The definition of an occupier is given under chapter 1, section 1 (n) of Factories Act,
1948.
An occupier of a factory means the person who has the ultimate control over the
affairs of the factory.
Functions of an occupier under Factories Act, 1948:
1. An occupier can give an application to the State Government to declare
different departments of his factory as separate factories or two or more
factories under him can be treated as a single factory.
2. The occupier has to send to the Chief Inspector a written notice, prior to
atleast 15 days before using the factory premises. This notice must contain
details of the factory including the nature of the manufacturing processes to
be conducted in the factory for the next 12 months and the number of
employees along with his communicating address.
3. Before resuming work in any manufacturing process which is ordinarily carried
on for less than 180 working days in the year, the occupier shall send a notice
to the Chief Inspector informing him about the work, atleast 30 days before
commencing the work.
4. In the absence of the acting manager, the occupier is deemed to be the
manager of the factory.
5. The occupier shall prepare a written statement of his general policy with
respect to health and safety of workers at work, and make arrangements to
bring the statement in notice of all the workers.
6. Appoint persons who possess qualifications and experience in handling
hazardous substances and to provide at the working place all the necessary
facilities for protecting the workers in the required manner.
7. To appoint safety officers in factories, employing more than 1000 workers.
8. To consider the initial factory setup or expansion of any such factory, State
Government appoints a Site Appraisal committee
