(hereinafter referred to as the "PURCHASERS", which expression shall
whenever the context so requires or admits, mean and include, their heirs,
executors, administrators and assigns),
RECITALS:
Whereas:
I.

The Vendor above named is the absolute owner of all that piece and
parcel of the Schedule Property bearing corporation No. 1, (BDA Site
No. 1064-B formerly the Northern portion of Old No. 123, renumbered
as 1064/1, E Main Road) Situated at E Main Road, Pipeline, Gokul
I Stage, IV Phase, Bangalore in corporation Ward No. 7, measuring
East to West 37 feet and North to South 47 feet together measuring
1739 square feet, comprising of 2800 square feet in the ground and
first Floor, which is more fully described in the Schedule hereunder
and which shall hereinafter be referred to as the Schedule Property
hereby conveyed.

II.

The Vendor has acquired the Schedule Property through the Gift
Deed dated 25/01/2006 from her mother Mrs. Shanthi Bai registered
as Document no. 6093/2005-06 in Book 1, Stored in CD. No. 84 in
the office of the Sub-Registrar, Rajajinagar, Bangalore 10.

III.

In the said manner the Vendor became the absolute owner in right,
title and interest of all that piece and parcel of the Schedule Property
which is more fully described in the Schedule hereunder and
hereinafter referred to as the Schedule Property.

IV.

The said Schedule Property has now come within the jurisdiction of
BBMP and the khata of the said Property is mutated in the office
records of BBMP in the name of Vendor.

V.

The Vendor is in peaceful possession and enjoyment of the Schedule


Property.

VI.

WHEREAS the Vendor are now desirous of disposing of the Schedule


Property, which

is morefully described in Schedule herein and

hereinafter referred to as Schedule Property and hence offered to


sell the Schedule Property for a sum of Rs. 60,00,000/- (Rupees Sixty
Lakhs Only) free from all encumbrances and the Purchasers above
named being in need of the said property agreed to purchase for the
said sum of Rs. 60,00,000/- (Rupees Sixty Lakhs Only) free from all
encumbrances. Pursuant thereto the parties hereto have entered into
an Agreement to sell on 10/07/2010 in terms contained therein.
VII.

The Vendor's husband (1) Sri. V.Nagendra Rao aged about 52 years
and their Daughter (2) Smt. Namratha, Aged about 24 Years, are
aware of this sale and agreed to this sale transaction and signed as
consenting witnesses to this sale deed.

NOW THIS DEED OF SALE WITNESSES:a) That in pursuance of the sale agreement dated 10.07.10 the purchaser
paid a sum of (i) 50,000/- (Rupees Fifty thousand only) by way of cheque
no. 828379 dated 26/06/10 drawn on Corporation Bank, Malleswaram
(ii) Rs. 5,00,000/- (Rupees Five Lakhs only) by way of Cheque no.
194498, dated 10-07-2010, drawn on ICICI Bank, Kumara Park Branch
(iii) Rs. 6,00,000/- (Rupees Six Lakhs only) by way of Cheque bearing
No. 896823, dated 10-07-2010, drawn on Corporation Bank,
Malleswaram (iv) Rs. 30.5 lakhs (Rupees Thirty Lakhs and Fifty
Thousand only) by cheque no. 896832 dated 29-09-10 drawn on
Corporation bank, Malleswaram, Bangalore.

The purchaser has availed the House Building Advance (HBA) of Rs.20
lakhs from employer, POWERGRID and withdrawn Rs.12 Lakhs from PF
for purchasing the schedule property.
And whereas The balance of Rs. 22,48,000 (Twenty Two Lakhs Forty Eight
Thousand only) being the loan amount sanctioned by Axis Bank, Bangalore
to the purchaser and paid by their DD No.

Bangalore, in favor of the vendor at the request and authorization of the


Purchaser and paid on this day to the vendor at the time of registration of
this absolute sale deed before the Sub-Registrar.
Thus, the Vendor acknowledges for having received the full sale
consideration amount of Rs. 60,00,000/- (Rupees Sixty Lakhs Only) in full
satisfaction

and final settlement of her consideration

and the Vendor

hereby sells , transfers all the right, title and interest in the said property and
set over the vacant possession of the schedule property and set-over the
vacant possession of the schedule property to the purchasers as absolute
owner from hereon and for ever and in consideration thereof the Vendor
hereby grant, convey, sell, transfer, assign and assure UNTO AND TO THE
USE of the said Purchasers all their right, title, interest, ownership and
other rights in Schedule Property free from all encumbrances, court
attachments, litigations, maintenance charges, claims and demands
whatsoever together with all the rights of way, easements of necessity,
water, water courses, drains, privileges, appurtenances, advantages
whatsoever pertaining to or belonging to the Schedule Property, who
shall hold, possess, use and enjoy all the right, title and interest claims,
payments of the Vendor and all other rights,

privileges and amenities

belonging thereto TO HAVE AND TO HOLD the Schedule Property and


every part thereof TO AND UNTO THE Purchasers absolutely and forever.

A. THE VENDOR COVENANTS WITH THE PURCHASERS THAT:

1. That the property hereby conveyed is the self acquired Property of the
Vendor and the same is absolutely owned and possessed by the Vendor
and that her title thereof is good, marketable and subsisting and that
none else has any right, title, interest or share therein and he has the
power to convey the same and that there is no impediment or prohibition
for this sale under any law, order, decree or contract and that it is not
subject matter to any encumbrance, attachment, court, acquisition
proceeding or charges of any kind and that the conveyance hereby made
is free from all encumbrances, attachments, court or acquisitions
proceedings or charges.
2. That the Purchasers shall be entitled to quietly enter upon, hold, possess
and enjoy the property hereby conveyed as absolute owners thereof and
shall be in the peaceful possession and quiet enjoyment thereof without
any interference or disturbance from the Vendor or her predecessors in
title or anyone claiming under her or anyone claiming any lawful title
thereto.
3. That the Vendor has this day delivered original / copies of the available
title deeds relating to the property hereby conveyed to the Purchasers.
4. That the Vendor shall whenever so required by the Purchasers, do and
execute all such acts, deeds and things for more fully and perfectly
assuring the title of the Purchasers to the property hereby conveyed.
5. That the Schedule Property is not mortgaged or offered as a

collateral

for securing any loan or for obtaining any advance whatsoever from any
individual, Bank or Financial Institution and it is not subject to any
encumbrance, attachment, court or acquisition proceedings or charges of
any kind, howsoever remote;

6. That the Vendor has the absolute right to transfer the Schedule
Property and there are no legal or other impediments of whatsoever
nature.
7. The Vendor have paid the property taxes and other taxes and charges in
respect of the Schedule Property to the concerned authorities upto date
and the Purchasers can pay the same hereafter from this day and in
case any taxes or charges are still due unpaid in respect of the Schedule
Property, the same shall be paid by the Vendor.
8. The Vendor have no objection for the Purchasers to get Khata of
Schedule Property transferred in the name of Purchasers in the records
of Bruhat Bangalore Mahanagara Palike.
9. The Vendor have this day delivered and put the Purchasers in actual
physical vacant possession of the Schedule Property.
10. The Vendor assure that apart from them, there are no other persons
interested in the Schedule Property or portions thereof and the Vendor
hereby agree to keep the Purchasers at all times fully indemnified and
harmless against any loss or liability, action or proceedings, cost or
claims which may arise against the Purchasers or the Schedule Property
by reason of any defect in or want of title on the part of the Vendor and/or
breach of the terms of this sale.
11. This deed has been made, executed and registered at the cost of the
Purchasers and the Purchasers have borne the stamp duty, registration
fee payable on this deed and if any further stamp duty and registration
fee is demanded by the registration authorities under whatever
proceedings the same shall only be borne by the Purchasers and the
Vendor shall have no liability in respect thereof.

SCHEDULE PROPERTY
All that Piece and Parcel of the residential Property bearing Corporation No. 1,
(BDA Site No. 1064-B, formerly the Northern portion of Old No. 123, renumbered as 1064/1, E Main Road) Situated at E Main Road, Pipeline,
Gokula I Stage, IV Phase, Bangalore in Corporation Ward No. 7, measuring
East to West 37 feet and North to South 47 feet totally measuring 1,739 Square
feet , along with RCC roofed building consisting of Ground and First floor (an
built up area of 2800 square feet) with basic civic amenities and bounded as per
the previous records:
