EXPLANATORY NOTE
Sponsored by: Hon. Amado C. Estrada
Upon the proclamation of the cityhood of Malaybalay, the spur of development
and groth as evidently manifested by the increase of its revenues.
Although it has augmented its revenues, the implementation of mar!et revenue
as still patent in the obsolete mar!et revenue legislation passed and approved several
years ago.
"ith this, it is deemed necessary to e#peditiously upgrade the establishment,
administration and management of the Malaybalay City $ublic Mar!et to ensure the
efficient and effective delivery of public service to the constituents of Malaybalay City.
%hus, the enactment of an &rdinance Establishing the Mar!et Code of the City of
Malaybalay.

AN ORDINANCE ESTABLISHING THE MARKET CODE OF THE CITY OF
MALAYBALAY
TITLE 1
GENERAL PROVISION

Secti! 1. Tit"e. %his shall be !non and be cited as the Mar!et Code of the City of
Malaybalay.
Secti! #. Dec"$%$ti! & P"ic'. *t is hereby declared a policy of the City of
Malaybalay to ma!e the $ublic Mar!et more responsive and effective
instrument of public service as ell as a dynamic and viable enterprise
thereby strengthening the financial capabilities of the City, and thus
significantly contributing to its local development. %oard this end, the
City shall develop, regulate and standardi+e the public mar!et system and
professionali+e the mar!et services.
Secti! 3. Sc(e & A(("ic$ti!. %his code shall govern the public mar!et of
Malaybalay City as hereinafter defined and including other public mar!ets
that may be established in the future, hether oned and,or managed by
the City -overnment or private groups of individuals, the provisions of this
shall apply to such public mar!ets as the Sangguniang $anlungsod may
from time to time designate. .i!eise to ba+aars, fairs, booths, stands
and others permitted on special occasions to be erected in public
thoroughfares or places such as vacant lots, hich may not have been
designated as public mar!ets by the Sangguniang $anlungsod.
Secti! ). De&i!iti! O& Te%*+. "hen used in this &rdinance, the folloing terms
shall be defined as follos.
/. A,*i!i+t%$ti-e P%-i+i!+. a provision in the ordinance on a particular
sub0ect created by an administrative agency through its regulations and
decisions.
'. A "$ c$%te 1 mobile eatery ith dishes listed and priced as separate items

Malaybalay City
5. Lc$" M$%1et A0t2%itie+ 1 refers to the City Mayor, his duly appointed
Supervisor,Administrator, the City %reasurer or any other City &fficial,s
charged ith the duty of day to day operations of the public mar!et and,or
specific aspects of such operations.
6. P03"ic M$%1et 1 refers to a place, building or structure of any !ind,
hether oned or leased from private persons, natural or 0uridical, and
operated by the City or managed by private persons or groups of
individuals designated by the service of the general public, and here
basic food items and other commodities are displayed and offered for
sale. $ublic mar!ets also include mar!et stalls, tiendas, buildings, roads
and the total area designated as the mar!et place.
7. M$%1et P%e*i+e 1 refers to any open space,s lot in the mar!et
compound, the mar!et lot consisting of service roads, bare ground
covered by the mar!et building, usually occupied by transient vendors
during mar!et days and the total lot area designated as the mar!et place.
8. M$%1et +t$""+ 1 refers to any allocated space or booth inside the public
mar!et building here merchandise of any !ind is sold or offered for sale,
and from hich regular fees are collected on a defined periodic basis.
). B$/+$1$! 1 refers basically to an open area here holesale goods,
commodities of foodstuffs offered for sale in one section or +one in the
mar!et.
/(. M$%1et Secti!i!/ 1 is the grouping together of same or similar goods,
commodities or foodstuffs or +one in the mar!et.

a. Seafood Section 1 area here fresh marine products, fish shells,
crustaceans, seaeeds and the li!e shall be sold.
b. Meat and Poultry Section 1 area here animals and fols, meat, cut9up
and cleaned in the authori+ed slaughterhouse and other
meat products, produced and supplied by the nationally
!non manufacturers,producers shall be sold,
provided that these meats, animals and fols shall be
separately displayed and goods properly labeled.
c. Dry good Section 1 area here te#tiles, :%";s, native products, toiletries,
novelties, footear, !itchenare, utensils, schools
supplies, grains and feeds shall be sold.
d. Grocery Section and Sari-Sari Store area here ca!es, biscuits,
pastries, butter, confections, candies, canned or bottled
goods, beverages, cigarettes and other household food
products shall be sold.
e. Fruits and Vegetables Section area here all !inds of vegetable, fruits,
coconuts and root crops and the li!es shall be sold.
f. Eatery and Carenderia area here all !inds of coo!ed and,or prepared
food shall be sold. %his includes refreshment parlors,
cafeterias, and other selling delicacies.
g. Cold Storage Service Section area here only refrigeration services
shall
be made available and the sale of ice in hatever
form shall be conducted.
h. Miscellaneous Section area here other businesses not classified herein
be alloed and conducted.

/'. St$""2",e% 1 refers to one ho has been granted the right to use a stall
here commodities or foodstuffs are displayed and sold, upon paying
guarantee deposit thereon.
/2. A*30"$!t4H$51e%+4Pe,,"e%+4T%$!+ie!t % Iti!e%$!t Ve!,%+ vendors
ho do not occupy a definite or permanent place or stall in the public
mar!et and ho sells goods either daily or occasionally by sitting or
moving from place to place ithin the mar!et premises.
/3. G,5i"" Fee is the amount paid by stallholders to the City
-overnment as a guarantee that their right of occupancy over the stalls
shall not be subleased or sold to another person. *n the event that a
stallholder so decides to cease doing business in their stalls, they are
obliged to surrender their rights to the Mar!et Authorities.
/5. F"e$ M$%1et4Ti$!//e refers to a place, building or structure usually
oned by private individuals here cheap basic foods and commodities
are displayed and offered for sale, but hich place does not have
complete amenities of a public mar!et.
/6. T%$!+&e% Fee the amount paid by the ne stallholder ho ta!es over
from the original stallholder
/7. H$51e%+ L$!e a place here ha!ers, peddlers and other transient
vendors are permitted to sell their merchandise during mar!ets days.
TITL# II
BASIC POLICIES AND REG6LATIONS
CHAPTER I
LOCATION7 ESTABLISHMENT AND CONSTR6CTION
SECTION 5. N0*3e% & M$%1et+. %he Sangguniang $anlungsod shall determine the
number of $ublic Mar!ets to be established in the city, hether city9
oned and,or managed by the city or private individuals or groups. %he
Sangguniang $anlungsod shall ta!e into consideration the need of both
the consumers and the traders in the City and the economic viability of
such mar!et.
Hoever, to ensure the spur of development and progress of the City
$ublic Mar!et, no mar!et hether city9oned and,or managed by the city
or private individuals or group shall be establish ithin the distance of
three <2= !ilometers from the Malaybalay City $ublic Mar!et.
SECTION 6 F"e$ M$%1et % Ti$!//e. %he establishment of flea mar!ets or tiangge
shall only be alloed on meritorious cases and upon approval of the
Sangguniang $anlungsod, the purpose of hich are for promotion of
trades and products and for generation of funds for religious, civic and
public affairs, tenure of operation shall be temporary and limited.
SECTION 8. Li*it$ti! ! T%$!+&e% & M$%1et Site. >o transfer of mar!et site or its
satellite shall be made unless conditions and development favorable to
the relocation or transfer of the mar!et site is obtained. %he Sangguniang
$anlungsod shall, after conducting of public hearing and by ma0ority vote,
transfer or relocate the mar!et site to a location more suited to current
needs and future developments and progress? provided further, that the
construction of the ne public mar!et shall be made in accordance ith
the provision of the >ational Mar!et Code of the $hilippines and other
e#isting las.
SECTION 9 N0*3e%i!/ O& St$""+. Each permanent stalls, stands or allocated
spaces for the use of vendors in the mar!et shall be given a number.
SECTION : P+ti!/ & R0"e+ $!, Re/0"$ti!+. %he CEE@M& shall post in English
and Ailipino, all rules and regulations approved by the Sangguniang
$anlungsod relating to the administrations, sanitation and good order of
such mar!et. Such rules and regulations shall be set forth the manner of
assignment, privileges to be granted to stallholders, tariff rates or rent of
stalls and such rules and regulations as deemed necessary.

SECTION 11 M$!!e% & E<(+i!/ Me%c2$!,i+e. All articles offered for sale in the
mar!et shall be arranged so that floor, stall stands and other places for
e#posing them can be easily and perfectly cleaned. *t shall be protected
against all !inds of insects and vermin and placed in a manner the
CEE@M &fficer or his authori+ed representative may direct.
Any container for merchandise shall be of such si+e, class and
condition as shall be suitable for the purpose for hich it is used.
SECTION 1# A++i/!*e!t & Ve!,%+. Cendors shall be assigned to sections,
according to the nature of the article intended for sale. Any attempt to
occupy any stall for any purpose other than that for hich it as
specifically assigned shall render void any privilege granted to the vendor
involved.
SECTION 13 A++i/!*e!t & A""c$te, S($ce Nece++$%'. >o person shall sell, offer
for sale, or e#pose for sale any article or articles in the public mar!et,
ithout first securing a ritten consent from the City -overnment after
payment of the reBuired fees.
SECTION 1) S2$!tie+ $!, St%0ct0%e. >o shanty or structure in the nature of an
independent room shall be permitted in or about the public mar!ets other
than the buildings authori+ed for the offices of employees or for other
official purposes. Hoever, any improvement,alteration made on the stalls
shall be reported and be approved by the City Engineer.
SECTION 15 O3+t%0cti! & F0!cti!+ & E*("'ee+. >o person shall resist or
prevent mar!et employees in the e#ecution of their duties as provided by
las or other applicable ordinances.
CHAPTER #
SANITATION
SECTION 16 C"e$!"i!e++ $!, S$!it$ti!. %he City $ublic Mar!et and its premises
under the supervision of the City Economic Enterprise @evelopment and
Management &ffice must at all time be !ept clean and in sanitary
condition to safeguard the health and safety of the buying public as ell
as the stallholders, vendors and mar!et personnel. Aacility for sanitation
and maintenance, such as cleaning and elimination of harborages,
cleaning and elimination of vermin shall be the responsibility of the
CEE@M& <City Economic Enterprise @evelopment and Management
&ffice=.
SECTION 18 S$!it$ti! 6!it. CEE@M& <City Economic Enterprise @evelopment and
Management &ffice= shall be the sanitation unit at the $ublic Mar!et. *t
must have an adeBuate number of personnel to ensure efficiency on the
maintenance of cleanliness and sanitation ithin the public mar!et and its
premises. %he cleaning of the public mar!et and its premises shall be
done daily and as often as necessary.
SECTION 19 Re+(!+i3i"it' & I!,i-i,0$" St$""2",e%+4Ve!,%+. *ndividual
stallholder shall !eep and maintain their stall in clean and sanitary
condition. %hey shall li!eise be responsible for the cleanliness of the
passageays, alleys and for their stall;s surrounding. %ogether ith the
local mar!et authorities and personnel, mar!et vendors and stallholders
shall be responsible for the general cleanliness and sanitation of the
public mar!et and its premises by performing pahinas usually every
Monday after tabo.

SECTION 1: F$ci"itie+ Re=0i%e, t 3e P%-i,e,>
%here shall be proper and adeBuate drainage and seerage system in
the public mar!et to ensure cleanliness and sanitation.
/. Appropriate facilities shall be installed to avoid pollution.
'. %he ground surface shall be properly drained and paved, and all
stands, stalls and mar!et fi#tures shall be constructed in such a
manner as the City Health &fficer and the City Engineer may approve.
SECTION #; ?$te% $!, D%i!1i!/ F$ci"itie+. %he public mar!et shall have available
ample ater supply for cleaning purposes.

SECTION #1 All ater and electric consumptions shall be shouldered in full by the
stallholders.

SECTION ## P03"ic Ti"et+ $!, ?$+2i!/ F$ci"itie+. $ublic %oilets ith adeBuate
lavatories for men and omen shall be !ept clean and saniti+ed at all
times by the assigned CEE@M& personnel. A fee of $hp
5.((,person,usage of the $ublic Mar!et Comfort :oom shall be collected
$hp 5.((.((,day shall be collected for the usage of the $ublic
Mar!et Comfort :oom to the members of Malaybalay Mar!et Cendors
Association <MAMACA= and their registered personnel.
SECTION #3 N Litte%i!/ Si/!+ . D>o .itteringE signs shall be posted in conspicuous
places to arn public mar!et users that such act is punishable by the la.
SECTION #) N0*3e% $!, T'(e & G$%3$/e Rece(t$c"e+. %he public mar!et shall be
provided ith large garbage receptacles ith proper cover for the
collection of all garbage and rubbish in the public mar!et and its premises
in consonance ith the solid aste management and the Clean and
-reen policies of the city. *n addition, an adeBuate number of garbage
cans shall be placed at strategic places for the garbage and rubbish of
public mar!et users. .i!eise, all stallholders and vendors shall have the
reBuired number of garbage cans.
SECTION #5 P0%(+e & C-e%. All garbage cans and receptacles shall be properly
covered and properly secured to !eep them from becoming the breeding
grounds of flies, rats, mosBuitoes, coc!roaches and other insects.
SECTION #6 Di+(+$" & G$%3$/e. Stallholders shall not place refuse on the floor,
stall or any place other than in the garbage cans provided for the
purpose. *t shall be the responsibility of the individual stallholders and
vendors to dispose off their garbage, rubbish and other refuse at the end
of each day by placing them in a receptacle referred to in Section '3
hereof.
"aste accumulated at each stall shall be transferred to the
designated central dumping area to facilitate efficient solid aste
management.
SECTION #8 Ti*e Sc2e,0"e &% C""ecti! $!, Di+(+$" & G$%3$/e. All the
garbage and the rubbish of the $ublic Mar!et shall be collected and
disposed of at to separate times, one in the morning and the other in the
evening as determined by the &ffice of the City Economic Enterprise.
SECTION #9 Me$t $!, P0"t%' P%,0ct+. %he City Ceterinarian pursuant to e#isting
las and ordinances shall inspect all meat and poultry products.
SECTION #: S$"e & M$%i!e P%,0ct+. &nly fresh fish or marine products, or dried
salted, smo!ed or fermented fish and marine products that are safe for
human consumption shall be sold. Aish and marine products caught by
means of e#plosives or by means of any poisonous substances or caught
in radio9active +ones as ell as in areas contaminated by the red tide or
to#ic substances and,or high in mercury count as determined by the
@epartment of Health <@&H= through the 4ureau of Aisheries and ABuatic
:esources <4AA:= shall be condemned and shall not be alloed for sale.
SECTION 3; P%tecti! $!, P%e+e%-$ti! & F,. All !inds of food, hich reBuire
no further coo!ing, shall be rapped, covered or enclosed in containers
to preserve their freshness and prevent contamination. Coo!ed foods
should be served hot and at all times protected from flies and other
insects and dirt.
SEC"(#) *+ !,,lication of the )ational Code on Sanitation
2/./ All provisions of the Code on Sanitation shall, henever applicable be
observed by and enforced upon the $ublic Mar!et and all the
establishments,
therein and their respective personnel.
2/.' Special effort shall be e#erted to strictly observe and enforce the
provisions of
the said Code on Sanitation relating to ater supply, food establishments,
seerage collection and disposal, e#ecutive disposals and drainage and
refuse disposal.
SECTION 3# C"e$!i!/ & M$%1et P%e*i+e+. All provisions of the >ational Code on
Sanitation shall be observed and enforced by all $ublic Mar!et users and
personnel. %he mar!et shall be provided ith all the necessary tools and
eBuipment for the cleaning and flushing of the floor drainage and toilets.
CHAPTER 3
MAINTENANCE OF P6BLIC MARKET
SECTION 33 M$%1et H0%+. %he public mar!et shall be opened at 3:(( A.M. and
closed at ):(( $.M. in accordance ith the reBuirements of security and
safety, order and sanitation.
SECTION 3) P%(e% I,e!ti&ic$ti!. All CEE@M& Staff shall be reBuired to display
conspicuously an identification card or other means of identification
prescribed and supplied by the City, such as proper earing of mar!et
uniform.
SECTION 35 Sec0%it' 6!it. Hired Security Agency in cooperatio(n ith the $hilippine
>ational $olice <$>$= shall provide the adeBuate security for the
protection of consumers and traders ithin the vicinity of the mar!et area,
provided that its members must be residents of the City of Malaybalay.
SECTION 36 L++e+ $!, D$*$/e+. %he City shall not be responsible for any loss or
damage any stallholders or vendor may incur in the public mar!et by
reason of fire, theft, force ma0eur or those incurred in regular business
operations. Any merchandise, goods or commodities left in the public
mar!et at closure time shall be at the ris! of the stallholder or vendor.
.ocal Mar!et Authorities, hoever, shall encourage stallholders to ensure
their commodities.
Hoever, the mar!et authorities shall e#ercise utmost vigilance
and care through the security unit under Section 26 hereof to prevent any
loss in the City Mar!et. And for this purpose, the security unit shall be
vested ith the authority to apprehend any offender of the Mar!et Code of
Malaybalay City and turn over the culprit and offender to the $hilippine
>ational $olice <$>$=.
CHAPTER 5
SERVICE AREAS4FACILITIES
SECTION 38 Se%-ice A%e$+. Storage facilities and other support and au#iliary mar!et
facilities such as those intended for ice and cold storage shall be
appropriately situated for efficient storage and distribution on perishable
good delivered to the City Mar!et.
SECTION 39 P$%1i!/ A%e$+. Ample par!ing areas shall be provided ithin the ne
vicinity of the public mar!et.
A. FEES. All spaces used as par!ing areas ithin the mar!et premises

SECTION 3:. Se%-ice R$,+. %he service roads ithin the mar!et premises at all
times be cleared from congestion and from any traffic obstruction to
ensure the free and smooth flo of vehicles thereof.
SECTION ); R$*(+ 5it2 R$i"i!/+ $!, St$i%5$'+. :amps ith railings and stairays
shall be placed in strategic visible locations near the approach points to
the mar!et structure in conformity ith the e#isting accessibility la to
enhance the mobility of the disabled persons hen necessary, regular
stairays shall complement the ramps installed in the public mar!et.
SECTION )1 O3+t%0cti! & P$++$/e5$'+. %o facilitate mobility, security and safety
at all time, mar!et aisles shall be free from any obstruction. Mar!et
officials and personnel, policemen and security guards detailed in the
vicinity of the public mar!et shall e#ercise strict vigilance on this matter
and en0oin strict compliance ith these provisions. .i!eise, stallholders
are strictly prohibited to e#tend the area of their stalls by placing their
goods and commodities offered for sale along passageays immediately
fronting or beside their stalls.
SECTION )# ?ei/2i!/ Sc$"e+. %he City shall provide eighing scales for the use of
the buying public to safeguard them against short eighing of
commodities. "eighing scales shall be located at strategic points in the
city mar!et.
CHAPTER 6
AWARD AND OCCUPANCY OF STALL
SECTION )3 A5$%, $!, A,@0,ic$ti!. Aard or ad0udication of nely constructed
vacant stalls shall be made pursuant to the provisions of this ordinance.
SECTION )) T ?2* t2e A5$%, M$' Be Gi-e!>
/. >o person shall operate a mar!et stall ithout first securing the
permits reBuired by the City. All applications for the aard of the
stalls shall be filled in the &ffice of the City Economic Enterprise of
the City of Malaybalay.
'. >o person shall sell, offer for sale, e#pose any article or articles in the
public mar!et or use, or occupy any stall ithout first having been
assigned to such stall in the manner prescribed herein. 4onafide
residents of Malaybalay City shall be given preference in the
occupancy or lease of stalls over non9resident applicants at the time
of the aarding of the stalls.
2. Cendors shall be assigned to a stall according to the nature of
merchandise or commodities intended for sale.
4. Stallholders shall not be alloed to occupy stalls or spaces other than
those assigned,aarded to them and it shall be the duty of the
Mar!et Administrator or his duly authori+ed representative to see to it
that the stallholders do not occupy other stalls or spaces.
SECTION )5 A((e$"+. Any applicant, ho is not satisfied ith the ad0udication made
by the Mar!et Committee of the stall applied by him, may file an appeal
for reconsideration.
SECTION )6 A,*i!i+t%$ti! & St$"". %he aardees of the mar!et stalls shall occupy
and personally administer the aarded stalls,booths. Stallholders shall
register all their employed helpers, including but not limited to the
spouse, parents and
children of the stallholder and ho are not disBualified under the
provisions hereof to the Mar!et Administrator. $rovided further, that the

transaction.
SECTION )8 S03ALe$+i!/ % D0**ie+ !t A""5e,. >o aardees shall sublet or
sub9lease the stall,space aarded. *f evidence is proven, outright
revocation of stall shall be implemented.
SECTION )9 Li*it ! N0*3e% & St$""+ A5$%,e,. >o person shall be alloed to
occupy more than one </= stall. *t shall be a violation of this section for
more than one member of a family consisting of the father, mother,
spouse, sons and daughters to hold stalls in the public mar!et unless
these sons and daughters are already living by themselves and
independently of their parents.
SECTION ): D0%$ti! & Occ0($!c'. %he duration of occupancy of the mar!et stalls
shall be reneable every year and such provisions shall be incorporated
in the contract to be e#ecuted for such purpose.
SECTION 5; Re-c$ti! $!, Di+=0$"i&ic$ti!. %he revocation of the right to occupy a
mar!et stall in the city public mar!et may be done for cause as provided
in the City Mar!et Code of Malaybalay, the e0ected stallholders shall be
disBualified from filing another application for the lease of another stall for
one year.
SECTION 51 A5$%,i!/ & V$c$!t St$""+>
/. Cacant stalls shall be aarded to applicants through the procedures to be
determined by the Mar!et Committee.
'. >ote of Cacancy of the stall or booths shall be posted for the period of not
less than ten </(= days prior to the date of actual aard to Bualified in
order
to apprise the public of the fact that such stalls or booths are vacant and
available for occupancy. Such notices shall be posted in the bulletin
boards
of the City Hall building and the City $ublic Mar!ets as ell as in the
vacant
stall or booth. An application of $/((.(( shall be collected from each of
the
applicant to cover the necessary e#penses and any e#cess thereof shall
form
part of the general fund of the City.
2. %he application and letter of intent shall be made under oath. %he
application and letter of intent form shall be made available at the &ffice of the
City Economic Enterprise. %he applicant either in person or through
authori+ed representative shall submit the duly accomplished form at the
same office.
3. *t shall be the duty of the CEE@M& to !eep a registry boo! shoing the
names and addresses of all applicants for vacant stalls or booths. %he
number and description of the stall,booth applied for by them, and the
date and hour of receipt of such application.
5. Aarding of mar!et stalls shall be done through draing of lots.
6. Stallholders are alloed to posses one stall only.
7. %he aarded applicant shall furnish to the local mar!et committee to <'=
copies of his pictures immediately after the aard of the stall,both. *t shall
be the duty of the local mar!et committee to affi# one </= copy of the

transferred to said parents, spouse or legitimate children provided that the local mar!et

SECTION 5: Ti*e $!, M$!!e% & P$'*e!t.
A. :ental for mar!et fi#ed stalls shall be paid to the City %reasurer or his
duly authori+ed representative on or before the first tenty <'(= days
of each month? in the case of the ne occupants, the rental for three
<2= full months shall be paid immediately upon occupying the stall.
4. '(H of the goodill fee shall be paid by the stallholder prior to the
aard of stall and the remaining balance shall be paid by eBual daily
payment for a period of 2 years provided, hoever, that the
stallholders ho desire to pay their annual goodill fee in cash may
do so and are entitled to a /(H discount, if paid ithin three <2=
months.
C. %he fee for the occupancy of mar!et premises shall be paid daily in
advance, before any commodity or merchandise is sold ithin the
mar!et premises.
@. Aor mar!et entrance fees, the toll shall be collected at the gate of the
$ublic Mar!et before transient vendors are alloed to sell their goods.
E. Surcharges shall be added to the delinBuency accumulated in a
month in a collection letter. *f after three months, delinBuency is still
incurred, a notice of foreclosure shall be sent to the oner and shall
be brought to the City Mar!et Committee for deliberation and final
decision.
A. &ld vendors in good standing shall have a /(H discount on -oodill

RESTRICTIONS

/. %he City Mar!et Committee shall promulgate such rules of conduct as
maybe applicable ithin the mar!et premises to render efficient
mar!et management and operation in cooperation and consultation
ith the Sangguniang $anlungsod and E#ecutive of the City.
'. %he name and pictures of the stallholders and those persons
authori+ed by the stallholders to be their helpers in the daily business
operation shall be registered ith the &ffice of the Mar!et Authorities.
SECTION 61 Pe,,"i!/ $!, H$51i!/>
/. >o person shall peddle, ha! or offer for sale or e#pose for sale any
article in the passageay of aisle used by the buying public in the City
Mar!et.
'. %he $eddling or sales of foodstuff, hich deteriorate easily, li!e meat
or fresh marine products outside the mar!et premises are hereby
prohibited. %he Mar!et Authorities and %as! Aorce of CA*CC%A ith
the assistance of the $hilippine >ational $olice is given the authority

A. >o fish, meat or goods sub0ect to putrefaction shall be sold
outside the Malaybalay $ublic Mar!et and ithin the territorial
0urisdiction of the // 4arangays of the poblacion, e#cept in
duly licensed et mar!et, $:&C*@E@, that those sold outside
the public mar!et and the // barangays of the $oblacion be
displayed only in places designated by the barangay
concerned, $rovided, further, that these items be sold only
after compliance ith the necessary health and sanitation
regulations. $rovided, finally, that the holesale of fish shall
only be done inside the Malaybalay $ublic Mar!et.
4. Any violation of this section shall be punishable by the
application of the provision of this code, e#cept the violation of
the last sentence of the preceding section, hich shall be
punishable by an imprisonment of not more than one year or a
fine of not more than $', 5((.(( at the discretion of the court.
'. .ocal mar!et authorities shall designate appropriate areas ithin the
open space of the mar!et premise, here peddlers, ha!ers, and
other transient vendors can occupy during mar!et days and its allotted
time, hich is from 3:(( p.m to 8:(( p.m only.
2. $eddlers or transient vendors shall not be permitted to e#pose or sell
merchandise on sideal!, par!ing areas, service roads or places
designed and,or intended for passage of the general public in the
mar!et.
3. Mar!et officials and personnel, police officers and,or security guards
detailed in the vicinity of the public mar!et shall e#ercise strict
compliance of the provisions of this Section.
SECTION 6# St%$' A!i*$"+. The mar!et authorities shall ma!e sure that no dogs or
other animals are left astray in the premises of the city mar!et, stray dogs
should be caught and impounded. $enalty after the redemption of dogs

SECTION 63 I""e/$" C!+t%0cti!. %he construction of permanent or temporary
delling Buarters and stalls inside the mar!et premises by stallholders,
vendors or individuals shall not be alloed and should be rendered illegal.
SECTION 6) A3$!,!*e!t & St$""+4Bt2+. Stall or booths !ept closed, unattended
or not operational for si#ty <6(= consecutive days shall be considered
abandonment and the lease contract to such stall or booth shall be
deemed terminated and the registered stallholder e0ected. As an
e#emption to this provision, prior formal notification to the mar!et
administrator for such temporary closure of stall or booth should be filed
by the registered stallholder and the payment of the mar!et fees for the
duration of the temporary closure shall be paid in the manner as provided
under this Code.
SECTION 65 A3$!,!*e!t & A%tic"e+4C**,itie+. Any article,commodities or
merchandise abandoned in the stall or booths or any place ithin the
mar!et premises in violation to any provisions of this code shall be
deemed a nuisance and the custody of hich shall be deemed the
responsibility of the CEE@M&. *n case the abandoned articles,
commodities or merchandise are claimed ithin tenty9four <'3= hours
thereafter, they shall be billed for e#penses incurred during the
safe!eeping. "hen the articles, commodities or merchandise have so
deteriorated as being ha+ardous to public health, in hich case, they shall
be disposed off in the manner approved by the mar!et authorities, hile
the same may be recommended by the mar!et authorities for revocation
of lease and the e0ection from the stalls if the offender is a registered
stallholder. *f the articles, commodities or merchandise have not
deteriorated and are not claimed ithin the time herein fi#ed, said items
shall be sold at public auction and the proceeds shall be accrued to the
general fund of the City.
SECTION 66 St$"" 2",e%+ are not alloed to alter or introduce any improvements in
their respective stalls.
SECTION 68 L$&i!/7 Lite%i!/7 Be//i!/ $!, t2e Li1e. Any person having no laful
business in or about the city mar!et shall not be alloed to idly sit,
lounge, or lie in or about the mar!et premises. 4eggars and solicitors of
alms or contributions of any !ind shall li!eise not be alloed ithin the
mar!et premises. -ambling, 0ueteng or any game of chance shall be
strictly prohibited ithin the mar!et premises.
SECTION 69 P%2i3iti!. >o stallholder in the city mar!et shall be alloed to store
gasoline, crude oil, fire crac!ers, pyrotechnic materials and other
petroleum products that are highly combustible e#cept if such products
are necessary in the course of the business.
TITLE III A ADMINISTRATION
CHAPTER 1
ADMINISTRATION OF THE CITY P6BLIC MARKET
SECTION 6: T2e Cit' M$%1et C**ittee. %here is hereby established a Mar!et
Committee to be composed of the City Mayor or his duly authori+ed

SECTION 8; %he City Mar!et Committee shall perform the folloing functions

mar!ets, tiangge ta!ing into consideration the provisions of this ordinance
and other .as.
2. %o establish rules and regulations relating to the administration, sanitation
and good order of the mar!ets, application for mar!et stalls, its reBuirements
and conditions.
3. @etermine from time to time the rates to be paid for the use of all stalls,

effective,efficient development of the City mar!ets.

8. Ad0udicate the transfer of stallholders from one section to another or from one
stallholder to another.
). Certify to the Sangguniang $anlungsod measures necessary to amend the
Mar!et Code of Malaybalay City to conform to the City;s goal and ob0ectives
on the day9to9day operations of the City Mar!et.

that directly affect the operation of the public mar!et through the City Anti9

SECTION 81 M$%1et C**ittee. %he Mar!et Committee is hereby created hose
composition, functions? duties and responsibilities are embodied in this
Section of the City Mar!et Code.
CHAPTER II
MARKET PERSONNEL
SECTION 8# CEEDMO O&&ice%. %he CEE@M& &fficer directly control and
supervises the City $ublic Mar!et and all subordinate personnel thereof
as authori+ed by the City Mayor.
SECTION 83 M$%1et C""ect%+. Mar!et collectors shall be bonded and shall be
directly under the City %reasurer in accordance ith the e#isting
ordinances and other rules and regulations pertinent thereto in so far as
collections, remittances and reporting of collections are concerned. %he
CEE@M&, hoever, shall supervise actual collection activities including
the assignment of mar!et collectors in the mar!et stores and premises.
SECTION 8) Aunction, $oers and @uties of the City Economic Enterprise
@evelopment and Management &fficer= shall:
/. E#ercise general supervision over the management and operation of
the public mar!et?
'. Enforce all las, rules and regulations affecting mar!et management
and operations?
2. Assist in the formulation of the budget for operation of the mar!et prior
to submission to the Sangguniang $anlungsod?
3. $ropose and coordinate plans and programs for the public mar!et on
all aspects of mar!et operations including lin!ages?
5. $ropose the revision of the mar!et fees to the Sangguniang
$anlungsod based on the standard set forth in this code?

collaboration ith the City %reasurer indicating mar!et income and
e#pense to be submitted to the City Mayor and the Sangguniang
$anlungsod? and
7. $erform such other functions and duties that may be assigned by the

SECTION 9: Any occupant ho is delinBuent in the payment of his rental for '
consecutive months shall forfeit his right to his booth or stall occupied by
him and shall be e#pelled from his booth or stall ithout the necessity of
Court action to serve the best interest of the government and ithout
detriment to the collection of delinBuent rental due through Court action,
goods, articles or merchandise found on hand, inside the delinBuents
booth or stall at the time of the delinBuents forfeiture shall be inventoried
in the presence of the delinBuent booth or stallholder ith their
corresponding inventory values duly receipted for impoundment until the
delinBuent rentals are fully paid or sold at public auction to satisfy the
amount of the delinBuency.
SECTION :; Aor failure to settle the administrative fine, the violators shall be directed
to report to the City Economic Enterprise @evelopment and Management

TITL I' ( PNALTY PRO'ISION
SECTION :# Pe!$"t' &% P%2i3ite, Act+. Any person violating, causing, inducing or
abetting the violations of any prohibitory provisions of this Code shall
upon conviction of the court, suffer the penalty of a fine of not less than
Aive Hundred $esos <5((.((= for the first offense, a fine of %o thousand
<',(((.((= for the second offense and a fine of %o thousand five
hundred pesos <',5((.((= for the third offense or imprisonment of not less
than si# <6= months and revocation of the permit to occupy a stall in the
public mar!et and the guarantee deposit in case the violator convicted is
a stallholder.
SECTION :3 Se""i!/ C!&i+c$te, G,+. .a enforcers, public mar!et authorities or
security guards ho confiscate goods from any vendor, ambulant or
otherise and sell or offer these goods for sale by himself or through a
third person shall be penali+ed under Section 75 or any applicable sub9
section of the provisions of the >ational Mar!et Code of the $hilippines.
SECTION :) ?ei/2t $!, Me$+0%e+.
a. &nly the eighing scales alloed by CEE@M& for use at the
%imbangan shall be used in eighing agricultural products li!e hogs,
fols, vegetables, fruits or rootcrops intended for sale at the City
$ublic Mar!ets. %he payment of "eighing scale use ill be /H of the
gross value.
b. >o persons are alloed to sell agricultural products li!e hogs, sine;s,
fols, vegetables, fruit or root crops intended for sale at the City
$ublic Mar!et unless the same have been inspected and eighed by
the City Mar!et Supervisor or his duly authori+ed representatives and
mar!et entrance fees therefore are imposed and paid for.

TITL ' ( FINAL PRO'ISIONS
SECTION :5 Se($%$3i"it' C"$0+e. *f for any reason, any part of this Code shall be
declared to be unconstitutional or invalid, other parts of provisions hereof
hich are not affected thereby shall continue to be in full force and effect.
SECTION :6 Re(e$ti!/ C"$0+e. All ordinances, rules and regulations or parts
thereof, inconsistent hereith are hereby repealed or modified
accordingly.
