The definitions given here represent how the terms are used in real estate. Some terms have
additional meanings, which can be found in a standard dictionary.
80/20 Rule Rule that says in order for individual
shareholders to continue to be able to write
off yearly taxes and mortgage interest, no
more than 20 percent of a co-ops yearly
income can come from non-shareholder
sources.
A
Abandonment The failure to occupy and use
property, which may result in a loss of rights.
Abutting Property Directly contiguous
properties, sharing at least one common
boundary.
Abstract of Title A brief summary of the history
of title to a property, listing all recorded
documents that affect the title.
Acceleration Clause Contract clause giving
the lender the right to declare the entire
loan balance due immediately because
of default, or other reasons stated in the
contract.
Acceptance Agreeing to the terms of an offer,
thereby creating a binding contract; taking
delivery of a deed.
Accession Gives property owners the right to
everything produced by their land. See:
Accretion; Annexation; Reliction.
Accessory Apartment An apartment within a
single-family dwelling.
Accessory Use The use or occupancy
incidental or subordinate to the principal
use or occupancy of a property.
Accord and Satisfaction An agreement to
accept something different (usually less)
from what the original contract required.
Accountability In an agency relationship, the
agents fiduciary duty to account to the
principal.
Accretion The gradual addition of land by the
forces of nature.
Acknowledgment The act of signing a
document before a notary public, stating it
was signed voluntarily.
Actionable Fraud Fraud meeting certain
criteria, so a victim can successfully
sue. Victim/plaintiff must prove the
defendant concealed material facts
or made false statements (intentionally
or negligently) with intent to induce the
victim to enter a transaction, and that the
victim was harmed by relying on these
misrepresentations.
Active Income Earnings received from any of
the following: wages, salaries, commissions,
bonuses, and other payments for services

R-Factor A way to measure the insulating value
or resistance to heat flow through a material
or an object. The more effective the
insulation, the higher the R-Value it will have.
Radon A naturally occurring radioactive gas
that emanates from rocks, soil, and water
because of the decay of uranium.
Rafter Sloped support beams that follow the
pitch of the roof and serve to hold the outer
roof covering. See: Joist and Rafters.
Range Lines North-south lines running parallel
to principal meridians at six-mile intervals in
the government survey system.
Rate Adjustment Period The interval at which
a borrowers interest rate changes with an
ARM (adjustable rate mortgage).
Rate Cap Used with ARMs to protect borrowers
from large interest rate increases.
Rate of Return The rate at which an investor
recaptures his investment in incomeproducing property.
Ratification Confirmation or approval of an act
not authorized when it was performed.
Ready, Willing, and Able Making an offer to
purchase on terms acceptable to the seller,
and having the financial ability to complete
the purchase.
Real Estate Land and everything permanently
affixed to it.
Real Estate Appraiser A person who is specially
trained to offer an unbiased value of real
property.
Real Estate Broker A person who is licensed to
represent one of the parties in a real estate
transaction for compensation.
Real Estate Owned (REO) Property acquired
through foreclosure and held in inventory by
a lending institution.
Real Estate Contract 1. A purchase agreement.
2. A land contract. 3. Any contract having
to do with real property.
Real Estate Cycles General swings in real
estate activity, resulting in increasing or
decreasing activity and property values
during different phases of the cycle.
Real Estate Investment Trust (REIT) A real
estate investment business with at least 100
investors organized as a trust.
Real Estate Salesperson A licensed real estate
professional associated with a broker and,
as such, who may perform most of the acts
as a broker, on behalf of him.
Real Estate Settlement Procedures Act (RESPA)
Requires lenders, mortgage brokers, or
servicers of home loans to provide borrowers
with pertinent and timely disclosures of
the nature and costs of the real estate
settlement process.
Real Estate Tax An annual tax levied on the
value of real property. Also called: Property
Tax or General Real Estate Tax.
Real Estate Transfer Tax A tax levied on the
transfer of real property.
Real Property The physical land and everything
attached to it as well as the rights of

Waiver The voluntary relinquishment or
surrender of a right.
Warranty Deed A deed carrying warranties
(guarantees) of clear title and the grantors
right to convey. See: General Warranty
Deed; Limited Warranty Deed.
Waste, Act of Destruction, damage, or material
alteration of property by someone in
possession who holds less than a fee estate
(such as a life tenant or lessee).
Water Rights The right to use water in or from
a river, stream, or lake. See: Appropriative
Rights; Littoral Rights; Riparian Rights.
Wetlands Ecosystems where the land is
permeated with water, which either lies on
or near the surface of the land.
Will A persons legally binding instructions
regarding how his or her estate should
be disposed of after death. Also called:
Testament.
Words of Conveyance A clause in a deed that
states that the grantor intends to convey
title to the land. Also called: Granting
Clause.
Womens Council of Realtors (WCR) An
organization devoted to addressing the
issues, needs, and concerns of women in the
real estate profession. (Now affiliated with
the NAR.)
Wraparound Mortgage When a seller keeps
the existing loan and continues to pay on it,
while giving the buyer another mortgage.
Also called: Wraparound Financing.
Writ of Execution A court order directing a
public officer (often the sheriff or marshal)
to seize and/or sell property to regain
possession for the owner and/or satisfy a
debt.
Writ of Possession A court order issued after an
unlawful detainer action, informing a tenant
that he must vacate the landlords property
within a specified period or be forcibly
removed by the sheriff.
