ORDER : According to sub-rule (2) of Rule 7 of the Tamil Nadu Government Servants Conduct Rules, 1973, a Government servant who enters into any transaction concerning any movable property exceeding five thousand rupees in value, whether by way of purchase, sale or otherwise should report to the prescribed authority within one month from the date of every such transaction. According to Explanation I under the above rule, movable property includes, inter-alia jewellery. 2. In view of the specific provision under Tamil Nadu under Tamil Nadu Government Servants Conduct Rules, 1973, referred to in para 1 above, it will be argued that the Government servant concerned should report the transaction of pledging of jewellery to the prescribed authority within one month from the date of each such transaction, so long as the expression or otherwise remains in sub-rule (2) of rule 7. 3. The Government servants used to frequently borrow money from the Co-operative Bank and from Nationalised Bank by pledging of jewels and if they are required to report on every occasion such pledging, this will cause hardship to the Government Servants and simultaneously throw additional workload on departments of Government also. However, with a view to obviate such inferences and to relieve Government servants from the unnecessary requirement of reporting the pledging of jewels by them on each occasion whenever the value exceeds Rs.5,000/- besides securing clarity and definiteness, the Government have decided that the expression or otherwise occurring in rule 7(2) of the Tamil Nadu Government Servants Conduct Rules, 1973 may be severed from the above rule.

Gazette :NOTIFICATION In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Tamil Nadu hereby makes the following amendment to the Tamil Nadu Government Servants Conduct Rules, 1973. AMENDMENT In the said Rules, in rule 7, in sub-rule (2), for the expression, by way of purchase, sale or otherwise, the expression by way of purchase or sale shall be substituted.
