COMPLAINT# 20140876524

The evidence, information, and other data led me to conclude:


On September 20.2014 between 2230 and 2245 James R. Bironas left his home at 101 Loring Court. Driver 1 then
drove east on Battery Lane between Loring Court and Franklin Pike. At that intersection he was met by a group of
people driven by Mr. Spencer Lathrop in a car to his left. Both parties turned left to Franklin Pike and according to the
other party Driver I chased them on northbound Franklin at speeds of up "110 miles an hour." The members of this
party assert Driver 1 followed them as far as Acklen Avenue. On southbound Franklin Pike between 2250 and 2303
on September 20. 2014 Ms. Cynthia Wilde observed Driver 1 following them. According to Ms. Wilde's statement
Driver l passed them going west on Battery Lane. Prior to the crash Driver I drove in the curve east of the crash site
at a speed of 73 miles per hour. traveled west on the north shoulder of Battery Lane for approximately 236 feet. struck
a tree, rotated counterclockwise. and came to final rest in the creek bed below. According to statements from MNFD
EMS Cameron Myers Driver 1 was dead on the scene but they transported him to VUMC because he was treated
inside the ambulance. The Report of the Davidson County Medical revealed Driver 1 died from blunt force injuries.
The toxicology report indicated a blood alcohol level of .218% and a controlled substance (diazepam) level of 9 ng/ml
blood. The level of diazepam was less than the therapeutic level for the drug as listed on the Winek Toxicology Data
Table (2001). The cause of the crash was Driver l's failure to maintain the proper lane and exceeding the posted
speed limit. This case is now closed.

Around 2245 hours on Saturdav. the 20th dav of Sentember I was disnatched to the narkine garaee of Belmont
Universitv near the intersection ofWedgewood Ave and 15th AveS. Officer Riddle and myself met with our
comolainant Connor Fralev. and three other individuals who were all ridinl! in the same vehicle Mr Fralev stated to

me that he was a passentzer in the vehicle (a

E_-lS01andJhev had been driving on Franklin Pke. Mr. Fralev

stated that thev had come to an intersection at Franklin Pke and Batterv Ln when thev rolled up next to Mr. Bironas'
vehicle (thev did not know the identitv of the oerson at this time). Mr. Fralev and his friends noticed that Mr. Bironas'
car was makin_g_ a weird noise and that it didn't sound good so they spoke to Mr. Bironas from their car window to let
him know that it seemed like something was wroqg_ with his car. Mr. Fraley_ stated to Police that Mr. Bironas looked
over at them and stated "I'm 2oin2 to kill

in your vehicle." Mr. Fraley_stated that he was shocked with what

he had heard and he and the other passengers didn't know what to do. Mr. Fraley stated that they continued drivine but

Mr. Bironas started to follow them in a reckless manner swervinp; all over the road and causing them to have to speed
up to "60-70moh." Mr. Fraley stated thatthev had made a number of turns goinR: down streets such as South Douglas
Ave and Acklen Ave trving to evade Mr. Bironas. Mr. Fraley stated that Mr. Bironas had come verv close to hitting
their vehicle. Mr. Fralev told oolice that eventually,_ near the intersection of Acklen Ave and Wed_gewood Ave it.
appeared that a police car had pulled behind Mr. Bironas' white SUV and made a traffic stop on it. I checked with our
dispatch to see if a traffic stop had been initiated by anv officer in this area at the time Mr. Fraley had given me. Police
dispatch stated that they didn't have record of a traffic stop occuring in that area. Mr. Fraley stated to me that he did
not want a

filed but he didn't know what to do while being chased so he called police bovine; that we could

intervene and stop/find Mr. Bimnas' vehicle.

On 09/2212014 at approximately 224S hours Officer C. Harris (823C) and I (821C) were dispatched on a call allhe parking garage located near \Vedgcwood
Avenue and 15th Avenue South. When we arrived at the scene we fowtd the victim's In lhe parJcing garage on the side that was closer to Wedgewood Avenue.
The victim Connor Fraley had another male and two females who were inside of the vehicle with him when the incident occurred. Connor Fraley stated that
when they approached the intersection of Battery Lane and Franklin Pike they bad noticed a weird noise coming from lhc vehicle that was beside them at the
intersection. Connor Fraley stated that the vehicle beside them was a white SUV possibly a Chevrolet Tahoe or GMC Yukon, which was later discovered to
be the vehicle operated by Rob Bironas. Connor Fraley stated that he rolled down the window and stated to Rob Dironas that I think something Is wrong with
your vehicle. Connor Fraley stated that Rob Bironas then stated to him "I will kill everyone in lhe vehicle". Connor Fraley stated that the driver then repeated
the statement Connor Fraley stated that he then pulled away from the intersection and begun traveling inbound on Franklin Pike. Connor Fraley SUited that
Rob Bironas then pulled out bebind him and started following him. Connor Fraley stated that Rob Bironas then started attempting to crash into him. Connor
Fraley stated that he then sped up attempting to gel away from Rob Bironas. Corutor Fraley stated tltat he hod been traveling at approximately 60-70 miles per
hour attempting to get away from Rob Bironas. Connor Fraley stated that be had made several attempts to get away from Rob Bironas by tlmling onto South
Douglas Avenue, AcklenAvenue, and lOth Avenue South. Connor Fraley slated that when be approached the intersection of Acldc:nAvenue and
Wedgewood Avenue he saw blue lights and thought that Rob Bironas had been pulled over. Connor Fraley stated that he then drove to the parking garage
where he met Officer C. Harris and I. Connor Fraley stated that he was not followed by Rob Bironas to the parking garage. Officer C. Harris attempted to
have dispatch find the traffic stop on Rob Bironas that Connor Fraley had claimed to have seen. Dispatch was unable to find the traffic stop and stated that
there had not been any traffic stops in that area. Officer C. Harris then offered to take a report for the victim, but he declined and did not want a report done.
The other three individuols who were in the truck conf11111ed the statements made by Connor Fraley. The vehicle crash involving Rob Bironas occurred
minutes prior to Officer C. Harris and I leaving the scene. After we left the scene officer C. Harris went to the scene of the crash and I went on another call.
After I got done on tbe call I was dispatched on 1 went to the scene of the crash and blocked of the roadway at Battery Lane and Church wood Drive until the
investigation was complete.

I responded to a 10-46 roll over at 890 Battery Lane where the witness stated that the driver
of a white SUV was driving reckless and drove off the road. When I arrived, I observed paramedics
assessing the victim of the roll over in the back of the ambulance. I asked the district fire chief had
they pronounced the driver deceased yet. He informed me they were on the phone with Vanderbilt
who just advised that he was deceased. At that time I was informed the driver of the vehicle was Rob
Bironas. I informed Sergeant Fondaw the driver was deceased and to inform Sergeant Lovell who
was the on duty fatal crash supervisor. I was later informed that the Paramedics transported the driver
to Vanderbilt Hospital by Sergeant Fondaw. Dispatch notified me there was a missing person's call in
the pending where the complaihant wanted to report the driver missing. I instructed Officer
Stambaugh to respond and to get a detailed statement from the complainant a timeline of the events
leading up to the crash. I instructed Officer Stambaugh not to inform her of her husband's passing
until the Chaplin's arrival. I assisted with Sergeant Fondaw' s command until I was instructed by
Captain Starling to assist the chaplain in esc01ting them to the his residence.

I was advised via ECC of a 10-46 located at 890 Batterv Lane involvine: a roll over sing[e car accident. Once units
were on the scene I was advised oer 811C (Officer Winl!:o) that the victim hadnossible code 3 iniuries. I was notified
a short time later that the victim was traooed and in the nrocess of beit12 extricated. Based on the totalitv of the
information at hand I resoonded to the scene. Uoon mv arrival I advised officers to oushback onlookers and be2in
establishing a crime scene utilizine: crime scene taoe. After the victim {Rob Bironas) was extricated I was advised
that oaramedics on the scene ran a strio and deemed that the victim could no

sustain life and wouldn't be

transported. I established a command (time 2349 hours), notified the fatal crash team and requested more units to
assist with road closures. As I was in the process of makimz calls and notifications I was advised that the oaramedics
decided to transomt the deceased desoite their initial statements that thev were not g_oin1! to be transnortin2. I
immediatelY_ notified Lt Gilliland ITraffic Section) of the change and started 832Cl_Officer Stambau1!h) to Vanderbilt
Hospital. Officer Stambaugh's resoonsibility was to pteserve the body as a crime scene and gather information as to
any_ and all that handled the body. The Field Captain was notified and responded to the scene. Lt Leavitt {C Detail
Lt} was phoned and advised of the situation. Based on the nature of the victim's celebrity_ status, Don Arron was
notified and responded to the scene as well. Once traffic was on the scene Lt Gilliland facilitated the investil!ation as
itpertains to the elements of the crash. Chaplains were 12_ag_ed out and responded to the scene to assist with the
notification. While on the scene as incident commander I assured that all entities were within deoat1mental
compliance and acted as a liaison between all elements involved. As the incident was deescalating and resources were
no longer needed I delegated the role of incident commander to unit 823C (Officer Ranis}. The time of the transfer
was 0221 hours.

COMPLAINT# 20140876524

On Saturday the 20th day of September 2014 at 2354 hours I was notified of an apparent single vehicle, single
occupant, DOA, and non-prosecutable fatal crash on Battery Lane at Dustin Lane. When I arrived on September
21st, 2014 at 0039 hours I observed Officer Johnson and SGT Lovell on the scene gathering information with
Field CPT Starling and SGT Pachciarz. I observed a white GMC SUV (Vehicle I) on the creek bank on the north
of the roadway with airbags deployed and the seatbelt in a worn position.

I observed a deciduous tree on the north shoulder of the roadway south of Vehicle 1. This tree was damaged
with at least one limb missing as if it was struck by Vehicle 1. The body of the deceased, James R. Bironas, was
removed from the scene and was transported to VUMC. I walked east from the tree and located a surface void.
Approximately 113 feet east ofthis void I located a 123 foot 8.34 inch scrape running parallel to the roadway.
Vegetation was pushed to a northwest position. This was the best evidence of a path of event travel for Vehicle 1.
Officer Augustine was present and gathered other information pertinent to the crash. Officer Johnson and I
mapped the crash and once we completed this we began the recovery.
Officer Bell ofthe DUI unit was at VUMC with the deceased (Driver 1) and was met there by Officer Smith
of Patrol. Officer Bell detected no sign of intoxication in the form of odor. Officer Smith and Lieutenant
Gilliland maintained security at VUMC after Officer Bell left.
I learned of a call which was initiated by one Rachel Bradshaw (Driver 1's spouse) which was filed under
complaint number 20140876787. At 2340 on September 20th, 2014 Ms. Bradshaw notified Emergency
Communications her husband was missing. The text of the call gave details of his absence which allegedly began
at 2140 hours. The originating address was 104 Loring Court which is less than .5 miles from the crash scene.
Ms. Bradshaw filed a Matter of Record Incident Report for the missing status which listed the incident date and
time as September 201h, 2014 at 2230. On September 26th, 2014 at 1220 I spoke with Ms. Bradshaw. She advised
that her last actual siting of Driver 1 was between 2145 and 2200 at 104 Loring Ct. when he claimed to be going
to bed. She stated she was unsure of the actual time because everything seemed ''normal" prior to his retiring for
the night. Ms. Bradshaw furnished me with the passcode to Driver l 's !Phone to which I obtained a search
warrant. Ms. Bradshaw can be reached at 615.305.6556.
Ms. Jenna Pate was a visitor at Driver 1's residence and was present with Driver 1 and his spouse when
Driver 1 left Loring Court. She stated the last time she saw Driver 1 at the residence was when he retired and she
estimated that time was between 2235 and 2240. Ms. Pate can be reached at 615.987.1407.
Another report was made by Mrs. Cynthia Wilde of Driver 1 attempting to force her vehicle off of the
roadway as she drove on Franklin Road southbound near Caldwell. She stated that between 2245-2300 Driver I
swerved toward them and forced them to shift left. Her passenger (Jamison Wilde) wrote Driver 11ooked at
Cynthia "like he thought he knew her." Mr. Wilde stated they accelerated past him and came to the intersection
at Battery where they were stopped by a red traffic signal. Mr. Wilde advised Driver I got close to them and
gunned his engine "in a threatening manner." Mr. Wilde wrote after they turned right to Battery Driver 1
continued to follow them and tailgated while he swerved into the eastbound lane. The Wilde party claimed to
have pulled over to the shoulder of the road to wait for him to pass. Mr. Wilde stated Driver 1 stopped in the
eastbound lane and stared at them. Mr. Wilde advised he got out of their vehicle and asked Driver 1 "What do
you want from us? What is your problem?" He stated a few seconds passed and Driver 1 "gunned the SUV and

sped off" going west on Battery. He stated they drove west after 3 or 4 vehicles passed them and came upon the
crash. I phoned Mr. and Mrs. Wilde on September 26th, 2014 tore-interview them and they confinned their
statement. (See the Witness Statements).
On September 22nd, 2014 I learned of another party who encountered Driver I prior to the crash. This party
consisted of 4 Belmont University students who observed Vehicle l eastbound on Battery Lane west of Franklin
Pike. This party was going east on Battery Lane behind Vehicle I. The driver for this party was Mr. Spencer
Lathrop. The passengers for this party were (seating positions 13-23 respectively) Connor Fraley, Karsyn Robb,
and Meg Ricci. I interviewed each of these occupants individually between September 22nd and September 23rd.
Each person in this party stated there was a strange odor and noise coming from Vehicle 1. They advised Vehicle
l was in the straight lane on eastbound Battery at Franklin and Driver I 's window was open. They said Fraley
advised Driver I there was a possible problem with Vehicle I. All of the occupants advised Driver I stated he
was going to "kill every [explicative] person in that vehicle." They stated they were away from this scene when
they observed Vehicle I was following them. They advised they called Emergency Communications and
attempted to evade Driver 1at high speeds on Franklin Pike going north from Thompson Lane. They stated when
they reached 8th and Douglas they turned onto Douglas and lost him when they turned ]eft from Acklen to
Wedgewood. They added they believed Driver 1 was stopped by police. They stated they went to Belmont

Sara Moon said she arrived at the scene of the crash at approximately 2300 having driven through "smoke."
She stated she stopped and heard someone calling for help. She stated she called Emergency Communications
and that her companion Art Preston went to the final rest position to offer aid. Her contact information is phone
number 615.414.1031.
Art Preston stated he went to Vehicle l after Ms. Moon stopped her car and checked on Driver 1. He advised
he observed Vehicle 1 upside down with no one in the back. He said he called out to Driver I but Driver 1 did
not respond. Mr. Preston's phone number is 615.663.3071.

I obtained a search warrant for the Airbag Control Module for Vehicle 1. I served the search warrant with
Officer Jessie Loy performing data extraction. The analysis and report ofthe data analysis was completed by
SGT. Burke. Officer Loy and SGT Burke are members of the MNPD Crash Investigation Unit and are certified
in data extraction. SGT Burke is credentialed to analysis and report on this data. Our data analysis indicated a
speed for Vehicle l of73 MPH up to .5 seconds prior to algorithm enable. The brake switch was not activated
and Driver 1's seatbelt was buckled. (See Search Warrant EDR and Onboard Event Data.)
I also obtained a search warrant for the Apple iPhone device located on the person of Driver 1, and a court
order for Verizon records pertaining to his account. With these instruments I would be able to discover if there
was information which would aid me in determining Driver I 's actions during the moments leading up to and
during the crash event. I executed actions on both and SISU extracted data from the iPhone using the pass code

which was furnished to me by Driver 1's spouse. Verizon responded with the information I requested from them.
In both instances I observed Driver 1's last call prior to his death was an incoming call at 2056 on September 20,
2014 from his spouse. The last text message prior to his death was a "sent" text on Septem her 20, 2014 at 2119.
I was notified ofthe existence ofCCTV footage of Driver 1 leaving his home on Loring Ct. I attempted to
review the video footage but the file would not load. I opted instead to view stills of the footage which showed
Driver 1 left his property and neighborhood on September 20,2014 between 2239 and 2240 according to the
timestamp. The footage and was provided by Driver 1's brother Greg Bironas.
All ofthe aforementioned evidence and information led me to conclude on September 20,2014 between 2230
and 2245 Driver I left his home at I 01 Loring Court. Driver 1 then drove east on Battery Lane between Loring
Court and Franklin Pike. At that intersection he was met by a group of people driven by Mr. Spencer Lathrop in a
car to his left. Both parties turned left to Franklin Pike and according to the other party Driver I chased them on
northbound Franklin at speeds of up "110 miles an hour." The members ofthis party assert Driver 1 followed
them as far as Acklen Avenue. On southbound Franklin Pike between 2250 and 2303 on September 20,2014 Ms.
Cynthia Wilde observed Driver 1 following them. According to Ms. Wilde's statement Driver 1 passed them
going west on Battery Lane. Prior to the crash Driver 1 drove in the curve east of the crash site at a speed of 73
miles per hour, traveled west on the north shoulder of Battery Lane for approximately 236 feet, struck a tree,
rotated counterclockwise, and came to final rest in the creek bed below. According to statements from MNFD
EMS Cameron Myers Driver 1 was dead on the scene but they transported him to VUMC because he was treated
inside the ambulance. The Report of the Davidson County Medical revealed Driver 1 died from blunt force
injuries. The toxicology report indicated a blood alcohol level of .218% and a controlled substance (diazepam)
level of 9 ng/ml blood. The level of diazepam was less than the therapeutic level for the drug as listed on the
Winek Toxicology Data Table (2001). The cause of the crash was Driver 1's failure to maintain the proper lane
and exceeding the posted speed limit. This case is now closed.

On Saturday, 09/20/201.4, at 2303 hours, I was notified by Sgt. Pachciarz that he needed the fatal
team to respond to a traffic crash on Battery Lane because the driver had been killed. While enroute,
Sgt. Pachciarz called me back and advised that the driver, who initially had been deemed deceased by
EMS, had now been transport to Vanderbilt Medical Center. I then had the dispatcher notify the on call
crash investigators and asked that they respond. I also notified Lt. Michael Gilliland, Traffic Division
supervisor, of the crash. When I arrived at the scene, I found that patrol officers had blocked all access
to Battery Lane and were diverting traffic away from the crash scene. As I exited my patrol car I was
approached by the acting District 8 EMS Chief, who handed me a form documenting how they extracted
the driver. I asked this acting District Chief why the driver was transported to Vanderbilt Medical Center if
he was deceased upon extraction. He told me, "Basically because he was Rob Bironis." He then left the
scene. I then began to coordinate with Mid Town Hills units, responding traffic units, on call Chaplains,
Captain Starling, and Don Aaron to request, and manage resources on the scene or still responding. I
also completed a MNPD Vehicle Tow report, and hold form for the crashed vehicle, and monitored the
scene while the crash investigators were completing their investigation.

011 Sunday September 21,2014 at 0014 hours I was dispatched to a fatal crash on Battery Lane. After
stopping at the Traffic office to collect the equipment I responded to the scene. Mid-Town officers had closed Battery
Lane just west of Franklin Pike. Once at the scene I was directed to take statements from two Nashville Fire
Department District Chiefs. After taking their statements I interviewed and took a statement from Mr. and Mrs.
Wilde. I handed the statements over to Officer Steel and depai1ed the scene a shol't time later.

Birionis. During the investigation a cellular smart phone was recovered from the person of the deceased
with the make and model being a an Apple Iphone Moo #A1429. inside a proetective black case. The
phone was logged into the MNPD property section and may contain the aforementioned data. In
addition to the images, text messages, call history, phone book, and e-mail, modern smart phones, such as
this one I'ecovered, can contain logs pertaining to GPS coordinates and WlFI networks the pl1one has
conie into contact with. WIFI logs can include the MAC add:ress, time stamps, and GPS coordinates of
the network the phone connected. It can also contain cell pllone tower information, various date and
time stamps of applications such as SMS Text, e-mail, ect. All of these logs will be analyzed for data
relating to the investigation. In addtion, Smut phones can contain information pe1taining to web sites
and social media platforms including but not limited to MySpace.com, Facebook.com, Google.com,
Yahoo. com, etc.
concrning web history and social sites will also be analyzed.

I WAS DISPATCH TO 401 LORING CT. IN REFERENCE TO A MISSING PERSON. THE COMPLAINANT RACHEL BRADSHAW STATED THAT SHE
WANTED TO REPORT HER HUSBAND, JAMES BIRONAS, WAS MISSING.

TOLD HER "GOODNIGHT" AND LEFT THE ROOM. SHE ASSUMED HE WAS GOING TO BED.
AFTER A FEW MOMENTS, SHE SPOKE TO HER FRIEND JENNA PAGE, WHO WAS STILL PRESENT WITH HER IN THE MOVIE ROOM. SHE THEN
WENT TO FIND JAMES BIRONAS. SHE SEARCHED THROUGHOUT THE RESIDENCE AND COULD NOT LOCATE HIM.
RACHEL BRADSHAW CALLED JAMES BIRONAS NUMEROUS TIME AND DID NOT RECEIVE AN ANSWER. SHE CALLED RELATIVES AND NO ONE
HAD CONTACT WITH HIM. SHE THEN CALLED POLICE BECAUSE SHE WAS CONCERNED.
RACHEL BRADSHAW STATED THERE WAS NO ARGUMENT PRIOR TO JAMES BIRONAS LEAVING THE RESIDENCE. SHE STATED IT WAS HIGHLY
UNUSUAL BEHAVIOR FOR HIM TO LEAVE WITHOUT TELLING HER. SHE STATED HE WAS NOT INTOXICATED.

On 9-20-2014 2350, I was called out to a fatal crash on Battery Ln. I arrived and noticed a vehicle flipped on the roof
in a creek bed. I walked the scene and observed a pattern of travel along the edge of the roadway leading to an impact

point with a tree. I held a prism pole at points of evidence as Officer Steel shot the points mapping the scene using a
Topcon Laser Device. I completed a Vehicle Exam and Sgt. Lovell completed a Hold and Tow Form.

Overview
On September 20, 2014 a 2009 GMC Denali was traveling west on Battery Lane. While negating a curve

the vehicle left the roadway, struck several trees, and came to rest on its roof.
Vehicle Information
Subject vehicle is a 2009 GMC Denali, VIN 1GKFK03229R200330.
Sensing Diagnostics Module Collection
On September 24, 2014 Officer Carey Steel obtained a search warrant for the collection of data stored In
the vehicles Sensing Diagnotsic Module (SDM)/Airbag Control Module{ACM) and the Roll-over Sensor
(ROS). The data contained in the SDM/ACM and ROS was accessed via the vehicles Diagnostic Link '
Connector (DLC). The Imaging of the data took place on September 24, 2014 pursuant to a search
warrant at the MNPD Impound Lot 1201 Freightliner Drive Nashville, Tennessee. The data was accessed
with Crash Data Retrieval Too\14.0. The data was sent to me via email from Officer Jessie Loy and is
stored on my department provided storage (F drive}.
The following data was imaged from the vehicle's SDM/ACM ad presented in the CDR report.

Non-Deployment Event
A Non-Deployment Event records data, but does not deploy the air bags. Analysis of the data
collected indicates there is pre-crash data stored on the SDM. This data includes Accelerator Pedal
Position, Vehicle Speed, Engine Speed, Percent Throttle, and Brake Switch Circuit State. This NonDeployment Event took place after the deployment event. This is Indicated by Diagnostic Trouble
Codes at Event, fault number: 1, BOOS2-00. This Trouble Code indicates airbag deployment. The
deployment event would have had to happen before the non-deployment event.
Up to 2.5 seconds of pre-crash data was recorded for Vehicle Speed, Accelerator Pedal Position,
Engine Speed, Percent Throttle, and Brake Switch Circuit State (See attached CDR Report for values).
Up to 1 second of pre-crash data was recorded for Reduced Engine Power Mode, Cruise Control
Active, Cruise Control Resume Switch Active, and Engine Torque (See attached CDR Report for
values).

Roll-Over Sensor
This vehicle is equipped with a Roll-Over sensor. Data at deployment Indicates that this incident was
a Roll-Over Event. CDR file Information indicates that no events were recovered. Data limitations
text indicates that If power to the Roll-Over Sensor is lost during the crash event, all or part of the
crash record may not be recorded. In the comments section ofthe CDR File there is a comment that
no battery was present in the vehicle.
Analyst's Conclusion
Upon review of the subject vehicle the driver side airbag and curtain alrbags had been deployed.
The SDM reported a Deployment and non-deployment event. It also Indicated that the recorded
events were not associated with the pre-crash data. There were three associated events that were
not recorded. The pre-crash data likely came from one of these events. The system at deployment
also indicated that this was a roll over event. The Roll-OVer Sensor indicates no event was
recovered. Since there was no battery In the vehicle, there was likely a power loss, which can
prevent the event from being recorded.
This crash is a long event. Driver/Passenger Side or Roof Rail/Head Curtain Time From Algorithm
Enable to Deployment Command Criteria Met (msec) is N/A. According to data limitations lfthe time
is reported as N/A the event is greater than 5 seconds;
There is pre-crash data from prior to Algorithm Enable. The CDR report indicated the driver was
wearing his safety belt; Buckled
CDR report indicates that a Deployment and a Non-Deployment event occurred on Ignition Cycle
9910. The CDR report also Indicates that Maximum SDM Recorded Velocity Change to place 290
(msec} after Algorithm Enable.
CDR report recorded a speed of 73 {mph) up to .5 seconds before Algorithm Enable.

Comments
Vehicle imaging through DLC. Vehicle was backpowered via Officer Carey Steel's marked patrol vehicle. We had to
use a set of jumper cables to clamp onto the red battery wire and onto the vehicle engine. No battery was present in
vehicle.
Vehicle imaging was pursuant to a search warrant obtained by Officer Carey Steel from Judge William Higgins.

Data Limitations
Recorded Crash Events:
There are two types of recorded crash events. The first is the Non-Deployment Event. A Non-Deployment Event records
data but does not deploy the air bag(s). The minimum SDM Recorded Vehicle Velocity Change, that is needed to record
a Non-Deployment Event, is five MPH. A Non-Deployment Event may contain Pre-Crash and Crash data. The SDM can
store up to one Non-Deployment Event. This event can be overwritten by an event that has a greater SDM recorded
vehicle velocity change. This event will be cleared by the SDM, after approximately 250 ignition cycles. This event can
be overwritten by a second Deployment Event, referred to as Deployment Event #2, if the Non-Deployment Event is not
locked. The data in the Non-Deployment Event file will be locked, if the Non-Deployment Event occurred within five
seconds of a Deployment Event. A locked Non Deployment Event cannot be overwritten or cleared by the SDM.
The second type of SDM recorded crash event is the Deployment Event. It also may contain Pre-Crash and Crash data.
The SDM can store up to two different Deployment Events. If a second Deployment Event occurs any time after the
Deployment Event, the Deployment Event #2 will overwrite any non-locked Non-Deployment Event. Deployment Events
cannot be overwritten or cleared by the SDM. Once the SDM has deployed an air bag, the SDM must be replaced.

Data:
-SDM Recorded Vehicle Velocity Change reflects the change in velocity that the sensing system experienced during the
recorded portion of the event. SDM Recorded Vehicle Velocity Change is the change in velocity during the recording
time and is not the speed the vehicle was traveling before the event, and is also not the Barrier Equivalent Velocity. For
Deployment Events, the SDM will record 220 milliseconds of data after Deployment criteria is met and up to 70
milliseconds before Deployment criteria is met. For Non-Deployment Events, the SDM can record up to the first 300
milliseconds of data after algorithm enable. Velocity Change data is displayed in SAE sign convention.
-The CDR tool displays time from Algorithm Enable (AE) to time of Deployment command in a Deployment event and AE
to time of maximum SDM recorded vehicle velocity change in a Non-Deployment event. Time from AE begins when the
first air bag system enable threshold is met and ends when Deployment command criteria is met or at maximum SDM
recorded vehicle velocity change. Air bag systems such as frontal, side, or rollover, may be a source of an enable. The
time represented in a CDR report can be that of the enable of one air bag system to the Deployment time of another air
bag system.
-Maximum Recorded Vehicle Velocity Change is the maximum square root value of the sum of the squares for the
vehicle's combined x and y axis change in velocity.
-Event Recording Complete will indicate if data from the recorded event has been fully written to the SDM memory or if it
has been interrupted and not fully written.
-SDM Recorded Vehicle Speed accuracy can be affected by various factors, including but not limited to the following:
-Significant changes in the tire's rolling radius

-Final drive axle ratio changes


-Wheel lockup and wheel slip
-Brake Switch Circuit Status indicates the open/closed state of the brake switch circuit.

the data point last sampled before AE. That is to say, the last data point may have been captured just before AE but no
more than 0.5 second before AE. All subsequent Pre-crash data values are referenced from this data point.
-Pre-Crash Electronic Data Validity Check Status indicates "Data Invalid' if:
-The SDM receives a message with an "invalid" flag from the module sending the pre-crash data

occurred first. If the value is positive, then the Non-Deployment Event occurred first.
-If power to the SDM is lost during a crash event. all or part of the crash record may not be recorded.
-The ignition cycle counter relies upon the transitions through OFF->RUN->CRANK power-moding messages, on the
GMLAN communication bus, to increment the counter. Applying and removing of battery power to the module will not
increment the ignition cycle counter.
-If more than one event is recorded, use the follow to determine which event the Multiple Event Data is associated with:
-If a Deployment event and not locked Non-Deployment event are recorded, the Multiple Event Data is
associated with the Deployment event
-If a Deployment event and a locked Non-Deployment event are recorded, then the Multiple Event Data is
associated with both events.
-If a Deployment event and Deployment event #2 are recorded, then the Multiple Event Data is associated with
both events.
-All data should be examined in conjunction with other available physical evidence from the vehicle and scene

All SDM recorded data is measured, calculated, and stored internally, except for the following:
-Vehicle Status Data (Pre-Crash) is transmitted to the SDM, by various vehicle control modules, via the vehicle's
communication network.
-The Belt Switch Circuit is wired directly to the SDM.

Comments
Vehicle imaging through DLC. Vehicle was backpowered via Officer Carey Steel's marked patrol vehicle. We had to
use a set of jumper cables to clamp onto the red battery wire and onto the vehicle engine. No battery was present in
vehicle.
Vehicle imaging was pursuant to a search warffint obtained by Officer Carey Steel from Judge William Higgins.

Data Limitations
Recorded Crash Events:
There are two types of recorded crash events. The first is the Non-Rollover Event. A Non-Deployment Event records
data but does not deploy the air bag(s). The ROS can store one Non-Rollover Event. This event will be overwritten by
the next Non-Rollover Event or by a second Rollover Event. A locked Non-Rollover Event cannot be overwritten or
cleared by the ROS.
The second type of ROS recorded crash event is the Rollover Event. The ROS can store up to two different Rollover
Events. Rollover Events cannot be overwritten or cleared from the ROS. Once the ROS records two Rollover Events,
the ROS must be replaced.
Data:
-The ROS Records lateral Acceleration, Vertical Acceleration, and Roll Rate data. This data reflects what the sensing
system experienced during the recorded portion of the event. For Rollover Events, the ROS will record 490 milliseconds

Cynthia was driving us south on Franklin Pike. We had just passed some construction near Caldwell.
Shortl after a white SUV drove u beside us. The v hide drifted into o

couple oH'eet to avoid touching. My wife looked over at him, and he seemed to be tr}ring to see who
she was, like he thought he knew her. I am not sure if he was aware that I was in the car with her. He
stayed beside our car as we drove down Franklin well under the speed limit, and I asked my wife to
accelerate past him to avoid any issues. At that point he also accelerated and maintained his position
beside us. then dropping behind us and tailgating us and swerving between lanes. We reached Harding
Place and stopped at a red
before taking a right on red. As we stopped at the light he came witli
inches of our car, still tailgating and gunning his engine in a threatening manner. We made the turn onto
Harding Place, heading west. He continued to chase and tailgate us, swerving into the oncoming lane
and back. I convinced my wife to stop the car to avoid having an accident, so she pulled off the road.
When we stopped, he stopped in the oncoming lane and stared us down. I got out of the passenger side
and walked around to the front bumper of our Tahoe. His window appeared to be down and I yelled
"What do you want from us? What is the problem?" My wife was extremely upset and afraid for me
and was also asking what he wanted from us. After a few more seconds, he gunned the SUV and sped
off. 34 cars passed us going west on Harding before we were able to pull back onto the road. As we
drove down the road, I was trying to calm my wife and noticed it seemed foggy up ahead. As we drove
through what turned out to be smoke we noticed debris on the road, and I realized there had been an
accident. My wife pulled over and my wife spoke to a 911 operator that another couple in a BMW had
dialed. We are not certain that the vehicle in the ditch was the same vehicle and driver, though that is
our assumption.

This affidavit is made by Officer Carey D. Steel Metropolitan Nashville Pollee Depatment, who now testifies herein
which is based upon information personally observed or received from other law enforcement officers, unless otherwise stated, which
your Affiant believes to be true, and is as follows:
On September 20, 2014 the stated vehicle was operated by Robert Bironis and was involved in a motor \'Chicle collision on
Battery Lane at Dnstiu in the Midtown Police sector of Metropolitan Nashille Davidson County Tennessee. Based on the
physical evidence located at the scene there is a reasonable belief the above stated vehicle w11s traveling west on Batteay Lane
at Dustin on the westbound side of the roadway wlten it ran off tile roadway. Tills motor vehicle ctash resulted in the death of
Robert Biron is. The search warrant wlll aid me in determining Mr. Bironis' actions around the time of the crash and will aid
me in reaching conclusions for this investigation.

I WAS DISPATCH TO 401 LORING CT.IN REFERENCE TO A MISSING PERSON. THE COMPLAINANT RACHEL BRADSHAW STATED THAT SHE
WANTED TO REPORT HER HUSBAND, JAMES BIRONAS, WAS MISSING.
ACCORDING TO RACHEL BRADSHAW, SHE WAS WITH HER HUSBAND AND A FRIEND, JENNA PAGE, DURING THE EVENING. THEY WERE
WATCHING A MOVIE IN THE MOVIE ROOM INSIDE THEIR RESIDENCE AT 401 LORING COURT. AT APPROXIMATELY 10:30 P.M. JAMED BIRONAS
TOLD HER "GOODNIGHT" AND LEFT THE ROOM. SHE ASSUMED HE WAS GOING TO BED.
AFTER A FEW MOMENTS, SHE SPOKE TO HER FRIEND JENNA PAGE, WHO WAS STILL PRESENT WITH HER IN THE MOVIE ROOM. SHE THEN
WENT TO FIND JAMES BIRONAS. SHE SEARCHED THROUGHOUT THE RESIDENCE AND COULD NOT LOCATE HIM.
RACHEL BRADSHAW CALLED JAMES BIRONAS NUMEROUS TIME AND DID NOT RECEfVE AN ANSWER. SHE CALLED RELATIVES AND NO ONE
HAD CONTACT WfTH HIM. SHE THEN CALLED POLICE BECAUSE SHE WAS CONCERNED.
RACHEL BRADSHAW STATED THERE WAS NO ARGUMENT PRIOR TO JAMES BIRONAS LEAVING THE RESIDENCE. SHE STATED IT WAS HIGHLY
UNUSUAL BEHAVIOR FOR HIM TO LEAVE WITHOUT TELLING HER. SHE STATED HE WAS NOT INTOXICATED.

SHE DID SEE HIM DRINK A BEER EARLIER IN THE EVENING. HE DID NOT HAVE ANY HISTORY OF WANTING TO HARM HIMSELF.
ACCORDING TO THE WITNESS, JENNA PATE, SHE WAS PRESENT WITH RACHEL BRADSHAW AND JAMES BIRONAS DURING THE EVENING. SHE
DID NOT OBSERVE ANY UNUSUAL BEHAVIOR OR ANY TYPE OF ARGUMENT PRIOR TO JAME BIRONAS LEAVING THE RESIDENCE.
