MUNICIPAL RESOLUTION NO. 011-2014

APPROVING THE OUTCOME OF THE NEGOTIATION BETWEEN HONORABLE MAYOR ANN
Y. ONGJOCO AND MR. FERNANDO RIVERA ON THE DONATION OF PORTION OF LOT NO.
7293 TO THE LGU OF GUINOBATAN PURSUANT TO MUNICIPAL RESOLUTION NO. 078-2013
THEREBY AUTHORIZING THE LOCAL CHIEF EXECUTIVE TO DISBURSE FUNDS WHICH
ARE NECESSARY AND INCIDENTAL FOR THE ACQUISITION OF SAID LOT.

WHEREAS,

Municipal Resolution No. 078-2013 was enacted by this august body to authorize
the Honorable Mayor Ann Y. Ongjoco, in behalf of this Local Government, to
negotiate and represent the latter, in the acquisition of a portion of Lot No. 7293
from Mr. Fernando Rivera, necessary for the construction of a Rural Health Center,
subject to the final approval of the Sangguniang Bayan;

WHEREAS,

the condition, as embodied in the Resolution previously mentioned, provides: x x

x that the Honorable Mayor shall report in writing to the Honorable Sangguniang
Bayan, the outcome of her negotiation with the Owner for the final approval of the
Sangguniang Bayan, stating therein, among others, the status of the Property and
its Title and the amount to be incurred by the LGU, otherwise, all expenses that
will be incurred without such approval by the Sangguniang Bayan shall not legally
bind the LGU for its payment;

WHEREAS,

the Office of the Sangguniang Bayan was in receipt, last 20 th of January, 2014, of
a written report from the Liaison-Designate of the LGU, duly noted by the
Honorable Mayor, attaching thereto the following documents, to wit: (1) Certified
Photocopy of Tax Declaration, (2) Duly Notarized Deed of Donation, (3) RTC
Clearance, (4) Faithful Reproduction of Title No. T-19433, (5) Photocopy of
Release of Real Estate Mortgage duly annotated with the ROD, (6) Affidavit
Executed by the Donor that the Lot in issue is free from all liens and
encumbrances, (7) Lot plan subject for Approval of the LMS/Bureau of Lands as to

the Identification of donated lot, (8) Certified photocopy of the Appropriation

Ordinance No. 09-2011, issued by the Budget Office for the appropriate charging
of expenses to be incurred by the LGU, (9) Certified photocopy of the SARO
issued by the Accounting Office as to the availability of funds, (10) Photocopy of
charge/fee of Surveyor, Engr. Rogelio B. Rivera, and (11) Notice of Real Property
Tax Bill issued by MTO, necessary for its final approval, and ultimately for its lawful
and legitimate acquisition;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED,

as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in

session assembled, to Approve as it hereby Approves the outcome of the
negotiation between Honorable Mayor Ann Y. Ongjoco and Mr. Fernando Rivera
on the donation of portion of Lot No. 7293 to the LGU of Guinobatan pursuant to
Municipal Resolution No. 078-2013 thereby authorizing the Local Chief to
Disburse Funds which are necessary and incidental for the acquisition of said lot.

RESOLVED FURTHER, that a copy of this resolution be furnished the Office of the Municipal
Mayor, and such other concerned offices or agencies, for their information and
appropriate action.
APPROVED UNANIMOUSLY, on motion of Honorable Councilor Frances John M. Oxales and duly
seconded by the members present this 27 th day of January, 2014 during their 4 th
Regular Session.
