HISTORY OF DONTOGAN ELEMENTARY SCHOOL

Dontogan Elementary School started as a primary school in 1987 with its first
building, the Marcos Building with three (3) classrooms used by grades one and two
upon its establishment. this building was constructed upon the request of the residents
of Dontogan Barangay headed by Brgy. Captain David Gadit who made representations
with the Department of Education and Culture and Sports (DECS), now Department of
Education (DepEd), the City Government of Baguio, and the Bureau of Animal Industry,
Department of Agriculture.
The parcel of land that the school occupies is the property of the Department of
Agriculture; and this is the main reason why the Brgy. Captain and the previous School
heads had to coordinate with the Department of Agriculture, bureau of Animal Industry. it
was on march 9, 1987 when the Department of Budget and Management issued
Treasury Warrant #B 05691879 and allocated the sum of Php 480,150.00 in order to
implement various school infrastructure projects of the national Government in the City
of Baguio. one of the projects funded by the treasury warranted the construction of the
Dontogan Primary School, a three-classroom building which was affirmed by the City of
School Building Committee dated July 2, 1987. The project was awarded to PROTECH
Construction, for the sum of Php 159,800.00 The construct then was signed by two
parties, the City of Baguio represented by Vice MSyor Nicholas A. Tabora and the
second party represented by Ropuerto G. Gumnad, the contractor representing
PROTECH Construction.
On September 1987, the clearing and construction of the first building started,
however, on September 28, 1987, a certain Rogelio Agcaoli filed a complaint in the
Regional Trial Court, First Judicial Region, Civil Case #1206-R for Injunction with

Damages and with Prayer for the issuance of Writ of Preliminary Injunction and/or
Restraining Order against Mr. David Gadit, Brgy. Captain; Mr. Rouperto Gummad, the
contractor; and Mr. Macario Goros, the foreman for the alleged illegal construction of the
Dontogan Primary School. The case was heard and on September 28, 1988 the case
was dismissed under the sala of Judge Valdez when Mr. Agcaoli caused the dismissal
of the case he himself filed, in accordance to rule 17 Sec. 1 of Rules of Court, as a
pleading to the written order of Judge Valdez, "Since it appears from the pleading
already stated that the City of Baguio and even possible the Republic of the Philippines
are indispensible parties of the case, the petitioner, Mr. Agcaoili is hereby directed to
study the matter and within 10 days file the necessary pleadings, failing in which, the
case will be dismissed."
According to the records, it appeared that a complaint was also filed by Mr.
Agcaoli against the Department of Education and Culture and Sports (DECS-CAR) in
Land Management Sector-CAR in 1987, to quote the Order of Honourable Edilberto
Quiaoit, Spl. land Investigator/hearing Officer on December 11, 1989, Respondent
DECS-CAR represented by Dr. Florencio Buen, the superintendent of the Division of
Baguio City, stated that, "the suit against the DECS filed by Mr. Agcaoili is tantamount to
a suit against the state itself, it appearing that the latter is not a separate entity but an
army of the government exercising governmental function which suit, if not prevented is
violaative of the well settled maxim that the state cannot be sued without its consent,"
as evidenced in Case # TSA (1-2) 794, Res. Sec. "L" Baguio City.
The principals/school heads strongly supported by the Barangay Captains, who
unitedly represented the school in the proceeding of the hearings were: Mr. Dionicio

Garcia (1987-1990), Dr. Ceferino Cawaon (1990-1991), and Dr. William Rilvera (19911992). A move to demolish the occupants in the school premises was processed and
relocation site for Mr. Agcaoli was agreed. However, the latter changed decisions. Years
after, there were other occupants in the back of the school. Te school, despite having
defended a lot entrusted the Department of Agriculture had followed it up to the AntiSquatting Committee to evict the informal settlers.
On March 31, 2008, Mrs. Brenda Lee Tade, the principal requested the
Department of Agriculture headed by Atty. Stacey Dumalan, the legal officer of the DA,
and Mr. Louuis Lang-oy, the OIC General manager of the Dairy Farm, for an ocular
inspection in the school. During the ocular inspection, three illegal occupants were from
identified inside the territory of the school. Mr. Roberto Agcaoili, Pastor Erin and Mrs.
ALimba.
Today the Dontongan Elementary School has 8 buildings which housed the
different grade levels from Kinder to Grade Six. Another two storey make-shift is being
constructed near the Marcos Building 2. A 2-storey building with 4 classrooms will soon
rise under the 3P-Public-Private-Partnership ni PNoy on Infrastructure projects will be
constructed within the school year 2014-2015. Once completed, this will house the
Computer Room, Library Room, Science room and a classroom for Grade Six. The
informal settlers in our school is already in the hands of the City Anti-Squatting
Committee under the leadership of Atty. Carlos Comilas.
Dontogan Elementary School will continue serving the community though quality
and affordable education for all.
