56

MINUTE entry before Honorable Joan B. Gottschall: The

court grants the State of Indiana's Motions for Leave of
Court to Intervene [ 4 ] with respect to Defendant Par
Pharmaceuticals. It does not provide leave to intervene with
respect to Defendants Alphapharm and Genpharm, as
requested in Indiana's Notice of Election to Decline
Intervention (5). Rule 24(b)(2)(A) allows a "state
governmental ocer" to intervene "if a party's claim or
defense is based on a statute or executive order
administered by the ocer...." Count IX of Relator's
complaint implicates conduct involving the Indiana False
Claims Act, Ind. Code 5-11-5.5 et seq. The alleged conduct
involved false claims to Indiana Medicaid that involved
illegally substituted drugs that resulted in damages to
Indiana. (See Compl. 376, 380, 390.) Accordingly, permissive
intervention is appropriate here with respect to Par
Pharmaceuticals. Mailed notice (mb, ) (Entered: 11/07/2011)

is taken under advisement for 14 days. The motion will be

granted if no ling is made by the plaintis to withdraw the
motion. If the plaintis' motion 234 is not withdrawn within
the 14 day period, that motion 234 and the Plaintis' motion

this regard, the Court notes as well that the plaintis have
not yet led a summary judgment motion; motion 234 only
seeks leave to le an oversized brief and statement of facts.
On the assumption that a summary judgment motion will also
be led to accompany that brief and statement of facts, the

reply will be due 2/19/14. Defendant PAR Pharmaceutical

discovery is complete. Expert discovery ends October 7, 2014

and cross motions are due on November 7, 2014. Plainti's
motion to strike defendant's objections to request to admit
and to compel full responses 291 is the only pending motion.
Defense counsel reports that there is one 30(b)(6) deposition
that has yet to be taken, however, a more complete discovery
production is needed from the State of Indiana. The State of
Indiana is to turn over the "Meyers" set of documents on or
before 6/24/2014. The remaining set of documents counsel
reports are being held up with the vendor, HP. Further status
is set for 6/26/2014 at 9:30 a.m. In the interim, the parties
are to work towards full production of discovery, as discussed
in open court. If the State of Indiana is still having issues
with the vendor, they are to notify the Court at the next
status hearing. Mailed notice (np, ) (Entered: 06/10/2014)

hearing held. Counsel for State of Michigan, Susan
Hellerman, appeared by telephone. Parties provided the
Court with a status of the case regarding discovery. State of
Indiana represented that discovery production is complete,
having reviewed and produced 171 boxes to the defendant
yesterday, 6/25/2014. Defendant will review the documents
and coordinate with Indiana's Counsel to schedule the
30(b)(6) deposition. Defendant also seeks to issue a few
additional interrogatories, regarding prescriptions, to the
State of Michigan. The Court advised the parties to meet and
confer regarding the issue and if an agreement is not
reached then the parties are to le a motion. Following
expert discovery, parties plan to proceed with cross motions
for summary judgment before Judge Tharp. The Court
inquired about settlement. Parties had a settlement
conference before Judge Keyes and did not settle; therefore,
the parties do not believe a settlement conference would be
fruitful at this time. Plainti's motion to strike defendant's
objections to request to admit and to compel full responses
291 is entered and continued. Court will rule by mail.
Counsel for the State of Michigan can appear by phone at
