The CPIO stated that the RTI application dated 16/09/2013 was replied vide letter dated
15/10/2013 and vide FAAs order dated 16/12/2013 the appellant was offered inspection of the
records but he did not avail the opportunity. He further stated that the appellant did not mark a
copy of his 2nd appeal to him and he has brought all the relevant records to enable the appellant to
take whatever information/documents he needs. The appellant stated that the information sought
in his 2nd appeal along with related documents should be supplied to him free of cost. The CPIO
agreed.
Decision notice:
As agreed by the CPIO the information requested by the appellant in his 2nd appeal should
be provided to him, free of cost, within 30 days from the date of receipt of this order.

Learned CPIO vide response number 29/3/2013/RTI-Pt.\/4001 dated 15.10.2013 did provide some (and not
complete) information in regards to query-number (8) regarding earlier TDSAT chairpersons but cleverly avoiding
main query-numbers (1) to (7) in regard to present TDSA T chairperson Mr Justice Aftab Alam. I filed my first
appeal dated 18.10.2013 requesting for CPIO to be directed to provide detailed and complete information in regard
to query-numbers (l) to (7) of my RTI petition with all related and sought documents now to be provided free-of
cost under section 7(6) ofRTl Act. I also requested for necessary department action against the concerned CPIO for
deliberately obstructing detailed information regarding query-numbers (1) to (7) regarding present TDSAT
chairperson Mr Justice Aftab Alam at a time when my queries were well understood because query (8) of similar
nature regarding earlier TDSAT charirpersons was tried to be provided though not completely.

Even in regard to query (8) attached note-sheets provide cost and source of purchase for items numbered from (16)
to (21) for purchases made for the then TDSAT chairperson Mr Justice Arun Kumar. But no such details including
cost and source of purchase were given in respect of item-numbers (1) to (15). It was also not revealed if due
purchase-process was followed for purchases made as detailed in attached note-sheets or not. I appealed CPIO to be
directed to provide cost and source of purchase for item-numbers (1) to (15) listed in attached note-sheets. I also
appealed that copies of purchase-orders and purchase-bills should be provided in respect of items listed in the
attached note-sheets mentioning also if all or some of these items were purchased through discretionary powers of
the then TDSAT chairperson without following usual government-process for purchases.

1 also appealed CPIO to be directed to provide similar information about any new purchases by TDSAT for
residence of earlier TDSAT chairperson Mr Justice SB Sinha. I also appealed CPIO to be directed. to reveal
whereabouts of listed items purchased for Mr Justice Arun Kumar and later for Mr Justice SB Sinha since after that
a different residential accomodation is provided to present TDSAT chairperson Mr Justice Aftab Alam. In case

items provided at residences of earlier TDSAT chairpersons Mr Justice Arun Kumar and Mr Justice SB Sinha are
disposed of, then directions were requested for providing complete details about such disposal.

Sought information becomes crucial because the CPIO in his response stated an upper limit of rupees four lakhs to
be borne by TDSAT in respect of furnishings etc at residence ofTDSAT chairperson while listed items are costing
much higher than the mentioned limit with cost and source of purchase not mentioned for majority of purchased
items for the then TDSAT chairperson Mr Justice Arun Kumar and totally avoiding details in respect of present
TDSAT chairperson Mr Justice Aftab Alam and the earlier chairperson Mr Justice SB Sinha.

It was indeed surprising that an appeal dated 18.10.2013 was placed before the ordering Appellate Authority only

on 27.11.2013 while documents reveal that there was an earlier Appellate Authority who received first appeal on
21.10.2013. Question arises why there was a wait for some other Appellate Authority to decide the first appeal.

The new Appellate Authority in its order dated 16.12.2013 instead of directing the CPIO to provide proper
information together with sought and related documents, at this stage offered inspection. If CPIO can provide
information for an earlier Chairperson from old files, then there is no logic that information relating to present
Chairperson that too from current files may not be provided. Undersigned petitioner has been paying thousands of
rupees towards copying charges on a single RTI petition if demand was made on time. Here in this case also,
petitioner would have paid copying charges if demand would have been made in time. In suspicious manner of

cpro replying and subsequent had ling of first appeal, I doubt that inspection offered may be a complete eye-wash
with proabilibity of useless files dumped before me so that I may not be practically able to sort out the required
ones like has been bitter expirie~ce with the undersigned in a solitary case of accepted inspection. Otherwise also,
even information-part is also incomplete as referred above.

I appeal TDSAT may kindly be directed to provide point-wise proper and complete information to each of the
query of my RTI petition together with sought and related documents but now to be provided free-of-cost under
section 7(6) ofRTI Act. I also appeal for compensation under section 19(8)(b) ofRTI Act. Erring ones may kindly
be penalised under section 20 of RTI Act with departmental proceedings directed against them. It is prayed
accordingly.

This is regarding the appeal filed by Shri Subhash Chandra Aarawal,


appellant against his RTI petition dated 16.9.2013 which was replied to by the CPIO,
TDSAT vide letter No. 29/3/2013/RTI-Pt-1I4001 dated 15.10.2013.

The Appellate Authority in TDSAT has been changed. The appeal was made
available to the undersigned on 27.11.2013 and sent to CPIO, TDSAT Mr. Sanjeev
Pandey on 28.11.2013 to furnish information (copy enclosed).

Reply of CPIO dated 9.12.2013 is enclosed herewith. Against pOints 1,2,4,7


and 10 of the petition, CPIO has furnished information/observations and against
pOints 3,5,6,8 and 9, CPIO has offered that the appellant may inspect the relevant
files at his convenience. He has stated that information pertains to various files and
is bulky. He has also listed 9 files which are relevant to the queries raised by the
appellant.

Order:
The appellant may inspect the files and seek copies of the documents

case items provided at residences of earlier TDSAT chairpersons Mr Justice Arun Kumar and Mr
Justice SB Sinha are disposed of, then directions may kindly be given for providing complete
details about such disposal.

Sought information becomes crucial because the CPIO in his response has stated an upper limit
of rupees four lakhs to be borne by TDSAT in respect of furnishings etc at residence of TDSAT
chairperson while listed items are costing much higher than the mentioned limit with cost and
source of purchase not mentioned for majority of purchased items for the then TDSAT

chairperson Mr Justice Arun Kumar and totally avoiding details in respect of present TDSAT
chairperson Mr Justice Aftab Alam and the earlier chairperson Mr Justice SB Sinha. It is prayed
accordingly.

etc. are being provided by TDSAT. Hon 'ble Chairperson is occupying Residential
accommodation in No.2, Tughlak Lane, New Delhi - 110001. Hon'ble Member
TDSA T has been allotted Residential accommodation in No. C-I/6, Tilak Lane,
New Delhi.
Hon'ble Chairperson is entitled for all the benefits as applicable to the sitting
judges of Supreme Court Judge due to which his Lordship is entitled for furnishing
upto Rs. 4.0 lakhs (Copy enclosed). With regard to providing of furniture,
computers etc., it has been made available by TDSAT for his Lordship's residential
office.
Residential accommodation No.2, Tughlak Lane, New Delhi 110001 is allotted
by Dte. of Estate.
At present TDSAT has not paid any amount to CPWD, all the expenses made by
CPWD for the renovation of the said Bungalow.

Definitions - In these rules, unless the context olhcf\vise require!>,


(a)

"AcC means the Telecom Regulatory Authority of India ACI, 1997


(24 of ] 997);

(b)

"Appellate Tribunal" means the Telecom Disputes Settlement and


Appellate Tribunal established urWer section 14 of the Act;

(c)

"Chairperson" means the Chairperson of the Appc.llate Tribunal


appointed under section 14 B(l) of the Act;

(d)

"Member'! means a Member of the Appellate tribunal appointed


under section 14 B(lJ of the Act;

(e)

Words and expressions us~d herein and not defined but defined in
the Act shall have the m,:,!anjngs respectively assigned to them in the

Provided that in case the retired Judge of the Su-preme Court or the retired
Chief Justice of a High Court, is ill receipt of, or has received or has become
entitled to receive any retirement benefits by way of pension, gratuity, employers
contribution to the Contributory Provident Fund or olher forms of retirement
benefits, the pay of such Chairperson s11ull be reduced by the gross amount of
pensipn or employers contribution to the Contributory Provident Fund or any other
form of retirement benefits, if any (except pension eCluivalent of gratuity). drawn
or to be drawn by him.

Leave (1) Wben a retired Supreme Court Judge or a Chief Justice of
High Court is appointed as Chairpersoil, he ~Ilall be entitled to 30 days of Eamcd
Leave for every year of service and the 'President of India shall be (he authori! y

competent to sanction leave to the Chairperson.


(2)
The payment of leave. salary during leave shall be governed
by rule 40 of the Central Civil Services (Leave) Rules, 1972.
(3,)
The Chairperson ::;hall be entitled to encashmenl of fifty per
cent of Earned Leave to his credit at any time.

5.
Contribution to Contributory Provident Fund ~- When a retired Supreme
Court Judge/ Chief Justice of High Court ~ appointed as Chairperson, he shall be
entitled to subscribe to the Contributory Provident Fund which sh.all be governed
by the Contributory Provident Fund Rules (India), 1962.
6.
Other conditions of service: The conditions of service of Chairperson for
which no provision is made in these rules shall be governed by the Supreme Cour1
Judges (C...onditions of Service) Act, 1958. Supreme Court Judges (Travelling
Allowance) Hules, 1959 and any other rule!; made under the Act t or the High
('...ourt Judges Act, 1954, High Court Judges (Travelling Allowance) Rules, 1956

When a serving Judge of the Supreme Court or
the Chief Justice of a High Court is appointed as ,tbe ChairPerson, his terms and

PUCs are the three RTI application of Shri Subhash Chandra Agrawal,
(Guinness Record Holder & RTI Activists) dated 16.9.2013 received in this office on
19.9.2013 regarding furnishing of Information under R.T.I. Act, 2005. Three postal
order having Nos.11 F 094437, 11 F 094436 & 11 F 094435 of Rs.101- each being
R.T.I. application fee in the name of Accounts Officer has also been enclosed.
In this regard, it is mentioned that the postal order should be in the name of
000, TDSAT instead of Accounts Officer,
Further, it may also be stated that at present no CPIO has been designation
in this office after relieving of Shri R.R. Tiwari, the then Director & CPIO.
Keeping in view of the above, submitted for orders of the Appellate Authority
& Head of Department for returning applications received from Shri Subhash
Chandra Agrawal with a statement that RTI fee (po'stal orders) should be in the
