Thereshallbenorule
makingorlegislation,that
wouldprohibitor
otherwisetakeawaythe
rightofthepeopleto
consume,cultivate,sellor
tradeanynaturalplant.

Thereshallbenorule
makingorlegislation,that
wouldprohibitor
otherwisetakeawaythe
rightofthepeopletoheal
themselvesnaturallywith
herbs,oils,tincturesor
anynaturalfoodsor
plants.
TheFreedomtoGardenHumanRightsRestorationAct

AnOrdinancetorestorethenaturalHumanRighttogrow
anduseplantsforthebasicnecessitiesoflife.

WhereasintheStateofCalifornia,thePeopleofthe
CountyofLakedoherebyFind,DeclareandOrdainas
follows:
Wheninthecourseofhumanevents,itbecomes
necessaryforpeopletoreaffirmandreestablishthe
fundamentalhumanrightswithwhichtheyarenaturally
endowed,andtoassumeamongthepowersoftheearth,
theequalstationtowhichthelawsofnatureandof
nature'soriginsentitlethem,andtorecognizeadecent
respectfortheopinionsofhumankind,requiresthatthey
shoulddeclarethecauseswhichcompelthemtocome
forwardtowardthereestablishmentofthoserights.

Weholdthesetruthstobeselfevident:
Thatallhumansbeingsarecreatedequal.Thathuman
beingsarenaturallyendowedwithcertainrights,andthat
amongthesearelife,libertyandthepursuitofhappiness,
andthattosecuretheserights,governmentsare
instituted,derivingtheirjustpowersfromtheconsentof
thegoverned,andthatwheneveranyformofgovernment
becomesdestructiveoftheseends,itistherightofthe
peopletoredeclareandreestablishtheinherenthuman
rightsthatwouldintrinsicallycorrectsuchgovernmental
negligence,andtoreconstitutesuchinaformastothem
shallseemmostlikelytoeffecttheirsafetyand
happiness.

Therefore,inaccordancewiththe9thAmendmentofthe
ConstitutionoftheUnitedStatesofAmerica,Amendment
IX:"TheenumerationintheConstitution,ofcertainrights,
shallnotbeconstruedtodenyordisparageothers
retainedbythepeople.",andalsoinaccordancewiththe
CaliforniaStateConstitution,Article1Declarationof
Rights,Section21.:
..."Thisdeclarationofrightsmaynotbeconstruedto
impairordenyothersretainedbythepeople.",
and,alsoasconsistentwithCountyofLakeOrdinance
No.2267inrelationtoprivatepropertyrights,and,

breedsortheweboflife,
orthatwouldthreatento
takeoveranaturalseed

makingorlegislation,that
wouldregulatingor
mandatingthepeopleto
forciblychemicalcultivate
orprocessourfoodor
preventthegrowing,
harvestingandstoringofit
naturally

Thereshallbenorule
makingorlegislation,that
wouldallowmassive
amountsofdangerous
chemicalstobesprayed
inouratmosphere,orto
otherwisepoisonourair
orfood

wouldallowpopulation

whereasdisregardandcontemptforcertainhumanrights
haveresultedinbarbarousactswhichhaveoutragedthe
conscienceofhumankind,and,whereasinaworldwhich
humanbeingsendeavortoenjoyfreedomofspeechand
belief,andwherefreedomfromfearandwanthasbeen
proclaimedasthehighestaspirationofpeoples
everywhere,beithereproclaimedthatithasbecome
necessarytoreaffirmandspecificallyreconstitutethe
selfevidentinherentfreedomtogrowanduseplantsas
describedherein:

Section1.,Findings:
Thathumanbeingsarenaturallyendowedwith
thefundamentalselfevidentrighttohaveandgrowthe
naturalplantsofthisearth,andthenaturallyoccurring
seedsthereof,
tobeusedfortheirownneedsasindividualsinpursuitof
lifeandinefforttolive,andthatsuchbasichumanrights
havebeenrecognizedandacknowledgedtoexist,and
thattheserightsareheldinperpetuityoutsideofthe
constitutionalresponsibilityofagovernmenttoprotectan
individual'srighttoengageincommerce.

Section1.(a)
ThatallCountyofLake
residentsresidingwithintheunincorporatedareasofthe
CountywhoexercisetherightsdescribedinSection1.of
thisActattheirresidencewithinsaidarea,andare
compliantwithSection
2.(a),andaregardeningoutside(outdoors)orina
greenhouse(andnotwithstandinganygenerallyapplicable
urgencyordinance(s)specificallyrelatingtowater
conservation),are,asaccordedintheparagraphsabove,
necessarilyexemptfromanyCountypermittingorother
Countyordinancesthatwouldlimitanindividual'shome
gardeningeffortsorabilitiesinconjunctionwithSection1.
Section1.(b)
Thatanylaw,totheextentthatitwouldspecificallydeny
ordisparagethehumanrightsasdescribedinSection1.
ofthisActisunconstitutionalbyboththeFederal
Constitutions9thAmendment,andalsobytheState
ConstitutionsArticle1DeclarationofRights,Section21,
andbythefactthatsuchselfevidenthumanrightsare
heldinperpetuitybythePeople.

Section2.,Responsibilities:
ShouldneighborcomplaintsthatarenotrelatedtoSection
Allchemicallycultivated
andgeneticallymodified
foodsmustbelabeledand
anyonecreatingor
growingorraisingfoodsin
suchawaycannotbe
immunefromprosecution
orlawsuitsbycourts,or
thepeopleclaimingtobe
harmedfromsuchfoods
orpractices
Anyrule,regulationor
prohibitiontothecontrary
ofthisactaredeemedto
benullifiedbytheadoption
ofthisact,
effectiveimmediately

2.(a)herein,orthatarenotrelatedtoaspecificmedically
verifiabletoxichealthrisktothepublicariseasanofficial
complainttotheCountyasaresultofanindividual(s)
exercisingtherightsasdescribedinSection1.,and
Section1.(a),(andnotwithstandinganyeffectedparty
choosingtoseekremedyandorreparationsbywayof
litigationthroughcivilproceedings),alltheeffectedparties
shallbedirectedtomediationprovidedforbytheCounty
ofLake,andifresolutionbetweentheeffectedparties
cannotbeachievedinareasonableefforttomediate(to
bedeterminedbytheappointedmediator),theeffected
partiesshallthencontinuemediationattheirownexpense
(tobeequallydividedbetweentheeffectedparties)untila
resolutionbetweenthepartiescanbeagreedupon,or
untiloneoftheeffectedpartieswithdrawsfromthe
mediation.
Section2.(a)
AllwhoexercisetherightsdescribedinSection1.,and
Section1.(a)ofthisAct,shalltakereasonablecareto
preventenvironmentaldestruction,andareresponsibleto
mitigateanypossibleforeseennegativeimpactsonthe
naturalenvironments,andallpersonswhoneglectsuch
practicesshallbesubjecttotheauthoritydesignated
underSection2.(b)herein,butsuchremediesaretobe
usedtohelpindividualscomeintocompliancewiththis
sectionandnottounreasonablyburdenindividualswho
exercisetherightsdescribedinSection1.
Section2.(b)
TheCountyofLakeEnvironmentalHealthDepartment
shalladministeroverindividualcircumstancesthatmay
ariserelatedtoSection2.andSection2.(a)herein,butall
suchadministrativeauthorityandcomplianceinquiries
shallberestrictedtocircumstanceswhereaverifiable
neighbor(orresidentofthecounty)complaintinwriting
andsignedbythecomplainanthasbeenofficially
registeredwiththecounty.

Section3.,SpecialCircumstances:
Anylaw,totheextentthatitwould
specificallydenyordisparagetheHumanRightsas
describedinSection1.ofthisAct,(andnotwithstanding
anindividualinviolationofusingillegalgardening
chemicals,includingbutnotlimitedto,certainpesticides,
herbicides,fungicidesandfertilizers),istobesetaside
unlessitcanbedeterminedthattheindividual
circumstanceisoccurringwithinthecontextof
"commerce"relatedactivitiesasdefinedherein,orif
anindividual'sviolation(s)ofSection2.(a)ofthisActare
totheextentofviolatingacriminalstatute.

Section3.(a)
ThisActshallnotapplyincircumstanceswhere(a)
privaterentalorleaseagreement(s)(contract)exist(s)
pertainingtotheoccupancyandoruseofanyprivateland
unlesssuchisotherwisespecificallyenumeratedwithin
saidagreement(s)(contract),orunlesstheagreement(s)
(contract)doesnotspecifyanyconditionsoragreement
pertainingtooutside(orgreenhouse)homegardening.

Section4.,Definitions:
(a)FortheexpresspurposesofthisAct,theword
"commerce"shallbetakentomean:
Thebuyingandsellingofgoodsorservices
inanyform,andindirectreferencetotheexchangeof
UnitedStatescurrency(orothersuchlegallyrecognized
tender)forsuchgoodsorservices.
(b)Fortheexpresspurposesofthis
Act,thewordsphrasedas"complianceinquiries"shall
betakentomean:
Awrittenanddeliveredinquiry,andaninpersoninquiryas
torespondingto(a)specificcomplaint(s),andtowhich
accesstoinspectprivatepropertyshallonlybein
circumstanceswheretherespondenthasvoluntarily
agreedtoandgrantedsuchaccess,orwhereonan
individualbasis,acourtorderhasprovidedforsuch
access.
(c)Fortheexpress
purposesofSection1.ofthisAct,thewordsphrasedas
"tobeusedfortheirownneeds"shallbetakentomean:
Foruseasfood,medicine,fiber,fuel,buildingmaterials,
environmentaldamagemitigationorotherenvironmental
concerns,privacy,aestheticsorambiance,
spiritual/religiousrequirement,(orother)basicnecessities
oflife.
(d)FortheexpresspurposesofSection1.ofthisAct,the
word"natural"andthewordsphrasedas"naturally
occurring"shallbetakentomean:
Plantspeciesandvarietiesofsuchthathave
evolvedinnaturethroughthetraditionalpollinationand
crosspollinationprocesses,bethatbywind/weather,or
animal(includinghuman)assistance.
(e)Fortheexpresspurposes
ofSection1.(a)andSection3.(a)ofthisAct,theword
"greenhouse"shallbetakentomean:
Anystructurewherethesun'slightcanpenetrateatleast
80%oftheroof(ceilingortop)surfaceandthatis
intendedforandusedforgrowingplantsin.

Section5.,Severability:
IfanyprovisionofthisActortheapplicationthereoftoany
personorcircumstanceisheldinvalid,suchinvalidity
shallnotaffectotherprovisionsorapplicationsoftheAct
whichcanbegiveneffectwithouttheinvalidprovisionor
application,andtothisendtheprovisionsofthisActare
severable.ThePeopleoftheCountyofLakehereby
declarethatwewouldhaveadoptedthisActirrespective
oftheinvalidityofanyparticularportionthereof.
