APPLICATION: Reopening

The respondent has appealed the Immigration Judge's decision dated March 11, 2013,
denying his motion to reconsider the denial of his motion to reopen. An Immigration Judge had
previously ordered the respondent removed in absentia on November 10, 2011, and the
respondent sought reopening, in part, because he had a pending application for immigration
benefits under the DHS's Deferred Action for Childhood Arrivals ("DACA") program.

The

Department of Homeland Security (DHS) has not filed an opposition to the respondent's appeal,
and it is thus deemed unopposed. Considering the totality of the circumstances presented in this
case, we conclude that it is appropriate to reopen and administratively close these proceedings.
