that are involved - apparently still eager to
finalize that deal - minimizing French objections: No no, everyone is on board, France is
just addressing some technicalities. Whether France will hold out remains to be seen.

As matters currently stand, there will be a short break, before negotiations are resumed
on November 20. In the meantime, Netanyahu intends to do a great deal of
lobbying. Yet, again.


Whether this deal goes through or not, whether France holds out or not,
whether Netanyahu convinces some other nations to take a more careful look at what
they are doing or not, I hold the Obama administration culpable at the most basic
levels.

Once, not so long ago, the US was the leader of the free world, and demonstrated
strength and perseverance. Now, from all indications, the US was terribly eager to sign
a very bad deal. This after Kerry had pontificated that no deal is better than a bad one.
How shameful is it, that it could be said that America was more eager for a deal than
Iran. What does this tell us?

And what an indictment, that perhaps the Americans caved because they want to be
done with it already. What a gross and shocking dereliction of Obama's basic
responsibility to his nation, and to the international community this would be.


It seems to have been the case that the US stance softened in the course of these recent
negotiations. What is still speculative is the reason why. A desire to "be done with it
already" is only one possible reason. There are other perspectives being advanced.
The Netanyahu government is especially incensed that the degree of reduction in
sanctions the US was prepared to agree to was greater than Israel had been told it
was. Reportedly early on Friday, before the negotiations for the day began in Geneva,
Kerry told Netanyahu that there would be "minor" sanctions relief offered to Iran that
would "not be significant."

And so there have been suggestions of deliberate deception. Jonathan Tobin of

The Daily Beast ran an exclusive two days ago regarding "Obama's Secret Iran Detente":

new president in June, months before the current round of nuclear talks in Geneva or

What this suggests is that the Obama administration didn't simply cave at the last
minute during negotiations, but was eager all along to provide relief to Iran -- and to
show Iran a weak negotiating stance.

Then the indictment against Obama is far graver: it becomes an issue of pre-
meditated intent to cut Iran as much slack as possible, and, yes, allow Iran to go
nuclear. And we have to ask which side Obama is on. (Again -- please, don't write to tell
me.)


As might be expected, Israeli-US relations are in a state of considerable tension right
now. And there is a way in which I consider this healthy. For Netanyahu can harbor no
illusions about a quid pro quo if Israel makes concessions, or about trusting the US to
stop Iran from becoming a nuclear power, or about the US having Israel's back.

Netanyahu's predisposition to respond to American pressure has to be slight at
best. We must trust that he will now proceed on the basis of what is best for Israel.
Period.

Obama is simply not to be trusted.


I want to circle back to a discussion of the "negotiations" -- for certainly what I have
written here has serious implications in that regard as well. In fact, the prime minister
himself alluded to this issue in his statement about the bad deal with Iran.

Because I have something of significance to share concerning Israel's stance on the
negotiations, I am going to save this for tomorrow's post.

As well, I hope to take a look at other ways in which Obama is weakening the country he
was elected to lead.

call for Republicans]. Attendees @ this event were reminded that, during last years event, this physician
argued *also vociferously+ that the GOP should stand-firm on pushing BHO to maintain the debt-ceiling
[and, thus, to cut the budget], a posture that presaged the [transiently successful] events in October.

costs, the term 'single-payer' is another way of saying "communism."

Under-reported is revelation of how BHO has tried to doctor the data: the bureau of labor-statistics
admitted-data-were wrong, for the unemployment-rate-really is 7.7%. Throughout much of October,
during the partial federal government shutdown, some 700,000 federal workers were furloughed. Yet,
according to data compiled by the Bureau of Labor Statistics, even though they were not working, they
were not unemployed, either. Sure enough, the governments data shows that the amount of people
working in October did decrease by 735,000. So, if the furloughed federal employees were not working,
yet were not unemployed, where were they? Apparently, not even in the labor force. According to the
Bureaus data, the civilian labor force shrank by 720,000 in October.

would have jumped to a whopping 7.7 percent, instead of the reported 7.3 percent. And, according to
the Bureaus press release, they should have been counted as unemployed, but were not: Workers who

recalled to their jobs should be classified in the household survey as unemployed on temporary layoff. In
October 2013, there was an increase in the number of federal workers who were classified as
unemployed on temporary layoff. However, there also was an increase in the number of federal workers

been introduced overnight-Sunday in one of the marathon-blasts; after having taken a history,
interventions were promulgated along the following lines, recognizing thatabsent an amendment
the Senate would probably pass the House Bill [rendering elementary/secondary curricula discretionary]
after two more readings on the floor. Thus, the following was remitted to the key-players [but recall

Analysis

First, note that the last graph of the blast e-mail has been updated [both infra and on
scribd]; essentially, the issues being explored related to the unfunded-mandate concept.
This is of-interest philosophically, for the sticking-point that has prompted insertion of

process.

Second, the expansion of the cc-list includes two staff-people from Mike Folmers
officeplus a critic of Common Core *who hosted an SRO-crowd over the weekend @

promulgated via the PDE and, if necessary, a contact-person who may [if necessary] be
called directly for clarifications.

Third, this physician is the President of a [Cyber Charter] School Board [which is
currently closing] and, thus, there exists justification to deal directly with the PDE
regarding curriculum. This could be obviated if the Senate Bill is placed on-hold

Synthesis

First, a number of ideas were promulgated, primarily to Ms. Jen Smeltz; she will be in-

through which an expansion of any given topic could then be invoked to encompass
Holocaust Education.

Second, some who fear unfunded-mandates fear other issues could be shoehorned-in

whatever fashion desired, with an optional CURRICULUM [or set of alternatives] being

Third, others who fear excess-costs associated with teacher-education could be
reassured that this would not be mandated and, further, that volunteer resources are
eager to be invoked. Therefore, although the ideal model would be to ensure a certified
teacher conveyed a comprehensive curriculum, it wouldnt be problematic to mandate
ensuring the topic be taught.

Therefore

First, an amendment to the pending Senate bill could be drafted [through the reference
bureau] that would ensure these legitimate practical concerns have been
unambiguously addressed. It would MANDATE the TOPIC be taught [in 1-8 and 9-12,
per existing structure] by ANY qualified teacher, invoking whatever
curriculum/volunteers/training may be available locally.

Second, note that this would easily be viewed as having been achieved within
customary organizational resources rather than foisting an additional cost-center upon
the School Board. And, certainly, the NEED to ensure these phenomena have been
conveyed to our youth cannot be denied by any sentient individual, particularly noting
this mandate exists in NY/NJ.

Third, as a Plan-B, the ability to employ a back-door approach by appending
Holocuast to anything else that may exist *in PDEs Core+ would necessitate,
perhaps, a more extensive re-write. EVERYONE should know that this e-mail represents

Syrian Kurds formed transitional government

After a series of military gains, Syrian Kurds in the northeast of the country announced

Long oppressed under Syrian President Bashar al-Assad and his father before him, Kurds
view the civil war as an opportunity to gain the kind of autonomy enjoyed by their

The announcement was made after talks in the mostly-Kurdish town of Qamishli, and
comes after Kurdish leaders announced plans to create the temporary government in
July.

The transitional autonomous government involves the division of Syrias Kurdish region
into three areas, each with its own local assembly, as well as representatives to a
regional executive body, AFP reported.

Tuesdays statement detailed the formation of a transitional civil administration for the
area of Western Kurdistan-Syria.

The meeting was held two days ago in the town of Qamishli between all the local
groups, which discussed the project of a transitional civil administration that was put
forward by the PYD earlier, it said, referring to the Kurdish Democratic Union Party.

The key responsibilities of the transitional administration will be preparation of local
election laws and preparing general elections, a well as political, military, security and
economic issues in the region and Syria.

Kurdish regions of northern Syria have been administered by local Kurdish councils since
forces loyal to Syrian President Bashar al-Assad withdrew in the middle of 2012.

The redeployment was seen as a tactical move by the regime, one which freed up forces
to battle rebels elsewhere, and encouraged the Kurds to avoid allying with the
opposition.

Last month Kurdish forces seized control of a crucial border point with Iraq.

Kurds represent about 15 percent of the Syrian population, and are mostly concentrated

Egypt expresses optimism over Russian ministers visit

On October 13, Israel announced the discovery of a terror tunnel 1.7 kilometres long
from Gaza under the border into Israel.

Responsibility for constructing the sophisticated tunnel was claimed by the Izzeddine Al
Qassem Brigades, the armed wing of Hamas, which said it had planned to use the tunnel
to capture Israeli soldiers and hold them in exchange for imprisoned Palestinians.

A Hamas leader, Bassem Naim, told AFP the tunnel was an important message to Israel

During the war, Palestinian militant factions in Gaza fired almost 1,500 rockets at Israel,

keep their plans is just as flawed and false as his original like your plan/keep it pledge.
The law itself is clear: ObamaCares new benefit mandatesthe requirement to cover
all individuals with pre-existing conditions, the new essential benefits, and mandates
increasing the percentage of health costs insurance plans must coverall take effect on
January 1, 2014.

As any follower of Schoolhouse Rock will know, theres only one institution that can
change the law: Congress. President Obamas plan attempts to ignore them entirely.
The Presidents proposal is but the latest in a long line of waivers and unilateral
changes made in a futile attempt to repair an inherently unworkable law.

The ultimate fix lies with Congress, and its a simple one: Undo this unfair,
unworkable, and unpopular law that never should have been passed in the first place.

supportive of this initiative, albeit recognizing ongoing challenges to its success.

War (in lieu of the no-fly-zone) could now be vindicated by the creation of a Homeland
for Kurds in Syria, Iraq, Iran and Turkey; far from providing sanctuary for cross-border

The Easy Way to Fix HealthCare.Gov: Redefine What 'Fixed' Means

The next big broken promise from the administration will be Jeffrey Zients' promise that
"by the end of November, HealthCare.gov will work smoothly for the vast majority of
users."

"Vast majority" means fewer folks than you think: "The Obama administration will
consider the new federal insurance marketplace a success if 80 percent of users can buy
health-care plans online, according to government and industry officials familiar with
the project As many as one in five Americans who try to use the Web site to buy
insurance will be unable to do so."

I don't ever want to hear another federal worker object to the phrase, "close enough for
government work," or complain that they're unfairly maligned as incompetent, slipshod,
or unreliable.

Now the right-wing doubters are sneering loudly: "And I'm not convinced it's going to be
fixed -- you know, I've seen a lot of tech rollouts. We don't do those well in this country.
My rule for them is -- and no matter what -- electronic medical records or the tax
department, it takes twice as long, costs twice as much and often you have to do it
twice."

Er, wait, scratch that. That was Howard Dean this weekend.

Don't Tell President Obama Bad News! He Can't Deal with 'the Drama'!

It's a real head-scratcher. Most powerful man in the free world. Most
important issue. Most politically explosive, particularly coming on the

heels of the government shutdown. Consider the context: Republicans
had just tried to defund ObamaCare, and they lost in a heap of public
humiliation. So the rollout of ObamaCare had to be really impressive,
because the Republicans had to be proven wrong.

And yet, as the dry-runs continued to produce red flagsover and
overthe president remained in his steely cocoon. If this were the
presidency of George W. Bush or Ronald Reagan, the obvious theories
would abound: the chief executive is disengaged. Or incurious. Or
worse. But since Obama is none of the above, what gives?

Notice how she just flatly asserts that Obama is not disengaged, incurious, or worse. But
what's even more amazing is that her very next paragraph confirms the possibility she
just denied:

This much is clear, after speaking with both past and present senior
administration officials: no one was really in charge, so no one knew for
sure how bad the overall picture was. What's more, andperhaps most
tellingno one wanted to even hint to the president that this techno-
savvy administration possibly had a website stuck in, say, 1995.
"People don't like to tell him bad news," says an ex-White House
staffer. "Part of it is the no-drama culture."

It is flat-out impossible to be a good president if you don't want to hear bad news.

One must, finally, appreciate what might have been had Mike not facilitated the

Of particular interest is the mea culpa issued by Dershowitz [Could Be a 'Chamberlain

was decidedly upbeat regarding BHO [ostensibly, having stated opposition to BDS],
recognizing that, politically, he [and his enablers, masquerading as sponsors+ intended
to anesthetize the Jewish Community from abandoning BHOs re-election effort. Thus,
one would expect the liberal powers-that-be to invite him back, so that he can ATONE;
of course, this would serve as a tacit admission that propping-up BHO was foolhardy.

Because Israel is heading for what could be its most severe confrontation with the US,

NYT: 'No One Can Seriously Argue' Iran Deal Makes World Less Safe], noting the anti-Zionist history of
the NY-Times. Overtly ignored is the fact that this deal further tests Obamas credibility, as some try to
explore ways the parties could Make the Iran Nuclear Deal Work. BHOs actions regarding iran prompted

within the GOP regarding the desirability of neo-isolationism by eschewing interaction
with Wall St./K St. *Establishment Republicans aren't just interested in showing they're
more headstrong than President Obama, they may also be trying to isolate non-
interventionists in their own party, most notably Kentucky senator and likely future
presidential candidate Rand Paul.+ Also, when a rhetorical/leading question is posed

Capability" which admits "The deal does not roll back the vast majority of the advances Iran has made in

In the wake of the deal just announced with Iran it is crucial to note that the efficacy of
Prime Minister Binyamin Netanyahu's valiant struggle to prevent a nuclear Iran has
never been either influenced or impaired by Israeli policy relating to the Palestinians in
general and in particular progress or lack thereof towards reaching an agreement to
create a sovereign Palestinian state.

This struggle is hardly over and we now find that the current round of talks with the
Palestinians are set to end at the same time that a final arrangement is supposed to be
reached with Iran.

There is no doubt that many supporters of a sovereign Palestinian state, come-what-
may, both in Israel and abroad, will seek to try and assert that Israel's case with regard
to Iranian nukes will be ignored if we dont march to their drummer.

That Barack Obama has betrayed Israel, the Sunni Arab nations, and his own people is,
to my thinking, beyond question. He has capitulated to a dangerous terrorist state.

The media are full of comments and analyses about what he has done, why he has done
it, and what comes next. I will attempt to summarize what is important here, and you
will find links to key articles below. But to share all of the various analyses and
viewpoints at length would require a book rather than a posting.

I do not pretend, not for a second, that I am sanguine about any of what is going
on. This is an infuriating, and exceedingly agitating business.

As to why he did what he did...

That he is an enemy of Israel is clear -- no matter what some liberal American Jews who,
incredibly, still like him may think. Did he act to weaken Israel (as Caroline Glick has
written) or even destroy Israel, or to attempt to preclude an Israeli attack on Iran (as
John Bolton has written), or to avoid having to attack Iran himself, no matter the
consequences? Or was he after better oil prices? All these theses have been advanced.

I read today that the deal is not yet finalized, but have not been able to secure further
information on this. From The Israel Project:

"News broke mid-Monday that the final details of this weekend's interim agreement
between the P5+1 and Iran had not yet been agreed upon, and that the six month
period during which Iran is expected to negotiate over a comprehensive deal - and
during which U.S. negotiators had committed to preventing the imposition of new
nuclear-related sanctions - had not yet started."

The six month countdown will begin, rest assured. That is, if Obama has anything to say
about it -- no matter what he has to do to get there. But the fact that the final details
have not been set in place yet is not a small matter.

Netanyahu is sending a team to Washington, which will include his national security
advisor Yossi Cohen. I'll say more about this below, but one of their tasks will be to find
out what the details are -- there remains confusion on some fine points.

This situation exists because the deal was rushed through so quickly. Rushed before it
could be stopped.

If there is any way to stop what Obama is doing -- either at this point or down the road -
- it is via Congress. A good number of Senators and Congresspersons -- both
Republicans and Democrats -- are angry about what the president has done.

However, President Obamas historic deal to curb Irans nuclear ambitions may be just
the thing to get lawmakers from both sides of the aisle working together again.

December,' said Schumer, the third-ranking Democrat in the Senate. 'I intend to discuss

region and who have been saying all along that any kind of deal with this regime in Iran

What is needed are tough sanctions that cannot be overturned by the president. This
works most effectively, I have been given to understand, with specific wording in the
legislation:

No presidential waiver can be permitted. (Sometimes legislation calls for a specific
action, except as the president, for reasons of national security or national interests
deems it unwise -- this sort of terminology must be avoided.)

The wording, additionally, must set out a requirement -- such and such "shall" happen,
not "should," or "may." What an associate of mine with considerable Congressional
lobbying experience calls "weasel words" must be avoided.

Lastly, the legislation can carry greater impact if it has a defunding provision: If this and
this is not done, then the budget for such and such will be cut.

Congress does not do these things lightly. But they can be done. And if there is sufficient
distress and anger within Congress now, they might be done.

representatives in Congress must hear from you immediately. In addition to feeling
their own distress about the current situation, they will be more motivated to act if they
understand that their constituents in large numbers want them to do something about
the deal Obama has struck.

As to what Netanyahu will do now, it is difficult to say. His position is close to
unbearable.

Some people believe that he has no diplomatic option to attack Iran right now, because
of the threats allegedly being made by Obama with regard to this (have no confirmation,
only reference to allegations) and the pressure being put on him more broadly. Obama
is not the only one:

British Foreign Minister William Hague, in the Parliament yesterday, called on Israel to
refrain from actions that could damage implementation of the agreement.

John Bolton, a senior fellow at the American Enterprise Institute and former US
ambassador to the UN, while recognizing the difficult position Netanyahu is in, favors a
strike by Israel before long. Writing in the Weekly Standard, he says (emphasis added):

"...the international climate of opinion against a strike will only harden during the next
six months.

"Undoubtedly, an Israeli strike during the interim deal would be greeted with outrage
from all the expected circles. But that same outrage, or more, would also come further
down the road. In short, measured against the expected reaction even in friendly
capitals, there is never a 'good' time for an Israeli strike, only bad and worse

times. Accordingly, the Geneva deal does not change Israels strategic calculus even
slightly...
"Israel still must make the extremely difficult judgment whether it will stand by as Iran
maneuvers effortlessly around a feckless and weak White House, bolstering its
economic situation while still making progress on the nuclear front, perhaps less
progress on some aspects of its nuclear work than before the deal, but more on others...
"So in truth, an Israeli military strike is the only way to avoid Tehrans otherwise
inevitable march to nuclear weapons, and the proliferation that will surely follow.
Making the case for Israels exercise of its legitimate right of self-defense has therefore
never been more politically important. Whether they are celebrating in Tehran or in
Jerusalem a year from now may well depend on how the opponents of the deal in
Washington conduct themselves."

But while Bolton thinks it will only get worse for Israel, with regard to international
reactions to an attack on Iran, there are other perspectives.

One suggestion is that Israel heighten its intelligence monitoring of Iran in order to
discover ways that the Iranians will be cheating on the terms of the current interim
agreement (shock! they cheat!). Then, going public with this would provide a rational for
hitting militarily that might resonate with some international leaders.

The independent Israeli monitoring of Iran's adherence to the deal is particularly
important in light of what Zalman Shoval suggests may be Obama's tendency to go
lightly on Iranian violations:

"Former Israeli ambassador to the U.S. Zalman Shoval expressed concern that
Washington, in an attempt to justify the Western deal with Iran limiting Tehran's
nuclear development program, would most likely 'go easy' on Iran when it came to
evaluating violations of the agreement."

I alluded above to the fact that an Israeli team is heading for Washington. One of its
purposes, we are being told, is to encourage the Obama administration (work with the
Obama administration, ostensibly) to develop the toughest possible terms for the final
agreement to be reached (at least in theory).

I read this and found myself bewildered as to what this was about. For I do not believe
Iran is going to sign on to a meaningful final agreement and I do not believe that our
prime minister thinks so either.

However, if the terms brought to the final negotiations are tough, then it might increase
the resistance of Iran with regard to even a semblance of cooperation. And this, too,
might reduce international resistance to a military strike.

It is the opinion of Dr. Aaron Lerner of IMRA that Netanyahu must continue his
campaign of alerting the world as to the dangers of a deal with Iran, with all possible
vigor (emphasis added):

"By the same token that the interim deal with Iran was driven by a desire to make a deal
come-what-may, the same will be the case in six months.

"The issue of enrichment and other elements that place Iran weeks from making a bomb
at any time are matters that President Obama is clearly willing to compromise on in the
final agreement in order to sign a piece of paper.

"And that is not going to change solely via intimate conversations.

"And it is not going to change because we offer to divide Jerusalem.

"It is only going to change if Obama faces so much pressure, both domestic and
international, that he finds himself opting for the right path rather than the easy path.

"And that pressure can only be achieved by continuing, over the next six month, with
the campaign to alert the world to just how dangerous an inadequate deal with Iran
will be."

by the Israeli Foreign Ministry (with emphasis added):

"Unprecedented international recognition of Iran's enrichment program

"...for the first time since the beginning of negotiations in 2003 the international
community recognizes Iran's enrichment program and agrees that it will not be rolled
back contrary to a longstanding policy of full suspension enshrined in several UN
Security Council resolutions.

"International acceptance of the heavy water reactor in Arak
"The elements of the comprehensive solution mentioned in the Geneva agreement lack
any commitment to the dismantling of the Arak heavy water reactor...which is uniquely
suitable for the production of military grade plutonium.
"Uninhibited R&D of advanced centrifuges
"The current agreement allows Iran to continue R&D of Advanced Centrifuges. This
means Iran will be able to further develop and strengthen its enrichment capacity under
the guise of this agreement, and will be in a better position technologically when it
decides it is time to further expand enrichment. Therefore, the agreement actually
enables Iran to get closer to breakout capability.
"Current stock of uranium enriched to a level of under 5% will remain intact
"Iran is allowed to preserve its current stock of about 7 tons of uranium enriched to a
level of 5%...
"Iran will be able to easily reverse the measures taken under the agreement and charge
ahead once it is politically convenient Iran is not required to roll back or dismantle
anything. Its nuclear infrastructure will remain intact, enabling it to resume full
operations upon decision. [Note: turning 5% into more highly enriched uranium is not
difficult]
"The agreement undermines the sanctions regime and provides Iran with crucial relief
in economic pressure
"The international concessions in the area of sanctions undermine the sanctions regime
and curb momentum for additional pressure on Iran....reducing sanctions without any
real concessions on the part of Iran is extremely counter-productive: Iran is now less
likely to agree to any significant restrictions on its nuclear program. [Note: once the
sanctions regime is weakened, restoring it is very difficult, see below]
"The agreement signals that it is now legitimate to do business with Iran
"The 'interim' agreement might become permanent
"Given the observations made above, this means that Iran will practically be escorted to
a nuclear threshold position by the international community."

about sounding the alarm about the dangers of a deal with Iran applies first to
Netanyahu, but then to each of us individually.

Iran Deal "Beginning of End" of Sanctions Regime, U.S. Caved on Enrichment "Right"

Analysts, diplomats, and journalists spent overnight Saturday and into Sunday outlining
both the meaning and the implications of an interim agreement secured last night
between the P5+1 global powers and Iran. Controversy erupted not just over the
substance of the deal - whether it met the benchmark previously set by President
Obama to prevent Iran from "advancing their program" - but even over what the deal
explicitly did and did not promise.
Western concessions - according to Mark Dubowitz, executive director of the
Foundation for Defense of Democracies - will inject Iran with financial relief ultimately
worth roughly $20 billion.
In exchange - per a quick New York Times assessment - Iran agreed to concessions that
not only fall short of "roll[ing] back the vast majority of the advances Iran has made in
the past five years," but that shorten its breakout time by "only a month to a few
months." The interim deal allows Iran to continue enriching uranium to 5% purity and to
keep building new centrifuges to repair worn ones. Iran will have to convert its 20%
enriched stock either to fuel or to diluted 5% stock, but those processes can be easily
reversed within weeks. The only way to put that material beyond use is to actually
irradiate the stock, but Iran doesnt have the capacity to do that. In any case experts
from the University of Virginia and the U. S.-based Institute for Science and International
Security (ISIS) recently warned [PDF]) that Iran can sneak across the nuclear finish line
using only its stockpile of 3.5% enriched uranium. Inasmuch as Iran is not being forced
to dismantle its centrifuges, there are fears it will either cheat or just wait six months
and use them when the interim period expires.

More controversially, Iran seems to have secured language under which the
international community acknowledges that a comprehensive agreement will still allow
Tehran to enrich uranium. The U.S. has long rejected Iran's claim that it has a "right" to
enrich, and last October lead U.S. negotiator Wendy Sherman told Congress that "the
President has circumscribed what he means by the Iranian people having access
access, not right, but access to peaceful nuclear energy in the context of meeting its
obligations." The interim language, however, describes a future comprehensive solution
as involving "a mutually defined enrichment program with practical limits and
transparency measures to ensure the peaceful nature of the program." Iranian state
media carried boasts by among others Iranian President Hassan Rouhani and Foreign
Minister Javad Zarif that the U.S. had caved on its long-standing position. The U.S. and
Britain both flatly denied Irans interpretation of the interim language with Secretary of
State John Kerry saying as much and the White House further denying it on a late-night
background call.
The Washington Post's Jackson Diehl this morning noted that the plain text of the
agreement favors the Iranian interpretation. Later in the day, the Daily Beast's Eli Lake
went further:
To be sure, the idea that Iran would be able to enrich uranium after a
final status deal has been floated in negotiations for the last two years.
But the offer represents a significant softening of earlier demands from
the United States and even the Obama administration. During his first
term, Obama offered Iran a deal that would have required Iran to
import enriched nuclear fuel, but not allow Iran to make that fuel in
facilities its government controlled... Already this language has drawn
fire from top Republicans. In a statement Sunday morning, House
Majority Leader Eric Cantor (R-VA) said, The text of the interim
agreement with Iran explicitly and dangerously recognizes that Iran will
be allowed to enrich uranium when it describes a 'mutually defined
enrichment program' in a final, comprehensive deal. It is clear why the
Iranians are claiming this deal recognizes their right to enrich.
The substance of the deal will deepen concerns that Tehran intends to pocket the
interim concessions and walk away. Patrick Clawson and Mehdi Khalaji, respectively the
director of research and a senior fellow at the Washington Institute, had already
expressed concerns weeks ago that "Khamenei has been laying the groundwork to walk
away from any deal by warning that the West is untrustworthy and will not deliver on its
promises the same reasons he gave for walking away from the earlier nuclear deals."
Danielle Pletka, vice president of foreign and defense policy studies at American
Enterprise Institute, was blunt in summing up what Iran got and what Iran gave, and
how that might affect the regime's calculations in walking away from the table:
Chatting last week with a prominent nuclear expert in Washington (a
Democrat), we talked about the problems with the then-prospective
deal. Ironically, we were in complete agreement:...Sequenced
agreements of this kind dont work (viz: North Korea). The
administration was too desperate for a deal. There will be no phase
two... Iran has given nothing of substance other than a pause in its

program... while the concessions to Iran on sanctions are in and of
themselves not dramatic, the reversal in momentum for sanctions and
the loss of the psychology of impenetrable sanctions is of immeasurable
value to Tehran. Dealmakers will be back, letters of credit will once
again be available, and it will be the beginning of the end of
international cooperation on sanctions.
The asymmetrical structure of the deal - with Iran "freezing" its program but the
international community chipping away at sanctions - may also influence whether Iran
decides to abandon negotiations over a comprehensive deal. U.S. concessions are
largely irreversible. Most straightforwardly, Iran will get to pocket the billions in
financial relief its gets, using the funds to stabilize the Iranian economy, bolster its
nuclear program, and fund its global terror network.
The arguably more significant danger, however, is that the sanctions regime cannot
survive even the limited erosion that the deal entails. There are multiple scenarios
under which the sanctions relief in the deal would trigger a downward spiral that
irreversibly and substantially eroded the regime. The most immediate fear is that major
powers and corporations will engage in a feeding frenzy to get into Iran: No one wants
to be left behind as Irans market opens up, and so everyone tries to get in first. Pletka's
suggestion about the "psychology of impenetrable sanctions" is one mechanism for a
downward spiral. Brookings Institute fellow Michael Doran earlier this week pointed to
evidence that such a downward spiral was already beginning, with Paris looking to
reopen a trade-related attach office in Tehran next year.
The Iranian economy is already recovering on expectations of a sanctions collapse:
Iran's currency jumped more than 3 percent against the U.S. dollar on
Sunday as news of a breakthrough deal to curb Tehran's nuclear
program raised hopes that the economy would start recovering from
international sanctions... by reducing the chance of military action
against Iran and raising the prospect of more sanctions relief in future,
the Geneva pact may stem capital flight from the country and
encourage a partial revival of domestic investment. This could be
enough to pull the economy out of the recession which has gripped it
for most of the past two years, while encouraging Iranian and foreign
businessmen to begin rebuilding trade ties. "We are feeling the positive
sentiment in Iran," Nariman Aflani, a foreign exchange trader at AFI
Group, an Iranian civil engineering firm in Tehran, said by telephone.
Prices of construction materials such as ceramics and cement in Iran are
already coming down because people hope a gradual loosening of
sanctions will make it easier for the country to obtain supplies from
abroad, he said.
