MUNICIPAL ORDINANCE NO. 07-2014

APPROVING THE REROUTING OF PUJs BOUND TO LEGAZPI CITY BY
PROHIBITING THE USE OF CEVALLOS ST., M.H. DEL PILAR ST., AND
OLA ROAD AND BY DECLARING RIZAL STREET OF POBLACION,
GUINOBATAN, ALBAY AS THE OFFICIAL AND PERMANENT ROUTE OF
THE JEEPNEYS GOING TO LEGAZPI CITY EXCEPT DURING OCCASION
SUCH AS FIESTA WHERE M.H. DEL PILAR SERVES AS AN ALTERNATE
ROUTE.

WHEREAS, the general welfare of the people is the prime duty of

government, local or national, in any Republican Democratic System;
WHEREAS, while it is the LTFRB which has jurisdiction in the grant of
franchises to PUJs, it is the Sangguniang Bayan that has jurisdiction or
authority in determining policies that would protect the general interest of its
constituents under the General Welfare Clause of R.A. 7160, the Local
Government Code of 1991;
WHEREAS, the present route of the PUJs from the 3rd District of Albay
bound to Legazpi City posed high risk from vehicular accident to school
children, ambulant vendors and passer by regularly using Cevallos Street,
M.H. Del Pilar & General Simeon Ola Road;
WHEREAS, if the said PUJs will travel along Rizal Street of the
Poblacion area, instead of its present route at Cevallos Street, M.H. Del Pilar
& Ola Road the latter shall be free from heavy traffic and thus remove the
risk of road users from vehicular accidents:
WHEREAS, the legitimate members of the GUILLIPOJODA will generally
benefit from the rerouting scheme because they would have equal access to
passengers coming from Mauraro, Quitago, Maguiron, Inamnam Pequeo,
Inamnam Grande, Calzada etc. with the PUJs bound to Legazpi City;

WHEREFORE, in view of the foregoing premises,

BE IT ORDAINED by the Sangguniang Bayan of Guinobatan,
Albay in session assembled, that:
SECTION 1. SCOPE & COVERAGE. This ordinance shall cover the
PUJs bound to Legazpi City presently using Cevallos Street, M.H. Del Pilar &
Ola Road as their official route. All Public Utility Jeepneys (PUJs) from 3 rd
District of Albay are now directed to use Rizal Street as official designated
route rather than Cevallos Street, M.H. Del Pilar & Ola Road except during
holidays such as Fiesta and the like whenever the need for temporary
rerouting arises;
SECTION 2. LOADING & UNLOADING ZONES OF GUILLIPOJODA
MEMBERS. The members of the GUILLIPOJODA shall enjoy their present
loading & unloading zone at the waiting shed in front of Roman Catholic
Church; provided, however, that the PUJs whose drivers or operators are
neither member of the GUILLIPOJODA or other organization may enjoy the
same rights to park, pick-up passengers at the official designated parade of
the GUILLIPOJODA on condition that they shall apply membership to the
organization. Provided further, that the GUILLIPOJODA shall provide a sticker
to the said jeepneys for the purpose of identification and provided finally,
that they are bound to observe 5-minute parking and loading time.
Moreover, they shall a right to pick up area from Ola Shrine to Petron Gas
Station.
SECTION 3. LOADING & UNLOADING ZONES FOR NON-MEMBERS
GUILLIPOJODA. There is hereby two designated areas for loading &
unloading zones for use of PUJs bound to Legazpi City by non-members of
the GUILLIPOJODA:
a. at the waiting shed along Cevallos Street corner Rizal Street;
and,
b. at the right side of Guinobatan East Central School or right in
front of the Fide School & Learning Center.
SECTION 4. PARKING FEES & PROCEEDS. The LGU-Guinobatan
shall impose a TEN PESOS (PhP10.00) parking fee for every PUJ parking at
the designated parking area. Fees collected for this purpose shall be
distributed in the following manner:
a. General Fund
- 30%
b. Task Force Kaayusan Fund
- 35%
c. PUJ Parada Priority Development
- 35%
SECTION 5. PENAL CLAUSE. Any drive/operator violating the
provisions of this ordinance shall be fined in the following manner:
a. 1st offense
- PhP 300.00;
nd
b. 2 offense
- PhP 500.00;
c. 3rd offense
- PhP 1,000.00 without prejudice to the
cancellation of franchise by the LTRFB whenever applicable.
SECTION 6. SEPARABILITY CLAUSE. If, for any reason or reasons,
any part or provision of this Ordinance shall be held to be unconstitutional or
invalid, other parts or provisions hereof which are not affected thereby shall
continue to be in full force and effect.
SECTION 7. REPEALING CLAUSE. Municipal Ordinance No. 04-2006
and any other ordinances or part or parts thereof which are inconsistent with

any of the provisions of this Ordinance are hereby repealed, amended or

modified accordingly.
SECTION 8. EFFECTIVITY.
immediately upon its approval.
