MUNICIPAL RESOLUTION NO. 104-2014

REQUESTING THE BICOL UNIVERSITY THRU ITS PRESIDENT, DR. FAY LEA PATRIA M.
LAURAYA, TO ALLOW THE MUNICIPALITY OF GUINOBATAN TO USE A TOTAL OF 7,000
SQUARE METER OF LAND WITHIN THE BICOL UNIVERSITY COLLEGE OF AGRICULTURE
AND FORESTRY FOR THE CONSTRUCTION OF HOSPITAL AND SLAUGHTERHOUSE AND
HEREBY GRANTING AUTHORITY TO THE HONORABLE MAYOR TO ENTER INTO A
MEMORANDUM OF AGREEMENT WITH THE BICOL UNIVERSITY FOR THIS PURPOSE.

WHEREAS, the Municipal Government of Guinobatan has been continually

opting/proposing the establishment of a hospital or wellness center within the municipality aimed to
provide patient treatment and is intended to carry out health care services which shall cater
patients/residents not just from this municipality but also those coming from neighbouring
municipalities;
WHEREAS, this municipal government also opts to establish a new slaughterhouse
compliant with national standard design, construction and installation of equipment;
WHEREAS, after due consideration thereof, it has been determined that only a total area
of 7,000 square meters is needed as site/location for the hospital and slaughterhouse, and that
construction of the same within the compound of Bicol University College of Agriculture and
Forestry (BUCAF) is most practicable and suitable for the intended purposes;
WHEREAS, since the passage of Municipal Resolution No. 038-2013, rectification has to
be made due to an incident, Re: having found out that the Local Government of Guinobatan, as per
Tax Declaration/ARP No. 02-05-011-00410, has been declared as owner of Lot No. 488 consisting
of 26,746 square meters, majority of which is currently in possession of the BUCAF, Albeit declared
as residential, the same is actually being used as school site (BUCAF) and as government site
(Rural Health Center);

WHEREAS, the Municipal Government of Guinobatan has full-heartedly decided on the

realization of the above-mentioned projects. Protocol and due respect, therefore, to the current
possessor of the property subject-matter of this resolution, unaware as we are as to the previous
agreement between the BUCAF and this local government, is being given to the possessor thereof
(BUCAF) for the peaceful negotiation as to the use and enjoyment of the same;
WHEREAS, it is now being sought that the Local Government of Guinobatan be provided
with the use and enjoyment of a total of 7,000 square meters area within the BUCAF compound for
the following purposes: (1) an area of 2,000 square meters for the construction of the proposed
hospital/wellness center, preferably within Lot No. 488 as to be adjacent to the Rural Health Center,
and (2) an area of 5,000 square meters for the construction of the proposed
abattoir/slaughterhouse which need not necessarily be within Lot No. 488 but within the BUCAF
compound as may be determined by negotiation, subject to the agreement of the concerned
parties;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in
session assembled, to request as it hereby requests the Bicol University thru its President, Dr. Fay
Lea Patria M. Lauraya, to allow the municipality of Guinobatan to use a total of 7,000 square meter
of land within the Bicol University College of Agriculture and Forestry for the construction of
Hospital and Slaughterhouse and hereby Granting Authority to the Honorable Mayor to enter into a
Memorandum of Agreement with the Bicol University for this purpose.
RESOLVED FURTHER, that this resolution repeals/supersedes Municipal Resolution Nos.
038-2013 & 102-2014.
RESOLVED FINALLY, that a copy of this resolution be furnished the President of Bicol
University, Dr. Fay Lea Patria M. Lauraya, the Dean of BUCAF, Dr. Marissa N. Estrella, the Hon.
Mayor Ann Y. Ongjoco, and such other concerned offices or agencies, for their information and
appropriate action.

and duly seconded by the members present this 22 nd day of September, 2014 during their 34 th
Regular Session.
