RECOMMENDATION(S):
By roll call vote, adopt a Resolution Authorizing the Mayor to Execute an Employment
Agreement between the City of Carmel-by-the-Sea and Douglas J. Schmitz, City
Administrator.
EXECUTIVE SUMMARY:
The October 2, 2014 Special City Council meeting, the City Council appointed Douglas
J. Schmitz as City Administrator for the City of Carmel-by-the-Sea. Mr. Schmitz start
date was Monday, October 6, 2014.
Mayor Burnett appointed an AdHoc Council committee to work with the City Attorney
and Mr. Schmitz regarding the terms of the contract. The final contract (Exhibit "A") is
attached for Council approval.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA
AUTHORIZING THE MAYOR TO EXECUTE AN EMPLOYMENT AGREEMENT
BETWEEN THE CITY OF CARMEL-BY-THE-SEA AND DOUGLAS J. SCHMITZ, CITY
ADMINISTRATOR.
WHEREAS, the City Council of the City of Carmel-by-the-Sea has conducted an
interview for the position of City Administrator; and
WHEREAS, the City Council thereafter offered the position of City Administrator
to Douglas J . Schmitz; and
WHEREAS, the City Council wishes to set forth the terms and conditions of
employment in a written agreement with Mr. Schmitz;
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of
Carmel-by-the-Sea that the attached employment agreement entitled Employment
Agreement (Exhibit A) is hereby approved, and the Mayor is directed to sign the
agreement for and on behalf of the City of Carmel-by-the-Sea.

Exhibit A
EMPLOYMENT AGREEMENT BETWEEN THE CITY OF CARMEL-BY-THE-SEA AND
DOUGLAS J. SCHMITZ

This agreement is entered into on this ________day of November 2014 between the City of Carmel by
the Sea (CITY) and Douglas J . Schmitz (EMPLOYEE) with an effective date of 6 October 2014.
STATEMENT OF PURPOSE: CITY desires to employ EMPLOYEE as its City Administrator.
TERM: Parties agree that this agreement shall be in effect from 6 October 2014 until such time as either
party provides the other at least 45 days written notice of intention to conclude the relationship.
VACATION: EMPLOYEE shall accrue vacation at a rate of ten (10) hours per month and shall begin
service with a balance of eighty (80) hours in his account.
MANAGEMENT LEAVE: EMPLOYEE shall receive forty (40) hours of Management Leave per fiscal
year, including 2014-15. Parties acknowledge that EMPLOYEE had previously committed to attend a
conference out of state in November 2014 and will utilize some of the 2014-15 Management Leave for
that purpose.
SICK LEAVE: Employee shall accrue sick leave at a rate of eight (8) hours per month and shall begin
service with a balance of fifty (50) hours in his account.
SALARY: EMPLOYEE shall receive $ 175,000 annually.
OTHER BENEFITS: EMPLOYEE will be entitled to paid holidays observed by the City organization,
retirement benefits and payments and life insurance. CITY will contribute $550 per month to
EMPLOYEES Deferred Compensation account. EMPLOYEE will not be entitled to an auto allowance,
health, dental or vision insurance coverages or cash in lieu thereof or a CITY issued cell phone or a cell
phone stipend. If EMPLOYEE chooses to attend any conferences, such expenses will be at EMPLOYEE
expense unless directed to attend by the City Council.
OUTSIDE EMPLOYMENT: Employee shall not be engaged in any other employment during his service
to CITY.
SURETY BOND: Parties agree that EMPLOYEE shall maintain on file with the CITY a faithful surety bond
in the principal amount of $100,000 or an amount as may be determined from time to time by the City
Council. Said bond premium shall be paid by the CITY pursuant to the Municipal Code.
REVIEWS: CITY shall undertake a performance review of EMPLOYEE at least every six months.
EXPENSES: Should EMPLOYEE incur job related expenses during his service, CITY shall reimburse
EMPLOYEE for those costs. CITY will reimburse EMPLOYEE up to $500 for relocation expenses upon
presentation of receipts.
This is the agreement in its entirety. The parties may make adjustments to it by mutual consent.
