1. Introduccin
Con una superficie de 9. 596. 961 km2 y lmites con 14 pases, China es el cuarto mas
grande del mundo, as como el ms poblado (1.334.habitantes).
Su capital es Pekn, pero la ciudad ms poblada es Shangai. El territorio est dividido
en 22 provincias, 5 regiones autnomas, 4 municipalidades y 2 regiones administrativas
especiales (Hong Kong y Macao). China es miembro de la Organizacin de las Naciones
Unidas (ONU) y del Foro de Cooperacin Econmica Asia-Pacfico.
China es un pas multitnico, y se han confirmado 56 etnias. De ellas la etnia han ocupa
alrededor del 90% de la poblacin total. Las otras 55 etnias son conocidas como etnias
minoritarias. Cada una de estas etnias tiene una larga historia y debido a su evolucin,
los subtipos y nombres de cada una de las etnias son tantas, que ya desde medio siglo
atrs, nadie saba cuantas etnias tena el pas exactamente.
El chino mandarn es el idioma oficial del pas. A diferencia de otros idiomas, tiene una
amplia variedad de dialectos (5 reconocidos) y formas escritas (2 alfabetos reconocidos).
Actualmente, hay una gran confusin acerca de la categorizacin, pero por regla
general se clasifican en 5 dialectos principalmente: mandarn, wu, min, yue y hakka.
Tambin es oficial en otros pases como la Repblica de China y Singapur. Es el idioma
ms hablado del planeta, con ms de 1000 millones de nativos.
China es la segunda economa y potencia comercial ms grande del mundo.
Su rgimen poltico est inspirado en el comunismo sovitico, siendo un estado
unipartidista, liderado por el Partido Comunista de China, sin embargo econmicamente
es un estado capitalista desde las reformas de 1978 a cargo de Deng Xiaoping. Desde
el ao 2003 hasta la actualidad gobierna Hu Jintao como presidente y Wen Jiabao
como primer ministro. China ha tenido un crecimiento econmico muy rpido, tanto
que es posible que sobrepase a la economa estadounidense hacia el ao 2016.
La mayora de la poblacin es rural debido al predominio de la agricultura como
principal recurso de subsistencia. Sin embargo, el empuje que ha tenido la industria ha
provocado el rpido crecimiento de numerosas ciudades. China es un pas unitario y
multitnico, con 56 etnias en total. Entre ellas la Han es la ms numerosa y representa
el 92% de toda la poblacin, mientras que las otras 55 llegan al 8%, y como son
numricamente menores en poblacin, se las llama habitualmente minoras tnicas.
La poblacin rural pas de 71% a 64% y la
urbana de 29% a 36%. La poblacin se
agolpa principalmente en la zona oriental,
sobre la costa de los mares de China
meridional y oriental. La provincia
ms poblada es Sichuan con ms
de 100 millones de habitantes, en
una superficie equivalente a la de
Espaa. La densidad media en el
este delpas, es de 300 habitantes
por kilmetro cuadrado y en el
oeste de 40.
6. Inocuidad de Alimentos
El 25 de mayo de 2012 ha sido el da elegido para los festejos de los 40 aos de
relaciones diplomticas de Argentina con la Repblica Popular China.
Los festejos tuvieron lugar en la embajada argentina en Pekn y cont con la presencia
del embajador argentino, Gustavo Alberto Martino, el ministro de Agricultura de Argentina,
Norberto Gustavo Yauhar, el vicepresidente del Comit Permanente de la Asamblea
Popular China, Jiang Shusheng, y el viceministro de Relaciones Exteriores de China,
Xie Hangsheng, adems de otros funcionarios chinos, miembros de las delegaciones
diplomticas de otros pases y numerosos miembros de la comunidad argentina en China.
El ministro de Agricultura mantuvo un encuentro con su par de China, en el que firmaron
acuerdos para ampliar y diversificar las exportaciones agroalimentarias al pas asitico.
Afianzamos lazos de cooperacin para llegar a los mercados emergentes con productos
de alto valor agregado, dijo Yauhar.
exportaciones; y el primer mercado para las exportaciones agrcolas del pas. Argentina
es, a su vez, el tercer proveedor de productos agrcolas a China, detrs de Estados
Unidos y Brasil. En su ltimo encuentro, la presidenta Cristina Fernndez de Kirchner
y el mandatario Hu Jintao acordaron otorgarle a la relacin bilateral un trato de socios
estratgicos.
La cartera de Agricultura resalt que los acuerdos celebrados con el Aqsiq son el fruto
de una larga y compleja negociacin tcnica a cargo del Senasa y se inscriben en
la poltica de ampliar y diversificar las exportaciones argentinas de agroalimentos a
China.
Desde la creacin del Ministerio de Agricultura se logr el acceso de diversos productos al pas asitico: carne vacuna (excepto menudencias); cebada; semen y embriones
bovinos; lcteos para consumo humano; harinas de carne, hueso y sangre de origen
bovino, caprino y ovino; cueros crudos bovinos, caprinos y ovinos; aceite de colza y
semillas de girasol para siembra.

Acompaaron a Yauhar los secretarios de Agricultura, Lorenzo Basso; Desarrollo Rural
y Agricultura Familiar, Carla Campos Bilbao; Emergencia Agropecuaria, Haroldo Lebed;

En el marco de las negociaciones de adhesin de China a la OMC, sta se comprometi a abrir sus mercados a los productos agrarios comunitarios mediante la firma de
Protocolos con cada uno de los Estados Miembros de la UE.

Comentarios especficos
Se destacan los siguientes aspectos de la Ley de Inocuidad Alimentaria que pueden
resultar de inters para los exportadores argentinos.
1. mbito de aplicacin
La Ley define en su Artculo 2 las actividades que quedan alcanzadas por sus disposiciones.
Sin embargo, algunos productos pareceran quedar sometidos a regmenes especiales
y no queda claro qu disposiciones de la Ley se les aplican en ltima instancia.
I. Productos agrcolas comestibles: el Artculo 2, ltimo prrafo dispone: [la] gestin
de la calidad e inocuidad de los productos agrcolas primarios destinados al consumo
(de aqu en adelante, productos agrcolas comestibles) quedan sujetos a la Ley de la
R.P. China sobre Calidad e Inocuidad de los Productos Agrcolas. Sin embargo,

la presente Ley [de Inocuidad Alimentaria] debe ser observada cuando se desarrollan
normas obligatorias de calidad e inocuidad y se hace pblica informacin sobre la
inocuidad de los productos agrcolas comestibles. Por su parte, el Artculo 56 del
Reglamento del Consejo de Estado dispone: La evaluacin y gestin de riesgo de los
productos agrcolas sern desarrolladas por el Ministerio de Agricultura de acuerdo a la
Ley sobre Calidad e Inocuidad de los Productos Agrcolas.
II. El Artculo 101 establece que [la] administracin de inocuidad alimentaria de los
productos lcteos, alimentos genticamente modificados, la faena de cerdos, vinos y
sal comn se realizar de acuerdo a esta Ley [de Inocuidad Alimentaria]; salvo en caso
de estar regulados por reglamentaciones especficas.
Finalmente, de acuerdo a explicaciones dadas por funcionarios del Ministerio de Salud,
la Ley se aplica a todos los alimentos, incluidos los productos agrcolas primarios, pero
no se aplica a los piensos para la alimentacin animal ni a los alimentos para mascotas.
Al respecto, cabe sealar la prxima publicacin por parte del AQSIQ de las Medidas
administrativas para la inspeccin, cuarentena y supervisin de las importaciones y
exportaciones de piensos1 y aditivos para piensos,que completarn el rgimen legal
para estos productos, junto a la normativa ya en vigencia del Ministerio de Agricultura.2
2. Normas Nacionales Obligatorias sobre Inocuidad Alimentaria
Base legal: Captulo 3 de la Ley; Reglamento del Consejo de Estado sobre la Implementacin de la Ley (Art. 13-17); Medidas para la Administracin de Normas Nacionales
sobre Inocuidad Alimentaria; y Medidas para el Registro de Normas Empresariales en
Materia de Inocuidad Alimentaria.
Rgimen legal:
La Ley dispone que las Normas de Inocuidad de Alimentos sern obligatorias y debern tener un sustento cientfico, ser razonables, seguras y confiables (Art. 18-19).
En ausencia de una norma nacional, las autoridades locales podrn dictar normas en
la materia aplicables a su jurisdiccin.
Contenido: las normas de inocuidad alimentaria regularn los siguientes aspectos:
I. cuestiones microbiolgicas, lmites de residuos de plaguicidas, drogas veterinarias,
metales pesados, contaminantes y otras substancias peligrosas para la salud humana en alimentos y productos relacionados a los alimentos;
II. variedades, mbito de aplicacin y dosis de aditivos para alimentos;
III. requerimientos para ingredientes nutricionales en alimentos de base y alimentos
especiales para infantes y otras poblaciones especiales;
IV. normas sobre etiquetado, identificacin e instrucciones de uso de los productos;
V. requerimientos higinicos.
Reordenamiento normativo. El Artculo 22 de la Ley instruye al Ministerio de Salud a
comenzar un programa de revisin de las normas obligatorias existentes en materia
de calidad e higiene, con el fin de unificarlas en una nica nueva norma nacional

de inocuidad. Mientras se lleve a cabo dicho proceso, la Ley aclara que las normas
existentes seguirn siendo aplicables. El objetivo del reordenamiento normativo es
eliminar las contradicciones y discrepancias entre las diferentes normas en vigencia
actualmente dictadas por los diferentes organismos competentes y realizar las
actualizaciones correspondientes.
El Consejo de Estado dispone en su Reglamento que el Ministerio de Salud, junto a los
dems organismos competentes, deben elaborar un programa anual de trabajo (Art.
13). De acuerdo a declaraciones de funcionarios del Ministerio de Salud, se comenzar
por las normas existentes para los productos lcteos, residuos de plaguicidas, residuos
de productos veterinarios y aditivos.3
Elaboracin de normas. El Art. 23 de la Ley dispone que las normas nacionales
de inocuidad alimentaria debern ser elaboradas a partir de los resultados de la
evaluacin de riesgo; debern tomar como referencia los normas internacionales
pertinentes y los resultados de las evaluaciones de riesgo realizadas a nivel internacional. Dichas normas debern ser redactadas por un comit de expertos elegidos al
efecto y revisadas y aprobadas por la Comisin de Examen y Evaluacin de Normas
Nacionales de Inocuidad, coordinada por el Ministerio de Salud y en la cual estarn
representados todos los organismos competentes. Tanto la Ley como las normas
reglamentarias disponen que los proyectos de normas debern ser sometidos a
consulta pblica y, una vez aprobados, debern ser revisados ni bien se identifiquen
problemas en su implementacin.
Normas locales. Las normas reglamentarias disponen que, en caso de inconsistencia
con las normas nacionales, las autoridades sanitarias provinciales deben proceder
a corregir o modificar las normas que hayan dictado. Al contradecirse las normas
locales entre s, las autoridades sanitarias provinciales concernientes debern actuar
coordinadamente para realizar los ajustes necesarios.
Estndares empresariales. La Ley dispone que en caso de ausencia de estndares nacionales o locales en materia de inocuidad alimentaria, las empresas deberan desarrollar
sus propios estndares (Art. 25). La ley tambin alienta a las empresas a desarrollar sus
propios estndares ms exigentes, an cuando existan normas nacionales o locales aplicables. En todos los casos, la Ley aclara que estos estndares empresariales sern solamente aplicables en la empresa en cuestin. Las Medidas para el Registro de Estndares
Empresariales en Materia de Inocuidad Alimentaria contienen disposiciones especficas
respecto al registro y publicacin de estos estndares empresariales.
3. Importacin de Alimentos No Regidos por Normas Nacionales de Inocuidad Alimentaria
Base legal: Ley de Inocuidad (Art. 63, c.c. Art. 44); Artculo 34 del Reglamento del
Consejo de Estado sobre la Implementacin de la Ley; Reglamento Interino del
Ministerio de Salud para la Administracin de Permisos de Importacin para Alimentos
Sin Norma Nacional de Inocuidad Alimentaria.
Rgimen legal:
mbito de aplicacin: los productos elaborados y comercializados fuera de la R.
P. China como alimentos y para los cuales todava no se ha formulado una norma
nacional sobre inocuidad alimentaria que les sea aplicable en la R. P. China. (Art. 2 del
Reglamento Interino del M. de Salud).

implementing rules by taking into consideration the local conditions and revolve around
the building of scientific and reasonable system of guaranteeing the safety and quality
of the imported and exported feeds, and drive the reform of inspection, quarantine and
supervision models.
3. Organize with due care and implement the Measures appropiately.
I. Import Inspection and Quarantine
1. Registration
AQSIQ will publish a list of countries/regions which are eligible to export their feed
products to China as well as a list of the permitted products, and will carry out the
registration of foreign feed producers step by step. For those countries/regions who
have completed registration, the imported feeds shall only be sourced from the registered
producers or processors; before a registration is completed, the feed products on the
list can continue to be exported to China (for updates, please refer to the website of the
AQSIQ).
2. Entry Quarantine Approval
In accordance with the Methods for Risk Grading, Inspection and Quarantine of Exports
and Imports of Feed and Feed Additives promulgated by AQSIQ, feed products which
fall into Grade I and Grade II quarantine risks are all required to apply for Animal and
Plant Quarantine License. It must be strictly carried out that the rule of online verification and
cancellation of licenses. Those enterprises which apply for more but use less licenses
will be blacklisted and subjected to strict control.
3. Checking of Label of Imported Feeds
Since Sept.1, 2009, each local CIQ shall check and approve the labels of imported feeds
in accordance with Regulations on Checking Labels of Imported Feeds and Feed
Additives (see attachment 1). If any labels are found not up to standard, the relevant
importers, the imported feed products and exporters will be put on record. The cargo
receivers or their representatives shall collect the Regulations and promise to correct
accordingly, ensuring that the labels of imported feeds imported after 28 February, 2010
conforming to the requirements. As of 1 March, 2010, imported feeds whose labels are
not up to standard must be delivered to the location designated by inspection and
quarantine institutions for label application or rectification.
4. Recording Importers
Each local CIQ shall, no later than Dec 31, 2009, report the list of feed-importing
enterprises, including name, address, contact information and imported feed categories
to Animal & Plant Quarantine Department of AQSIQ. (Please send electronic version to
siliao@aqsiq.gov.cn). The list should be updated and reported to AQSIQ semi-annually.
II Export Inspection and Quarantine
1. Registration
From Sep. 1, 2009 on, new enterprises dealing in production, processing and
warehousing shall register strictly adhering to the Measures. Such related documents as
registration application form, document-reviewing form, acceptance notification, on-site

evaluation record, incompliance and tracking report, numbering rules for registration,
form of registration certificate, notice of denial, export supply certificate and the form of
supervisory manual shall be referred to in Appendix 2-11 (available for download from
feed safety column of the website of the Division of Animal and Plant under the General
Administration of Quality Supervision, Inspection and Quarantine of the P.R.C.).
Each bureau will organize an annual auditing and rectification towards registered feedexport companies in the near future. In the event of enterprises having been reported
of defects aborad and having not yet resumed export business, if it has been confirmed
through investigation that such enterprises shall be held responsible but they have put
forward no improvement, registration of such enterprises shall be revoked, provided
that they are not in compliance with the requirements referred to in the Measures, have
significant safety loopholes and undertake to effective measures to improve. In the event
of discovery of any general incompliance, a written notice of defects and rectification
requirements shall be issued to direct the enterprises to establish and complete their
self-inspection and self-control systems. Each bureau shall submit to the Division of
Animal and Plant of the General Administration of Quality Supervision, Inspection and
Quarantine of the P.R.C. an annual auditing and rectification report as well as a list of
registered enterprises in both Chinese and English prior to Dec. 31, 2009 according to
Appendix 12 (the list shall be forwarded to liujl@aqsiq.gov.cn in the form of excel.)
In the event of any registration requirements by the import country/region, each
bureau shall report to the General Administration after a review and approval. The
General Administration of Quality Supervision, Inspection and Quarantine of the P.R.C.
shall organize a sampling test by a group of experts before circulating a notice of
recommendation. The results of registration shall be published on the website of the
Division of Animal and Plant of the General Administration.
2. Establish a Scientific Mode of Export Supervision
By the way of risk analysis, a scientific mode of export supervision shall be gradually
established on the basis of self-inspection and self-control, consisting mainly of official
supervision and supplemented by spot tests. Each bureau shall put the emphasis on
supervision and management of change in suppliers of materials, safety and health
control, critical control points and filling in of Supervisory Manual for Exported Feeds.
3. Inspection, Quarantine and Issue of Certificates
The inspection and quarantine rules of the origin shall be strictly complied with. The
application for inspection must not be filed in a city other than the origin. The to-beexported feeds must have an outgoing quality certificate provided by the producer, and
evaluated on the basis of self-inspection by the producer, daily supervision, safety and
health management, on-site examination and pre-export spot test results as necessary.
The General Administration of Quality Supervision, Inspection and Quarantine of the
P.R.C. shall gradually enter into agreements with major import countries on the form
of health certificate and forward it to each bureau for implementation. A uniform health
certificate shall be issued for feeds to be exported to import countries with which an
agreement has been reached. For feeds to be exported to other countries, a health certificate shall be issued according to the previous form and requirements. For countries
where no health certificate is required, feeds to be exported shall be inspected and
quarantined before released.

3.5 Ingredients
Ingredient means any substance (not including processing aid), including food
additive, used in the manufacture or preparation of a food and present in the final
product although possibly in a modified form.
3.6 Date of Manufacture
Date of package means the date on which the food becomes the final product.
3.7 Fecha de duracin mnima (preferentemente antes del)
Fecha de duracin mnima (preferentemente antes del) significa la fecha que seala
el final del perodo en el que, bajo cualquier condicin de almacenamiento indicada
en la etiqueta del alimento preenvasado se mantendr la calidad del producto y ste
permanecer comercializable
3.8 Configuracin
Configuracin significa la descripcin de la relacin entre el peso neto total y las unidades cuando el alimento preenvasado contiene ms de un alimento preenvasado.
4 Basic requirements
4.1 The labeling of prepackaged food shall be in accordance with the requirements
of the state laws and regulations, and the related food safety standard.
4.2 The labeling of prepackaged food shall be clear, prominent, indelible and readily
legible.
4.3 The labeling of prepackaged food shall be.
4.4 The labeling of prepackaged easily understood by the public, precise and
supported by scientific evidence. Any indications, which are superstitious,
pornographic, debasing other products, or unscientific, shall be prohibited.
4.5 The labeling of prepackaged food shall not be described or presented in a manner
that is false, misleading or deceptive; or is likely to create an erroneous impression
by means of different word size or color contrast. food shall not be described or
presented by words, pictorial or other devices which refer to or are suggestive either
directly or indirectly, of any other product with which such food or its certain property
might be confused.
4.6 Labels in prepackaged foods shall be applied in such a manner that they cannot
become separated from the container.
4.7 The words used on the label of the prepackaged food shall be in normal Chinese
characters, which does not include registered trademark. Art characters of different
kinds used for decorating must be written correctly and readily legible, including
handwriting characters, art characters, anamorphosis character, seal characters,
clerical script, and cursive style of calligraphy and so on.
4.7.1 In addition to Chinese characters, the Chinese pinyin and/or languages of
minority ethnic groups may also be used on the label of prepackaged food, but

the size of words shall not be larger than the corresponding Chinese characters.
4.7.2 In addition to Chinese characters, foreign languages may also be used
corresponding to the Chinese characters (except the name and address of the
manufacturer of the imported food; the name and address of the overseas
distributor; and website address). The foreign letters shall not be larger than the
corresponding Chinese characters (except for registered trademarks).
4.8 Where the largest surfaces area of a package (container) of prepackaged food
is more than 35 cm2, the minimum size of the words, symbols and numerals in the
mandatory labeling information shall not be less than 1.8 mm in height.(the method
of calculation for the largest surfaces area is referred to appendix A) 3
4.9 Where through an outer wrapper, the whole or part of the mandatory labeling
information can be clearly distinguished in the inner package (or container), or the
outer wrapper is readily opened for labeling information distinguished, the same
labeling information may not be repeated on the outer wrapper.
4.10 Where the inner package (container) is covered by an outer wrapper as selling
unite for direct delivery to consumers, and the inner package (container) is not a
selling unite, the mandatory labeling information may only be indicated on the outer
wrapper.
5 Labeling information
5.1 Labeling information of prepackaged food for direct delivery to consumers
5.1.1 The name of the food
5.1.1.1 The specific name of the food shall be presented in the prominent
place of the label, and shall clearly indicate the true nature of the food.
5.1.1.1.1 Where a name or several names have been established in
respect of a certain food under a national, trade, or local standard, one of
these names or an equivalent name shall be selected for use.
5.1.1.1.2 In the absence of any such name, either a common or usual name
which is not misleading or confusing to the consumer shall be used.
5.1.1.2 A coined, fanciful, transliterated, brand name, folk name or
trade mark may be used, provided it in the same display panel one of the names
provided in Section 5.1.1.1.
5.1.1.2.1 When a coined, fanciful, transliterated, brand name,
folk name or trade mark contains misleading words or terminologies,
a specific name which indicates the true nature of the food in the same
word size, shall be used in close proximity to this name.
5.1.1.2.2 When a specific name, which indicates the true nature of the
food, is misleading as to the nature of the food due to the different size of
the words, the same word size shall also be sued to indicate the specific name.
5.1.1.3 There shall appear on the label either before or after the name of the
food, such additional words or phrases as necessary to avoid misleading or

confusing the consumer in regard to the true nature, physical condition of the
food, or method of preparation of the food; for example dried, concentrated,
reconstituted, smoked, fried, powdery, granular.
5.1.2 List of ingredients
5.1.21 A list of ingredients of the prepackaged food shall be declared on the label.
5.1.2.1.1 The list of ingredients shall bear the title of Ingredients or List
of ingredients.
5.1.2.1.2 All ingredients shall be listed in descending order of their weights
added in the process of manufacture or preparation of the food; those
ingredients constituting less than 2% of the food may not be listed in
descending order.
5.1.2.1.3 Where an ingredient is itself the product of two or more
ingredients, such a compound ingredient may be declared, as such, in the
list of ingredients, provided that it is immediately accompanied by a list,
in brackets, of its primary ingredients in descending order of proportion.
Where a compound ingredient (for which a name has been established in
a national, trade or provincial standard) constitutes less than 25% of the
food, its primary ingredients need not be declared.
The food additives in ingredients in accordance with GB2760, which do
not serve a technological function in the finished product, need not be
declared.
5.1.2.1.4 Water added during preparation or processing of the food shall
be declared in the table of ingredients. Water or other volatile ingredients
evaporated in the course of manufacture need not be declared.
5.1.2.1.5 The edible package shall also be declared in the table of
ingredients, for example, edible capsule, edible paper of candies.
5.1.2.2 A specific name shall be used for ingredients in accordance with
Section 5.1.1 except for the following situations.
5.1.2.2.1 The names of food additives shall be declared in general names
in accordance with GB2760, except for nutrition fortifier, edible flavors
and gum base for chewing gum. When two or more additives are used in
a food, their class name shall be declared, followed by, in brackets, the
specific names shall be declared, for example: colorants (tumeric yellow,
allura red AC, rosa laevigata michx brown) and so on .(refer to appendix B)
5.1.2.2.2 The food additives may be declared in the position of the
ingredients list as one of the following forms. (Refer to appendix B)
Form 1: considering with other ingredients, declare as requirements in
Section 5.1.2.1.2 and Section 5.1.2.1.3.
Form 2: establish the item of food additives in ingredients list, and in this
item all the food additives directly used in the food shall be declared, the
position of this item is depended on the total weight of the food additives

added. Nutrition fortifier, edible flavors and gum base for chewing gum
may not be declared in the item of food additives, while in the ingredients
list. The food additives in compound ingredients shall be declared as the
requirements in Section 5.1.2.1.3.
5.1.2.2.3 The following ingredients may be declared in accordance with
the class names as stated in Table 1.
