IN REMOVAL PROCEEDINGS

ON BEHALF OF RESPONDENT:

Muakum J. Sherman, Esquire

APPLICATION: Reopening

The respondent has appealed the Immigration Judge's decision dated March 11, 2013,
denying his motion to reconsider the denial of his motion to reopen. An Immigration Judge had
previously ordered the respondent removed in absentia on November 10, 2011, and the
respondent sought reopening, in part, because he had a pending application for immigration
benefits under the DHS's Deferred Action for Childhood Arrivals ("DACA") program.

The

Department of Homeland Security (DHS) has not filed an opposition to the respondent's appeal,
and it is thus deemed unopposed. Considering the totality of the circumstances presented in this
case, we conclude that it is appropriate to reopen and administratively close these proceedings.

See Matter ofAvetisyan, 25 I&N Dec. 688 (BIA 2012).

immigration benefits under DACA.

It appears that the DHS has now granted

Administratively closing these proceedings while the

respondent holds an immigration status which permits him to lawfully be present in this country
and obtain employment is an efficient use of this Board's resources.

See Matter ofGutierrez, 21

l&N Dec. 479, 480 (BIA 1996). Accordingly, we will reopen and administratively close these
proceedings.
If either party to this case wishes to reinstate the proceedings, a written request to reinstate
the proceedings may be made to the Board. The Board will take no further action in the case
unless a request is received from one of the parties. The request must be submitted directly to
the Clerk's Office, without fee, but with certification of service on the opposing party.
