Incidentals/Events
On November 22, 2014 at about 6:00 P.M., the complainant, Bethyl Joy P. Porras, together with her friends, Roxy Solidarios and Natalie Kim Gokong Wei were purchasing tickets for the movie
NIGHT CRAWLER (2014) at SM movie cinema 2. Afterwards, she entered the cinema to look for the best possible spots while her friends were still outside buying their popcorn and drinks. She
had chosen the last row of seat to maximize their viewing experience. Seated beside the complainant was a man wearing jacket and hood. At exactly 6:30 P.M., Roxy and Natalie had returned and
were already seated to their respective seats. During this time, the complainant asked her friends to watch over her bag and cell phone because she was going to the restroom. Before the movie started,
the complainant had already returned to her seat when she realized that her cell phone was missing. She immediately asked her friends if they have seen her cell phone. Roxy then tried calling the
number of the complainant when a ringtone sounded which was similar to the ringtone of the phone of the complainant rang. The ringtone of the cell phone originated from the man seated beside the
complainant. Upon hearing the phone rang, the accused panicked and tried his best to dispose the cell phone by putting it in the floor, making it look like that the phone of the complainant had just
fallen from her chair to the floor. However, the accused was caught in flagrante delicto of disposing the cell phone by the complainant. During this time, the complainant was certain that was her cell
phone which prompted her to shout kawatan (thief). Upon hearing the scream of the complainant, the accused run and was blocked by the security guards near the exits of the cinema. However, the
accused was too nimble and was able to escape the guards. At around 7:00 P.M., the complainant together with her friends and the security guards went to the Police Precinct to file a blotter report
about the incident. The police were able to identify the accused based on the description of accused given by the complainant and her witnesses in the rogues gallery of the Police, namely Michael
Sason O. Basa
