REGULATIONS FOR WORK & INTERNSHIP IN THE NETHERLANDS
Applicable only to students registered as full-time students at RSM or
graduates of RSM!! An internship DURING your study: Any student that wishes to do an internship in the Netherlands during their study may do so without a work permit. An internship AFTER your study/graduation:
Whether persons without the Dutch nationality are allowed to work in the Netherlands is established in the Wet Arbeid Vreemdelingen. Citizen of the EU/EEA and Switserland Citizens of the EU/EER and Switserland, with the exception of Romanians and Bulgarians, have free access to the Dutch labour market. If someone wants to do an internship after their study/graduation, the employer does not need to apply for a Work Permit (TWV). This is in accordance with the EC treaty. Citizens of Romania and Bulgaria Romanians and Bulgarians also belong to the European Union but for them a transitional provision in the law applies to the execution of labour. The limited access of Romanians and Bulgarians to the Dutch labour market is based on the Legal Acts of entry into the EU of Romania and Bulgaria. This transitional provision in the law means that if Romanians and Bulgarians wish to conduct paid labour, the employer is obliged to possess a Work Permit (TWV) for that person for twelve months. If that person has conducted actual and practical labour with that employer, they will get full access to the Dutch labour market. - When a Romanian/Bulgarian does an internship during their study, the employer does not need a Work Permit; only the internship agreement: http://www.rsm.nl/portal/page/portal/RSM2/attachments/doc1/Nuffic %20stageovereenkomst%20EN1.doc - When a Romanian/Bulgarian does an internship after graduation and resides in the Netherlands on the basis of the EC treaty, the employer needs to have a Work Permit, unless the intern has already conducted actual and practical labour with an employer that had a Work Permit for him/her.
- When a Romanian/Bulgarian does an internship after graduation and the
application for residence during the search year graduate has been approved, the graduate can conduct labour during the search year without a Work Permit. Citizens of non-EU/EEA countries and Switserland - When doing an internship during the study and the employer has the internship contract with the student and university, the employer does not need to apply for a Work Permit. http://www.rsm.nl/portal/page/portal/RSM2/attachments/doc1/Nuffic %20stageovereenkomst%20EN1.doc - When the application for residence during the search year graduate has been approved, the graduate can conduct labour during the search year without a Work Permit. The purpose of stay will have to be changed from residence during search year graduate to work as an employee. See Vreemdelingencirculaire (B) 5/ 2.5. - When the person is in possession of a residence permit with the additional labour market note labour free permitted, no Work Permit necessary ('Arbeid vrij toegestaan, TWV niet vereist'), that person can of course do an internship after graduation and the employer does not need to apply for or have a Work Permit. - When the person is in possession of a EU/EEA residence document with the additional note 'family member of a citizen of the Union', the person may do an internship after graduation and the employer does not need to have a Work Permit. A job AFTER your study/graduation: The same conditions as above apply for working under employment (permanent or part-time job/contract) after studying. A job DURING your study: However, if you wish to work during your study, (not an internship), other conditions apply. Citizens of the EU/EEA and Switserland Citizens of the EU/EEA and Switzerland, with the exception of Romanians and Bulgarians, have free access to the Dutch labour market. If the student is employed, the employer does not need a work permit. Citizens of Romania and Bulgaria If a Romanian or Bulgarian students wants to work during their study, the employer must have a Work permit for the student, unless the student has already conducted actual and practical labour with an employer with a Work Permit or if the Romanian or Bulgarian is in possession of a Residence Permit with the note labour free permitted, no Work Permit necessary ('Arbeid vrij toegestaan, TWV niet vereist'). Citizens of non- EU/EEA countries and Switserland If a student has a Regular Residence Permit for Study, the student can work a maximum of 10 hours per week or conduct seasonal work in the months June, July and August. For conducting labour of additional kind the student needs a Work Permit. If the student has a Residence Permit with the note labour free permitted, no Work Permit necessary ('Arbeid vrij toegestaan, TWV niet vereist') or an EU/EEA Residence Document with the note family member of a citizen of the Union ('familielid van een burger van de Unie'), the student may work during the study without a Work Permit.
