Context and rationale
Development problem:
The problem of industrial and household waste management is one of the priority directions in the Concept of Environmental
Security of Kazakhstan. The optimization of waste management should provide the environmental security and sustainable
development of the country.
There are number of efforts and actions of the government and donor projects aimed to solve the issue. In addition to the
main baseline documents on Environmental Security, Industrial Innovational Strategy there are number of environmental laws
and regulations, mainly, Constitution of 30 August 1995; Environmental Law of RK of 15 July 1997; Basel Convention on
Control of Trans-boundary Transportation of Hazardous Wastes and Removal was accepted in RK in February 2003; Draft
Law on Wastes is considered by Parliament. Ministry of EP is elaborating the amendments and regulations;
Provisions of Cabinet of Ministers of RK; Methodological Regulations of MEP RK. All these regulations and acts do not lay the
good basis for the economic benefits, does not provide beneficial entry points for the private structures and does not attract
national and foreign investors due to the low costs and absence of the infrastructure.
At the same time Kazakhstan does not have the state system of waste management that includes state legislation with
regard to monitoring, treatment and utilization of existing wastes. The working inter-sectoral team on Waste Legislation
was established, and in parallel, the work of experts and decision makers to systematize environmental legislation in the form
of Ecocodex (Govt. and UNDP support) is in process. The role of Government should be increased significantly, providing the
relevant waste authority on central and municipal level.
This proposal is an output of the support provided in 2004 by UNDP-Kazakhstan and UNDP-Bratislava (RBEC) with regard to
the analysis of the situation of wastes management system by Czech NGO TODERO in Kazakhstan and, in particular, in
Almaty city. Six Kazakhstan specialists and decision makers, reflecting interests of research institute in household wastes,
industrial enterprises, ministries, municipalities and parliament, as members of the Wastes Legislation Team, took part in the
one week study tour to learn the experience of Czech Republic in management of wastes. Due to the fact-finding mission to
Kazakhstan priority actions to promote the effective management and utilization of wastes were identified by Czech and
Kazakhstan specialists and are reflected in this proposal.
In addition, the present proposal contains activities in resource mobilization for the full-scale project from internal and external
sources of support, using the public private partnership approach in efforts to improve the waste management system in
Kazakhstan.

Role of UNDP-Kazakhstan: project development, facilitation of the project implementation, administration and monitoring, to
ensure the public private partnership, transparent financial reporting, etc.
Expected results:
Effective and competent inter-sectoral Wastes Legislation Team will facilitate the adoption of the Law on Wastes by the
Government and the Parliament in 2005-2006.

Project strategy:
The project will assist Kazakhstan in the development of state waste management system (WMS) on the policy and legislation
levels. A number of meetings of the Waste Legislation Team (WLT) will be organized with participation of local and Czech/Slovak
experts to consider the gaps of environmental legislation. WLT will work out the Guiding Principles of WMS in Kazakhstan,
adoption of the new Law on Wastes, Waste Classification System (WCS) and the Tracking System on Wastes. WMS should reflect
the priorities in a following sequence:
- Prevention of waste production through minimized usage of resources and through minimized waste quantity and/or
hazardous properties of wastes
- Reuse of products or their parts for the same or alternative purpose
- Recycling processing of waste materials in order to use them as a raw material for processing of the same or
alternative product
- Use upgrading of wastes through composting, energy production or by application of other technologies
- Liquidation through safe waste deposition or incineration (without energy production)
At the same time the lessons learnt from this project will be used during the implementation of Central Asian Regional
Environmental Action Plan for further replication in other countries.

Activities (extent and duration):

meeting in 2005 and 2 meetings in 2006) - 16 months within 2005-2006
1.3 Participation of three Kazakh experts in Technical Workshop in Czech Republic to discuss WMS aspects with Czech experts

Risks and assumptions: The objective of the project coincides with the state policy. The inter-sectoral cooperation is being
developed in the framework of the strategy of industrial and innovative development of the Republic of Kazakhstan till 2015.
Nevertheless, one project can be insufficient motivation.
PROJECT ADMINISTRATION
Project management:
Requirements on implementing institution / project manager:
UNDP Regional Centre for Europe and CIS will be responsible for backstopping the projects, in terms of identified outputs
and in terms of finance. It will identify and subcontract of international expert/institute (but should make sure that the
subcontractor reports to UNDP Kazakhstan and is paid based on performance assessment report elaborated by UNDP
Kazakhstan)

UNDP Kazakhstan will oversee the project implementation, it will identify and subcontract national project manager
responsible for delivering the project outputs based on the UNDP rules and regulations (ToR for project manager are in
the Annex 1), and will report on the project implementation and outcomes to the UNDP Bratislava Regional Centre.

Management and Operations:
The project will be financed by UNDP RBEC, Ecocom and co-financed by UNDP CO funds. The Ecocom cash contribution
will be allocated and taken from Development Advisory Services of UNDP-Kazakhstan. The Project experts supported by
UNDP RBEC and Ecocom Cost Sharing Contribution will work together with the team of experts on EcoCode development
supported by UNDP CO and will report to the Ministry of Environment Protection (MEP) through the Vice Minister MEP,
National Project Director. The project implementation unit (PIU) will consist of the Leading expert, national and
international experts (Please find the ToRs enclosed below) will be selected according to UNDP rules and regulations. The
daily work on national level will be coordinated by Senior Program Assistant within UNDP Good Governance and Sustainable
Development Unit.
The payment for experts will be result oriented based on milestones reflected in ToRs and released upon approval of UNDP
CO.
An international expert/institution will be responsible for project coordination and for a transfer of know-how on
bioremediation methods. ToR for the international expert/institution is in the Annex 2.
