Pharmaceuticals. It does not provide leave to intervene with
respect to Defendants Alphapharm and Genpharm, as
requested in Indiana's Notice of Election to Decline
Intervention (5). Rule 24(b)(2)(A) allows a "state
governmental ocer" to intervene "if a party's claim or
defense is based on a statute or executive order
administered by the ocer...." Count IX of Relator's
complaint implicates conduct involving the Indiana False
Claims Act, Ind. Code 5-11-5.5 et seq. The alleged conduct
involved false claims to Indiana Medicaid that involved
illegally substituted drugs that resulted in damages to
Indiana. (See Compl. 376, 380, 390.) Accordingly, permissive
intervention is appropriate here with respect to Par

of Magistrate Judge Cox's most recent scheduling order, the
12/4/2014 status hearing with Judge Tharp is stricken. A
status hearing is set for 1/8/2015 at 9:00 a.m. The parties
should be prepared to set a schedule for dispositive motions
at that time. In lieu of the hearing, the parties may move for

of compliance indicating that the parties have discussed
these issues thoroughly and outline what issues remain

which time the parties should be prepared to discuss what
