(Jan. 15, 2015), and Bourke v. Beshear, No. 14-574, --- S.Ct. ----, 2015 WL 213651 (Jan. 15,
2015).
The second question (Does the Fourteenth Amendment require a state to recognize a
marriage between two people of the same sex when their marriage was lawfully licensed and
performed out-of-state?) is the precise claim raised by Plaintiffs April and Ginger Aaron-Brush.
Given the Supreme Courts grant of review on this question, the parties believe that the
briefing deadline in this case should be extended to approximately one month after the end of the
current Supreme Court Term, July 31, 2015, in order to give the parties the benefit of having the
Supreme Courts opinion to incorporate in such briefing. Indeed, depending upon the Courts
disposition of the cases, the parties may be able to stipulate to the appropriate final outcome in this
case and file promptly after the decision.
Wherefore, the parties move to extend the deadline for dispositive motions (Doc. 21, 10)
to July 31, 2015. In addition, 12 (pretrial conference date) and 14 (trial date) should be adjusted
accordingly. No other deadlines need be altered.
Respectfully submitted,
