AFFIDAVIT OF SOLE ADJUDICATION

With DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:
I, CORAZON A. ACEDERA, of legal age, Filipino, widow and a resident of
Happy Land, Barangay Anibong, Tacloban City, after having been sworn
according to law, depose and say: THAT--WHEREAS, sometime in October 28, 1982, the Estate of Engracio Pener
filed a Estate Tax Return of decedent Engracio Pener, who died on 3 August
1940, with the surviving Heirs consisting only of Moises M. Pener, Severina P.
Navarro and Corazon A. Acedera who were son, daughter and granddaughter
respectively;
WHEREAS, the remaining property of the Estate of Engracio Pener is a
certain real property in Tacloban City covered by an Original Certificate of Title
No. 1518 registered in the name of Engracio Pener by the Register of Deeds of
Tacloban City and particularly described as follows:
A parcel of land Lot No. 5830 or Lot No. 4233-C Tacloban
Cadastre No. 220, Case 8, situated in Brgy. Bagacay,
Tacloban City, Province of Leyte. Bounded on the North by Lot
No. 5829; on the East by Creek; on the Southeast by Creek;
and on the Southwest by Lot No. 5829; containing an area of
1,750 sq.m. more or less.
WHEREAS, abovenamed co-heirs MOISES M. PENER and SEVERINA P.
NAVARRO likewise died on August 13, 1983 and September 14, 1986
respectively, pending the settlement by the Estate of Engracio Pener of its tax
oblgations, leaving no other heirs except the undersigned adjudicator;
WHEREAS, above premises considered,I am now the sole and only
surviving heir of decedent ENGRACIO PENER, who died intestate in Tacloban,
Leyte on 3 AUGUST 1940, leaving the aforedescribed certain real property in
Tacloban City.
WHEREAS, the decedent has left no known debts or obligations that have
remained unpaid or unsettled; neither has he left any other heir entitled to
succeed in his estate, except the herein affiant who is his sole surviving
granddaughter.
NOW THEREFORE, for and in consideration of the foregoing premises,
and invoking the provision of Section 1, Rule 74 of the Rules of Court, the herein
affiant does hereby adjudicate unto herself the estate hereinabove described,
subject only to contingent liabilities to creditors, heirs and other persons who
might have been deprived of lawful participation therein in accordance with
Section 4, Rule 74 of the Rules of Court.
PROVIDED FURTHER, that IN CONSIDERATION of the sum of FIVE
THOUSAND PESOS (PhP5,000.00), Philippine Currency, to me in hand paid by
BASILIA A. MENDIOLA, of legal age, Filipino, widow and a resident of Brgy. Bagacay,
Tacloban City, we do by these presents hereby SELL, TRANSFER AND CONVEY, in a
manner absolute and irrevocable unto BASILIA A. MENDIOLA, her heirs and

assigns the above described real property subject of adjudication.

That I hereby warrant valid title to, and peaceful possession of that certain
real property herein sold and conveyed, and will defend the same unto the said
VENDEE, her heirs and assigns against the claims of third persons whomsoever.
FURTHER, AFFIANT SAYETH NAUGHT.
IN WITNESS WHEREOF, I have hereto have affixed my signature
this 10th day of March, 1995 at Tacloban City, Philippines.

ACKNOWLEDGMENT
BEFORE ME, this 16th day of March 1995 in Tacloban City, personally
appeared CORAZON A. ACEDERA, exhibiting to me her Community Tax
Certificate No. 14364922A issued on 03/10/95 in Tacloban City, known to me to
be the same person who executed the foregoing instrument, consisting of two (2)
pages including this page whereon the acknowledgment is written and signed by
the adjudicator and her witnesses, and she acknowledged to me that the same is
her free act and deed.
