COMPLAINT-AFFIDAVIT
I, ALFREDO C. MATEO, of legal age, Filipino and a resident of
No. 268 Purok 2, Putot, Brgy. Sta. Arcadia, Cabanatuan City, Nueva
Ecija after having been sworn in accordance with law, deposes and
states THAT:

1.

I know the persons of SPS. REYNALDO T. MACTAL, JR.

and JULIETA J. MACTAL, who are both of legal age, Filipinos, and a
resident of No. 539 Pedro St., Magsaysay Sur, Cabanatuan City,
Nueva Ecija, where they may be served with subpoena and other
processes pertaining to this Complaint;

In the first week of April 2014, Mr. Gregorio C. De Belen

approached and told me that he has acquaintances who are buying

Palay. Later he introduced the aforesaid Sps. Mactal and we have
agreed that I will deliver to them cavans of Palay and in exchange
they will issue post-dated checks representing the value of the Palay
including its sacks. A copy of the Sinumpaang Salaysay of Mr. De
Belen is attached hereto as Annex A;

Also in the first week of April 2014, I have delivered 1,271

cavans of Palay to the Sps. Mactal. In exchange, they issued three

(3) post-dated checks for the value of the Palay and its sacks in my
favor with the following details:

4. At the time the Sps. Mactal issued the above checks to me,
they made the assurance and representation that the said checks
were good and would be covered by sufficient funds when presented
for payment;
5. However, when the checks were deposited to my account on
November 10, 2014, the same were dishonored and returned by
the bank for the reason "Account Closed". The true and faithful
machine reproduction of the said checks are hereto attached as
Annexes "B" to B-1. The Debit Advice from my Bank
(Plantersbank) for the returned checks is also attached herewith as
Annex B-2;
6. As such, I notified thru my counsel the Spouses Mactal of
such dishonor and return of the said checks and demanded from
them that they make good of the said checks within five (5) days from
the receipt of the notice dated November 24, 2014. However, they
failed to make good of the said checks. A copy of the notice is hereto
attached as Annex "C", while the LBC Official Receipt is likewise
attached herewith as Annex C-1, as well as the LBC Delivery
Dispatch Report as Annex C-2;

On December 12, 2014 Sps. Mactal met me in Lamarang

Restaurant in Cabanatuan City and inquired about the demand letter

my counsel sent and received by them. They asked for more time to
settle their obligation but I did not agree since it was not our previous

agreement;

To date, SPS. REYNALDO T. MACTAL, JR. and JULIETA

J. MACTAL have not heeded to my demand to pay the said

dishonored checks;

9.

I am therefore executing this Complaint-Affidavit in

support of the charges for Violation of Batas Pambansa Bilang 22

& Estafa Through Bouncing Check (Art. 315 Par. 2(d), Revised
Penal Code) against the Sps. Reynaldo T. Mactal, Jr. and Julieta J.
Mactal.
IN WITNESS WHEREOF, I have hereunto set my hand this 18 th
