Coal Ash Regulations and
their Implications for Utility
Operations

Coal-fired power plants are facing a


challenging future on the overall management
of fly ash, bottom ash, FGD, and other process
residuals. The potential risks associated with
the management of coal combustion residuals
(CCR), often called coal ash, have resulted in
the advancement of national standards.
EPA has proposed regulations under the
Resource Conservation and Recovery Act
(RCRA) for CCR generated by power utilities
which could have significant impacts on the
management, cost, and beneficial reuse of
these byproducts. The proposal includes
two approaches. The first would list CCR as
hazardous waste subject to Subtitle C of the
RCRA. The second would classify CCR as
non-hazardous waste subject to Subtitle D
of the RCRA. EPA, under a recent Consent
Agreement filed January 29, 2014 has agreed
to issue the final CCR rules by December 19,
2014. The current expectation is that the
EPA will issue the rule under Subtitle D.
EPA has also proposed Effluent Limitations
Guidelines and Standards (ELG) that could
place significant burdens on coal-fired units.

TRC reviewed critical technical, regulatory,


economic, and sociopolitical issues in siting a
fly ash disposal facility for Black Dog Generating Station in Burnsville, MN. Potential impacts
of ash disposal were defined, and a preliminary
design was prepared for the facility.

TRC planned, managed, and implemented


an initial site report and feasibility report
for the siting of a 30-acre coal ash disposal
facility for Dairyland Power Coop in
Wisconsin. TRC also provided comprehensive
landfill design and permitting services.
