Mistake of fact
a misapprehension of fact/s on the part
of the person who caused injury to
another. He is not criminally liable
because he did not act with criminal
intent.
Requisites (Code: WIM):
1. the act done would have been lawful
had the facts been as the accused
believed them to be.

performing the act must be lawful
3. the mistake must be without fault or
carelessness on the part of the

Proximate cause
that cause, which, in the natural and
continuous sequence, unbroken by any
efficient intervening cause, produces the
injury, and without which the result would not
have occurred. (Bataclan v. Medina, 102 Phil
181)
BUT the felony committed is NOT the proximate
cause of the resulting injury when:
1. there is an active force that intervened
between the felony committed and the
resulting injury, and such is a distinct act
or fact absolutely foreign from the
felonious act of the accused;
2. the resulting injury is due to the
intentional act of the victim.

Requisites of par. 3:

the date altered essential?
Yes. There is falsification under this paragraph
only when the date mentioned in the document is
essential. The alteration of the date or dates in a
document must affect either the veracity of the
