if in light of these issues, there is a need to change the law. Affirmative action laws have been a
point of contradiction due to several issues that have come to light during the recent years. The
Affirmative action programs are governed by several overlapping laws, of which a common
principle is that Loading...affirmative action programs should be encouraged to redress the
effects of discrimination that has happened in past. In case of the American employment law,
affirmative action has been evolving and reached here through a series of government
proclamations as well as court decrees. The private employers who do not receive any public
funding re not bound to adopt the affirmative action policies. But, in case of the Federal
contractors or the subcontractors, they have to take affirmative action for the recruitment of
qualified minorities, women, persons with disabilities etc. The affirmative action programs
mostly come under question in case of the educational system. In case of education, the most
often highlighted case is that of mismatch. Scholars have also raised the question that if the
affirmative action programs are benefiting or harming the beneficiaries. However, it had been
suggested as early as the 1960s that these laws could also prove harmful for the intended
beneficiaries. Some cases related to negative effect of affirmative action laws on the beneficiaries
have been brought to light by the scholars. The beneficiaries after getting their admission into the
elite institutions are not able to keep pace or bear the academic pressure, which often results in
falling CGPAs and poor career graph. This phenomenon is often referred to as mismatch. My
research paper will aim to answer mainly the following questions: Are affirmative action laws
serving the intended purpose? Are the beneficiaries being benefited? What are the negative
effects of these laws and how the beneficiaries instead of being benefited may be being harmed
especially in case of education? My paper will discuss the reasons for changing the laws as well
as shed light on the situations where these laws are giving birth to trouble. The laws are

frequently being a Loading...bone of contention and the number of court cases related to the
affirmative action laws has also been rising. The paper will discuss all these points including the
things which put a question mark on the validity of these laws. At last the paper will also address
the question that if there is really a need for affirmative action laws. For research I will
accumulate information from primary as well as secondary resources. Primary data can be
collected by interviewing employers who recruit under the affirmative action laws as well as
other resources like beneficiary students or college officials. There has been too much debate on
this topic and there are several cases where media has highlighted the questionability of the law.
At this point the most important requirement is to discuss whether there is really a need for
formative action laws. We have come across situations which indicate towards a need for
changing these laws. The problem of mismatch is also frequently being highlighted. In the light
of all these issues and situations it is really crucial to discuss the validity of the affirmative action
laws and programs.
