diverse cross section of the community, active


registered Republicans and Democrats, past
Mayors holding a variety of important local,
regional and statewide offices along with local busi-
nessmen and women took the assignment to Endorse
a Candidate for the Office of City Attorney -City of
Huntington Beach very seriously.
Huntington Beach, the 18th largest City in the State,
with a population exceeding 200,000 people employ-
ing over 900 men and women, managed by a 7 person
City Council is a hot bed of legal issues, legal chal-
lenges, personal injury claims, municipal law quag-
mires of Ordinances, Special Districts, and legislative
protocols all demanding, at
a minimum, an experienced
Administrator. On the sin-
gle issue of EXPERIENCE,
Jennifer McGrath, with 18+
years in the specific field of
Municipal Law, in our com-
munity, drove us to this
unanimous conclusion.
We are in the midst of
several issues with long his-
tories of complicated battles
such as the community's
Senior Center, Desalination, Fireworks, Plastic Bags, ter-
mination of Redevelopment resources, strategic Labor Ne-
gotiations, and critical Annexation debates, to name but a
few current topics with significant legal ramifications.
These demands and more compel us, among the two can-
didates seeking the office, to endorse Jennifer McGrath.
The opponent has significantly less experience, no
known Municipal Law cases, nor known direct experience
with drafting or advising on City Ordinances or managing
a law firm of Municipal Attorneys.
In this election cycle, among the two candidates, we rec-
ommend the re-election of Jennifer McGrath for Hunting-
ton Beach City Attorney.

en young women will vie for the crown at the
2014 Miss Fountain Valley Scholarship Pag-
eant, scheduled for 7 p.m. Nov. 1 at the Saigon
Performing Arts Center.
The contestants in the pageant will compete for
more than $10,000 in scholarships and other
prizes, and the winner will compete at the 2015
Miss California pageant. Theyve all been busy
with photo shoots and rehearsals.
They will compete in four categories:
fitness/swimsuit, evening gown, talent and per-
sonal interview.

ou may have heard on the news about a Southern California man who was put under
72-hour psychiatric observation when it was found he owned 100 guns and allegedly
had 100,000 rounds of ammunition stored in his home.The house also featured a secret
escape tunnel.
I was thinking on a regional basis and concluded:
In Arizona, he'd be called "an avid gun collector."
In Arkansas, he'd be called "a novice gun collector."
In Utah, he'd be called "moderately well prepared," but they'd probably reserve judgment
until they made sure that he had a corresponding quantity of stored food."
In Kansas, he'd be "A guy down the road you would want to have for a friend."
In Montana, he'd be called "The neighborhood 'Go-To' guy."
In Idaho, he'd be called "a likely gubernatorial candidate."
In Georgia, he'd be called "an eligible bachelor."
In North Carolina, Virginia, W.Va., Louisiana, Mississippi, Tennessee, Kentucky
and South Carolina he would be called "a deer hunting buddy."
And in Texas: he'd just be "Bubba, who's a little short on ammo."
INSPIRATION

A
s I've aged, I've become kinder to my-
self, and less critical of myself. I've be-
come my own friend.
I have seen too many dear friends leave this
world, too soon; before they understood the
great freedom that comes with aging.
Whose business is it, if I choose to read, or
play, on the computer, until 4 AM, or sleep until
noon? I will dance with myself to those won-
derful tunes of the 50, 60 & 70's, and if I, at the
same time, wish to weep over a lost love, I will.
I will walk the beach, in a swimsuit that is
stretched over a bulging body, and will dive
into the waves, with abandon, if I choose to, de-
spite the pitying glances from the jet set. They,
too, will get old.
I know I am sometimes forgetful. But there
again, some of life is just as well forgotten. And,
I eventually remember the important things.
Sure, over the years, my heart has been broken.
How can your heart not break, when you lose a
loved one, or when a child suffers, or even when
somebody's beloved pet gets hit by a car? But,
broken hearts are what give us strength, and un-
derstanding, and compassion. A heart never
broken, is pristine, and sterile, and will
never know the joy of being imperfect.
I am so blessed to have lived long
enough to have my hair turning gray, and
to have my youthful laughs be forever
etched into deep grooves on my face. So
many have never laughed, and so many
have died before their hair could turn
silver. As you get older, it is easier to
be positive. You care less about what
other people think. I don't question my-
self anymore. I've even earned the right
to be wrong. So, to answer your ques-
tion, I like being old. It has set me free.
I like the person I have become. I am
not going to live forever, but while I
am still here, I will not waste time
lamenting what could have been, or
worrying about what will be. And I shall
eat dessert every single day (if I feel like it).

Fishing Derby
Draws 200
Participants
M
ore than 200 children from 4
to 15 had the time of their
lives participating in The 51st An-
nual Huck Finn Fishing Derby
Contest on the Huntington Beach
Pier recently. The sponsors that
made it happen were Parks Make
Life Better, California Department
of Fish & Game, Lets Go Fishing,
New Fishall Bait, The Surf City
Store, Surf City Al-
bertson's, HB Fishing
Club, Aqua Clip,
Sports Chalet,
Davey's Locker and
Newport Landing.
Awards were given
for the Largest and
Smallest Fish caught.
Many of the catches
were small smelts,
lizard fish and a few
surf perches, with the
heaviest coming in at
0.37 pounds. There
was also a Costume Contest for
the best-dressed Huck Finn and
Becky Thatcher. I really enjoyed
being a judge. If you haven't been
to this event it is a must. Thanks to
City of HB Community Services
Department Intern Stephanie
Blomquist, Erin Burke, Jon Vilen-
sky and many others for helping
the young fishing boys and girls
have a fun time they will remem-
ber all their lives.

uring a speech at Colorado Christian University
on Wednesday, Supreme Court Justice Antonin
Scalia argued that the U.S. Constitution does
not prohibit religious references in public places, in-
cluding schools:
I think the main fight is to dissuade Americans
from what the secularists are trying to persuade them
to be true: that the separation of
church and state means that the gov-
ernment cannot favor religion over
nonreligion.
Scalia suggested that if Americans
want a more secular political system,
such as those in Europe, they can
enact that by statute, but to say thats
what the Constitution requires is ut-
terly absurd.
At the heart of the argument over
separation of church and state lies the
age-old debate over the intent of the
First Amendment:
Congress shall make no law re-
specting an establishment of religion, or prohibiting the
free exercise thereof; or abridging the freedom of
speech, or of the press; or the right of the people peace-
ably to assemble, and to petition the Government for a
redress of grievances.
So is the intent freedom of religion, or freedom from
religion? Justice Scalia argues that it is the former:
We do Him [God] honor in our pledge of allegiance,
in all our public ceremonies. Theres nothing wrong
with that. It is in the best of American traditions, and
dont let anybody tell you otherwise.
I think we have to fight that tendency of the secular-
ists to impose it on all of us through the Constitution.
As a conservative on the bench, Scalia has endured
the wrath of liberals for years. These comments are
sure to add to the fire. His take on his critics?
What can they do to me? I have life tenure.

."Here are some other politically correctness
to consider: I agree with our Native American
population. I am highly insulted by the
racially charged name of the Washington
Redskins. One might argue that to name a
professional football team after Native
Americans would exalt them as fine war-
riors, but nay, nay. We must be careful
not to offend, and in the spirit of po-
litical correctness and courtesy, we
must move forward. Let's ditch the
Kansas City Chiefs, the Atlanta
Braves and the Cleveland Indi-
ans. If your shorts are in a wad
because of the reference the
name Redskins makes to skin
color, then we need to get rid
of the Cleveland Browns.
The Carolina Panthers ob-
viously were named to keep
the memory of militant
Blacks from the 60's alive.
Gone. It's offensive to us
white folk.
The New York Yankees of-
fend the Southern population.
Do you see a team named for
the Confederacy? No! There
is no room for any refer-
ence to that tragic war
that cost this country so many young men's
lives.
I am also offended by the blatant references to the
Catholic religion among our sports team names. To-
tally inappropriate to have the New Orleans Saints,
the Los Angeles Angels or the San Diego Padres.
Then there are the team names that glorify criminals
who raped and pillaged. We are talking about the hor-
rible Oakland Raiders, the Minnesota Vikings, the
Tampa Bay Buccaneers and the Pittsburgh Pirates!
Now, let us address those teams that clearly send the
wrong message to our children. The San Diego
Chargers promote irresponsible fighting or even
spending habits. Wrong message to our children.
The New York Giants and the San Francisco Gi-
ants promote obesity, a growing childhood epi-
demic. Wrong message to our children.
The Cincinnati Reds promote downers/barbitu-
rates . Wrong message to our children.
The Milwaukee Brewers---well that goes without
saying . . . Wrong message to our children.
So, there you go. We need to support any legislation
that comes out to rectify this travesty, because the
government will likely become involved with this
issue, as they should. Just the kind of thing the do-
nothing congress loves . . .
As a die hard Oregon State fan, my wife and I, with
all of this in mind, it might also make some sense to
change the name of the Oregon State women's athletic
teams to something other than "the Beavers."

oys & Girls Clubs of Huntington Valley
hosted its 36th Annual Benefit Dinner
& Auction Great Futures Start Here
at the Hyatt Regency Huntington Beach Resort
& Spa. More than 600 guests were in atten-
dance. Funds raised will benefit the Boys &
Girls Clubs programs for at-risk children.
These include free programs like after school
care for children in the Oak View neighbor-
hood of Huntington Beach, the Twilight Edu-
cation Project, which helps low-income
English Language Learner families, and the
sliding scale program that allows families to
pay only what they can afford for childcare
and before after school programs at all its lo-
cations.
Ken Jacobs was honored at the event as
Boys & Girls Clubs of Huntington Valleys
2nd annual Champion of Youth. For the past
19 years, Mr. Jacobs has been one of the
Clubs most dedicated supporters. In his role
as the founder and chair of the JMG Security
Systems Annual Benefit Golf Tournament, Mr.
Jacobs has worked tirelessly to raise over $1.2
million to help the Club run quality programs
that make a difference.
When I first started the JMG Golf Tourna-
ment years ago, I didn't expect to be standing
here talking about it nearly two decades later,
said Mr. Jacobs, But the Boys & Girls Club
does so much good for the kids in our commu-
nity that I had to keep the tournament going!
In fact, our 20th anniversary tournament will
be on May 20th, 2015. Ive seen for myself the
good work that the Club does with our com-
munitys kids. It makes me proud to stand with
the Boys & Girls Club as they work toward
creating great futures for kids in need.
As he stepped down from the podium after
delivering his remark, Mr. Jacobs was congrat-
ulated by none other than Robert Mayer Sr.,
the Clubs inaugural 2013 Champion of Youth.
A fellow avid supporter of the Club, Mr.
Mayer helped launch the Building Dreams
capital campaign and build the Robert Mayer
Child Development Preschool at Golden West
College in 2011. With two amazing men from
the Boys & Girls Club family standing side by
side, the night was one to be remembered!
Many have served the Boys & Girls Clubs
of HB/FV with distinction. High on that list
is Mr. Fountain Valley, Mr... just nice guy -
Ed Arnold. Perenial recipient of so many
awards -Ed Arnold personifies the concept
of community service. Ed was the Master of
Ceremonies for this event (again) and adds
a level of credibility, professionalism and
demeanor that is hard to find elsewhere.
R
epublic Services Inc (RSG: Quote), Wednesday announced the acquisition of one of
Southern California's largest independent solid waste companies, Rainbow Disposal Co
Inc.
The deal further enhances Republic's Southern California footprint, and reinforces the
company's growth strategy to expand its operations through targeted, accretive acquisi-
tions.
Republic has acquired Rainbow's business and facilities, which include hauling
routes in Huntington Beach, Fountain Valley, Midway City, Westminster, Orange
County, Newport Beach and Irvine as well as a recycling facility, a transfer station,
a compressed natural gas refueling station, and a vehicle fleet, powered by CNG.s
As part of the deal, the primary principals at Rainbow, Jerry Moffatt and Jeff
Snow, have joined Republic Services, and will now lead a newly created
business unit of the company based at the Huntington Beach campus. Re-
public's new business unit will continue to serve residential and commer-
cial customers, providing waste collection, transfer, disposal, diversified
material recovery/recycling and organic composting.
There just could be couple of Millionaire Trash collec-
tors with this stock swap. Rainbow has been an ESOP
for quite some time with the employees being
share holders based on their length of serv-
ice with the company...We congratulate
them all, from top to bottom for a long
history of community service and out-
standing performance as a con-
tractor to Huntington Beach
and out neighboring commu-
nities.

references to
Con-
gress are oftentimes preceded by the
words, do-nothing, read on.
In the wake of repeated reports
of domestic violence commit-
ted by NFL players, New
Jersey Senator Cory
Booker introduced a
bill designed to repeal
the leagues tax-ex-
empt status. Not to
be outdone, three
of Bookers pub-
licity starved
colleagues intro-
duced a second
bill to scrap the
NFLs tax-ex-
empt status be-
cause of the
refusal of the
Washington Red-
skins to change
their name.
A cynic might sug-
gest that a responsible
Congress should address
more important issues than
the NFLs tax-exempt status.
But of course, using the word
responsible in the same sentence
with Congress is an oxymoron.
Neither bill is likely to become law. Con-
gress do-nothing reputation is well-earned, in part because
legislators rarely agree on anything. However, sports leagues
are famously and rightfully concerned about their public
image. Teams receive public funding for facilities and
infrastructure. They also enjoy assorted tax
benefits which are dependent on the
support of legislative bodies.
That means whether Con-
gress is grandstanding or
not, you can rest as-
sured that the bills
have caught the at-
tention of the
NFL.
Even if they
passed, nei-
ther bill
would have
any adverse
effect on the
NFL. The
league is in-
corporated
as a
501(c)(6) en-
tity for the
purpose of
s c h e d u l i n g
games, making
and enforcing
rules, and adminis-
tering the business of
professional football. Al-
though the NFL is not organ-
ized to make a profit, unlike a
501(c)(3) organization, it is not re-
quired to be a charitable organization.
The NFLs receipts are derived mainly from member-
ship dues approximately $6 million per year - paid by each
of its 32 teams. Those funds are used primarily to pay the
exorbitant salaries of league executives Commissioner
Roger Goodell earned $44 million last year and other ad-
ministrative expenses, including rent on a swanky office on
Park Avenue in New York City.
The nearly $10 billion generated by the NFL last year
was funneled through four subsidiaries that, unlike the
league itself, are for profit entities. However, those entities
are merely conduits, distributing the lions share of their
media, licensing and sponsorship revenue to the individual
teams, only one of which, the publicly-owned Green Bay
Packers, is organized as a non-profit. The other 31 teams
are all subject to income taxes.
Based on an examination of public documents, the NFL
had a slight excess of receipts over disbursements in 2012,
but paid out substantially more than it took in during the two
preceding years. If the NFL had been a for profit entity in
2012, it still could have avoided paying income taxes by con-
solidating 2012s return with prior years. The net effect: No
tax consequence.
While Congress may have a role in addressing the scourge
of domestic violence, in this instance its doing what it so
often does: Nothing.

Swim

untington Beach Firefighters joined teams from the Long Beach Fire
Department, Long Beach Lifeguards, and Seal Beach Lifeguards in
a team relay swim to raise money for the Children's Cancer Center at
Miller Children's
Hospital of Long
Beach.
Just before 10
p.m. on Friday night,
the HBFD relay
team, along with the
other public safety
agencys teams,
slipped into the
water to begin the
relay race from
Catalina Island to
Long Beach. Seven
members of the
HBFD swam the
relay in darkness
from Catalina to
Long Beach. In addi-
tion, five HBFD
team members were
on stand-up paddle-
boards escorting the
swimmers, along with a support boat. The teams arrived in Long Beach Sat-
urday morning.
Swimmers were: Tristan Gale, Kane Johnson, Eric McCoy, Dane Morris-
sey, Kevin Shanahan, Wendy Stiver, Zac Wright Paddlers: Bill Cerri, Bob
Farrar, Chad Garrett, Phil Voci, and Tom Wilson If you are interested in learn-

Dear EarthTalk:
A friend of mine re-
cently stopped using
skin and beauty products
with parabens in them. What are
parabens and should we all be avoiding them? -- Betsy John-
son, Port Chester, NY
First commercialized in the 1950s, parabens are a group of
synthetic compounds commonly used as preservatives in a
wide range of health, beauty and personal care products. If
the product you are using contains methylparaben, ethyl-
paraben, propylparaben, butylparaben and isobutylparaben,
it has parabens.
These ingredients are added to deodorants, tooth-
pastes, shampoos, conditioners, body lotions and make-
ups, among other products, to stop the growth of
fungus, bacteria and other potentially damaging mi-
crobes. Researchers have also found that some 90 per-
cent of typical grocery items contain measurable
amounts of parabens, which is why even those who
steer clear of potentially harmful personal care products
also carry parabens around in their bloodstreams.
What worries public health advocates is that while
individual products may contain limited amounts of
parabens within safe limits set by the U.S. Food &
Drug Administration (FDA), cumulative exposure to
the chemicals from several different products could be
overloading our bodies and contributing to a wide
range of health problems. Of greatest concern is that
parabens are known to disrupt hormone function, an ef-
fect that is linked to increased risk of breast cancer and
reproductive toxicity, reports the non-profit Campaign
for Safe Cosmetics (CSC). Parabens mimic estrogen
by binding to estrogen receptors on cells. Research
has shown that the perceived influx of estrogen beyond
normal levels can in some cases trigger reactions such
as increasing breast cell division and the growth of tu-
mors.
CSC cites a 2004 British study that detected traces
of five parabens in the breast tumors of 19 out of 20
women studied. This small study does not prove a
causal relationship between parabens and breast cancer, but
it is important because it detected the presence of intact
parabensunaltered by the bodys metabolismwhich is an
indication of the chemicals ability to penetrate skin and re-
main in breast tissue. According to the group, a more recent
study found higher levels of one paraben, n-propylparaben,
in the axilla quadrant of the breast where the roportion of
breast tumors is found. CSC reports that parabens have also
been linked to reproductive, immunological, neurological and
skin irritation problems.
Health advocates are pressuring the FDA to ban parabens
in products sold in the U.S.like the European Union did in
2012but concerned consumers must take matters into their
own hands for now by reading product labels and avoiding
products with parabens.
Many natural and organic cosmetics manufacturers have
found effective alternatives to parabens to prevent microbial
growth in personal care products, reports CSC. Some com-
panies have created preservative-free products that have
shorter shelf lives than conventional products (six months to
a year), but if used daily are likely to be used up before they
expire. Readers can check out Breast Cancer Actions list of

Synthetic compounds called parabens are added to tooth-
pastes, deodorants, shampoos and other products to
stop the growth of fungus, bacteria and other potentially
damaging microbes. Individual products contain limited

could be overloading our bodies and contributing to a
wide range of health problems, including breast cancer
and reproductive toxicity.

Wine industry executives are worried about the
growing interest in craft beer and spirits from Amer-
ica's 20- and 30-somethings. That's one takeaway
from a fascinating new survey of the wine industry's
top executives by Robert Smiley, dean and professor
emeritus at the University of California Davis Grad-
uate School of Management.
Smiley's survey is conducted each year and always
generates headlines, since Smiley is able to connect with
some of wine's heaviest hitters. This year, for instance,
senior executives at E&J Gallo, The Wine Group, and
Constellation Brands participated. The nation's three
largest wine companies, these firms account for nearly
half the wine sold in the
United States.
Worrying about
America's 75 million
millennials makes sense.
But fearing millennials'
interest in craft beer and
spirits is misguided.
America's thirst for wine
appears insatiable.
Last year, the nation
consumed 892 million
gallons of wine, a 40 per-
cent increase from just
ten years ago. The United
States consumes more
wine than any other na-
tion in the world, and one
in four adults drinks wine
regularly. This trend
shows no sign of slowing.
In Smiley's survey, many executives were excited
about these numbers and the interest they're seeing from
young consumers.
"We find that the millennials are fabulous," said one
participant (the responses were unattributed). "They're
adopting wine at a faster pace and they're a different type
of consumer than we've seen in the past."
But many fretted about other alcoholic beverages. Smi-
ley asked executives how their branding strategies en-
sured "competitiveness in the growing market of craft
beers and cocktails."
"Spirits are going to intrude
onto the dining room table," said
one executive, "and the mixologist
is going to be working with the
chef to do cocktails that are paired
with foods."
Noted another, "I'm worried
about it, in that it's sort of a share
of stomach issue."
These concerns ignore Amer-
ica's changing food and drinks cul-
ture.
Researchers at the Beverage In-
formation Group recently exam-
ined American drinking habits
from 2001 to 2011. While they
found that liquid consumption is a
zero-sum game, Americans are
willing to replace non-alcoholic
beverages with alcoholic ones. Indeed, consumers are
abandoning juice, soft drinks, milk, and cheap light beer
and embracing bottled water, tea, wine, and spirits.
This shift makes sense. In the 1950s and 60s, Coca-
Cola was synonymous with American culture. Today's
youngest consumers grew up alongside Starbucks, so
they've always been com-
fortable with bitter bever-
ages.
Food preferences are
also changing. The high-
end steakhouses and fast-
food burger joints of
yesteryear are being re-
placed with farm-to-
table restaurants and
designer salad shops.
Put simply, younger consumers are eating and drinking
adventurously. This bodes well for the wine industry.
Today's consumers have more access to more wines
from more places than ever before. Consider that an av-
erage upscale supermarket now carries more than 1,500
wine selections, a number that dwarfs the variety of
breakfast cereals. Those who are interested in craft beer
and small-batch spirits are willing to explore the un-
known. Wine offers infinite choices.
Global wine brands do have some reason to worry. As
one executive noted, "younger consumers in particular
are interested in authenticity and it seems to me that the
craft beer and craft spirits business looks a lot more like
the wine business these days."
But that concern has nothing to do with craft beer and
spirits per se. Rather, as consumers think more critically
about consumption, purchases will shift away from huge
producers who churn out industrialized, soulless wines
and toward small wineries, unheralded wine regions, and
esoteric grapes. That's a good thing.
Dinner tables across the country will certainly have
more room for craft beer and cocktails in the years ahead.
But wine will also be there.

A
big congratulations to Claire Margaret Epting, the
winner of Miss Huntington
Beach 2014-15. Claire, 18, attends Orange County School
of Arts where she is working towards her career as a work-
ing actor and educator.
She plans on attending a four year college where she will
major in Theatre and minor in Literature. Claire spends
much of her free time volunteering for various charities and
projects, including the Wetlands and Wildlife Center and
Friends of Bolsa Chica Clean-up.

Beach for over 100 years, celebrating the young woman of

S
eal Beach Police Officers are investigating a
disturbance on the northeast corner of 8th
Street and Ocean Avenue, where a 23 year
old, Hispanic male victim from Lakewood, CA was
reportedly stabbed in the abdomen with an un-
known sharp object. The victim was transported to
a local hospital where he is currently being treated
for life threatening injuries.
Due to the condition of the
victim and limited witness
information, suspect in-
formation is extremely
limited. No arrests
have been made and
the suspect is de-
scribed as a Hispanic
male, mid 30's, 5'05,
180 pounds, medium
to chubby build, with
short black hair and possibly
a mustache. The suspect was wearing a plain char-
coal colored t-shirt with jeans and unknown shoes.
There were no described piercings or tattoos.

Drama In
Seal Beach
M
onday, October 6, Police Officers responded to a domestic dispute call located on Alabama Street
. The caller and home owner had fled the location before calling police. The home owner reported
that a roommate at the location had a male acquaintance arrive unannounced, armed with a firearm.
The male acquaintance fired the firearm, causing the caller to flee the scene.
Officers arrived and contained the scene. They identified everyone involved and attempted to contact the
suspect and female roommate. After hours of attempting to contact the individuals with no success, fearing
a potential hostage situation, the HB
SWAT team and Crisis Negotiators were called in, with an attempt to contact the suspect and resolve the
situation.
After several hours, perimeter SWAT officers observed movement in the residence. Attempts to contact
the suspect were un-
successful. At 9 p.m.,
the suspect, Adam
Murdock, exited the
apartment briefly and
was quickly taken into
custody. The female
was found and secured
inside unharmed.
During the investi-
gation, investigators
discovered a bullet
hole inside the apart-
ment and
recovered a hand-
gun. Murdock was
booked for Assault
with a Deadly Weapon
and other felony
charges. The incident
concluded at approxi-
mately 11:30 p.m.

I
s it really that difficult to get a mortgage
these days? For the vast majority of home-
owners and homebuyers, the process re-
mains quite simple. But there are certain groups
of people who are more likely to face challenges
navigating through the new lending require-
ments.
Federal regulators took over the mortgage in-
dustry in 2009 and have since done a complete
legislative overhaul. The underlying theme in
the new laws is that everything must be docu-
mented. Individuals who relied on stated or lim-
ited documentation programs in the past will
find it much more challenging to obtain a mort-
gage today.
The most challenged group will be those who
simply cant document enough income to justify
the ability to repay a mortgage obligation. The
reality is that not everyone can afford a home.
To protect those who cant afford it from being
taken advantage of, federal legislators have
passed rules which prohibit lenders from offer-
ing loans to those who cant document the abil-
ity to repay. As common sense as this may
appear, there have been unintended conse-
quences with other groups of homeowners and
homebuyers getting caught in the line of fire.
The most significantly impacted are the self-
employed. Whereas a W2d employee is quali-
fied based on their gross income,
self-employed individuals are re-
quired to qualify using their net in-
come after all deductions. And
because they are afforded many tax
breaks not available to most every-
one else, self-employed individuals
typically document much less in-
come that what they are truly earn-
ing. Those in this situation will find
it much more difficult to provide
the documentation required to meet
todays lending requirements.
Perhaps the biggest surprise in
this is that some of the most quali-
fied individuals are the ones who
have to jump through the most
hoops in order to qualify for and
obtain a mortgage. Highly qualified
individuals frequently have com-
plex investment portfolios. This
will frequently make the
amount of paperwork
required to obtain a
mortgage extremely
cumbersome and over-
whelming. Since every-
thing is required to be
documented, the more
complex someones finan-
cial position is, the more
documentation will be re-
quired of them.
Even Ben Bernanke, the
former Chairman of
the Federal Reserve,
admitted that he was
having a hard time re-
financing his own
mortgage loan.
Speaking at a confer-
ence in Chicago, he
told moderator Mark Zandi of Moodys Analyt-
ics: Just between the two of usI recently tried
to refinance my mortgage and was unsuccessful
in doing so.
Undoubtedly much of the new legislation that
federal regulators have imposed on the mortgage
industry was required. The 1995 deregulation of
financial markets made possible the irresponsi-
ble lending practices in the decade that followed.
The new legislation that has been enacted since
2009 has swung the pendulum too far in the
other direction, creating an overly-regulated
market with very restricted qualifying criteria.
The vast majority of homeowners and home-
buyers in the middle of the qualifying spectrum
are not likely to notice any significant change or
challenge. Its the ends of the spectrum, the most
qualified and the least qualified, that are mainly
affected.
The housing area is one area where regula-
tion has not yet got it rightthe tightness of
mortgage credit / lending is still probably exces-
sive, says Bernanke.

TV host Jeff Thomason, of Weather-
ford, Texas, landed a world bowfishing
record for Mako shark August 12 off
the coast of Huntington Beach,
California. The shark, which
weighed 809.5 pounds and
stretched 11 feet, beat the pre-
vious world bowfishing record
for Mako by about 300 pounds,
according to the Bowfishing
Association of America.
Jeff Thomason landed the
huge fish, which weighed 809.5
pounds and stretched 11 feet,
off the coast of Huntington
Beach, California on August
12. The shark beat the previous
world bowfishing record for
Mako by about 300 pounds, ac-
cording to the Bowfishing As-
sociation of America.
Thomason, of Weatherford,
hosts the cable television show
"Predator Pursuit," which airs
on the Sportsman Channel.
Thomason said the world-record catch
took a total of five people 30 minutes
to haul in.
Thomason and his crew spread
chum in large area and waited for
about 30 minutes for a shark to get
close enough to shoot, Lone Star Out-
door News reported.
Theyve got to be about three feet
from the boat to get the arrow to stick,
so we threw a fish on a line and teased
him to the boat, Thomason told Lone
Star Outdoor News. I try and
shoot for the top of the back. As
soon as the arrow hit, all hell
broke loose. We freaked out be-
cause I spined him and we
thought he might sink."
The crew raced back to shore
after securing the fish and had it
measured at a certified weigh
station in Los Angeles.
"It was one of those days
when everything went right,"
Thomason said.
The largest Mako shark ever
caught weighed 1,221 pounds
and was reeled in off the coast
of Massachusetts in 2001 with a
rod and reel, according to the
International Game and Fish
Association.
Thomason and his crew do-
nated 400 pounds of shark meat
to a Los Angeles homeless shelter, ac-
cording to Lone Star Outdoor News.
