( hereinafter called The Member ) of the first part, and the CENTRAL COMMITTEE OF
PERSATUAN KEBAJIKAN NAMAKKAL, MALAYSIA (hereinafter called The
Association) on the second part and

(hereinafter called The Sureties) of the third part.
WHERES:
(1)

The Member / members Child is a person admitted in an Institution of higher

learning approved by the Association for a course described in Item 1 of the First
Schedule of this Agreement.

(2)

The Association had decided to provide the Member with Study Loan to enable
him / his / her child to pursue the Course of training described in the First schedule
to this Agreement subject to terms and conditions hereinafter contained:

NOW THIS AGREEMENT WITNESSETH as follows:

1.

The Member, with the approval and consent of the Sureties hereby agrees:
(a)

That he / his / her child will enter upon and diligently continue in the Course of
Training described in Item 1 of the First Schedule to this Agreement and that he /
his / her child will complete the said Course of Training within he prescribed time
as set out in Item 3 of the said First Schedule herto or such longer time as the
Association may approve.

(b)

That he / his / her child will not during the course of study, engage in any activities
which the Association considers not in with accordance with the Associations or
the National Interest and will, if required so do to, desist the said member / his / her
child from further participating herein;

(c)

That he / his / her child will, for the purpose of such training, study in such place or
places either in Malaysia or elsewhere where the Association may from time to
time direct, and that he / his / her child will confirm to such regulations and
disciplines as may be in force from time to time, in any Institution during the
period of training or under whose direction the Course of Training or any part
thereof may be conducted;

In consideration of the above premises the Association hereby agrees that it will provide
the member / his / her child with a study loan as stated in the Second Schedule hereto and
repayable in the manner stated therein.

3.

It is hereby agreed and declared that if any time during the existence of this Agreement
either one or both of the Sureties shall die or cease to reside within Malaysia or remain out
of Malaysia for more than twelve consecutive months or shall be adjudged bankrupts, than
the member / his / her child may find other sureties who shall be to the satisfaction of the
Association be ready and willing to be substituted in the place of the Surety / Sureties dead
or ceasing to reside or remaining out of the country as aforesaid or being adjudged a
bankrupt. Provided that in the event of another Surety not being found to the satisfaction
of the Association or in the event of such other Surety refuses to enter in to an Agreement
whereby he / she agrees to be bound by the terms and conditions of this Agreement relating
to sureties, the Association may at its sole discretion at any time thereafter, terminate the
Study Loan and the member shall thereupon cease to have any claim to any benefits under
this Agreement and the Loan shall immediately became due and repayable.

In the event the member fails or omits for any reason whatsoever to reply to the
Association the monies as expended by the Association to him/his/her child or any part
thereof as required to the Clause 1 (e) and/or Clause 3 of this Agreement, the member and
the Sureties shall be jointly and severally liable for themselves, their heirs, executors or
assigns to refund to the Association on demand all monies expended on the member
/his/her child by the Association or such part thereof as remains unpaid together with costs
and disbursements (legal or otherwise and where legal both judicial and extra judicial as
between Solicitor and own Clint) incurred or paid by the any monies due or to became due
to the Association under this Agreement. The Sureties will equally share the said liabilities
to the member.

(a) It is further agreed and declared that if the member /his/her child at any time during
the period of his/her Course of Training.
(i) has in the opinion of the Association misconduct himself/herself, in a manner
likely to bring discredit to himself/herself, to the Association or to the country, or
neglected, or otherwise showed himself/herself to be indifferent to his studies; and
or
(ii) has failed to comply with any request made under Clause 1 (b) then an in any
such the Association may at its absolute discretion terminate the Study Loan and
thereupon he/she shall cease to have any claim to any benefits of this Agreement.
(b) The termination pursuant to Paragraph (a) of this Clause shall be find and conclusive.

6.

It is further agreed and declared that if the member / his/her child;

(i) abandons his/her Course of Training before the completion thereof without the
consent of the Association; or
(ii) fails to graduate in the Course of Training aforesaid; or

(iii) has his/her Study Loan terminated as hereinbefore mentioned; then and in any such
case, the student and the Sureties shall be jointly and severally liable for
themselves, their heirs, executors or assigns to refund to the Association on demand
all Monies which have been paid to the Student or on his/her behalf and all other
monies expended, or for which liability has been incurred by the Association by
way of fees, passages, costs, disbursements (legal or otherwise and costs as between
Solicitor and own Clint) incurred or paid by the Association incidental to this
Agreement or the Collection of any monies due to or to became due to the
Association under this Agreement or otherwise in connection with the Study Loan.
7.

It is hereby agreed and declared that anything hereinbefore contained to the contrary
notwithstanding, the Association may be one months notice in writing to the member
addressed to the member and the Sureties at their last known addresses by prepaid post,
cancel this Agreement at any time, without assigning any reasons therefore and thereupon
all benefits to and liabilities of the member or the Sureties under this Agreement shall
cease; except that the Associations right to recover the monies already expended on the
member /his/her child or on his behalf as at the date of such termination under this Clause
shall not be prejudiced and save that if at such time there is vested in the Association a
cause of action against the member and/or the sureties, such cause of action against the
member / or the sureties, such cause of action shall survive

for the benefit of the

Association.
8.

It is hereby agreed and declared that the Schedules attached hereto shall be read with and
from part of this Agreement.
